<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>NORTHERN TERRITORY OF AUSTRALIA<strong>Plan</strong>ning ActLITCHFIELD AREA PLAN <strong>2004</strong>PART I – PRELIMINARY1.1 CITATIONThese development provisions “this <strong>Plan</strong>” may be cited as the <strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong><strong>2004</strong>.1.2 AIM AND OBJECTIVESAim – This <strong>Plan</strong> aims to protect the rural character of the <strong>Litchfield</strong> Shire <strong>and</strong> toidentify locations suitable for the range of activities <strong>and</strong> services associated withdevelopment in the Shire.Objectives – The objectives of this <strong>Plan</strong> are –(a)(b)(c)(d)(e)(f)(g)(h)(i)to contribute to the ecologically sustainable use <strong>and</strong> development of l<strong>and</strong> <strong>and</strong>water resources so that the use <strong>and</strong> development of l<strong>and</strong> is consistent with theprinciples of sustainable development <strong>and</strong> avoids or minimises thedegradation of the environment or the pollution or over commitment of waterresources;to protect <strong>and</strong> promote the use of l<strong>and</strong> identified as having horticulturalpotential;to protect the integrity of areas of environmental <strong>and</strong> conservation value;to ensure that visually intrusive developments on arterial roads areappropriately screened <strong>and</strong> located to minimise impacts on the efficiency ofthe road network;to create a flexible plan that can accommodate fluctuations in the growth ofthe area;to ensure that development controls reflect the physical <strong>and</strong> environmentalcapabilities of l<strong>and</strong> <strong>and</strong> accessibility to services;to ensure that non-residential development is sited to avoid or minimiseconflict with the residential amenity of adjoining lots;to ensure that lot sizes reflect the capabilities of l<strong>and</strong> in <strong>Litchfield</strong> Shire; <strong>and</strong>to identify l<strong>and</strong> for residential, business <strong>and</strong> industrial development inappropriate locations.31.01.2007 iv


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>1.3 PLANNING FRAMEWORKThe interpretation of this <strong>Plan</strong> <strong>and</strong> the determinations of the consent authority musthave regard to the planning principles <strong>and</strong> concepts contained in the <strong>Litchfield</strong><strong>Plan</strong>ning Concepts <strong>and</strong> <strong>L<strong>and</strong></strong> Use Objectives 2002 <strong>and</strong> ensure that a use ordevelopment is consistent with them.1.4 APPLICATIONThis <strong>Plan</strong> applies to <strong>and</strong> in relation to the l<strong>and</strong> comprised within the boundaries ofthe Shire of <strong>Litchfield</strong>.1.5 CONSENT AUTHORITYThe Development Consent Authority “the Authority” is the consent authority.1.6 EXCEPTIONSNothing in this <strong>Plan</strong> prevents –(a) the use of any l<strong>and</strong> –iiias a public street; oras a public park.(b) the construction, alteration, repair or maintenance of –iiiiiifacilities for the reticulation of water, sewage, gas or electricity, or thereticulation or transmission of telecommunication services other than,subject to clause 6.12, towers, aerials or masts for mobile telephonetelecommunications;stormwater drains; orroads <strong>and</strong> traffic lights; or(c)applies to the strengthening or restoration to a safe condition of a building orworks;(d) the erection or display of a sign which is –iiiiiiivva traffic control or driver advisory guide, service or similar device;displayed by reason of a statutory obligation by the Territory, a statutorycorporation, an authority of the Territory or of the Commonwealth, or alocal government authority;on enclosed l<strong>and</strong> or within a building <strong>and</strong> not readily visible from l<strong>and</strong>outside the enclosure or building;displayed on or inside a vehicle, other than a vehicle which is adapted<strong>and</strong> exhibited primarily as an advertising sign; oran interpretive sign used for describing sites or items of historical oreducational significance;31.01.2007 5


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>(e)(f)the maintenance of shipping channels or the use of mooring facilities withinthe port of Darwin within the meaning of the Darwin Port Corporation Act; orthe use of l<strong>and</strong> under an extractive mineral permit issued under the Mining Actor an authorisation under section 178(2) of that Act.1.7 DEFINITIONSIn this <strong>Plan</strong>, unless the contrary intention appears –"abattoir" means premises used for the slaughter <strong>and</strong> dressing of animals, <strong>and</strong>includes the processing of meat from such slaughter;"advertising sign" means a device using words, letters or images exhibited for thepurpose of advertising, announcement or display <strong>and</strong> includes a businesssign <strong>and</strong> a promotion sign;"agriculture" means, as a commercial enterprise –(a)(b)the growing of crops, pasture, timber trees <strong>and</strong> the like, but does not include anursery or horticulture; <strong>and</strong>the keeping or breeding of livestock, but does not include intensive animalhusb<strong>and</strong>ry;"bed <strong>and</strong> breakfast accommodation" means temporary accommodation fortravellers provided within a dwelling by the resident of that dwelling;"business sign" means an advertising sign restricted to the name <strong>and</strong> occupationof, <strong>and</strong> the nature of the services or goods available from, the personoccupying the l<strong>and</strong> on which the sign is erected, <strong>and</strong> includes, where anumber of persons are carrying on different businesses in a place, a signidentifying the place;"caravan" includes a vehicle registered or eligible for registration within themeaning of the Motor Vehicles Act which is designed or adapted for humanhabitation;"caravan park" means l<strong>and</strong> used for the parking of two or more caravans or theerection or placement <strong>and</strong> use of tents, mobile homes or cabins for thepurpose of providing accommodation;"caretaker’s residence" means a dwelling which is ancillary to the lawful use ofthe l<strong>and</strong> on which it is erected <strong>and</strong> which is used as a residence by thecaretaker of the l<strong>and</strong>;"car park" means the provision for parking of motor vehicles otherwise than as anancillary use of l<strong>and</strong> whether or not the car park is operated as a commercialenterprise;"car parking space" means an individually accessible space set aside ordesignated for the parking of one motor vehicle;"child care centre" means a building or place used for the minding or caring of fiveor more children who are not permanent residents of the building or place;31.01.2007 6


