<strong>G7</strong> ELMAU PROGRESS REPORT 59resources with respect to accessing genetic resources andthe sharing of benefits from their utilization; ii) obtain priorin<strong>for</strong>med consent from the providers of the genetic resources,unless otherwise determined by the relevant stateparty, and to require the establishment of mutually agreedterms,whichmayaddress benefit-sharing and subsequent use.<strong>G7</strong> countries such as France, Germany and Italy are involvedin capacity-building initiatives supporting the <strong>development</strong>and implementation of national regulations on Access andBenefit-Sharing (ABS), the establishment of ABS-compliantvalue chains and the participation of indigenous peoplesand local communities. France also has a specific chapterwithin its national draft legislation on biodiversity aimingat setting up a national ABS regime to protect its geneticresources and traditional knowledge. The draft legislationis currently being discussed by the French Parliament.Moreover, the EU, Japan and other <strong>G7</strong> countries have beenvery active in developing the concept of ABS, both throughthe negotiations within the CBD leading to the NagoyaProtocol, and by providing considerable support in capacity-buildingand enabling exchange of best practices withdeveloping countries (see Examples 4.28 and 4.29). The <strong>G7</strong>also supports the International Treaty on Plant GeneticResources <strong>for</strong> Food and Agriculture as a specialized ABSagreement consistent with the CBD and the Protocol recognizingthe importance of these genetic resources and theirspecial role in food security.
