The quotation will be opened at 1500 hours on 17.9.2013 in the office of theDeputy Conservator, 6 th floor, Centenary building, Chennai Port Trust,Chennai 600 001.3. The rates quoted shall be inclusive of all taxes and other levies if any and shallbe final till the completion of the work and no claim in this regard will beentertained at a later stage for any upward revision.4. The contractor shall supply suitable persons who are fit to carryout such kindof work and the workmanship and shall be to the entire satisfaction of theDeputy Conservator or his representative. The Deputy Conservator or theOfficer authorized by him has full powers to adopt any means to satisfythemselves to ascertain the quality of the work.5. The contractor shall be responsible for supervision and execution of the workas instructed by the Trust officials.6. The Deputy Conservator or his authorized representative reserves the right tosupervise the workmanship in connection with the above-mentioned work atany point of time during the course of the work.7. The D.C. reserves the right to accept or reject any offer or to cancel the entirequotation process without assigning any reasons whatsoever.8. The harbour entry passes for the labourers shall be obtained by the contractorfrom the Pass Section on payment of necessary charges.9. No tools and equipments will be supplied by the Trust.10. The contractor shall be solely responsible for any accident, damage or injurycaused to any of his employees or the employees of the Chennai Port Trust inthe execution of the said work and shall not hold the Chennai Port Trustresponsible in respect thereof and also in respect of any claims made by anyperson in the employment of the contractor for any reason whatsoever.11. The contractor shall ensure safety of the personnel and the personal protectionequipments shall be utilized by the personnel engaged by the contractor whilecarrying out the jobs as per the requirements of applicable regulations andsafety norms.12. While carrying out the job, if any damage caused to the trust property by thecontractor or his employees, the same shall be either replaced or repaired tothe entire satisfaction of the DC or his representative.

13. During the course of work, if found not satisfactory, the firm has to re-do thejob as per DC’s or his representative’s instruction and the firm shall carryoutthe work to the satisfaction of Trust officials. No payment will be made if thework is left incomplete and the Trust reserves the right to engage any othercontractor to complete the work.14. The contractor shall conform to the regulations and by-laws of the ChennaiPort Trust Board and of all other local authorities such as the Corporation ofChennai, the Factories Act, the labour Rules and Regulations, the CustomsDepartment, Dock15. Safety Regulations and Police Department etc., The contractor shall conformto rules, regulations, etc., concerning injury to workmen compensation forinjury to workmen, insurance for workmen etc., The contractor shall alsoconform to contract labour (Regulations and Abolition) Central Rules 1971etc.,16. The Contractor shall comply with the ESI Act as applicable to the labourengaged for the above work.17. The contractor shall be solely responsible for reporting to the Board, DockSafety and Police Department immediately of any serious or fatal accidentinside the Trust’s premises to any of his employees / workmen engaged byhim or any person involved in an accident in the execution of the work.18. The Chennai Port Trust is not responsible for any loss / injury to the contractpersonnel during the course of work.19. The contractor has to furnish an undertaking within 2 days from the date ofreceipt of Trust order on a non-judicial stamp paper to the value of Rs.50/-agreeing to all the terms and conditions.20. The contractor shall pay 5% of the total value of the contract towards Securitydeposit which will be refunded after satisfactory completion of the work.21. The contractor shall start the work immediately after beaching the craft onslipway and the work should be completed within 5 days excluding Trust'sholidays and Sundays and the commencement of the work shall be intimatedone day prior to beaching of the tug. Chennai Port Trust will not beresponsible for any delay in beaching the tug.22. The Contractor shall removed all the Barnacles and see weeds scraped fromthe crafts immediately after work is completed and the same should bedumped to the place identified by the Trust officials.

23. The work shall be carried out without causing any damage to the Trustproperty and without causing any hindrance to the other works being carriedout.24. The work shall be carried out as required by the Marine Department duringday time between 0730 hours and 1700 hours during Trust working days.25. Payment shall be made within 30 days from the date of acceptance of thework and submission of proper bill in the Trust’s format.26. For delay in completion of work, a sum equivalent 1% of the contract valueper day or part thereof subject to a maximum of 10% of the contract value willbe levied as liquidated and ascertained damages and not by way of penaltysubject to force majuere conditions.27. The decision of the Deputy Conservator shall be final on any dispute arisingin any manner regarding this work.DEPUTY CONSERVATOR