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>"clearing of native vegetation" means the removal or destruction, by any means,of native vegetation on an area of l<strong>and</strong>, other than –(a)(b)(c)(d)(e)(f)the removal or destruction of a declared weed within the meaning of theWeeds Management Act or of a plant removed under the <strong>Plan</strong>t DiseasesAct;the lopping of a tree;incidentally through the grazing of livestock;the harvesting of native vegetation planted for harvest;the clearing of firebreaks, fencelines or roads for access to the l<strong>and</strong> orother l<strong>and</strong>; orin the course of Aboriginal traditional use, including the gathering offood, the production of cultural artefacts <strong>and</strong> the use of fire;"cluster dwellings" means a building or group of buildings on a site whichindividually or collectively contain more than one dwelling each of which hasa separate entrance at ground level, but does not include a dependant unit;"community centre" means a building or part of a building designed or adaptedprimarily to provide facilities for social, sporting or cultural purposes, but doesnot include premises licensed under the Liquor Act;"consent" means the consent of the Authority;"convention centre" means a building, or part of a building, used for conventions,conferences or similar functions including, for such purposes, a bar, arestaurant <strong>and</strong> offices;"demountable structure" means a building, including transport containers, which iswholly or substantially prefabricated <strong>and</strong> which is designed to be transportedfrom site to site but does not include a caravan or transportable module usedin conjunction with an educational establishment or as a temporary officeon a construction site;"dependant unit" means a dwelling ancillary to <strong>and</strong> constructed on the same siteas a detached dwelling for the purpose of providing accommodation for adependant of a resident of the detached dwelling;"detached dwelling" means a building containing one dwelling;"dwelling" means a building, or part of a building, designed, constructed or adaptedfor human habitation as a self-contained unit;"domestic livestock" means the keeping, exercising or training, other than as acommercial enterprise, of any of the following – horse or other equine animal,ox, buffalo or other bovine animal, or camel."educational establishment" includes an academy, college, gallery, kindergarten,lecture hall, museum, primary or secondary school, technical college oruniversity, but does not include a child care centre, an institutionalestablishment or a place of worship;31.01.2007 7


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>"extractive materials supplies" means the bulk processing, sale, storage <strong>and</strong>distribution of s<strong>and</strong>, soil, screenings, rocks <strong>and</strong> other like materials but doesnot include a nursery;"flats" means a building or part of a building (other than a cluster dwelling)containing two or more dwellings;"floor area", in relation to a building, includes –(a)(b)all wall thicknesses of the external walls; <strong>and</strong>all roof areas used as floors,but does not include ver<strong>and</strong>ahs, balconies or areas set aside for car parking oraccess to car parking;"flora <strong>and</strong> fauna sanctuary" means l<strong>and</strong> set aside for the protection of plant <strong>and</strong>animal life;"fuel depot" means a depot for the storage or sale of solid, liquid or gaseous fuel,but does not include a service station;"funeral parlour" means a building used for the storage or preparation for burial orcremation of human bodies, <strong>and</strong> includes a funeral chapel associated with it;"general industry" means an industry other than mining, a light industry or arural industry;"guesthouse <strong>and</strong> hostel" includes boarding houses, lodging houses <strong>and</strong> otherpremises used to provide board or lodging with communal toilet, ablution,dining <strong>and</strong> cooking facilities but does not include a motel or hotel or bed <strong>and</strong>breakfast accommodation;"habitable room" means any room of a dwelling other than a bathroom, laundry,toilet, pantry, walk-in wardrobe, corridor, stair, lobby, photographic darkroom,clothes drying room or other space of a specialised nature that is not occupiedfrequently or for extended periods;"home based contracting" means the storage on the site of a dwelling ofmaterials <strong>and</strong> / or vehicles associated with a business operated by a personresident in the dwelling, but not operated on the site of the dwelling;"home occupation" means an occupation or profession which is carried on in adwelling or within the curtilage of a dwelling by a person resident in thedwelling <strong>and</strong> which does not detrimentally affect the amenity of a locality butdoes not include a child care centre or home based contracting;"horticulture" means the commercial cultivation of fruit, nuts, vegetables, flowers<strong>and</strong> the like but does not include a nursery;"hospital" means a building used to provide health services including preventativecare, diagnosis, medical or surgical treatment <strong>and</strong> counselling to personsadmitted as in-patients;"hotel" means premises which require a licence under the Liquor Act <strong>and</strong> where, asa principal part of the business, alcoholic beverages are ordinarily sold to thepublic for consumption on the premises, whether or not accommodation isprovided for members of the public <strong>and</strong> whether or not meals are served, butdoes not include a motel or licensed club;31.01.2007 8


