: Texas Administrative CodeTITLE 40PART 1CHAPTER 97SUBCHAPTER BRULE §97.19SOCIAL SERVICES AND ASSISTANCEDEPARTMENT OF AGING AND DISABILITY SERVICESLICENSING STANDARDS FOR HOME ANDCOMMUNITY SUPPORT SERVICES AGENCIESCRITERIA AND ELIGIBILITY, APPLICATIONPROCEDURES, AND ISSUANCE OF A LICENSEIssuance of a Renewal License(a) A license is valid for one year. The new licensure period begins the day after the previous licenseexpires.(b) For renewal of an initial license, an agency must:(1) meet the requirements for an initial survey as specified in Subchapter E of this chapter (relating toLicensure Surveys);(2) show compliance with the minimum standards and the provisions of this chapter for the servicesauthorized under the license as confirmed by an initial survey; and(3) apply for renewal of the license in accordance with §97.17 of this chapter (relating to ApplicationProcedures for a Renewal License).(c) For renewal of a license other than an initial license, an agency must:(1) comply with this chapter; and(2) apply for renewal of the license in accordance with §97.17 of this chapter.(d) DADS does not renew a license if:(1) the agency is licensed to provide licensed and certified home health services, and the agencyvoluntarily or involuntarily withdraws from or is terminated from participation in the Medicare program.However, if the agency demonstrates continued compliance with the requirements for licensed homehealth services, the license may be renewed with the category of licensed home health services;(2) renewal is prohibited by the Education Code, §57.491, concerning defaults on guaranteed studentloans;http://info.sos.state.tx.us/pls/pub/readtac$ext.TacPag...oc=&p_tloc=&p_ploc=&pg=1&p_tac=&ti=40&pt=1&ch=97&rl=19 (1 of 2)6/1/2006 12:40:21 AM
