Name<strong>Date</strong>Page 3 <strong>of</strong> 5<strong>RE</strong>NTAL ABATEMENTPERIOD:USE OF P<strong>RE</strong>MISES:RIGHT OF EXCLUSIVE USE:LANDLORD’S WORK:So long as Tenant is not in default <strong>of</strong> the <strong>Lease</strong>, Tenant shall notbe required to pay Base Rent during months ____________through _________________ <strong>of</strong> the primary <strong>Lease</strong> term. Allother charges due under the <strong>Lease</strong> such as Triple Net Chargesand Rental Tax shall be due as <strong>of</strong> the <strong>Lease</strong> Commencement<strong>Date</strong>.The Premises shall be continuously used, throughout the term <strong>of</strong>the <strong>Lease</strong>, solely <strong>for</strong> the purposes <strong>of</strong>and <strong>for</strong> no other purpose.So long as Tenant is not in default <strong>of</strong> the <strong>Lease</strong>, Landlord shallnot enter into a lease with any other business whose expressedprimary purpose (use) is______________________________________________. Existing tenants, anchortenants and parcels not owned by Landlord are excluded.Landlord shall deliver the Premises with the following worksubstantially completed prior to the <strong>Lease</strong> Commencement <strong>Date</strong>(“Landlord’s Work”):1) walls drywalled, taped, textured but not painted,2) smooth concrete floor,3) 2'x4' grid, lay-in acoustical tile ceiling with fluorescentlighting throughout,4) electrical service and outlets per code,5) one finished handicap accessible bathroom,6) Heating, Ventilation and Air Conditioning (HVAC) withdistribution duct work and vents.CONDITION OF THEP<strong>RE</strong>MISES:TENANT IMPROVEMENTALLOWANCE:Landlord shall deliver and Tenant shall accept the Premises in an“as-is” condition, except that the HVAC shall be in goodworking condition on or about the <strong>Lease</strong> Commencement <strong>Date</strong>.Landlord’s sole obligation with respect to the construction <strong>of</strong> theTenant Improvements shall be to provide Tenant with anallowance <strong>of</strong> $______ per sq. ft. leased to be paid upon thefollowing occurrences i) Tenant’s opening <strong>for</strong> business in thePremises, ii) Tenant’s submittal to Landlord <strong>of</strong> a Certificate <strong>of</strong>Occupancy, and iii) Tenant’s submittal to Landlord <strong>of</strong> completelien waivers. All additional improvements to the Premises shallbe at Tenant’s sole cost and expense.
