INTRODUCTIONDear SirDear Madam<strong>You</strong> have been granted <strong>refugee</strong> status <strong>in</strong> <strong>Belgium</strong>. It gives you numerousrights, comparable to those of a Belgian citizen, <strong>as</strong> well <strong>as</strong> obligations.<strong>You</strong> will doubtless be <strong>as</strong>k<strong>in</strong>g yourself what the future holds <strong>in</strong> storefor you <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> <strong>Belgium</strong>. In the follow<strong>in</strong>g pages you will f<strong>in</strong>d avariety of <strong>in</strong>formation that I trust will answer your questions. If <strong>in</strong> doubt,ple<strong>as</strong>e check with the departments mentioned <strong>in</strong> the follow<strong>in</strong>g pages.This brochure gives b<strong>as</strong>ic <strong>in</strong>formation only. It is impossible to go <strong>in</strong>toevery detail and <strong>as</strong>pect. 1. RESIDING IN BELGIUMHav<strong>in</strong>g been granted <strong>refugee</strong> status gives you the right to reside <strong>in</strong><strong>Belgium</strong> permanently.<strong>You</strong> must <strong>as</strong>k to be registered <strong>in</strong>to the 'register of foreign nationals' ofthe municipality where you live.Go to your municipality and show the certificate given to you by theOffice of the Commissioner General for Refugees and Stateless Persons(CGRS).The municipality will provide you with an identity document:◘◘◘◘Either, <strong>in</strong> most c<strong>as</strong>es, a type B electronic card for foreign nationals(gives right of residence);Or a type C electronic card for foreign nationals (gives right of establishment).Make sure that the word '<strong>refugee</strong>' appears under the head<strong>in</strong>g 'nationality'.Ask the municipality to correct it if necessary.The CGRS does no longer issue the <strong>refugee</strong> certificate, also known <strong>as</strong>the 'green card', s<strong>in</strong>ce 17 February 2003. It is essential, therefore, thatyour <strong>refugee</strong> status is mentioned on your identity document. S<strong>in</strong>ce thatdate, the CGRS only provides certificates of <strong>refugee</strong> status.The electronic card for foreign nationals is valid for 5 years. It is yourresponsibility to <strong>as</strong>k for it to be extended or renewed.If you f<strong>in</strong>d that you have lost your residence permit or that it h<strong>as</strong> beenstolen, you must make a declaration to that effect to the police <strong>in</strong> thelocation where the loss or theft w<strong>as</strong> determ<strong>in</strong>ed.Introduction - Resid<strong>in</strong>g <strong>in</strong> <strong>Belgium</strong> │ 7


2. WORKING IN BELGIUMAs a <strong>recognized</strong> <strong>refugee</strong>, you do not need a work permit to work <strong>in</strong><strong>Belgium</strong>. <strong>You</strong> have access to the labour market under the same terms<strong>as</strong> Belgians.As a <strong>recognized</strong> <strong>refugee</strong>, <strong>in</strong> <strong>Belgium</strong> you do not need a card certify<strong>in</strong>gthat you belong to a particular profession if you want to be selfemployed.<strong>You</strong> can obta<strong>in</strong> <strong>in</strong>formation about your rights and obligations <strong>in</strong> relationto your work (health <strong>in</strong>surance, child benefit, etc.) from a social servicesdepartment, the Public Social Welf<strong>are</strong> Centre (CPAS/OCMW) <strong>in</strong> yourmunicipality or from a trade union).These organisations can also provide <strong>in</strong>formation about <strong>in</strong>come support(unemployment benefit, etc.) if you <strong>are</strong> out of work.8 │ <strong>You</strong> <strong>are</strong> <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> <strong>Belgium</strong> - <strong>You</strong>r rights and obligations


3. RESPECTING BELGIAN LAWAs a <strong>recognized</strong> <strong>refugee</strong>, you <strong>are</strong> subject to Belgian law, not to the lawof your country of orig<strong>in</strong>.<strong>You</strong> must respect the same laws <strong>as</strong> all Belgians, for example <strong>in</strong> mattersrelated to:◘◘◘◘◘◘◘◘◘◘◘◘◘◘the age of majority;marriage;divorce;p<strong>are</strong>ntal authority over m<strong>in</strong>ors;custody of children <strong>in</strong> the event of separation;recognition of paternity;etc.<strong>You</strong> can get further <strong>in</strong>formation from a lawyer, a notary, a legal service,a social support department <strong>in</strong> your municipality, etc.Work<strong>in</strong>g <strong>in</strong> <strong>Belgium</strong> - Respect<strong>in</strong>g Belgian law │ 9


