Application of International TariffThis Tariff contains the rules, regulations and rates forInternational Long Distance Services offered to Pioneer LongDistance, Inc. subscribers.2. Description of ServicePioneer Long Distance, Inc. (Company) provides switchedmessage service to international locations described in thistariff. Service is available 24 hours a day, seven days aweek.3. Liability of the Company(A) The Company shall be indemnified and held harmless bythe Customer against:(1) Claims for libel, slander, infringement ofcopyright or unauthorized use of any trademark,trade name or service mark arising out of thematerial transmitted over the Company'sfacilities; and(2) Claims for patent infringement arising fromcombining or connecting the Company's facilitieswith apparatus and systems of the Customer; and(3) All other claims arising out of any act oromission of the Customer in connection with anyservice provided by the Company.(B) The Company shall be indemnified and held harmless fromany and all loss, claims, demands, suits, or otheraction, whether suffered, made, instituted, or assertedby the Customer or by any other party or persons, forany personal injury to, or death of any person orpersons, and for any loss, damage, defacement ordestruction of the premises of the Customer or anyother property, whether owned by the Customer orothers, caused or claimed to have been4

PIONEER LONG DISTANCE, INC.caused directly or indirectly by the installation,operation, failure to operate, maintenance, removal,presence, condition, location or use that is not thedirect result of the Company's negligence. No agentsor employees of other carriers shall be deemed to beagent or employees of the Company.(C) The liability of the Company for damages arising out ofmistakes, omissions, interruptions, delays, errors ordefects in transmission occurring in the course offurnishing service, and not caused by the negligence ofthe Company, shall in no event exceed an amountequivalent to the proportionate charge to the Customerfor the period during which the call was affected. Noother liability shall in any case attach to theCompany.(D) The Company and/or Customer shall not be liable to theother for any failure of performance due to causesbeyond its control including fire, flood, epidemic,earthquake, other acts of God, explosion, strike orother labor disputes, riot or civil disturbance, war(whether declared or undeclared) or armed conflict,failure of common carrier or "carrier's carrier" ormunicipal ordinance, any state or federal law,governmental order or regulation or order of any courtor occurrence not within the control of Carrier orCustomer, as the case may be.4. Use of ServiceInternational Long Distance Message TelecommunicationsService (LDMTS) may only be used to transmit communicationsof the customer and authorized users in a manner consistentwith the terms of this tariff and the policies andregulations of the Federal Communications Commission (FCC)and local authorities having jurisdiction over the service.5

7. Promotional RatesPIONEER LONG DISTANCE, INC.Company may offer discounted promotional rates for one ormore of its international routes. Promotional rates will beeffective for one or more days not to exceed one billingperiod in a calendar year.20
