The law isorganized into four parts: Part A: Administration; Part B: school age and preschoolprograms for children with disabilities; Part C: birth to 3 years –infants and toddlers; andPart D: national studies, technical assistance investments, personnel preparationinvestments, and research investments.When <strong>IDEA</strong> was recently updated in 2004, there was a change regarding where theprovision <strong>of</strong> services could take place for “parentally placed” students with disabilities(students placed in private schools by parent choice). The new amendment states thatschool districts are responsible for identifying parentally placed students with disabilitieswithin their districts – regardless <strong>of</strong> where the parent resides. School districts must workwith these students’ schools to provide a proportional share <strong>of</strong> services. Federal law setsminimum standards <strong>of</strong> service delivery and State law/regulations cannot under-provide.However, they can do more should the states choose to do so. The same is true for theLEA (local education agencies). New regulations were issued in August, 2006 and it isimportant for people to attend meetings in local areas to be part <strong>of</strong> the dialogue.LEA’S must take action regarding “parentally placed” students in the following ways:∞ Conduct a “child find,” which means that they must assertively look for childrenwith disabilities. Confidentiality is not breached because this is done withoutspecific names generated.∞ Provide evaluations in the same way as they do for public school children.

Some districtsprovide transportation from the JDS or home to the public site.
