Democracy is strengthened by improving st<strong>and</strong>ards in the workplace,enhancing the quality of life for workers <strong>and</strong> by promoting social policies in theC<strong>on</strong>tinent. .III. Democracy, Sustainable Development, <strong>and</strong> Combating Poverty <strong>and</strong> Illiteracy,<strong>and</strong> C<strong>on</strong>flictArticle 11Sustainable stability in Africa dem<strong>and</strong>s the establishment <strong>and</strong> strengthening ofdemocratic structures <strong>and</strong> accountable <strong>and</strong> transparent <strong>governance</strong> based <strong>on</strong> the rule oflaw <strong>and</strong> the eliminati<strong>on</strong> of corrupti<strong>on</strong>.C<strong>on</strong>flict is <strong>on</strong>e of the most serious threats to <strong>democracy</strong> <strong>and</strong> development in Africa. TheAU members commit themselves to promote peace, security <strong>and</strong> stability in theirrespective countries, regi<strong>on</strong>s <strong>and</strong> in the c<strong>on</strong>tinent by fostering participatory politicalsystems with well functi<strong>on</strong>ing inclusive instituti<strong>on</strong>s, by promoting solidarity with othercountries <strong>and</strong> by supporting the c<strong>on</strong>flict preventi<strong>on</strong> <strong>and</strong> resoluti<strong>on</strong> initiatives that the AUmay undertake.Article 12Poverty, illiteracy, <strong>and</strong> low levels of human development are factors that adversely affectthe c<strong>on</strong>solidati<strong>on</strong> of <strong>democracy</strong> in Africa. The AU member states are committed toadopting <strong>and</strong> implementing all those acti<strong>on</strong>s required to generate productive employment,reduce poverty, <strong>and</strong> eradicate extreme poverty <strong>and</strong> illiteracy, taking into account thedifferent ec<strong>on</strong>omic realities <strong>and</strong> c<strong>on</strong>diti<strong>on</strong>s of the countries of the C<strong>on</strong>tinent . This sharedcommitment to address the problems associated with development <strong>and</strong> poverty alsounderscores the importance <strong>and</strong> the obligati<strong>on</strong> to strengthen social awareness, cohesi<strong>on</strong><strong>and</strong> <strong>democracy</strong>.Article 13Draft African Charter <strong>on</strong> Electi<strong>on</strong>s, Democracy <strong>and</strong> Governance (versi<strong>on</strong> 1.1) 20 th February, 2003 5


Draft African Charter <strong>on</strong> Electi<strong>on</strong>s, Democracy <strong>and</strong> Governance (versi<strong>on</strong> 1.1), 20 th February 2003The promoti<strong>on</strong> <strong>and</strong> observance of ec<strong>on</strong>omic, social <strong>and</strong> cultural rights are inherentlylinked to integral development, equitable ec<strong>on</strong>omic growth, <strong>and</strong> to the c<strong>on</strong>solidati<strong>on</strong> of<strong>democracy</strong> in the states of the C<strong>on</strong>tinent .Article 14Member states agree to review periodically the acti<strong>on</strong>s adopted <strong>and</strong> carried out by the AUto promote dialogue, cooperati<strong>on</strong> for integral development, <strong>and</strong> the fight against poverty,illiteracy in the C<strong>on</strong>tinent, <strong>and</strong> to take the appropriate measures to further theseobjectives.Article 15The principles of <strong>democracy</strong> <strong>and</strong> popular participati<strong>on</strong>, equal opportunity <strong>and</strong> equitableaccess <strong>and</strong> transparent redistributi<strong>on</strong> of resources for all people must underlie alldevelopment objectives <strong>and</strong> strategies;Partnership, trust <strong>and</strong> transparency between leaders <strong>and</strong> citizens will be critical to ensuresustainable development, based <strong>on</strong> mutual resp<strong>on</strong>sibilities <strong>and</strong> a shared visi<strong>on</strong>.It