The defendant has been charged with Assault <strong>in</strong> <strong>the</strong> First Degree, a class Afelony and Endanger<strong>in</strong>g <strong>the</strong> Welfare <strong>of</strong> a Child <strong>in</strong> <strong>the</strong> First Degree, a class Cfelony. The victim is an 8 year old child.2. Upon fil<strong>in</strong>g <strong>of</strong> compla<strong>in</strong>t on July 20, 2012, <strong>the</strong> St<strong>at</strong>e requested <strong>the</strong> bond beset <strong>in</strong> <strong>the</strong> amount <strong>of</strong> $100,000/10%.3. The warrant for arrest signed by Judge Fahnestock on July 20, 2012 shows abond <strong>of</strong> $100,000/10%.4. A review <strong>of</strong> <strong>the</strong> Order <strong>of</strong> Commitment shows <strong>the</strong> orig<strong>in</strong>al bond was set <strong>at</strong>$100,000/10%.5. A review <strong>of</strong> <strong>the</strong> St<strong>at</strong>e’s “Request for Grand Jury Indictment” <strong>in</strong>dic<strong>at</strong>es <strong>the</strong>St<strong>at</strong>e requested a bond <strong>of</strong> $100,000/10%.6. A review <strong>of</strong> <strong>the</strong> St<strong>at</strong>e’s “Case Record Sheet” <strong>in</strong>dic<strong>at</strong>es th<strong>at</strong> AssistantProsecut<strong>in</strong>g Attorney Julie Hamilton recorded <strong>the</strong> bond upon <strong>in</strong>dictment as$100,000/10%.


7. On July 27, 2012 <strong>the</strong> case was presented to <strong>the</strong> grand jury for <strong>in</strong>dictment.The grand jurors issued a true bill. The bond written on <strong>the</strong> <strong>in</strong>dictment was$10,000/10%.8. The record reflects no request to reduce <strong>the</strong> bond was filed by <strong>the</strong> defendantand <strong>the</strong> St<strong>at</strong>e did not request or agree to a reduced bond.9. Co-defendant, Jeffrey Kraft (1216-CR03053), who was charged withcommitt<strong>in</strong>g <strong>the</strong> same crimes, was charged by compla<strong>in</strong>t on <strong>the</strong> same day asthis defendant. His bond was set <strong>at</strong> $100,000/10% upon <strong>the</strong> fil<strong>in</strong>g <strong>of</strong> <strong>the</strong>compla<strong>in</strong>t. The co-defendant was <strong>in</strong>dicted on <strong>the</strong> same day as thisdefendant. The co-defendant’s bond rema<strong>in</strong>ed <strong>the</strong> same <strong>at</strong> $100,000/10%.10. The St<strong>at</strong>e believes a clerical error occurred when record<strong>in</strong>g <strong>the</strong> bond on <strong>the</strong>Indictment. The St<strong>at</strong>e believes <strong>the</strong> correct bond <strong>in</strong> this m<strong>at</strong>ter is$100,000/10%.11. The defendant has posted <strong>the</strong> erroneous $10,000/10% bond th<strong>at</strong> wasrecorded on <strong>the</strong> Indictment.WHEREFORE, <strong>the</strong> St<strong>at</strong>e believes th<strong>at</strong> a clerical error occurred when <strong>the</strong> bond waswritten on <strong>the</strong> <strong>in</strong>dictment. The St<strong>at</strong>e moves this Honorable Court to correct <strong>the</strong> errorand re<strong>in</strong>st<strong>at</strong>e <strong>the</strong> correct and appropri<strong>at</strong>e bond <strong>of</strong> $100,000/10%. The St<strong>at</strong>erequests this Court to order <strong>the</strong> defendant to surrender herself to <strong>the</strong> Court and post<strong>the</strong> correct bond.
