No. ENV- 10-200-3821-P 22 January, 2004To,Shri Vikram Amin,Chief Executive Officer,M/s <strong>Essar</strong> <strong>Steels</strong> <strong>Limited</strong>,Hazira, District: Surat.Sub: <strong>Environmental</strong> <strong>Clearance</strong> <strong>of</strong> M/s <strong>Essar</strong> <strong>Steels</strong> <strong>Limited</strong> <strong>for</strong> <strong>their</strong> proposed 2 X120 + 5 % MW (Total 240 + 5 % MW) imported coal based CPP within thepremises <strong>of</strong> your existing unit at Hazira, District: Surat.Dear Sir,This has reference to your application dated 7/12/2000 seeking environmental clearanceunder the EIA notification 1994 <strong>for</strong> your proposed 2 X 120 + 5 % MW (Total 240 + 5 %MW) imported coal based CPP at Hazira, District: Surat and subsequentcommunications in this regards.The Department has examined your application along with EIA/EMP and otherdocuments/ reports. It is noted that the project proponent has proposed <strong>for</strong> 2 X 120 + 5 %MW (Total 240 + 5 % MW) imported coal based CPP at Hazira, District: Surat,.Theproject would be located in an area <strong>of</strong> 31.5 Hectares at Hazira, Dist. Surat. The projectdoes not involve <strong>for</strong>est land and displacement <strong>of</strong> people Water requirement <strong>for</strong> the projectwould be 19873 M3/day, which will be met from River Tapi. The final industrial effluentto be generated to the tune <strong>of</strong> 5625 M3/day, would be used <strong>for</strong> ash handling and balancewould be discharged into estuary (Tidal Zone <strong>of</strong> River Tapi). The sewage generated to thetune <strong>of</strong> 13.5 M3/day would be treated in the STP <strong>of</strong> your existing unit and treated sewagewould be utilized <strong>for</strong> plantation and gardening. It is also noted that the project proponenthave proposed to use imported Coal with low content <strong>of</strong> ash (3 % max.) and sulphur (0.15% max.). Coal consumption would be 2640 Tonnes per day at full operation. Flyashgeneration would be 80 tonnes per day at full operation.The Forests and Environment Department, Government <strong>of</strong> Gujarat, hereby accords<strong>Environmental</strong> <strong>Clearance</strong> to the above project under EIA Notification dated 27th January,1994 as amended from time to time subject to strict compliance <strong>of</strong> the followingconditions:A. SPECIFIC CONDITIONS(i)(ii)All the conditions stipulated by the Gujarat Pollution Control Board (GPCB)with regard to Site <strong>Clearance</strong> Certificate dated 27/3/1995 shall be strictlyimplemented.The imported coal having ash content <strong>of</strong> 3 % (maximum) and sulphur content<strong>of</strong> 0.15 % (maximum) shall be used as fuel in the power plant. Any other fuelor imported Coal exceeding the ash and sulphur content limits as above shallnot be used. Documents regarding import <strong>of</strong> coal and its Analysis report,particularly <strong>for</strong> ash and sulphur content shall be regularly submitted to theForests and Environment Department as well as to the GPCB.