is essential that the African states implement policies <strong>and</strong> strategies to protect theenvir<strong>on</strong>ment, including applicati<strong>on</strong> of various treaties <strong>and</strong> c<strong>on</strong>venti<strong>on</strong>s, to achievesustainable development for the benefit of future generati<strong>on</strong>s.Article 16Educati<strong>on</strong> is key to strengthening democratic instituti<strong>on</strong>s, promoting the development ofhuman potential, alleviating poverty <strong>and</strong> fostering greater underst<strong>and</strong>ing am<strong>on</strong>g Africanpeoples. To achieve these ends, it is essential that a quality educati<strong>on</strong> be available to all,especially girls <strong>and</strong> women, rural inhabitants, minorities, disabled <strong>and</strong> otherdisfranchised groups.IV. Strengthening <strong>and</strong> Protecting Democratic Instituti<strong>on</strong>sArticle 17It is the obligati<strong>on</strong> of member states to uphold the principles of <strong>democracy</strong> <strong>and</strong> tostrengthen <strong>and</strong> protect democratic instituti<strong>on</strong>s. Strict adherence to these principles <strong>and</strong> thestrengthening of democratic instituti<strong>on</strong>s reduces the risk of unc<strong>on</strong>stituti<strong>on</strong>al change. It isthe resp<strong>on</strong>sibility of the African Uni<strong>on</strong> to support all efforts aimed at promotingadherence to these principles.Article 18When situati<strong>on</strong> arise in a member state that may affect the development of its democraticpolitical instituti<strong>on</strong>al process or the legitimate exercise of power, the AU Commissi<strong>on</strong>, atthe behest of any member state, the Chair of the AU or the Commissi<strong>on</strong> itself, mayDraft African Charter <strong>on</strong> Electi<strong>on</strong>s, Democracy <strong>and</strong> Governance (versi<strong>on</strong> 1.1) 20 th February, 2003 6

The AU Commissi<strong>on</strong>will submit a report to the Assembly, which will undertake a collective assessment of thesituati<strong>on</strong> <strong>and</strong>, where necessary, may adopt decisi<strong>on</strong>s for the preservati<strong>on</strong> of thedemocratic system <strong>and</strong> its strengthening as agreed under the security <strong>and</strong> stability pillarsof the CSSDCA Solemn Declarati<strong>on</strong>. These decisi<strong>on</strong>s may include, but are not limited tothe deployment of; diplomatic missi<strong>on</strong>s <strong>and</strong> good offices, mediators, peace m<strong>on</strong>itors,peacekeepers, peacemakers <strong>and</strong> peace-enforcers.Article 19Based <strong>on</strong> the principles of the C<strong>on</strong>stitutive Act of the AU <strong>and</strong> subject to its norms, <strong>and</strong> inaccordance with the Declarati<strong>on</strong> of Lomé, an unc<strong>on</strong>stituti<strong>on</strong>al interrupti<strong>on</strong> of thedemocratic order or an unc<strong>on</strong>stituti<strong>on</strong>al alternati<strong>on</strong> of the c<strong>on</strong>stituti<strong>on</strong>al regime thatseriously impairs the democratic order in a member state, c<strong>on</strong>stitutes, while it persists, aninsurmountable obstacle to its government's participati<strong>on</strong> in sessi<strong>on</strong>s of the Assembly, theExecutive Council, Permanent Representatives Committee, Specialized TechnicalCommittees, Ec<strong>on</strong>omic, Social <strong>and</strong> Cultural Council, Financial instituti<strong>on</strong>s of the AU,the specialized c<strong>on</strong>ferences, the commissi<strong>on</strong>s, working groups, <strong>and</strong> other bodies of theAU .An unc<strong>on</strong>stituti<strong>on</strong>al change is recognised as;a military coup d’état against a democratically elected government;interventi<strong>on</strong> by mercenaries to replace a democratically elected government;the replacement of