SEVENLEGAL REQUIREMENTS – CITESDetermining the impact of trade28If a party wishes to export a CITES-listedspecies, the exporting country should have aNon-Detriment Finding (NDF). An NDF is afinding that the export will not be detrimentalto the survival of that species.The NDF should be based on scientific studiesof the status of the wild population fromwhich the animal was taken. A scientificassessment should show that trading theanimals (or their parts) will not deplete thewild population.CITES does not require an NDF to be formallywritten or published. Enquiries about NDFsneed to be directed to the CITES authorities inthe exporting and/or importing country.Transporting animalsKEY POINTS• CITES is legally binding andprotects wild animals fromover exploitation throughinternational trade.• CITES applies three levels ofprotection to endangeredanimals in international trade.• CITES import and exportpermits are issued whentrading listed animals (ortheir parts).• CITES is enforced usingdomestic legislation ineach country.29A CITES export permit for any live specimenof a species listed on CITES Appendix I or 2may only be granted when the ManagementAuthority of the exporting country is satisfiedthat the animal will be: “prepared and shippedso as to minimise the risk of injury, damage tohealth, or cruel treatment”.A CITES import permit may only be grantedwhen the Management Authority of theimporting country is satisfied that: “theproposed recipient of a living specimen issuitably equipped to house and care for it”.For CITES resources see Appendix 6: sourcesof further reading.GLOBAL <strong>WELFARE</strong> GUIDANCE FOR <strong>ANIMAL</strong>S IN TOURISM: A Best Practice Guidance Manual©2013 <strong>ABTA</strong>
