6.4 Refunds made by Euro Disney Vacances will be made in the currency used for payment.6.5 No refund will be given for any unused part of an inclusive holiday.Article 7 - Alterations Made By Euro Disney VacancesWhilst it is unlikely, it may, in certain circumstances be necessary to cancel or make changes to your holidayand Euro Disney Vacances reserves the right to do so at any time.Minor changes would occur for example where a facility or a small number of facilities are closed formaintenance or Euro Disney Vacances had to allocate you to a different hotel of the same or higher standardor, in the event air or other transport* is included, the aircraft operator or aircraft type is changed.A significant change would occur where Euro Disney Vacances had to allocate you to a different hotel of alower standard or, if air transportation* is included, Euro Disney Vacances had to change the destinationairport (no other changes will be considered as significant).Where Euro Disney Vacances make any such changes, Euro Disney Vacances will let you know as soon aspossible.Where Euro Disney Vacances make a significant change, Euro Disney Vacances will offer you a choice of:• accepting an alternative stay of a comparable standard, if available,• accepting an alternative stay of a higher standard if available,• cancelling your stay and receiving a full refund,• accepting the lower standard stay offered and being compensated by way of a payment of the difference inprice of the two stay. Such compensation will not be payable where the cancellation resulted from unusualand unforeseeable circumstances beyond our control.Should you wish to raise a claim against us for breach of contract due to such significant change, you mustgive us notice of your claim within reasonable time after having been informed by us of the requiredsignificant change. Failure to give notice of your claim in such reasonable time will result in the loss of yourremedies against us.It is agreed that “reasonable time” shall mean at the latest fourteen (14) days after notice of the significantchange or, should the beginning of the stay be closer than 21 days from the time of receipt of the significantchange notice, “reasonable time” shall mean at the latest seven (7) days prior to the arrival date (arrival dateexcluded).Euro Disney Vacances will not pay any compensation for minor changes or additional costs over and abovethose detailed above.Article 8 - InsuranceWe have arranged for you an insurance cover to protect you, for example should you need to cancel yourholiday in the unfortunate event of accident or illness.Please see details of such insurance cover in the brochure.Your contract for insurance cover is with a French insurance company, MONDIAL ASSISTANCE, TourGalliéni II - 36, avenue du Général de Gaulle 93175 Bagnolet Cedex, France.The insurance cover must be requested at the time of booking and the insurance premium must be paidimmediately along with the full payment of your holiday.Insurance contract is not transferable. Insurance premiums are not refundable. Children under 3 years old areprotected under such insurance provided that such insurance cover has been taken out by the adultsaccompanying such children.Part II – BOOKINGS OF SEPARATE EURO DISNEY SERVICESThese conditions apply only to Euro Disney services purchased independently from any package holidayssuch as entrance tickets to the Disney® Parks, rooms only; shows, dinner shows and special events (asfurther described in the Brochure and on our website) (“Separate Services”).1. OrderAll our Separate Services may be booked over the Internet at www.disneylandparis.com or byphone.According to the nature of the Separate Services and the way you reserved you will be having thechoice of ordering either e-voucher/e-ticket (“E-Tickets”) or hard ticket (“Hard Tickets”).Separate Services may be ordered until 12.00 P.M. (midday) GMT on the day before your date ofarrival/use except for entrance tickets to Disney Parks and tickets for Special Events which needto be delivered to your home, which given the time involved for delivery, must be ordered at thelatest 10 days before your anticipated arrival date.Our contractual arrangements for Separate Services will be confirmed to you in writing.Unless otherwise specified on the service description, the number of tickets for any service orproduct that may be requested per order is limited to 12.2. Formation of ContractBy Internet - our contract is formed once you click on the button for “confirm your order”,whereby you declare that you have read and accepted all the Conditions of Sale withoutreservation applicable and your full payment due to us has cleared.Telephone orders - our contract is formed once you are given a reservation number and yourdeposit or full payment due to us has cleared and applicable terms and conditions have beenmade available to you.3. Price - Payment - Reimbursement - ExchangeSeparate Services must be paid for in full in Danish Kroners by, Visa, Euro Card/Master Card,American Express ( unless otherwise stated at time of booking ) at the time of ordering.Passes and tickets for Separate Services remain our property and may not be used until theamount of the price has cleared to us and may be withdrawn should your payment subsequentlynot clear to us.Unless otherwise specified, you will not be entitled to a refund for cancellation or to substituteservices, unless you exercise the right to withdraw your order, under clause 4.Any partial or total cancellation of rooms as Separate Services, will be charged as follows:Article 9 - LiabilityEuro Disney