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>"indoor recreation establishment" means a building used for recreation purposes,but does not include a dwelling used for private recreation;"industry" includes the following operations:(a)(b)(c)(d)(e)(f)(g)(h)the carrying out of a process of manufacture whether or not to produce afinished article;the dismantling <strong>and</strong> separating into parts of an article, machinery orvehicle;the breaking up of articles, machinery or vehicles;the treatment of waste materials;the packaging of goods or machinery;the process of testing or analysis of an article, goods or materials;the storage outdoors of goods, equipment or vehicles not in associationwith any other activity on the site, but not including a vehicle salesyard;if on the same l<strong>and</strong> as any of the operations referred to in paragraphs (a)to (g) –(i)(ii)(iii)the storage of goods used in connection with or resulting fromany of the operations referred to in these paragraphs;the provision of amenities for persons engaged in the operations;the sale of goods resulting from the operations;(iv) any work of administration or accounting in connection with anoperation; <strong>and</strong>(v)an industry or a class of industry particularly described ordefined in this <strong>Plan</strong>,but does not include a home occupation or home based contracting;"institutional establishment" means premises used wholly or principally as –(a)(b)a home or institution for mentally ill persons within the meaning of theMental Health Act; ora penal or reform institution;"intensive animal husb<strong>and</strong>ry" means –(a) the keeping <strong>and</strong> feeding of animals, including horses, cattle, poultry <strong>and</strong>pigs, in buildings, ponds, compounds or stockyards; or(b) aquaculture;as a commercial enterprise;31.01.2007 9


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>"kennel <strong>and</strong> cattery" means an establishment used for the accommodation,breeding or training of dogs or cats as a commercial enterprise;"licensed club" means premises used as club rooms which require a licence underthe Liquor Act;"light industry" means an industry in which the process carried on, the machineryused <strong>and</strong> the goods <strong>and</strong> commodities carried to <strong>and</strong> from the premises onwhich the industry is sited are not of a kind likely to cause an injury to orprejudicially affect the amenity of the surrounding locality by reason of theemission of noise, vibration, smell, fumes, smoke, vapour, steam, soot, ash,dust, waste water, waste products, grit, oil or otherwise;"main road" means a main road shown on the zoning map;"medical clinic" means premises used by one or more medical practitioners,physiotherapists, dentists or persons ordinarily associated with health care, ortheir employees;"mining" means all modes of extracting minerals or extractive minerals byunderground, surface or open-cut workings, other than in pursuance of anextractive mineral permit issued under the Mining Act or an authorisationunder section 178(2) of that Act for a like purpose <strong>and</strong> includes the crushing orstorage of such material on the l<strong>and</strong> from which the material is extracted or onadjacent l<strong>and</strong>;"motel" means premises wholly or principally used for the accommodation oftravellers <strong>and</strong> the vehicles used by them, whether or not the building is alsoused to provide meals to the travellers or to members of the general public<strong>and</strong> whether or not the premises are licensed under the Liquor Act but doesnot include bed <strong>and</strong> breakfast accommodation;"motor body works" means premises for repairing damaged motor vehicles <strong>and</strong>includes body building, panel beating or spray painting of motor vehicles;"motor repair station" means premises used for carrying out repairs to motorvehicles but does not include a motor body works;"net floor area" in relation to premises, includes all the area between internalsurfaces of external walls but does not include –(a)(b)stairs, cleaners' cupboards, ablution facilities, lift shafts, escalators ortea rooms where the tea rooms are provided as a st<strong>and</strong>ard facility in thebuilding;lobbies between lifts facing other lifts servicing the same floor;(c) areas set aside as public space or thoroughfares <strong>and</strong> not usedexclusively by the occupiers of the building;(d)(e)(f)areas set aside as plant <strong>and</strong> lift motor rooms;areas set aside for use of service or delivery vehicles; <strong>and</strong>areas set aside for car parking or access;31.01.2007 10


