Wye Plantation has been farmed without interruptionsince the 17th Century. One of its early owners was WilliamPaca, signer of the Declaration of Independence and firstgovernor of Maryland. Paca, who died in 1799, is buried atWye Plantation. His heirs sold the property to a Centreville,Maryland family whose descendents owned it until 1937when it was purchased by Arthur A. Houghton.Houghton, then chief executive of Steuben Glass,employed James B. Lingle, an experienced cattleman, tomanage Wye Plantation. While they had different businessbackgrounds, these two men had similar beliefs in quality.Houghton was determined to make the finest glass in theworld, and Lingle was determined to create greater beefcattle than the world had ever known-cattle that would begreat in size, fine in quality, and economically profitable.Although Lingle had previously worked primarily withdairy cattle, he admired the production qualities of Angus,particularly the uniformity of the breed. Once Houghtonand Lingle agreed on Angus as the breed of Wye, theybegan selecting stock for the new herd.They started with 18 heifers and a bull calf, purchasedin 1938. The 18 heifers are all the females that Wye Plantationhas ever purchased. Twelve of the cow families theyrepresented are still present in the Wye herd today. Thebull calf, Blakeford Buxton, was a combination of Earl Marshalland Blackcap Revolution breeding.Lingle searched for cattle with larger than usual frames.He knew that the larger, taller animals had a “rangier” chassison which to hang more meat without any sacrifice incarcass quality. His first heifers all proved to be consistentbreeders, good mothers, satisfactory milkers, and wereblessed with longevity. Outstanding among the first 18 Wyeheifers was Capearl #82 who dropped her last calf at theage of 18.Scottish InfluenceAt the time Wye’s herd was beginning, American breederswere raising Angus according to the standards thendictated by the show ring-small, compact, “baby-beef” typeanimals. Lingle wanted large-framed cattle, and he noticedthe great size of Scottish-bred cattle. He particularly likedthe “growthiness” of Scottish bulls.Consequently, in 1941 and 1946 respectively, Wyeadded two Scottish-bred bulls to the herd. These wereJuryman of Wickwire and Puck of Wickwire, both importedto the United States “in dam” from Scotland and born atWickwire Farm in Earleville, Maryland.In 1957, Lingle made a trip to the British Isles in searchof more big-framed bulls to add to the Wye herd. His purchasesincluded bulls from Scotland, Ireland, England, andWales. Among these bulls was Imp. Prince of Malpas fromthe famous Harviestoun herd in Scotland. Prince was a bullof great proportion who sired some of the most femininefemales developed at Wye Plantation during the 1960’s. Healso sired some high performing sons that met with considerabledemand. Other imports included Jai of Framptonfrom Wales, noted for his tremendous muscle expression;Valour of Ardrass; and Geroge Swiftbrook were sons ofPrince Paul of Barnolby from Ireland and both bulls were ofWye Angus - The Early Yearsexceptional height, length, and overall frame. A total of 25bulls were imported from the British Isles by Wye Plantationbetween 1941 and 1959. Since then no outside or “newblood” has been added to the Wye Angus herd.In 1979, Mr. Houghton gifted the University of Marylandwith the Wye Angus herd. The private, nonprofit Universityof Maryland Foundation was created to accept and hold thegift for use by the University, and remains the legal owner ofthe herd today.Within the University System of Maryland, the MarylandAgricultural Experiment Station was charged with managingthe herd on a daily basis and it continues to do so today.With acceptance of the herd gift, the University agreed tomake any animals deemed excess to research needs availablefor the general public in some equitable fashion. Theagreement to the annual public auction of Wye Angus cattleheld each April since 1979.The University of Maryland Wye AngusProgram TodayIt is almost ironic, although not surprising, to considerthat the Wye Angus program today, in the first years of anew millennium, reflects in large measure, the vision of thelate James B. Lingle. In his closing thoughts in his book,some 25 years ago, Mr. Lingle predicted that the WyeAngus program would “…move ahead with research in theidentification of superior-performing animals through blood,milk, and possibly, hormone analysis”.Our program today is a balanced mix of both basic andapplied research, educational outreach through Extension,and education and training of undergraduate and graduatestudents in beef-cattle science and production. Theunderpinnings of our research effort include