4. TRAVELLING ABROAD<strong>You</strong> have the right to travel abroad, but you risk los<strong>in</strong>g your <strong>refugee</strong>status if you return to your country of orig<strong>in</strong>.If you had a p<strong>as</strong>sport on arrival <strong>in</strong> <strong>Belgium</strong>, you have handed it overto the CGRS. <strong>You</strong> may not <strong>as</strong>k for a new p<strong>as</strong>sport at the emb<strong>as</strong>sy ofyour country of orig<strong>in</strong>. If you do so, you risk los<strong>in</strong>g your <strong>refugee</strong> status.The only p<strong>as</strong>sport you can use is the '<strong>refugee</strong> travel document', alsoknown <strong>as</strong> the 'blue p<strong>as</strong>sport'. <strong>You</strong> must have this 'blue p<strong>as</strong>sport' withyou even when travell<strong>in</strong>g to another country of the European Union,and every member of your family who is <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong><strong>Belgium</strong> must carry his/her own 'blue p<strong>as</strong>sport'.<strong>You</strong> can obta<strong>in</strong> <strong>in</strong>formation about the vis<strong>as</strong> required (even for a Europeancountry) from the emb<strong>as</strong>sies or consulates of the countries you wishto travel to.In the event of problems abroad, Belgian emb<strong>as</strong>sies and consulates canprovide you with consular (adm<strong>in</strong>istrative) <strong>as</strong>sistance.Documents you must provide <strong>in</strong> order to obta<strong>in</strong> a ‘blue p<strong>as</strong>sport’1. your identity card;2. two identity photos;3. if there <strong>are</strong> one or more children under the age of 18 <strong>in</strong> yourhousehold, a family declaration form which you can obta<strong>in</strong> fromyour municipality.4. if you live <strong>in</strong> the Brussels-Capital Region, a family declaration formwhich you can obta<strong>in</strong> from your municipality.Some countries require a visa. Long stay abroadIf you <strong>in</strong>tend to stay abroad for a long time you have to <strong>in</strong>form themunicipality where you live. They will give you <strong>in</strong>formation and extendyour residence permit beforehand, if necessary.If you would like to settle <strong>in</strong> another country you must of courseconform to the visa and residence regulations of that country. Contactthe emb<strong>as</strong>sy or consulate of the country where you <strong>in</strong>tend to settlebeforehand.Return to <strong>Belgium</strong>If you stay abroad for a long time you may be removed from the municipalregister. This may cause some problems when you return to <strong>Belgium</strong>.<strong>You</strong> should pay special attention to the follow<strong>in</strong>g:◘◘◘◘if you have a valid travel document for <strong>refugee</strong>s and a valid residencepermit, you <strong>are</strong> authorized to return to <strong>Belgium</strong> with<strong>in</strong> a year follow<strong>in</strong>gyour departure;if you stay abroad for more than a year your return <strong>in</strong> <strong>Belgium</strong> isno longer guaranteed and you will need a ‘re-entry permit’ whencross<strong>in</strong>g the border (if your travel document is no longer valid, youhave to contact a Belgian diplomatic representation <strong>in</strong> the countrywhere you <strong>are</strong> stay<strong>in</strong>g; the possibility to grant you the right ofre-entry <strong>in</strong>to <strong>Belgium</strong> will then be exam<strong>in</strong>ed).Transfer of <strong>refugee</strong> status to another country<strong>You</strong> <strong>are</strong> advised to <strong>in</strong>quire about the possibility to obta<strong>in</strong> a ‘transfer’of your <strong>refugee</strong> status <strong>in</strong> the country where you <strong>in</strong>tend to live. If your<strong>refugee</strong> status is ‘transferred’, the authorities of this country will deliverTravell<strong>in</strong>g abroad │ 11