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>"nursery" means premises wholly or principally used for growing <strong>and</strong> / or display ofplants, for sale, whether or not seeds, equipment, soil, s<strong>and</strong>, rocks, railwaysleepers or other associated products are produced, displayed or sold, butdoes not include the use of l<strong>and</strong> for horticulture or agriculture;"office" means premises used for the conduct of administration whether public orotherwise, the practice of a profession, or the carrying on of mercantile,banking, insurance, legal, clerical or similar services, but does not include ahome occupation, a medical clinic or a veterinary clinic;"outdoor entertainment" means the provision outdoors of entertainment oramusement to members of the public, whether or not food is provided;"parking area" means an area inclusive of all car parking spaces <strong>and</strong> connectingdriveways set aside or designated for the parking of three or more motorvehicles;"passenger terminal" means premises used as a railway or bus station, airlinepassenger terminal or shipping passenger terminal;"place of worship" means premises used as a church, chapel, mosque,synagogue or place of religious instruction or worship or for the purpose ofreligious training, but does not include an institutional establishment or aneducational establishment;"plot ratio" in relation to a site, means the number obtained by dividing the floorarea of the building or buildings on the site by the area of the site;"promotion sign" means an advertising sign which contains information relatingto –(a)(b)goods, services or products of a class not provided, produced or sold;orevents or activities which are not carried on,on the l<strong>and</strong> or in the building on which the sign is constructed or erected;"proposed main road" means a proposed main road shown on the zoning map;"recycling depot" means premises used for the collection, storage, ab<strong>and</strong>onmentor sale of scrap metals, waste paper, rags, bottles or other scrap material orgoods, or used for the collection, dismantling, storage, salvaging orab<strong>and</strong>onment of automobiles or other vehicles or machinery whether or notparts of them are for sale;"restaurant" means premises (other than a shop, hotel or motel) in which mealsare served to the public for consumption on the premises, whether or not thepremises require a licence under the Liquor Act;"retail agricultural stall" means premises used for the display <strong>and</strong> retail sale ofagricultural <strong>and</strong> / or horticultural produce grown on the l<strong>and</strong> on which thebuilding is erected, but does not include a shop;"rural industry" means an industry, which involves the treatment, processing orpacking of primary products transported to the site, where the process carriedon, the machinery used <strong>and</strong> the goods <strong>and</strong> commodities carried to <strong>and</strong> fromthe premises on which the industry is sited are not of a kind likely to cause aninjury to or prejudicially affect the amenity of the surrounding locality;31.01.2007 11

<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>6.7 LAND IN PROXIMITY TO AIRPORTSThe purpose of this clause is to –(a)(a)minimise the detrimental impacts of noise generated by aircraft operations onthose who reside or work on l<strong>and</strong> in the vicinity of airports; <strong>and</strong>preclude any new use or intensification of development on l<strong>and</strong> that wouldprejudice the safety or efficiency of an airport.Despite anything to the contrary in this <strong>Plan</strong>, in zones PA, RL1, RL2, CP or OC, theuse or development of l<strong>and</strong> near an airport which is bounded by the AustralianNoise Exposure Forecast (ANEF) 20 unit value contour defined on ANEF Mapsproduced by the Department of Defence, Facilities <strong>and</strong> Property Division (asamended from time to time) <strong>and</strong> illustrated on the zoning maps requires consent.In determining an application for the use or development of l<strong>and</strong> which is boundedby the ANEF 20 unit value contour, the consent authority must have regard to theBuilding Site Acceptability Table based on ANEF Zones taken from St<strong>and</strong>ardsAustralia Table 2.1, AS 2021 – 1994 as a guide to the type of developmentconsidered appropriate.The open design of industrial buildings in the Top End means that noise attenuationcannot be achieved <strong>and</strong> it is therefore inappropriate that new industrial areasdevelop within the area bounded by the ANEF 20 unit value contour line.Lighting associated with development on l<strong>and</strong> within the flight approach paths mustnot be prejudicial to the safe operation of an airport.The use or development of l<strong>and</strong> must not be of a nature that attracts birds to anextent that might prejudice the safe operation of the airport.6.8 EXCEPTIONS RELATING TO IRONSTONE AND KNUCKEY LAGOONS LOCALITYThe purpose of this clause is to provide protection to the catchments of HolmesJungle <strong>and</strong> Knuckey <strong>and</strong> Ironstone Lagoons.Despite anything to the contrary in this <strong>Plan</strong>, use or development of l<strong>and</strong>, zoned RL2<strong>and</strong> identified as Ironstone <strong>and</strong> Knuckey Lagoons Locality on the zoning maps, forthe purpose of horticulture requires consent.The development of l<strong>and</strong> within the Ironstone <strong>and</strong> Knuckey Lagoons Locality forintensive animal husb<strong>and</strong>ry or horticulture must demonstrate consideration of<strong>and</strong> the Authority must have regard to –(a)(b)advice from the Controller of Water Resources under the Water Act regardingpotential impacts of the proposed development on the ground <strong>and</strong> surfacewater resources (particularly in relation to protection of environmental flows toHolmes Jungle) <strong>and</strong> water quality in the lagoons; <strong>and</strong>buffers required to minimise the impacts on the amenity of adjacent l<strong>and</strong> <strong>and</strong>the lagoons.23.08.2005 64


