The Office of the General Counselmanages lawsuits against the agency in conjunction with Risk Management. The attorneys regularlyprovide advice and guidance regarding legal issues, draft and approve all contracts executed by the Sheriff,review policies and procedures, attend court hearings, and provide guidance to the agency with respect tolabor and employment issues.Areas in which the Office of the General Counsel traditionally provides legal services include, amongothers, the following: litigation, labor and employment, confiscations, forfeitures, detention, childprotective investigations, drug court, pre-trial services, contracts, risk management, arrest/search andseizure, court procedures, policies and general legal advice. It is responsible for the management, mitigation andresolution of all liability claims presented against the Sheriff's Office. This is achieved by providingprompt and professional claims and insurance services in response to any and all risk related issues andliabilities which may have a financial impact to the operation and efficiency of the Broward Sheriff's Officeand its employees. Part of this process also involves a strong emphasis on loss prevention and safety byseeking the input and cooperation of all BSO departments at all levels in helping to reduce and eliminatelosses.Effective October 1, 2012 the Risk Management Office assumed full responsibility for the Agency’sworkers compensation program and all of its 6,000 employees covered under the program.OBJECTIVES:The Division of Risk Management of the Broward Sheriff's Office falls under the umbrella of the Office ofthe General Counsel. The Broward Sheriff's Office is self-insured with the Self Insurance Fund beingmaintained and administered by the Broward County Board of County Commissioners. The Sheriff makespayments to the County's Self-Insurance Fund based upon actuarial estimates of amounts required to settleany prior and current year claims, and the maintenance of a reserve fund.The Broward Sheriff's Office Division of Risk Management provides risk management and claimsadjusting services for all general, public, professional and automobile liability claims which may bebrought against the Sheriff's Office as well as administering to the needs of the agency’s employeesthrough the newly transitioned workers compensation program. By utilizing claims investigativetechniques together with law enforcement investigative reports and other resources, the Division of RiskManagement strives to mitigate claim costs. Based upon the results of an investigation, the Divisionevaluates the claim, claim-related expenses and ultimately implements procedures as required. It is theresponsibility of the Division of Risk Management to handle cases to their conclusion. This may involvethe denial of a claim, a negotiated settlement, mediation or trial, in bringing the file to closure.The Division of Risk Management liaisons with insurance providers, the Office of the General Counsel andoutside counsel in order to provide a complete range of claims adjusting services to facilitate effective andsatisfactory resolution of claims on behalf of the Sheriff and the Broward Sheriff's Office.33
