<strong>K9</strong> USAGE GUIDELINESIt is a wheeled device to aid those whohave lower leg, ankle or foot injuries ordisabilities.Provides mobility without crutches withlittle more effort than walking.Hands and arms are free for normal use.Can be steered with the knee andbecomes a sort of substitute lower leg.Very manoeuvrable, turns in its ownlength.Scoots 2 or 3 metres at one push.Becomes a footrest when seated.Weighs only 6kg and can be dismantledin 4 pieces for easy packing andtransportation.It is height adjustable to suit individualrequirements and is suitable for personsof 1.42m (4ft8”) upwards.It is load tested up to 180kg (28 stones).It should not be used on stairs orescalators, on slopes or on boats oraircraft. <strong>K9</strong> SALE TERMS & CONDITIONSB to C - Standard terms and conditions for sale of goods ofJohn Reid & Sons (Structsteel) Ltd1 DEFINITIONSIn this document the following words shallhave the following meanings:1.1 “Buyer” means the person who buys Goodsfrom the Seller;1.2 “Consumer” shall have the meaning ascribedin section 12 of the Unfair Contract TermsAct 1977;1.3 “Goods” means the articles that the Buyeragrees to buy from the Seller;1.4 “List Price” means the list of prices of theGoods maintained by the Seller as amendedfrom time to time;1.4 “Seller” means John Reid & Sons(Structsteel) Ltd, Reid Street, Christchurch,Dorset, BH23 2BT, England.1.5 “Terms and Conditions” means the termsand conditions of sale set out in thisdocument and any special terms andconditions agreed in writing by the Seller.2 GENERAL2.1 These Terms and Conditions shall apply to allcontracts for the sale of <strong>K9</strong> <strong>Orthopaedic</strong> <strong>Leg</strong><strong>Trolley</strong> Goods by the Seller to the Buyer andshall prevail over any other documentation orcommunication from the Buyer.2.2 All orders for Goods shall be deemed to bean offer by the Buyer to purchase Goodspursuant to these Terms and Conditions andare subject to acceptance by the Seller. TheSeller may choose not to accept an order forany reason.2.3 Acceptance of delivery of the Goods shall bedeemed conclusive evidence of the Buyer’sacceptance of these Terms and Conditions.2.4 Any variation to these Terms and Conditionsshall be inapplicable unless agreed in writingby the Seller.2.5 Nothing in these Terms and Conditionsshall affect the Buyer’s statutory rights asa Consumer.3 PRICE AND PAYMENT3.1 The price of the Goods shall be thatstipulated in the Seller’s current List Price/on the Seller’s website/as contained in theSeller’s Quotation (as applicable) at thedate of order or as agreed between theparties. The price is EXCLUSIVE of VATand EXCLUSIVE of any delivery chargesunless declared otherwise.3.2 Payment of the total purchase price(including VAT and any delivery charges)must be made in full before dispatch ofthe Goods.4 DELIVERY4.1 Delivery of the Goods shall be made bythe Seller notifying the Buyer that theGoods are available for collection at theSeller’s premises or for delivery to suchplace and on such terms as agreedbetween the Seller and the Buyer at thetime the order is placed.4.2 All Goods, wherever possible, will bedelivered within 30 days of the orderbeing placed and the Buyer shall make allarrangements necessary to take deliveryof the Goods whenever they are tenderedfor delivery.4.3 The Seller shall use its reasonableendeavours to meet any date stated fordelivery. In any event time of deliveryshall not be of the essence and the Sellershall not be liable for any losses, costs,damages or expenses incurred by theBuyer or any third party arising directly orindirectly out of any failure to meet anyestimated delivery date.4.4 Some Goods may not be in stock at thetime the order is placed. In the event thatthe Seller is unable to deliver the Goodswithin the time specified in Clause 4.2, theSeller will contact the Buyer to advise of thesituation and the Buyer shall be entitled tocancel the order and receive a full refund oragree a later delivery date.4.5 Title and risk in the Goods shall pass tothe Buyer upon delivery of the Goods.


5 WARRANTYThe Seller warrants that the Goods willat the time of delivery correspond to thedescription given by the Seller.6 CANCELLATION AND RETURNS6.1 The Buyer shall inspect the Goodsimmediately upon receipt and shall notify theSeller within 7 days of delivery if the Goodsare damaged or do not comply with any ofthe Contract.6.2 The Seller shall not accept any responsibilityfor items which arrive damaged. Where aclaim of defect or damage is made then itshall be the responsibility of the Buyer tosend back faulty Goods. It is at the Sellersdiscretion as to wether the Buyer shall beentitled to replacement Goods or a full refund(including delivery costs, if applicable) plusany return carriage charges if the Goods arein fact defective.6.3 Where returned Goods are found to bedamaged due to the Buyer’s fault the Buyerwill be liable for the cost of remedying suchdamage.6.4 Refunds are only given where an item isnot as described when sold.6.5 All orders online are final and cannotbe cancelled.7 GUARANTEESIn addition to the Buyer’s statutory rights, theSeller guarantees all Goods against faultyworkmanship and materials for a period of30 days from the date of delivery.8 LIMITATION OF LIABILITY8.1 Nothing in these Terms and Conditionsshall exclude or limit the liability ofthe Seller for death or personal injury,however the Seller shall not be liablefor any direct loss or damage sufferedby the Buyer howsoever caused, asa result of any negligence, breach ofcontract or otherwise in excess of theprice of the Goods.8.2 The Seller shall not be liable under anycircumstances to the Buyer or any thirdparty for any indirect or consequentialloss of profit, consequential or othereconomic loss suffered by the Buyerhowsoever caused, as a result ofany negligence, breach of contract,misrepresentation or otherwise.9 FORCE MAJEURENeither party shall be liable for any delayor failure to perform any of its obligationsif the delay or failure results from events orcircumstances outside its reasonable control,including but not limited to acts of God, war,terrorism, strikes, lock outs, accidents, fire,flooding, breakdown of plant or machineryor shortage or unavailability of raw materialsfrom a natural source of supply, and the partyshall be entitled to a reasonable extension ofits obligations.10 SEVERANCEIf any term or provision of these Termsand Conditions is held invalid, illegal orunenforceable for any reason by anycourt of competent jurisdiction suchprovision shall be severed and theremainder of the provisions hereofshall continue in full force and effectas if these Terms and Conditions hadbeen agreed with the invalid, illegal orunenforceable provision eliminated.11 GOVERNING LAWAND JURISDICTIONThese Terms and Conditions shallbe governed by and construed inaccordance with the law of Englandand the parties hereby submit tothe exclusive jurisdiction of theEnglish courts.<strong>K9</strong> ORTHOPAEDICLEG TROLLEY