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>6.9 ENVIRONMENTAL PROTECTIONThe purpose of this clause is to minimise the detrimental impacts of development onareas of environmental significance <strong>and</strong> natural attributes by maintaining l<strong>and</strong>scapecharacter, quality <strong>and</strong> amenity.Development of l<strong>and</strong> within Priority Environmental Management areas identified onthe map titled “Priority Environmental Management <strong>Area</strong>s – <strong>Litchfield</strong> Shire” (asamended from time to time) produced by the Department of Infrastructure, <strong>Plan</strong>ning<strong>and</strong> Environment must demonstrate consideration of <strong>and</strong> the Authority must haveregard to –(a)(b)environmental evaluation of the significance of natural vegetation <strong>and</strong> otherl<strong>and</strong>scape features such as rugged terrain, rainforest patches, lagoons,wetl<strong>and</strong>s, rivers <strong>and</strong> other drainage systems; <strong>and</strong>the retention <strong>and</strong> protection of those areas established by this evaluation to besignificant.6.10 EXCAVATION AND FILLThe purpose of this clause is to ensure that excavation <strong>and</strong> / or filling of l<strong>and</strong> doesnot degrade the environment of adjoining areas or the quality of adjacent waterways<strong>and</strong> associated riparian areas <strong>and</strong> is suited to the intended future use of the site.The excavation <strong>and</strong> / or filling of l<strong>and</strong>, other than that normally required inassociation with the construction of a dwelling, requires consent.Excavation <strong>and</strong> / or filling of l<strong>and</strong> must demonstrate <strong>and</strong> the Authority must haveregard to –(a)(b)(c)(d)the suitability of the site for the proposed future use;hydrological assessment of potential upstream <strong>and</strong> downstream impacts of theexcavation or filling;ongoing management to ensure erosion <strong>and</strong> sediment is controlled particularlyin respect of siltation of creeks <strong>and</strong> riparian areas; <strong>and</strong>measures to prevent the creation of mosquito breeding areas.6.11 DEVELOPMENT OF LAND ZONED FDThe purpose of this clause is to enable the development of l<strong>and</strong> zoned FD, whenservices are (or can be) made available to that l<strong>and</strong>, for urban (typically residentialor mixed use) development in anticipation of subsequent rezoning to reflect the finalpattern of l<strong>and</strong> use.Despite anything to the contrary in this <strong>Plan</strong>, where a development permit has beenissued for the subdivision of l<strong>and</strong> zoned FD, the Authority may permit developmentof the l<strong>and</strong>, consistent with the anticipated ultimate zoning having regard to therelevant provisions of the <strong>Plan</strong>.23.08.2005 65

<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>(c)(d)(e)(f)Zone RL1 – 2 ha;Zone RL2 – 8 ha;Zone HP – 25 ha; <strong>and</strong>Zone SU – as specified by the Authority.The number of medium density dwellings, which may be constructed on a site inzone MD, should be 1 per 300 m 2 of site.7.4 EXCLUSIVE RURAL RESIDENTIALThe purpose of this clause is to provide a rural residential environment thatprecludes other l<strong>and</strong> uses.Despite anything to the contrary in this <strong>Plan</strong> <strong>and</strong> in particular clause 10.2, the use ordevelopment of l<strong>and</strong> identified on the zoning map as an area for Exclusive RuralResidential is limited to residential <strong>and</strong> ancillary <strong>and</strong> development <strong>and</strong> the clearingof native vegetation is restricted to that required for construction of a detacheddwelling <strong>and</strong> associated outbuildings normal for domestic use.The Authority must not consent to a development application contrary to thisclause.7.5 ESTATE DEVELOPMENTThe purpose of this clause is to ensure estate rural living development does notunreasonably detract from the amenity of adjacent rural living areas or detrimentallyimpact on the environment.Notwithst<strong>and</strong>ing the minimium lot sizes established by clause 11.1, l<strong>and</strong> within zoneRR, RL1, RL2 or HP may, with consent, be developed as an Estate Developmentunder the provisions of the Unit Title Act.The overall density of an estate development should match the density of the zonein which it is located.Applications for consent for estate development must demonstrate consideration of<strong>and</strong> the Authority must have regard to –(a)(b)(c)(d)detailed evaluation of the capability of the l<strong>and</strong> to accommodate dwellings<strong>and</strong> associated water supply <strong>and</strong> waste disposal infrastructure;retention <strong>and</strong> protection significant natural <strong>and</strong> cultural features;provision of appropriate waste disposal <strong>and</strong> water supply infrastructure;provision of an effective buffer between dwellings <strong>and</strong> boundaries of adjacentrural living lots;(e) the need for buffers between proposed activities on common areas <strong>and</strong>adjacent rural living areas; <strong>and</strong>(f)details of the management plan for common areas.23.08.2005 69


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>7.6 RESIDENTIAL DEVELOPMENT IN ZONES C AND TCThe purpose of this clause is to ensure residential development of a site within zoneC or TC does not prejudice the use or development of the site for commercial orretail activity in accordance with the purpose of the zone.A site within zone C or TC should only be used or developed for residentialpurposes where the development includes, at least at ground level, occupancies forcommercial activity of a floor area consistent with the service function that exists orcould reasonably be expected of the centre.7.7 ASSOCIATED RESIDENTIAL USES7.7.1 CARETAKER’S RESIDENCEThe purpose of this clause is to ensure a caretaker’s residence remains a usesubsidiary to the primary use of the l<strong>and</strong> <strong>and</strong> that the residential use does notprejudice the use of the site or adjoining l<strong>and</strong> for the purpose for which it is zoned.A building or part of a building should only be constructed, modified or adapted foruse as a caretaker’s residence where –(a)(b)the floor area of the caretaker’s residence will not exceed 50 m 2 ; <strong>and</strong>there is only one caretaker’s residence on the site.7.7.2 CARAVANSThe purpose of this clause is to ensure that the use of caravans does not adverselyaffect rural residential amenity in the locality of the site.Other than within a caravan park, l<strong>and</strong> is to be used to provide accommodation in acaravan only where the caravan is the only caravan used as a residence on thesite <strong>and</strong> is used:(a)(b)(c)(d)as a temporary residence by the owner of the site;by a dependent of a person occupying a detached dwelling on the site;temporarily by a bona fide visitor; orby a bona fide caretaker of the l<strong>and</strong>.For the purposes of this clause, caravan includes a tent.7.7.3 DEPENDANT UNITThe purpose of this clause is to ensure that a dependant unit remains subsidiary tothe detached dwelling on the site <strong>and</strong> does not adversely affect rural residentialamenity in the locality of the site <strong>and</strong> to maintain residential density.A building or part of a building should only be constructed, modified or adapted foruse as dependant unit where –(a) the floor area of the dependant unit will not exceed 50 m 2 ;(b)it shares public utility services <strong>and</strong> an effluent disposal system (if any) with thedetached dwelling; <strong>and</strong>23.08.2005 70


