Development Order Condition 5f states that the Developer will contribute 50 feet ofright-of-way to the City of North Port along the Myakkahatchee <strong>Creek</strong> betweenAppomattox and Price Boulevards, for the purpose of constructing a greenway/bicycleand pedestrian pathway. It is the City’s desire to make this greenway/bicycycle andpedestrian pathway part of larger, city-wide trail system over the coming years. As aresult of discussions between the City and the Developer/Applicant, this stipulation isproposed to be revised.5.f.5.f.The applicant shall dedicate 50 feet of right of way for a greenway/bicycle andpedestrian pathway extending on the west side of the property, running parallelto the Myakkahatchee preserve from Appomattox to Price Boulevard.The City of North Port will prepare plans, utilizing their consultant, for theconstruction of an at-grade shell, or other cost comparable pervious material,pathway within existing City-owned right-of-way along the eastern bank of theMyakkahatchee <strong>Creek</strong>, from Appomatox Drive to Price Boulevard. These planswill be utilized by the City for the purpose of permitting the pedestrian/bicycletrail through appropriate regulatory agencies as well as for a Major Site andDevelopment Plan Approval by the City. Within 120 days after Major Site andDevelopment Plan Approval by the City, the applicant shall commenceconstruction of the pathway as described above; or should the City elect toconstruct the pathway, the applicant shall provide funding that is costcomparable to the construction of an at-grade shell pathway. Should the Cityelect to construct the pathway other than at-grade or utilizing material other thanpervious shell, the City shall be responsible for providing funding above theApplicant’s contribution as described above.4