(iii) All the concerned provisions <strong>of</strong> the Notification No. S. O. 763(E) dated 14/9/99and the amendments issued there<strong>of</strong> from time to time on Utilization <strong>of</strong> theflaysh issued by the Ministry <strong>of</strong> Environment and Forests, Government <strong>of</strong>India, shall be complied with by the Project Proponent. The project proponentshall take appropriate action to make utilization <strong>of</strong> the flyash strictly as per theAsh Utilization Action Plan (Alternative - 2), submitted to us vide your letterno. ESTL/ENV/CPP-250/EC/PS/03-09 dated 17/9/2003.(iv) The treated industrial effluent totalling to 5625 M3/day con<strong>for</strong>ming toprescribed standards shall be discharged into estuary (tidal zone <strong>of</strong> River Tapi)through a pipeline at a point to be decided by the National Institute <strong>of</strong>Oceanography or other competent organization/authority and after obtainingnecessary approvals from the competent authority under the CRZnotification,1991 and GPCB under the Water Act, 1974.(v) Sewage to be generated to the tune <strong>of</strong> 13.5 M3/days shall be treated separatelyin a Sewage treatment plant and the treated sewage con<strong>for</strong>ming to theprescribed standards shall be utilized <strong>for</strong> gardening and plantation.(vi) The gaseous emissions (So 2 , No x & CO) and particulate matter from variousprocess units shall con<strong>for</strong>m to the standards prescribed by the concernedauthorities from time to time.(vii) Ambient Air Quality Monitoring Stations shall be set up in consultation withthe GPCB in the downwind directions as well as at a point where the maximumground level concentration <strong>of</strong> SPM is anticipated.(viii) Fugitive emissions in the coal as well flyash handling area/s shall be regularlymonitored and report shall be furnished to the GPCB.(ix) The Hazardous Wastes shall be transferred / disposed <strong>of</strong>f only in a manner asauthorized by the GPCB. The project proponent shall obtain authorization fromthe GPCB under the Hazardous Wastes (Management & Handling) Rules <strong>for</strong>the said purpose.(x) Comprehensive EIA Report shall be prepared and submitted within one year tothe Department as well as to the GPCB. All the suggestions / recommendations<strong>for</strong> the purpose <strong>of</strong> environmental protection to be mentioned in thecomprehensive EIA shall have to be implemented.(xi) The project proponent shall in<strong>for</strong>m the public that the project has beenaccorded environmental clearance by Department and copies <strong>of</strong> letter areavailable with the Gujarat Pollution Control Board and may also be seen at thewebsite <strong>of</strong> the Department at http://gujenv<strong>for</strong>.gswan.gov.in. This shall beadvertised within fifteen days from the date <strong>of</strong> issue <strong>of</strong> the clearance letter, atleast in two local newspapers, one Gujarat and one English, that are widelycirculated in the region and a copy <strong>of</strong> the same shall be <strong>for</strong>warded to thisDepartment as well as to the GPCB at the earliest.(xii) The provisions <strong>of</strong> the CRZ notification 1991, along with its amendment, issuedfrom time to time by the Ministry <strong>of</strong> Environment and Forests, Government <strong>of</strong>India, shall be strictly adhered to by the applicant and no activity shall becarried out in violation <strong>of</strong> the CRZ notification.B. GENERAL CONDITIONS(i)(ii)The project authorities shall strictly adhere to the stipulations made by theGPCB in the NOC/ Consents issued by it.At no point <strong>of</strong> time, the discharge / emission levels shall go beyond thestipulated standards. In the event <strong>of</strong> failure <strong>of</strong> pollution control system/sadopted by the unit, the respective unit shall not be restarted until the controlmeasures are rectified to achieve the desired efficiency.


