6SPECIAL CONDITIONSAll horses and ponies will be sold under the General MarketConditions of sale plus the following conditions:1. No horse sold for 750 guineas or less shall have any warranty whatsoever, and is sold as itstands.2. All horses sold as “Warranted” are sold as sound in Wind, Eyes and Heart and not showing anytechnical unsoundness. This warranty will apply up to forty-eight hours after the conclusion ofthe sale. All warranted horses are sold as sound in action, this warranty will apply only up to onehour after the conclusion of the sale, unless prior notification has been given to the Auctioneersby the Purchasers, requiring the opinion of the Veterinary panel.3. ALL HORSES ISSUED WITH A PASSPORT BORN AFTER 30TH JUNE 2009 MUST BEMICROCHIPPED. All passports will be checked upon arrival, and any passports not matchingthe scanned microchip will lead to the horse not being offered for sale.4. A fee of £25 (plus VAT) for Veterinary examination will be payable to the Auctioneers at the timeof notification, the defaulting party being responsible for costs.5. All warranted horses sold must be quiet to ride in traffic, and in the case of riding ponies under14 h.h. manageable by an average child appropriate to their size.6. Crib-biters, Wind Suckers and Weavers and horses which have been tubed or otherwiseoperated on for their wind must be declared. This warranty will apply for forty-eight hours afterthe day of sale and notification of such defect must be accompanied by a Veterinary certificateor other Veterinary evidence.7. The Opinion of the Veterinary panel will be final and binding in all cases.8. No lot entered for sale, and brought to the sale centre is to be sold privately before auction,unless the transaction is booked through the Auctioneers office.9. HEALTH AND SAFETY RULESHARRISON & HETHERINGTON LIMITEDNOTICE TO ALL VISITORS AND TRADERSPLEASE READ AND OBSERVETHE FOLLOWINGAll visitors and traders on site will be responsible forensuring that they and their employees or sub-contractorsengaged by them comply with all legal requirements,including the Health and Safety At Work etc., Act 1974, TheManagement of Health and Safety At Work Regulations,The Provision And Use of Work Equipment Regulations,etc.All visitors and traders will be responsible for ensuring thattheir operations in no way affect the integrity of thecompany or its fire, safety or security arrangements and inno way compromise the health and safety and welfare ofother visitors to and or employees of Harrison &Hetherington.Although it is the visitors and traders responsibility toensure that plant, equipment and systems in work are safe,Harrison & Hetherington Limited reserve the right to askany visitor or trader to leave the market for any breaches inthe Health and Safety Rules and/or Regulations.Vendors must inform Harrison & Hetherington Limited ofany livestock due to attend the market whose temperament,behaviour or condition may call for additional precautionsfor its safe handling.When loading or unloading livestock handlers must ensurethat the dock and vehicle gates are securely fixed so as toprevent the escape of animals.Traders are responsible for providing and maintainingsuitable livestock handling equipment. They should ensurethat livestock handlers are fit, experienced in livestockhandling and familiar with the livestock in their charge.Children must not be permitted in any area where they maybe at risk from livestock or machinery.In the case of bulls, during the period when the show/saleis open to visitors, bulls in stalls or pens should not be leftunattended. If the handler is temporarily absent,arrangements should be made with another vendor,steward or member of Harrison & Hetherington staff tooversee the bull until the handler returns.Handling of Livestock at shows and sales: Harrison &Hetherington Limited recommend that an adult personshould accompany any junior person during the showing/sale of livestock in the ring and reserves the right tointervene at any point if, in the company’s opinion, theperson showing the livestock is at risk in undertaking thatactivity.Passageways must be kept clear at all times during theauction sale. PLEASE DO NOT STAND IN THE SALE RINGENTRANCE AND EXIT PASSAGES.The auction ring man escapes and refuges must be keptclear at all times.All portable electrical equipment supplied and/or used byvisitors and traders must be safe and fit for the purpose andshould have a valid portable appliance test certificate.AUCTIONEER’S TERMS & CONDITIONS OF SALE(Incorporating the Auctioneer’s Terms andConditions as recommended by the NBA)1. The biddings to be regulated by the Auctioneers and thehighest bidder, subject to the Vendor’s reserve (if any), to bethe purchaser. No bid shall be retracted and if any disputeshould arise between two or more bidders, the Lot in disputeto be put up again and resold, or the Auctioneers maydetermine the dispute at their own discretion and theirdecision shall be final. The Auctioneers reserve the right torefuse the bid of any person without being called upon togive reason for such action.2. The Purchaser to give his full name and dwelling place andpay for all Lots purchased immediately at the close of sale.No Lot or Lots shall be removed from the sale premises untilpaid for and a pass-out slip obtained from the Auctioneer’sclerk but each and every Lot shall immediately at the fall ofthe hammer be considered as delivered and be and remainin every respect at the absolute risk and expense of therespective purchaser or purchasers thereof and shall beremoved from the sale premises at the purchaser’s expense.The right of property shall not pass until the full purchaseprice is paid.3. All statements in the catalogue, or made by the Auctioneersat the time of sale, also the correct identification of theanimals, are the entire responsibility of the Vendors. TheAuctioneers take no personal responsibility for thecorrectness of such statements or identities.5. All statements in the catalogue, or any made by theAuctioneers at the time of sale relating to any veterinary orother tests are to be taken as statements of fact only. Nosuch statements shall guarantee the purchaser of any animalagainst loss arising from the subsequent reaction of suchanimal to any test administered after the sale and theVendors shall not be liable in any way should this occur.6. All stock is sold subject to the Conditions of Salerecommended for use at markets by the LivestockAuctioneers’ Markets Committee for England and Walesexcept in so far as these conflict with any Special Conditionsapplicable to the sale of pedigree stock, when the latterConditions shall prevail.7. Neither the Vendors nor the Auctioneers will be responsiblefor any accident or injury to persons or property, through fireor any other cause whatsoever, nor for any damage byanimals prior to, during or after the sale.8. No undertaking by the Auctioneers or their servants to takecharge of any Lot or Lots after the sale or to forward them totheir destination shall be held to impose upon theAuctioneers any legal obligation or vitiate any of theseConditions.9. Inasmuch as the Auctioneers act as agents for a disclosedprincipal they shall not be considered personally responsiblefor any default on the part of either purchasers or Vendorsand the remedy shall be against them only and not againstthe Auctioneers.10. If these conditions are unfulfilled, the Vendors orAuctioneers shall have the power to resell the Lots,retaining any surplus and charging any deficiency andexpense to the defaulter.11.