work towardunderstanding and improving the efficient production ofbeef cattle in an extensive, forage based system whileimplementing and demonstrating the components of profitable,sustainable and environmentally sensitive beef cattleproduction.Over the past 10 years we have diligently and selectivelyreintroduced a number of the foundation sires backinto our breeding program with exciting results. Our focusis two-fold. First, we seek to enhance and solidify keymaternal traits, including udder and teat structure alongwith milk production and mothering ability, while preservingcalving ease. Second, we are targeting specific carcasscharacteristics including muscle depth and thickness andmarbling ability. Careful study of the sire selection, breedingdecisions and animal performance of years past has ledus to conclude that the Wye Angus herd is poised to makea significant contribution toward the efficient and consistentproduction of superior beef carcasses. We are using currenttechnologies such as live animal ultrasound to evaluatecarcass composition and make subsequent breeding andselection decisions. The seller makes the following guarantees with respect to all “pregnant recipients”:(i) that the female is pregnant, (ii) that the resulting calf is of the pedigree represented,and (iii) that the resulting calf is of the sex represented (if so represented).Genetic defect guarantee1. All animals are guaranteed by the seller not to produce a calf with the followingdefects for a period of two years after the date of sale:Dwarfism, Osteopetrosis(marble-bone disease), Double Muscling, Syndactyly (mule foot) and HeterochromiaIrides (white eye).2.The buyer must notify the seller in writing immediately upon the birth of a calfsuspected of being defective or immediately after determination is made that suchcalf is defective.3. The seller at his expense will be permitted, and provided with reasonable opportunity,to obtain DNA material of an alleged defective calf and its sire and dam for thepurpose of DNA-marker analysis to establish parenthood.4. The animals will be returned by the buyer to the seller at the buyer’s expense (unlessprohibited by the health requirements of the seller’s state).5. The return of the purchase price in connection with a defect-producing animal willbe deemed full satisfaction and settlement.6. The buyer and seller agree to fully and promptly comply with all rules of theAmerican Angus Association relating to genetic defects.7. If there is a dispute as to whether or not a calf is defective, the American AngusAssociation will make the final determination.8. Unless otherwise agreed by the buyer and the seller, with respect to the sale ofsemen the seller makes no guarantees with respect to the performance or characteristicsof such semen and the buyer is purchasing such semen “as is.”EmbryosUnless otherwise agreed by the buyer and the seller, with respect to the sale of embryosthe seller makes no guarantees with respect to the performance or characteristicsof such embryos and the buyer is purchasing such embryos “as is.”Options and privileges of return or adjustment1. Except as provided in paragraphs 2 and 3 of this section, all claims for adjustmentor refund must be made in writing on or before the later of (i) six months after thesale date and (ii) the date on which the animal reaches 30 months of age.2. All claims relating to genetic defects will be handled in accordance with the section“Genetic defect guarantee.”3. All claims relating to the misrepresentation of service sire and all claims relatingto paragraphs 10 and 11 of this section must be made in writing on or before thesecond anniversary of the date of sale.4. If an animal is claimed to be a non-breeder, the animal may be returned to theseller if in good condition and complying with the health requirements of the seller’sstate. The seller is entitled to six months trial following the return of the animal inwhich to prove that the animal is a breeder. If at the end of the six-month period theseller is unable to prove the animal is a breeder, the seller must, at the option of thebuyer, replace the animal with another of equal value or refund the purchase price.The return of the full purchase price will be deemed full satisfaction and settlement.Any expense incurred for transporting an animal claimed to be a non-breeder willbe the responsibility of the buyer, except that the seller will be responsible for transportationcosts in excess of the distance between the buyer’s farm and the locationwhere the sale took place. If the seller proves the animal to be a breeder, it will bethe obligation of the buyer to take delivery of the animal and pay all transportationexpenses.5. If a female sold