You may file th<strong>is</strong> petition <strong>for</strong> yourself if you have establ<strong>is</strong>hed a newcommercial enterpr<strong>is</strong>e• in which you will engage in a m<strong>an</strong>agerial or policy-making capacity, <strong>an</strong>d• in which you have invested or are actively in the process <strong>of</strong> investing the amountrequired <strong>for</strong> the area in which the enterpr<strong>is</strong>e <strong>is</strong> located, <strong>an</strong>d• which will benefit the U.S. economy, <strong>an</strong>d• which will create full-time employment in the U.S. <strong>for</strong> at least 10 U.S. citizens,perm<strong>an</strong>ent residents, or other immigr<strong>an</strong>ts authorized <strong>to</strong> be employed, other th<strong>an</strong>yourself, your spo<strong>use</strong>, your sons or daughters, or <strong>an</strong>y nonimmigr<strong>an</strong>t aliens.The establ<strong>is</strong>hment <strong>of</strong> a new commercial enterpr<strong>is</strong>e may include:• creation <strong>of</strong> a new business;• the purchase <strong>of</strong> <strong>an</strong> ex<strong>is</strong>ting business with simult<strong>an</strong>eous or subsequentrestructuring or reorg<strong>an</strong>ization resulting in a new commercial enterpr<strong>is</strong>e; or• the exp<strong>an</strong>sion <strong>of</strong> <strong>an</strong> ex<strong>is</strong>ting business through investment <strong>of</strong> the amountrequired, so that a subst<strong>an</strong>tial ch<strong>an</strong>ge (at least 40%) in either the net worth,number <strong>of</strong> employees, or both, results.The amount <strong>of</strong> investment required in a particular area <strong>is</strong> set <strong>by</strong> regulation.Unless adjusted downward <strong>for</strong> targeted areas or upward <strong>for</strong> areas <strong>of</strong> highemployment, the figure shall be $1,000,000. You may obtain th<strong>is</strong> in<strong><strong>for</strong>m</strong>ationfrom <strong>an</strong> INS <strong>of</strong>fice or Americ<strong>an</strong> consulate.General Filing Instructions.Please <strong>an</strong>swer all questions <strong>by</strong> typing or clearly printing in black ink. Indicate that<strong>an</strong> item <strong>is</strong> not applicable with "N/A". If <strong>an</strong> <strong>an</strong>swer <strong>to</strong> a question <strong>is</strong> "none," pleaseso state. Your petitionmust be properly signed <strong>an</strong>d filed with the correct fee.Initial Evidence Requirements.The following evidence must be filed with your petition:• Evidence that you have establ<strong>is</strong>hed a lawful business entity under the laws <strong>of</strong>the jur<strong>is</strong>diction in the U.S. in which it <strong>is</strong> located, or, if you have made <strong>an</strong>


investment in <strong>an</strong> ex<strong>is</strong>ting business, evidence that your investment has ca<strong>use</strong>d asubst<strong>an</strong>tial (at least 40%) increase in the net worth <strong>of</strong> the business, the number<strong>of</strong> employees, or both.Such evidence shall cons<strong>is</strong>t <strong>of</strong> copies <strong>of</strong> articles <strong>of</strong> incorporation, certificate <strong>of</strong>merger or consolidation, partnership agreement, certificate <strong>of</strong> limited partnership,joint venture agreement, business trust agreement, or other similar org<strong>an</strong>izationaldocument; a certificate evidencing authority <strong>to</strong> do business in a state ormunicipality or if such <strong>is</strong> not required, a statement <strong>to</strong> that effect; or evidence thatthe required amount <strong>of</strong> capital has been tr<strong>an</strong>sferred <strong>to</strong> <strong>an</strong> ex<strong>is</strong>ting businessresulting in a subst<strong>an</strong>tial increase in the net worth or number <strong>of</strong> employees, orboth. <strong>Th<strong>is</strong></strong> evidence must be in the <strong><strong>for</strong>m</strong> <strong>of</strong> s<strong>to</strong>ck purchase agreements,investment agreements. Certified fin<strong>an</strong>cial reports, payroll records or othersimilar instruments, agreements or documents evidencing the investment <strong>an</strong>d theresulting subst<strong>an</strong>tial ch<strong>an</strong>ge.• Evidence, if applicable, that your enterpr<strong>is</strong>e has been establ<strong>is</strong>hed in a targetedemployment area. A targeted employment area <strong>is</strong> defined as a rural area or <strong>an</strong>area which has experienced high unemployment <strong>of</strong> at least 150% <strong>of</strong> the nationalaverage rate. A rural area <strong>is</strong> <strong>an</strong> area not within a metropolit<strong>an</strong> stat<strong>is</strong>tical area ornot within the outer boundary <strong>of</strong> <strong>an</strong>y city or <strong>to</strong>wn having a population <strong>of</strong> 20,000 ormore.• Evidence that you have invested or are actively in the process <strong>of</strong> investing theamount required <strong>for</strong> the area in which the business <strong>is</strong> located. Such evidencemay include, but not be limited <strong>to</strong> copies <strong>of</strong> b<strong>an</strong>k statements, evidence <strong>of</strong> assetswhich have been purchased <strong>for</strong> <strong>use</strong> in the enterpr<strong>is</strong>e, evidence <strong>of</strong> propertytr<strong>an</strong>sferred from abroad <strong>for</strong> <strong>use</strong> in the enterpr<strong>is</strong>e, evidence <strong>of</strong> monies tr<strong>an</strong>sferredor committed <strong>to</strong> be tr<strong>an</strong>sferred <strong>to</strong> the new commercial enterpr<strong>is</strong>e in exch<strong>an</strong>ge <strong>for</strong>shares <strong>of</strong> s<strong>to</strong>ck, <strong>an</strong>y lo<strong>an</strong> or mortgage, prom<strong>is</strong>sory note, security agreement, orother evidence <strong>of</strong> borrowing which <strong>is</strong> secured <strong>by</strong> assets <strong>of</strong> the petitioner.• Evidence that capital <strong>is</strong> obtained through lawful me<strong>an</strong>s, the petition must beaccomp<strong>an</strong>ied, as applicable, <strong>by</strong>: Foreign business reg<strong>is</strong>tration records, taxreturns <strong>of</strong> <strong>an</strong>y kind filed within the last five years in or outside the United States,evidence <strong>of</strong> other sources <strong>of</strong> capital, or certified copies <strong>of</strong> <strong>an</strong>y judgment, pendinggovernmental civil or criminal actions, or private civil actions against thepetitioner from <strong>an</strong>y court in or outside the United States within the past fifteenyears.• Evidence that the enterpr<strong>is</strong>e will create at least 10 full-time positions <strong>for</strong> U.S.citizens, perm<strong>an</strong>ent residents, or aliens lawfully authorized <strong>to</strong> be employed(except) yourself, your spo<strong>use</strong>, sons, or daughters, <strong>an</strong>d <strong>an</strong>y nonimmigr<strong>an</strong>taliens).