(iii)(iv)(v)(vi)(vii)Regular Monitoring <strong>of</strong> the waste water, stack emission, ambient air, noise, andhazardous wastes shall be carried out. Periodical monitoring <strong>of</strong> ground water(around the project site) shall also be carried out. The sampling points,parameters and frequency <strong>of</strong> sampling shall be decided in consultation with theGPCB. The reports <strong>of</strong> the monitoring as mentioned above shall be submitted tothis Department and the GPCB.No further expansion, modernization or modification in the CPP shall becarried out without prior approval <strong>of</strong> the State Government in Forests andEnvironment Department. In case <strong>of</strong> deviations or alterations in the projectproposal from the one submitted to this Department <strong>for</strong> this clearance, a freshreference shall be made to this Department.The unit shall develop rainwater harvesting structures to harvest the run-<strong>of</strong>fwater <strong>for</strong> recharge <strong>of</strong> ground water, in consultation with the experts. The actiontaken report in this regard shall be submitted to this Department. .Green belt <strong>of</strong> adequate width and density shall be developed to mitigate theeffects <strong>of</strong> fugitive emission all around the project area. Development <strong>of</strong> theGreen Belt shall be as per the guidelines published by the Central PollutionControl Board.Massive af<strong>for</strong>estation programme shall be taken up in the neighborhood <strong>of</strong> theproject over a period <strong>of</strong> time.(viii) Adequate precautions shall be taken to ensure that the overall noise level in andaround the plant area shall be kept well within the standards (85 dBA) byproviding noise control measures including acoustic hoods, silencers,enclosures etc. on all sources <strong>of</strong> noise generation The ambient noise levels shallcon<strong>for</strong>m to the standards prescribed under the Environment (Protection) Act,1986.(ix)(x)(xi)(xii)The project proponent shall comply with all the environmental protectionmeasures, safeguards and suggestions as recommended in the EIA, EMP andRisk Assessment reports.A separate <strong>Environmental</strong> Management Cell equipped with full fledgedlaboratory facilities and suitable qualified staff shall be set up to carry out the<strong>Environmental</strong> Management and Monitoring functions.The project proponent shall constitute a monitoring Committee <strong>for</strong> reviewingthe compliance to various environmental safeguard measures by involvingrecognized local NGOs, GPCB, Institutions, Experts in the field, Forests &Environment Department, etc.The project authorities shall provide adequate separate funds, both recurringand non-recurring, along with item wise breakup, to implement the conditionsstipulated by the Forests and Environment Department as well as the GPCB.The funds so provided shall not be diverted <strong>for</strong> any other purpose.(xiii) The project authorities shall take up socio-economic upliftment activities in theregion in consultation with the District Collector / District DevelopmentOfficer. A separate fund in this regard shall be earmarked every year.(xiv)(xv)The implementation <strong>of</strong> the project vis-à-vis environmental management plansshall be monitored by the GPCB regularly.Necessary permissions shall be taken from all the concerned authorities be<strong>for</strong>ecommencing the power plant including the one from the Gujarat StateElectricity Authority.(xvi) Programmes <strong>for</strong> the improvement <strong>of</strong> skills <strong>of</strong> the villagers shall be taken up.(xvii) A half yearly report on the status <strong>of</strong> implementation <strong>of</strong> the conditions stipulatedand environmental safeguards shall be submitted to this Department on aregular basis.


(xviii) The project authorities shall contribute financially <strong>for</strong> any common study orfacility <strong>for</strong> the purpose <strong>of</strong> environmental protection and improvement that maybe proposed by this Department <strong>for</strong> this region.(xix) The project authorities shall bear the cost <strong>of</strong> the supervision / monitoring by theexternal agency that may be appointed by this Department to oversee / monitorthe activities during construction / operation phases.(xx) The project proponent shall contribute financial <strong>for</strong> implementation <strong>of</strong> theNational Green Corps Scheme in the region by the GEER Foundation inconsultation with this Department.(xxi) Any other conditions that may be stipulated from time to time.This clearance is valid <strong>for</strong> a period <strong>of</strong> three years from the date <strong>of</strong> issue <strong>of</strong> thisletter <strong>for</strong> implementation <strong>of</strong> the project.The Department may revoke or suspend the clearance, if implementation <strong>of</strong> any <strong>of</strong>the above conditions is not satisfactory.The Department reserves the right to stipulate additional conditions, if foundnecessary. The company in a time bound manner will have to implement these conditions.The above conditions will be en<strong>for</strong>ced, interalia, under the provisions <strong>of</strong> the Water(Prevention & Control <strong>of</strong> Pollution) Act, 1974, the Air (Prevention & Control <strong>of</strong> Pollution)Act, 1981, the Environment (Protection) Act, 1986 and the Public Liability Insurance Act,1991 along with <strong>their</strong> amendments and rules.(J.