a travel document for <strong>refugee</strong>s and other documents. In that c<strong>as</strong>e theCGRS will no longer be competent.Travel to your country of orig<strong>in</strong><strong>You</strong>r <strong>refugee</strong> status does not allow you to visit your country of orig<strong>in</strong>. <strong>You</strong>have been <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> because of the fear of persecutionwhich you mentioned before be<strong>in</strong>g <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong>: travell<strong>in</strong>gto your country of orig<strong>in</strong> could result <strong>in</strong> your status be<strong>in</strong>g reconsidered.However, <strong>in</strong> certa<strong>in</strong> exceptional c<strong>as</strong>es, you may visit your country oforig<strong>in</strong> for a short time (maximum one month). <strong>You</strong> must give yourre<strong>as</strong>ons to the CGRS and obta<strong>in</strong> their agreement <strong>in</strong> advance. If theCGRS agrees, it will set the conditions for this visit. <strong>You</strong> should sendyour request to: CGRS – Documents department, WTC II, Boulevarddu Roi Albert II, 26 A, 1000 BRUSSELS. 5. REQUEST FOR DOCUMENTS AT THE CGRS<strong>You</strong>r <strong>refugee</strong> status does not allow you to have any contact with theemb<strong>as</strong>sy of your country of orig<strong>in</strong>. The CGRS can issue certa<strong>in</strong> documentsthat you cannot obta<strong>in</strong> from the authorities of your country of orig<strong>in</strong>. TheDocuments department of the CGRS can issue the follow<strong>in</strong>g documents:◘◘◘◘◘◘◘◘◘◘◘◘birth certificate;marriage certificate if both spouses <strong>are</strong> <strong>in</strong> <strong>Belgium</strong>;divorce certificate;certificate of widowhood;<strong>refugee</strong> certificate;certificate of end of status.The Documents department is open Monday to Friday between 8.30am and 10.00 am.<strong>You</strong> can send your request by fax to 02 205 52 01,by e-mail: CGRA-CGVS.Documents@ibz.fgov.beor by post (CGRS – Documents department, WTC II, Boulevard du RoiAlbert II, 26 A, 1000 BRUSSELS). 6. OBTAINING REFUGEE STATUS FOR YOUR CHILDREN<strong>You</strong>r children who arrived at the same time <strong>as</strong> you <strong>are</strong> <strong>recognized</strong> <strong>as</strong><strong>refugee</strong>s if you requested this dur<strong>in</strong>g the procedure (the children musthave been registered on your annex 25 or 26).However, children born <strong>in</strong> <strong>Belgium</strong> after recognition of your <strong>refugee</strong>status <strong>are</strong> not automatically eligible for <strong>refugee</strong> status. <strong>You</strong> can <strong>as</strong>k forthese children to be given the same status <strong>as</strong> you:◘◘◘◘◘◘If both p<strong>are</strong>nts <strong>are</strong> <strong>recognized</strong> <strong>as</strong> <strong>refugee</strong>s <strong>in</strong> <strong>Belgium</strong>, sendyour request to the Documents department of the CGRS, WTC II,Boulevard du Roi Albert II, 26 A, 1000 BRUSSELS.If one of the p<strong>are</strong>nts is not <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> <strong>Belgium</strong>,send your request to the Immigration Department, Asylum Bureau,T 02 793 90 73 (French) or 02 793 90 71 (Dutch).If paternity h<strong>as</strong> not been legally established, the mother of a childborn <strong>in</strong> <strong>Belgium</strong> may also apply to the Documents department butshe must present a recent copy of the child’s birth certificate.Any of your children who arrive <strong>in</strong> <strong>Belgium</strong> after recognition of your<strong>refugee</strong> status must be reported to the Immigration Department.For further <strong>in</strong>formation, contact the Asylum Bureau of the ImmigrationDepartment, T 02 793 90 73 (French) or T 02 793 90 71 (Dutch).14 │ <strong>You</strong> <strong>are</strong> <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> <strong>Belgium</strong> - <strong>You</strong>r rights and obligations