Vacances is liable pursuant to sections 15 to 27 of the Act on Package Holidays, which containprovisions on the operator’s breaches of contract both before and after commencement of the packageholiday. Holders of non-Danish passports should check whether they require any special permits or visas forFrance.We would like to stress that it is your responsibility to be in possession of a valid passport and visa for anycountry you intend to visit/transit. Please seek the advice of your Consulate or Embassy, or that of thecountry you intend to visit/transit. Euro Disney Vacances cannot accept liability or consider refunds forclients who are unable to travel because they have insufficient or incorrect documentation.Article 11 - HealthWe would recommend you to check the Department of Health of your country, and also check with your owndoctor as to which inoculations the Department of Health considers necessary.Article 12 - ComplaintsYou have been expressly informed that, if you want to complain of a defect of the holiday, you must notifyEuro Disney Vacances thereof or your travel agent within a reasonable time after your discovery of thedefect.Any complaint or dissatisfaction you may have with any aspects of your holiday should be reportedimmediately to the manager of your hotel or other service producer at the first available opportunity to enableEuro Disney Vacances to remedy the situation as rapidly as possible. Should you not be satisfied with theassistance given or wish to draw Euro Disney Vacances’ attention to your complaints, notification of suchshall be made within two (2) months of the end of your holiday, by recorded delivery to Disneyland Resort<strong>Paris</strong>, Guest Communication, BP 100, 77 777 Marne La Vallée, Cedex 4, France.Apart from the cases mentioned in section 26(2) and section 27 of the Danish Act, you forfeit the right tocomplain of a defect if the complaint is not made in due time and Euro Disney Vacances regrets it will beunable to entertain any claim you may make after the above timescale.Please write to Disneyland® Resort <strong>Paris</strong>, Guests Communication, B.P. 100, 77777 Marne-La-Vallée Cedex4, France, detailing your concern, the date of your stay at Disneyland <strong>Paris</strong> and your booking number.Please note that any correspondence with you on complaints is private and confidential.Article 13 - Property rightsYou will not acquire any property right nor any right of use of the names, signs, emblems, logos, trademarks,any other signs, other authors' rights, industrial or intellectual property rights, belonging to Euro DisneyAssociés SCA, Disney Enterprises Inc. or any one of their subsidiaries or affiliated companies.You agree that you will not include our services in any package or group of services and, in particular, youwill not offer any of our services as part of any "give-away", premium or lottery.Article 14 - Applicable Law Settlement of DisputesRelationship between Euro Disney Vacances and its guests are governed by Danish law and any dispute willbe submitted to the competent Court of Law in Copenhagen (Copenhagen City Court).Article 15- SeverabilityShould any part of this agreement be deemed by rule of law to be void, the remainder of the agreement willremain in full force and effect.4. Right to WithdrawYou may cancel your order or any part of it within a period of 10 days from the time of paymentfor your order, following which per legal obligation we will reimburse you UNLESS, accordingto the law the Separate Services you purchase are for specified date. The costs of returningSeparate Services/items by registered mail will be borne by you. In this case, the SeparateServices/items should be returned to the following address: Disneyland Resort <strong>Paris</strong>, Bat. PeterPan, Ticket Services, B.P. 103, 77777 Marne La Vallée Cedex 04, France.5. Home Delivery/Collection/Print at Home5.1 Compulsory collection at Disneyland Resort <strong>Paris</strong> of Hard TicketsFor any order of Park Tickets, Annual Passports, “Buffalo Bill’s Wild West Show” dinner show,and for special events tickets (unless specified otherwise upon reservation by telephone or on theInternet website), placed less than 10 days before the anticipated date of your visit Hard ticketsmust be collected from the ticket office specified in the confirmation letter we end to you. Youwill need to take your confirmation letter or a print-out of the e-mail with you and a form ofidentification in order to collect you’re your HARD tickets.5.2 Home Delivery, mail costs and packingHome delivery can be made for Parks tickets and tickets for Separate Services except where thecircumstances detailed in clause 5.1 above apply.Hard Tickets for Separate Services can be sent to you by post to the address you provide whenordering by telephone once you have ordered and paid all costs including for mail and packingcommunicated to you upon reservation; and for delivery of the Hard Tickets ordered on thewebsite the mail and packing costs are mentioned on the websiteWe cannot be held responsible for delays in delivery, non-delivery or for the consequences ofsuch delays unless caused by us.5.3 Printing of the E-Tickets at homeOn the website Park E-tickets and Separate Services may be booked and directly printed on yourpersonal printer.E-Tickets giving you direct access to the Separate Services entrance, or E-voucher to beexchanged at Disneyland Resort <strong>Paris</strong> (exact place indicated in your confirmation letter).6. Customer ServiceOur customer service team is at your disposal for any further information.