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>(c)there is only one dependant unit associated with a detached dwelling.7.7.4 HOME OCCUPATIONSThe purpose of this clause is to ensure that home occupations are established <strong>and</strong>continue to operate in a manner that does not detract from the amenity of thelocality.A dwelling should only be used for the purpose of a home occupation where –(a)(b)(c)(d)(e)(f)assistance is provided only by persons resident in the dwelling;the total area used (whether temporarily or permanently) does not exceed30 m 2 ;no greater dem<strong>and</strong> or load is imposed on the services provided by a publicutility organisation beyond that which is ordinarily required by other users ofthe services in the locality;no sign is displayed, other than a business sign, which is not more than0.5 m 2 in size;no goods are visible from outside the site; <strong>and</strong>not more than one vehicle is used for the purpose of the home occupation.7.7.5 HOME BASED CONTRACTINGThe purpose of this clause is to ensure that home based contracting isestablished, <strong>and</strong> continues to operate, in a matter that does not detract from theamenity of the locality.The site of a dwelling should only be used for the purpose of home basedcontracting –(a) in zone RL1, RL2, HP, PA or FD where –(i)(ii)(iii)(iv)(v)the total area used (whether temporarily or permanently) does notexceed 200 m 2 ;no greater dem<strong>and</strong> or load is imposed on the services provided by apublic utility organisation beyond that which is ordinarily required by otherusers of the services in the locality;no sign is displayed, other than a promotion sign which is not more that0.5 m 2 ;no goods are visible from outside the site; <strong>and</strong>not more than three vehicles are used for the purpose of the homebased contracting; or(b) in any other zone –(i)the total area used (whether temporarily or permanently) does notexceed 30 m 2 ;23.08.2005 71

<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>DIVISION 3 – REQUIREMENTS FOR COMMERCIAL USE AND DEVELOPMENT8.1 SITE COVERAGE RESTRICTIONSThe purpose of this clause is to ensure that there is adequate open space betweenbuildings having regard to the existing <strong>and</strong> desirable intensity of development withinzone C, SC or C.No building should be constructed within zone C, SC or TC if the building coversmore than 70% of the site.8.2 SETBACKSThe purpose of this clause is to provide a minimum setback area within which nodevelopment is to occur other than l<strong>and</strong>scaping to enhance the visual amenity of thelocality.Developments in zone C, SC or TC should incorporate setbacks of a minimum of5 m to one side boundary <strong>and</strong> to the rear boundary of the site.8.3 LANDSCAPING REQUIREMENTSThe purpose of this clause is to ensure that developments in the zone C, SC or TCinclude an adequate amount of l<strong>and</strong>scaping to enhance the level of visual amenity inthe locality.Developments in zone C, SC or TC should incorporate an adequately l<strong>and</strong>scapedopen space area of at least 15% of the site.8.4 SHOPS IN ZONES LI, DV AND OCThe purpose of this clause is to facilitate retailing of a nature <strong>and</strong> intensity servicingonly the needs of the zone within which the shop is located.Within zone LI, DV or OC the net floor area of a shop should not exceed 200 m 2 .8.5 SERVICE STATIONSThe purpose of this clause is to ensure that service station developments do not,by reason of appearance, cause detriment to the amenity of an area or, by reason ofvehicle movements, create a potential hazard to traffic on abutting roadways.A site should only be developed for a service station where –(a)(b)(c)a vehicular crossing over the footpath is not more than 9 m wide, is not closerthan 6 m to another vehicular crossing <strong>and</strong> is not closer than 15 m to a roadintersection;separate entrances to <strong>and</strong> exits from the site are provided <strong>and</strong> exits areseparated by physical barriers <strong>and</strong> so identified by suitable signs readilyvisible to persons using the adjoining road or entering or leaving the site;vehicles temporarily stored pending repairs or upon completion of repairs arescreened from view from a road <strong>and</strong> from l<strong>and</strong> used for residential purposes;23.08.2005 73