7. FAMILY REUNIFICATIONIf you <strong>are</strong> authorized to reside <strong>in</strong> <strong>Belgium</strong>, the members of yourimmediate family may request a 'family reunification visa' from theBelgian diplomatic post <strong>in</strong> their country of residence. This request isprocessed by the Immigration Department (visa department) of theFederal Public Service of the Interior.The follow<strong>in</strong>g <strong>are</strong> eligible for this 'family reunification':◘◘your spouse or partner;◘◘children at your expense under the age of 18.If you <strong>are</strong> under the age of 18 and you stay <strong>in</strong> <strong>Belgium</strong> without be<strong>in</strong>gaccompanied by an adult who is responsible for you, your p<strong>are</strong>nts <strong>are</strong>eligible for family reunification.In order for your immediate family to be eligible for family reunification,you must provide evidence that:◘◘◘◘◘◘<strong>You</strong> have adequate accommodation to house the member(s) of yourfamily who is (<strong>are</strong>) <strong>as</strong>k<strong>in</strong>g to jo<strong>in</strong> you (the municipality will give youfull details and provide you with the certificate);<strong>You</strong> have health <strong>in</strong>surance cover<strong>in</strong>g the risks for you and your family<strong>in</strong> <strong>Belgium</strong>, e.g. you <strong>are</strong> contribut<strong>in</strong>g to a health <strong>in</strong>surance scheme.<strong>You</strong>r municipality can give you <strong>in</strong>formation about this;<strong>You</strong> have sufficient, stable and regular resources to prevent thatyour family members need recourse to the social <strong>as</strong>sistance systemof the public authorities.These three conditions do not have to be met if the p<strong>are</strong>ntal relationshipexisted prior to your entry <strong>in</strong>to <strong>Belgium</strong> and if the request forfamily reunification w<strong>as</strong> made <strong>in</strong> the year follow<strong>in</strong>g the decision recogniz<strong>in</strong>gyour <strong>refugee</strong> status.Obsta<strong>in</strong><strong>in</strong>g <strong>refugee</strong> status for your children - Family reunification │ 15


If you have children at your expense who <strong>are</strong> disabled and over the ageof 18, they may also be eligible for family reunification, but <strong>in</strong> this c<strong>as</strong>eyou always have to provide evidence that you have adequate accommodationand health <strong>in</strong>surance.Members of your family who <strong>are</strong> granted residence under the familyreunification scheme will receive residence permit limited to 3 years.After 3 years, the right to residence is unlimited, if dur<strong>in</strong>g those 3 yearsyou fulfilled all conditions.Certa<strong>in</strong> social services may give you more detailed <strong>in</strong>formation aboutfamily reunification and <strong>as</strong>sist with the steps you need to take <strong>in</strong> orderto br<strong>in</strong>g a member of your immediate family from your country of orig<strong>in</strong>to <strong>Belgium</strong>. <strong>You</strong> will f<strong>in</strong>d the list of social services <strong>in</strong> the annex to thisdocument.Trac<strong>in</strong>gNote that the Red Cross offers a trac<strong>in</strong>g service which will try to f<strong>in</strong>drelatives you have lost contact with. <strong>You</strong> can f<strong>in</strong>d the address of theRed Cross ('Rode Kruis Vlaanderen' and 'Belgian Red Cross') <strong>in</strong> theannex nr. 2.16 │ <strong>You</strong> <strong>are</strong> <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> <strong>Belgium</strong> - <strong>You</strong>r rights and obligations


8. CONFIRMATION OF REFUGEE STATUSIt is important to be aw<strong>are</strong> that a person <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong>another country cannot reside <strong>in</strong> <strong>Belgium</strong> for a long period of time andis subject to the normal rules <strong>as</strong> regards long-term vis<strong>as</strong> and residencepermits (temporary residence, residence for study purposes, residencefor unlimited duration and family reunification).If a member of the family is <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> another countryof the European Union, he may rema<strong>in</strong> <strong>in</strong> <strong>Belgium</strong> for a maximum of3 months if he holds a '<strong>refugee</strong> travel document' issued by his hostcountry. To stay longer, he needs a residence permit issued by theBelgian emb<strong>as</strong>sy or consulate <strong>in</strong> his host country.If a member of your family is <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> a non-Europeancountry, a tourist visa is normally required to travel to <strong>Belgium</strong>(<strong>in</strong>formation should be obta<strong>in</strong>ed from the Belgian emb<strong>as</strong>sy or consulate).Application should also be made to the Belgian emb<strong>as</strong>sy or consulatefor a long-term permit.To request confirmation <strong>in</strong> <strong>Belgium</strong> of <strong>recognized</strong> <strong>refugee</strong> status <strong>in</strong>another country, even if <strong>in</strong> the European Union, you need:1. A family reunification residence permit issued by the Belgian emb<strong>as</strong>syor consulate (note: a temporary residence permit for study<strong>in</strong>g <strong>in</strong><strong>Belgium</strong>, for example, does not allow confirmation of status), to beregistered with the municipality and to hold a (type B, C, F or F+)electronic card for foreign nationals;2. To have been a regular resident <strong>in</strong> <strong>Belgium</strong> without <strong>in</strong>terruption forat le<strong>as</strong>t 18 months;3. To be granted residence <strong>in</strong>def<strong>in</strong>itely (family reunification gives entitlementto limited residence for the first 3 years: dur<strong>in</strong>g this periodFamily reunification - Confirmation of <strong>refugee</strong> status │ 17