as “safe in calf ” proves not to be in calf, the buyer may receiveservice from the bull previously used, if available. If the bull is not available, theseller must make a satisfactory adjustment on the purchase price to the buyer or, atthe buyer’s option, refund the purchase price upon return of the animal to the farmof the seller. Any adjustment provided for in this paragraph 6 will absolve the sellerfrom further liability, except in if such female proves to be a non-breeder. If a femalerepresented as “safe in calf ” to a certain bull at the time of sale proves to havebeen bred to a different bull, the seller must make a satisfactory adjustment on thepurchase price to the buyer or, at the buyer’s option, refund the purchase price uponreturn of the animal to the farm of the seller (adjustments will not be considered tobe a breeding fee or an allocation of the purchase price to any unborn calf ).6. If a female sold as “open” proves to be with calf, the buyer may return the animalto the farm of the seller prior to calving for a refund of the full purchase price or foranother animal of equal value, whichever is acceptable to the buyer. The Seller isresponsible for all transportation expenses.7. Cows with calves at their side are presumed to be breeders with no further fertilityguarantee.8.White skin or hair must not be painted or altered. If such painting or alteration hasoccurred, the buyer may return the animal to the farm of the seller for a refund of thefull purchase price or for another animal of equal value, whichever is acceptable tothe buyer.9. If an animal (including the offspring of a pregnant recipient) is sold and at a laterdate proves not to have been eligible for registration under the rules of the AmericanAngus Association, the seller must make a satisfactory adjustment on the purchaseprice to the buyer, or at the option of the buyer, refund the purchase price upon thereturn of the animal to the farm of the seller.10. If (i) an animal is sold (including the offspring of a pregnant recipient) andthrough DNA-marker-typing is proven to have incorrect parentage, as representedby the certificate of registration, and for which parentage can be determined, or (ii)the resulting calf of a pregnant recipient is not of the sex represented, the seller isobligated to make a satisfactory adjustment on the purchase price to the buyer or,at the buyer’s option, refund the purchase price upon the return of the animal to thefarm of the seller.11. Except as provided in paragraphs 4 and 6 of this section, all transportationexpenses incurred will be the responsibility of the buyer, except that the seller will beresponsible for transportation costs in excess of the distance between the buyer’sfarm and the location where the sale took place.Retention of genetic material1. Unless otherwise agreed in writing by the seller and the buyer, the seller will notretain any genetic material of any animal (including embryos and semen) for thepurpose of cloning.Miscellaneous1.The above terms and conditions of sale constitute a contract between the buyerand the seller of each animal and are equally binding upon both parties. Each saleor resale of an animal constitutes a separate transaction.2.Neither the sponsor or sponsors, the sale manager, nor any other person connectedwith the management of the sale, assumes any liability, legal or otherwise.3. These sale terms and conditions and all rights, obligations and duties arisinghereunder and all disputes arising hereunder will be construed in accordance with,and governed by, the laws of the state in which the sale of the animal or animalsoccurs, without giving effect to such state’s choice of law rules.ONE-THIRD SEMEN INTERESTWye Angus is retaining one-third semen interest in several bulls with no possession.Wye Angus may, at the buyer’s convenience, collect semen from the said bullfor within herd or commercial use. The buyer receives two-third interest full possessionof said bull and is in no way limited in activities with the bull or his semen. Eitherparty may promote and merchandise semen from said bull. Either party may sell theirinterest in said bull at any time and is only required to notify the other owner that thetransaction has occurred.Wye Angus retains a semen interest in several bulls from each calf crop for use infuture breedings at Wye. We offer the semen publicly through semen sales to comparethe Wye genetics to the general Angus population in a wide variety of environmentsand management styles. It is not the intention of Wye Angus to compete with the newowner of the bull in semen sales. Wye Angus is willing to consider separate agreementsregarding the promotion and merchandising of semen from said bull.