<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>9.5 TRANSPORT TERMINALS IN ZONES RL2 AND HPThe purpose of this clause is to ensure that transport terminals do not, by reasonof appearance, operation <strong>and</strong> associated vehicle movements, cause detriment tothe amenity of a locality or create a potential hazard to traffic on abutting roads.A site within zone RL2 or HP should not be developed for a transport terminalunless –(a)(b)(c)any activity associated with the transport terminal is located at least 50 mfrom the side <strong>and</strong> rear boundaries of the site <strong>and</strong> 100 m from the roadreserve boundary of the site;the boundary setbacks are l<strong>and</strong>scaped to provide an effective screen tominimise the potential detrimental impacts on the existing <strong>and</strong> future amenityof adjacent areas <strong>and</strong> the road; <strong>and</strong>appropriate access is available to the site to minimise the impacts of heavyvehicles on the local road network.9.6 RURAL INDUSTRY IN ZONES RL1, RL2 AND PAThe purpose of this clause is to ensure that a rural industry does not, by reason ofappearance, operation <strong>and</strong> associated vehicle movements, cause detriment to theamenity of a locality or create a potential hazard to traffic on abutting roads.A site within zone RL1, RL2 or PA should not be developed for a rural industryunless –(a)(b)(c)any activity associated with the rural industry is located at least 50 m fromthe side <strong>and</strong> rear boundaries of the site <strong>and</strong> 100 m from the road reserveboundary of the site;the boundary setbacks are l<strong>and</strong>scaped to provide an effective screen tominimise the potential detrimental impacts on the existing <strong>and</strong> future amenityof adjacent areas <strong>and</strong> the road; <strong>and</strong>appropriate access is available to the site to minimise the impacts of heavyvehicles on the local road network.9.7 INDUSTRIAL DEVELOPMENT ON MIDDLE ARM PENINSULAThe purpose of this clause is to limit the nature of industrial developments on MiddleArm Peninsula.(a)Despite anything to the contrary in this <strong>Plan</strong> <strong>and</strong> subject to (b), l<strong>and</strong> on MiddleArm Peninsula must not be used or developed for –iiiiiiivvthe processing of methane or ethane (or both) into Liquid Natural Gas orother liquid for export by sea;the production of methanol <strong>and</strong> ammonia or similar natural gas products;refineries using natural gas as a raw material;power generation required for metal smelting <strong>and</strong> production; ormetal smelting or production.23.08.2005 76

<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>DIVISION 5 – REQUIREMENTS FOR NON-URBAN USE AND DEVELOPMENT10.1 ANIMAL RELATED USE AND DEVELOPMENTThe purpose of this clause is to ensure that animal related industries <strong>and</strong> activitiesdo not cause detriment to the environment or the amenity of adjoining l<strong>and</strong>.In zones RR <strong>and</strong> RL1 domestic livestock should be kept only where at least 1 haper animal of well maintained ground cover of grass or other pasture species isavailable at all times.The design <strong>and</strong> operation of premises used for the keeping of animals for thepurposes of abattoir, agriculture, domestic livestock, intensive animalhusb<strong>and</strong>ry, or kennel <strong>and</strong> cattery should ensure that the use or development willnot –(a)(b)(c)(d)create a risk of contamination of ground or surface waters;contribute to the erosion of the site or of adjoining l<strong>and</strong>;cause detriment to the amenity of the locality by reason of excessive noise,offensive odours, excessive dust or the attraction of flies, vermin or otherwise;orconstitute a risk of the spread of infectious disease or other health risk.10.2 CLEARING OF NATIVE VEGETATION IN ZONES HP, PA, RR, RL1, RL2, CP, OC ANDWM.The purpose of this clause is to ensure that clearing of native vegetation does notunreasonably contribute to physical, ecological or other environmental degradationof the locality.This clause does not apply if the clearing of native vegetation is required orcontrolled under any Act in force in the Territory.The clearing of native vegetation is to:(a) be based on l<strong>and</strong> capability <strong>and</strong> suitability for the intended use;(b) allow for the retention of native wildlife corridors;(c) allow for protection of waterways; <strong>and</strong>(d) avoids impacting on environmentally significant or sensitive vegetation <strong>and</strong>fragile soils.All clearing of native vegetation in zone OC requires consent.Clearing of native vegetation of more than 1 ha in aggregate of l<strong>and</strong> (including anyarea already cleared of native vegetation) in zone HP, PA, RR, RL1, RL2, CP orWM requires consent subject to clause 10.3.The clearing of native vegetation on l<strong>and</strong> identified on the zoning map forExclusive Rural Residential is subject to clause 7.4.23.08.2005 78


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>10.3 CLEARING OF NATIVE VEGETATION – PERFORMANCE CRITERIAThe purpose of this clause is to outline matters to be taken into account in assessingan application for the clearing of native vegetation.An application for the clearing of native vegetation under clause 10.2 mustdemonstrate consideration of, <strong>and</strong> the Authority must have regard to:(a)(b)(c)(d)(e)(f)(g)(h)(i)(j)(k)areas not required or unsuitable for the intended use;whether there is sufficient water for the intended use at maturity;sensitive or significant vegetation communities such as rainforest, vine thicketor closed forest;essential habitats, within the meaning of the Territory Parks <strong>and</strong> WildlifeConservation Act;areas of erosion hazard within the meaning of the Soil Conservation <strong>and</strong> <strong>L<strong>and</strong></strong>Utilisation Act;erosion prone soils <strong>and</strong> previously eroded areas;areas subject to rehabilitation;declared heritage places or archaeological sites within the meaning of theHeritage Conservation Act;natural drainage lines;seasonally waterlogged soils;permanent water features (eg swamps, lagoons, or lakes);(l) areas within –(i)(ii)(iii)(iv)50 m from the primary / top bank of the outer stream channel of first<strong>and</strong> second order streams (water courses <strong>and</strong> gullies);100 m from the primary / top bank of the outer stream channel of third<strong>and</strong> forth order streams (creeks);200 m from the primary / top bank of the outer stream channel (rivers);or200 m from the maximum flood levels (wetl<strong>and</strong>s);(m)where slopes exceed 1.0%, the type of erosion control to be implemented;(n) alignments of fence lines, roads <strong>and</strong> firebreaks noting that –(i)(ii)(iii)cleared lines should be located along the tops of ridge lines or keptclose to the contour as possible; <strong>and</strong>cleared lines on slopes exceeding 1.0% will require some form oferosion control;the same alignment should be used, where possible, for a number ofpurposes (eg road, firebreak <strong>and</strong> fence line);23.08.2005 79