of limited residence, the law does not allow transfer (confirmation)of <strong>refugee</strong> status);4. To request confirmation of <strong>refugee</strong> status from the CGRS and toattach to the application:◘◘◘◘a copy of the residence card or the residence permit;and of the travel document issued <strong>in</strong> the country which <strong>recognized</strong>the <strong>refugee</strong> status.The Commissioner General may decide to confirm the <strong>refugee</strong> statusif all conditions <strong>are</strong> met.Confirmation of <strong>recognized</strong> <strong>refugee</strong> status <strong>in</strong> another country, enablesyou to be eligible for the benefits <strong>as</strong>sociated with <strong>recognized</strong> <strong>refugee</strong>status <strong>in</strong> <strong>Belgium</strong>. Prior to this confirmation, only the country which <strong>recognized</strong>your <strong>refugee</strong> status may prolong or provide a '<strong>refugee</strong> traveldocument', and the CGRS cannot provide any document.18 │ <strong>You</strong> <strong>are</strong> <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> <strong>Belgium</strong> - <strong>You</strong>r rights and obligations


9. BECOMING BELGIANThere <strong>are</strong> two procedures to obta<strong>in</strong> Belgian nationality: a declarationof nationality and naturalization. If you obta<strong>in</strong> Belgian nationality, youwill lose your <strong>refugee</strong> status.Declaration of nationalityThe conditions to become a Belgian citizen through a declaration ofnationality <strong>are</strong> too extensive to be listed here. <strong>You</strong> can f<strong>in</strong>d the legalconditions (<strong>in</strong> Dutch and French) on the website of the M<strong>in</strong>istry ofJustice: http://www.justice.belgium.be via the menu on the left-handside ‘Personen en gez<strong>in</strong>nen / Personnes et familles’ – ‘Nationaliteit /Nationalité’.<strong>You</strong> make a declaration of nationality before the registrar of your placeof residence. The registrar will give you the necessary <strong>in</strong>formation aboutthe documents you have to present to complete your file.<strong>You</strong> can <strong>as</strong>k the Documents Service of the CGRS for birth certificatesand <strong>refugee</strong> certificates, which you have to add to your declaration ofnationality (see page 13).NaturalizationConditions<strong>You</strong> have1. to be at le<strong>as</strong>t 18 years old,2. to stay <strong>in</strong> <strong>Belgium</strong> legally,3. to show ‘exceptional merits’ <strong>in</strong> science, sports or the socioculturaldoma<strong>in</strong>,4. to prove that it is hardly possible for you to obta<strong>in</strong> Belgian nationalitythrough a declaration of nationality.Confirmation of <strong>refugee</strong> status - Becom<strong>in</strong>g Belgian │ 19

