Under Thai law, foreign nationals mayown buildings or property developed onland leased by them, but not the landitself. Buyers sign 30-year leases, with twooptions to renew the lease for anadditional 30 years each, with OceanBreeze Estate Limited, a Thai company, forthe apartment and the right to use thecommon areas in the project. The buyersalso subscribe to shares in Ocean BreezeOwners Corporation, an offshorecompany which owns the controllinginterest in Ocean Breeze Estate Limited.At the completion of the project, allshares of Ocean Breeze OwnersCorporation will be owned by the lesseesin the project, giving effective control forrenewals and collectively controlling thefreehold of the project.To secure the selected Apartment orSuite, buyers sign a ReservationAgreement which defines therelationship you will have with thedeveloper.