democratically elected government by armed dissidents <strong>and</strong>rebels;or the refusal of an incumbent government to relinquish power to the winningparty after free, fair <strong>and</strong> regular electi<strong>on</strong>s.Article 20In the event of an unc<strong>on</strong>stituti<strong>on</strong>al alterati<strong>on</strong> of the c<strong>on</strong>stituti<strong>on</strong>al regime that seriouslyimpairs the democratic order in a member state, any member state, the Chairpers<strong>on</strong> of theAssembly or the Chairpers<strong>on</strong> of the Peace <strong>and</strong> Security Council may request theimmediate c<strong>on</strong>vocati<strong>on</strong> of the Assembly to undertake a collective assessment of thesituati<strong>on</strong> <strong>and</strong> to take such decisi<strong>on</strong>s as it deems appropriate.The Peace <strong>and</strong> Security Council, depending <strong>on</strong> the situati<strong>on</strong>, may adopt decisi<strong>on</strong>s for therestorati<strong>on</strong> of the democratic system <strong>and</strong> its strengthening as agreed under the security<strong>and</strong> stability pillars of the CSSDCA Solemn Declarati<strong>on</strong>. These decisi<strong>on</strong>s may include,but are not limited to the deployment of; diplomatic missi<strong>on</strong>s <strong>and</strong> good offices,mediators, peace m<strong>on</strong>itors, peacekeepers, peacemakers <strong>and</strong> peace-enforcers.If such diplomatic initiatives prove unsuccessful, or if the urgency of the situati<strong>on</strong> sowarrants, the Peace <strong>and</strong> Security Council shall immediately c<strong>on</strong>vene a special sessi<strong>on</strong> ofthe Assembly. Draft African Charter <strong>on</strong> Electi<strong>on</strong>s, Democracy <strong>and</strong> Governance (versi<strong>on</strong> 1.1), 20 th February 2003The necessary diplomatic initiatives, including good offices, to foster the restorati<strong>on</strong> of<strong>democracy</strong>, will c<strong>on</strong>tinue during the process.Article 21When the special sessi<strong>on</strong> of the Assembly determines that there has been anunc<strong>on</strong>stituti<strong>on</strong>al interrupti<strong>on</strong> of the democratic order of a member state, <strong>and</strong> thatdiplomatic initiatives have failed, the special sessi<strong>on</strong> shall take the decisi<strong>on</strong> to suspendsaid member state from the exercise of its right to participate in the AU by an affirmativevote of two thirds of the member states in accordance with the C<strong>on</strong>stitutive Act of theAfrican Uni<strong>on</strong> . The suspensi<strong>on</strong> shall take effect immediately.The suspended member state shall c<strong>on</strong>tinue to fulfill its obligati<strong>on</strong>s to the AU, inparticular its human rights obligati<strong>on</strong>s.Notwithst<strong>and</strong>ing the suspensi<strong>on</strong> of the member state, the AU<strong>and</strong> other initiatives to restore <strong>democracy</strong> in that state.will maintain diplomaticArticle 22Once the situati<strong>on</strong> that led to suspensi<strong>on</strong> has been resolved, any member state or theChair of the Commissi<strong>on</strong> may propose to the Assembly that suspensi<strong>on</strong> be lifted. Thisdecisi<strong>on</strong> shall require the vote of two thirds of the member states in accordance withC<strong>on</strong>stitutive Act of the African Uni<strong>on</strong>. .V. Democracy <strong>and</strong> Free <strong>and</strong> Fair Electi<strong>on</strong>sArticle 23Member states are resp<strong>on</strong>sible for organizing, c<strong>on</strong>ducting, <strong>and</strong> ensuring free <strong>and</strong> fairelectoral processes.Member states, in the exercise of their sovereignty, may request that the African Uni<strong>on</strong>provide advisory services or assistance for strengthening <strong>and</strong> developing their electoralinstituti<strong>on</strong>s <strong>and</strong> processes, including preliminary assessment, observati<strong>on</strong>, m<strong>on</strong>itoring <strong>and</strong>supervisory, or technical assistance missi<strong>on</strong>s for that purpose.Article 24AU missi<strong>on</strong>s in support of free <strong>and</strong> fair electi<strong>on</strong>s shall be carried out at the request of themember state c<strong>on</strong>cerned. To that end, the government or appropriate agency of that state<strong>and</strong> the Chair, or his or her deputies, of the Commissi<strong>on</strong> of the African Uni<strong>on</strong> shall enterinto an agreement establishing the scope <strong>and</strong> type of electoral missi<strong>on</strong> in questi<strong>on</strong> inaccordance with AU guidelines. The member state shall guarantee c<strong>on</strong>diti<strong>on</strong>s of security,free access to informati<strong>on</strong>, n<strong>on</strong>-interference, freedom of movement <strong>and</strong> full cooperati<strong>on</strong>with the electoral missi<strong>on</strong>.Draft African Charter <strong>on</strong> Electi<strong>on</strong>s, Democracy <strong>and</strong> Governance (versi<strong>on</strong> 1.1) 20 th February, 2003 8


Draft African Charter <strong>on</strong> Electi<strong>on</strong>s, Democracy <strong>and</strong> Governance (versi<strong>on</strong> 1.1), 20 th February 2003Electoral missi<strong>on</strong>s shall be carried out in accordance with the principles <strong>and</strong> norms of theAU governing democratic electi<strong>on</strong>s agreed in Durban, 2002. The AU shall ensure thatthese missi<strong>on</strong>s are effective <strong>and</strong> independent <strong>and</strong>, together with the member states, shallprovide them with the necessary resources for that purpose. Electoral missi<strong>on</strong>s shall bec<strong>on</strong>ducted in a professi<strong>on</strong>al, objective, impartial, <strong>and</strong> transparent manner <strong>and</strong> with theappropriate technical expertise.All electoral missi<strong>on</strong>s shall present a report <strong>on</strong> their activities in a timely manner to theAssembly through the Chair of the AU Commissi<strong>on</strong>.Article 25The electoral missi<strong>on</strong>s shall advise the AU Commissi<strong>on</strong>, if the necessary c<strong>on</strong>diti<strong>on</strong>s <strong>and</strong>envir<strong>on</strong>ment for free <strong>and</strong> fair electi<strong>on</strong>s as agreed in AU principles governing democraticelecti<strong>on</strong>s have been satisfied.The AU may, with the c<strong>on</strong>sent of the state c<strong>on</strong>cerned, send special advisory missi<strong>on</strong>swith a view to creating or improving said c<strong>on</strong>diti<strong>on</strong>s.VI. Promoti<strong>on</strong> of a Democratic CultureArticle 26The AU will c<strong>on</strong>tinue to carry out programs <strong>and</strong> activities designed to promotedemocratic principles <strong>and</strong> practices <strong>and</strong> strengthen a democratic culture in Africa, bearingin mind that <strong>democracy</strong> is a way of life based <strong>on</strong> liberty, freedom of choice, freedomfrom want <strong>and</strong> fear <strong>and</strong> the enhancement of ec<strong>on</strong>omic, social <strong>and</strong> cultural c<strong>on</strong>diti<strong>on</strong>s forthe peoples of Africa . The AU will c<strong>on</strong>sult <strong>and</strong> cooperate <strong>on</strong> an <strong>on</strong>going basis withmember states <strong>and</strong>, where appropriate with civil society organizati<strong>on</strong>s working in thosefields.Article 27The objective of the programs <strong>and</strong> activities will be to promote good <strong>governance</strong>,transparent <strong>and</strong> accountable administrati<strong>on</strong>, democratic values, <strong>and</strong> the strengthening ofpolitical instituti<strong>on</strong>s <strong>and</strong> civil society organizati<strong>on</strong>s.