It is emphasised that there are areaswithin zones where the characteristics of the l<strong>and</strong> are such that it would beinappropriate to subdivide to the minimum area. For example, l<strong>and</strong> may be floodprone, have limited potential for sufficient groundwater yield, or have topographicalconstraints. <strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>(a)(b)environmental evaluation of the significance of natural vegetation <strong>and</strong> otherl<strong>and</strong>scape features such as rugged terrain, rainforest patches, lagoons,wetl<strong>and</strong>s, rivers <strong>and</strong> other drainage systems; <strong>and</strong>the transfer to public ownership of those areas established by this evaluationto be significant.11.4 SUBDIVISION OF LAND ZONED RRThe purpose of this clause is to ensure that small lot rural residential subdivisions –(a)(b)(c)(d)respond to the physical characteristics of the l<strong>and</strong>;are integrated with local infrastructure, community services <strong>and</strong> facilities;are proximate to arterials or collector roads; <strong>and</strong>contain lots of a size, configuration <strong>and</strong> orientation suited for the purpose.Subdivision design must provide connection to reticulated water <strong>and</strong> should providefor the following:(a)(b)(c)(d)(e)(f)all lots to be of a minimum size of 1 ha in area;lots of a minimum size of 2 ha in area if those lots are adjacent to any existinglots 2 ha or more in area;protection of the amenity of existing rural living areas;continuous sealed access through to a sealed arterial or collector road;connection to reticulated sewerage or if no reticulated sewerage is available,demonstrate that the soils are suitable for the on-site absorption of effluentwithout detriment to the environment, in particular to groundwater resources;<strong>and</strong>adequate drainage within the road reserve or through engineered drainagereserves.11.5 SUBDIVISION OF LAND ZONED FDThe purpose of this clause is to enable the subdivision of l<strong>and</strong>, when services are(or can be) made available to that l<strong>and</strong>, for urban (typically residential or mixed use)development in anticipation of subsequent rezoning to reflect the final pattern of l<strong>and</strong>use.Despite anything to the contrary in this <strong>Plan</strong>, where l<strong>and</strong> zoned FD is proposed to besubdivided for urban development, including residential, industrial, community orcommercial purposes, the Authority may permit subdivision into allotments of a size<strong>and</strong> configuration consistent with the anticipated ultimate zoning of the l<strong>and</strong> havingregard to the relevant provisions of Parts 3, 4, 5 <strong>and</strong> 6..23.08.2005 82


<strong>Litchfield</strong> <strong>Area</strong> <strong>Plan</strong> <strong>2004</strong>PART 6 – TRANSPORT AND INFRASTRUCTURE12.1 UTILITIESThe purpose of this clause is to ensure the use or development of l<strong>and</strong> within theUtility Zone does not prejudice the future development of the utility <strong>and</strong> in particularto –(a)(b)(c)(d)identify high pressure gas pipelines so that gas is safely delivered to users atminimal risk to people <strong>and</strong> the environment;identify elevated sites for water storage;identify sites for sewerage ponds sufficiently distant (1.5 km) from residentialareas; <strong>and</strong>identify sites for power stations.<strong>L<strong>and</strong></strong> zoned U may be used or developed other than for a utility only with consent<strong>and</strong> in accordance with the requirements of the service authority responsible for theutility on the l<strong>and</strong>.12.2 LAND ADJACENT TO MAIN ROADSThe purpose of this clause is to ensure that access to main roads from adjacentl<strong>and</strong> does not prejudice traffic safety.Despite anything to the contrary in this <strong>Plan</strong>, access to a proposed use ordevelopment from a main road is to be only with consent <strong>and</strong> in accordance withthe requirements of the service authority responsible for the care, control <strong>and</strong>management of the main road.12.3 MAIN ROADS AND PROPOSED MAIN ROADSThe purpose of this clause is to ensure that use or development of l<strong>and</strong> –(a)(b)in zone M does not prejudice traffic safety or the amenity of the main road;<strong>and</strong>in zone PM does not prejudice the future development of the proposed mainroad.Despite anything to the contrary in this <strong>Plan</strong>, l<strong>and</strong> in zone M or zone PM may beused or developed other than for a public road only with consent <strong>and</strong> in accordancewith the requirements of the service authority that is or will be responsible for thecare, control <strong>and</strong> management of the main road or proposed main road, asapplicable.23.08.2005 83