10. CESSATION OF REFUGEE STATUSThe <strong>refugee</strong> status may be ended <strong>in</strong> several ways:1. <strong>You</strong> can give up <strong>refugee</strong> status voluntarily<strong>You</strong> can give up your <strong>refugee</strong> status if you believe that the re<strong>as</strong>onswhich caused you to flee you country no longer apply (<strong>as</strong> a result of achange <strong>in</strong> the political situation or changes to your personal situation).Procedure:◘◘◘◘<strong>You</strong> must go <strong>in</strong> person to the Documents department of the CGRSwith your 'blue p<strong>as</strong>sport' (<strong>refugee</strong> travel document), your <strong>refugee</strong>certificate if you have one, and your identity document. <strong>You</strong> must signa declaration that you <strong>are</strong> giv<strong>in</strong>g up your status and the Documentsdepartment will give you an 'end of status certificate' and yourp<strong>as</strong>sport if you had one.<strong>You</strong> must then go to the municipality with this certificate. The municipalitywill amend your identity document: the reference '<strong>refugee</strong>'willbe replaced by reference to your nationality.Note: to make this amendment, the municipality will require a validnational p<strong>as</strong>sport provided by the emb<strong>as</strong>sy of your country.In this <strong>in</strong>stance: <strong>You</strong> will be able to cont<strong>in</strong>ue to reside <strong>in</strong> <strong>Belgium</strong>.<strong>You</strong> will then be subject to the same rules <strong>as</strong> other foreign nationalswith authorized residence <strong>in</strong> <strong>Belgium</strong>. These rules concern residence,prolonged absence abroad, removal orders (public order), etc.<strong>You</strong> will use the same p<strong>as</strong>sport <strong>as</strong> your compatriots.<strong>You</strong> will be able to travel to and reside <strong>in</strong> your country of orig<strong>in</strong> withoutauthorization from the CGRS. <strong>You</strong> must take c<strong>are</strong>, however, to notifythe municipality <strong>in</strong> the event of prolonged residence outside <strong>Belgium</strong>.Becom<strong>in</strong>g Belgian - Cessation of <strong>refugee</strong> status │ 21

Certa<strong>in</strong> actions will result <strong>in</strong> cessation of <strong>refugee</strong> status◘◘◘◘◘◘◘◘<strong>You</strong> acquire a new nationality.<strong>You</strong> travel to your country of orig<strong>in</strong> without authorization from theCGRS.<strong>You</strong> resettle <strong>in</strong> your country of orig<strong>in</strong>.<strong>You</strong> obta<strong>in</strong> a p<strong>as</strong>sport of your country of orig<strong>in</strong>.◘◘The circumstances which enabled your <strong>refugee</strong> status to be <strong>recognized</strong>no longer exist (for example <strong>in</strong> the event of significant andlong-term changes <strong>in</strong> your country of orig<strong>in</strong>).If you f<strong>in</strong>d yourself <strong>in</strong> one of these situations, you obviously can giveup <strong>refugee</strong> status (see above).However, <strong>in</strong> these situations, the CGRS may also consider cessationof the status.In this c<strong>as</strong>e,◘◘◘◘◘◘you will be <strong>in</strong>vited to the CGRS for an <strong>in</strong>terview, dur<strong>in</strong>g which youwill be able to give a full explanation of your re<strong>as</strong>ons for want<strong>in</strong>g tocont<strong>in</strong>ue to be eligible for <strong>refugee</strong> status.a decision of cessation of the status will be taken if your status nolonger corresponds with the reality of the situation and if you donot give up the status.an appeal with full jurisdiction is possible before the Council foralien law litigation.A decision of cessation h<strong>as</strong> the same effect <strong>as</strong> giv<strong>in</strong>g up <strong>refugee</strong> status.22 │ <strong>You</strong> <strong>are</strong> <strong>recognized</strong> <strong>as</strong> a <strong>refugee</strong> <strong>in</strong> <strong>Belgium</strong> - <strong>You</strong>r rights and obligations

The CGRS may also withdraw your <strong>refugee</strong> status◘◘◘◘If recognition of <strong>refugee</strong> status w<strong>as</strong> b<strong>as</strong>ed on <strong>in</strong>accurate or fraudulentevidence, orIf your behaviour <strong>in</strong>dicates that you do not have the fear of persecutionthat you claimed.If a decision to withdraw recognition of <strong>refugee</strong> status is considered,◘◘◘◘◘◘<strong>You</strong> will be <strong>in</strong>vited to the CGRS for an <strong>in</strong>terview, at which you willbe able to give a full explanation of the new evidence brought tothe attention of the CGRS,A decision to withdraw the status will be taken if the evidence issuch <strong>as</strong> to justify do<strong>in</strong>g so,An appeal with full jurisdiction is possible before the Council foralien law litigation.If a decision is taken to withdraw <strong>refugee</strong> status, the ImmigrationDepartment may, <strong>in</strong> certa<strong>in</strong> c<strong>as</strong>es, issue an order to leave the territoryand thus term<strong>in</strong>ate your right of residence.Cessation of <strong>refugee</strong> status │ 23
