CHAIRPERSON’S REPORT TO PARLIAMENT
FOR THE 2004/05
1. introduction
2004/05 was arguably the most significant year
for the Board since its inception. The advent of
the Health Practitioner Competence Assurance
Act (2003) (HPCA) in September significantly
changed the rationale, administration and
direction of the Board and its implementation will
take a number of years to complete. This report
outlines the work of the Board in implementing
the Act, and summarises other significant Board
activities related to education and examinations,
professional discipline, relationship development,
Trans-Tasman Mutual Recognition (TTMRA) and
financial administration.
2. health practitioner
competence assurance act
The provisions of the HPCA took effect on 18
September 2004. I am comfortable with the
progress the Board has made in establishing
its administration under the new legislative
environment, however, the Board recognises
that much work has yet to be done, in fully
implementing the professional discipline and
continuing competence opportunities available
under the Act.
If the Board had a single concern regarding the
legislation it would be the time still required
to address disciplinary issues. While the Act
provides a wider range of options for the Board
to address concerns about the professionalism of
chiropractors, the process is still protracted and,
at times, leaves Board members uneasy that these
issues cannot be addressed more expeditiously.
Furthermore, it is, in the opinion of the Board, an
unwieldy situation when a chiropractor has been
convicted of a criminal offence, there is still the
need to have a protracted and expensive process
to deal with the situation.
However, I have been satisfied with how the
Board has successfully addressed the issues
presented by the new legislation over the last
year, and I am confident it has the capacity to
meet new challenges as they arise.
3. competence examinations
Over the last year the Board has been giving
formal consideration to aligning the examination
system of Australia with our own. The proposal
arises from the Board’s work in promoting
a single Australasian set of examination
protocols which limit the ability of some
foreign, or foreign-educated, chiropractors to
use the provisions of the Trans-Tasman Mutual
Recognition Act to ‘shop and hop’.
The Board has been successful in encouraging
its Australian colleagues to establish common
standards which non-Australasian chiropractors,
and those educated outside Australasia,
must meet before registration is granted.
The logical development of this approach
is the establishment of a single Australasian
competence examination.
In promoting this development the Board
is conscious that its governing legislation
is different in substance to that regulating
Australian jurisdictions, and that New Zealand
has a cultural competence component to its
administration which is absent from Australian
states and territories.
This matter, which has the unanimous support
of the Australian Chiropractic Boards, will
require further detailed consideration in the
coming year.

4. competence reviews
The introduction of the HPCA gave the Board
a new tool for the support and discipline
of members of the profession. The option
to undertake a competence review of a
chiropractor’s professional practice gives the
Board the option of a collegial, supportive
approach to professionals who it is believed
may be practicing in contradiction of the
Board’s Code of Ethics and Standards of
Practice document.
At the time of preparing this report only a small
number of competence reviews have been
undertaken and my initial impression is that
they have the potential to allow the Board to
assist chiropractors to meet their professional
obligations. However the cost of implementing
reviews is substantial and with this additional
cost in mind the Board has increased its financial
provision for dealing with reviews from $10,000
to $50,000 for the coming year.
In making this provision the Board has asked that
the Minister’s attention be drawn to the extent
of these costs and note that at some stage in the
future there may be a need to increase the cost
of an annual practising certificate to support this
expenditure.
5. formal contact with acc
One of the major steps forward for the Board
this year has been to establish regular formal
meetings with ACC. The Board is conscious
that an ongoing dialogue with ACC is of
considerable value to the profession and the
public and these have now been put in place
at two levels:
a. Formal six monthly meetings between
representatives of the Board and senior ACC
officials; and
b. Regular meetings between the Board
Registrar and ACC officials working on a
day-to-day basis with chiropractic affairs.
The Board looks forward to the development of
this relationship in the interests of the profession
and the public, and notes that the relationship has
already provided some very positive results.
6. new zealand college of
chiropractic
I noted in my 2003/04 report that I was extremely
pleased with the development of the relationship
between the College and the Board over the
previous year. I also noted the difficulties that
had been experienced in the past, and expressed
the hope that there would be significant progress
in future. That hope has been realised and in
my view the growth in confidence in both sides
means that the profession will be well served
in future with a respectful and professional
relationship between the two institutions. The
Board notes that the College received a two-year
accreditation from the Council for Chiropractic
Education Australasia.
7. waiting list practice
In July 2004 the Board approved the Chairman
issuing a letter to all chiropractors advising
that the Board and the Health and Disability
Commissioner’s office continues to receive
complaints from members of the public, and
some chiropractors, concerning members of
this organisation or practitioners employing
similar practice strategies such as forward billing
techniques.
The Board has no objection to chiropractors
using the Waiting List Practice organisation’s
methods provided all transactions with the public
and the profession are ethical and in compliance
with statutes and regulations, and the Board’s
recently revised Code of Ethics and Standards
of Practice.
8. changes to the board’s
code of practice
Significant changes to the Board’s Code of
Ethics and Standards of Practice have been
made over the last year. The document
is available on the Board’s website
www.chiropracticboard.org.nz.

9. extra vertebral treatment
During the year the Board approved regulating a
list of practitioners who are qualified to receive
payment from ACC for extra-vertebral (EVT) work.
ACC have decided that those chiropractors who
received appropriate EVT under-graduate training
or have completed, to a similar standard, postgraduate
courses in EVT, will be able to diagnose
and treat this category of patient. The Board, in
association with the Chiropractors Association,
conducted a very exhaustive appraisal of all
chiropractic educational institutions and their
graduates. The result is an ‘A’ list of those
qualified for ACC reimbursement and a ‘B’ list of
those who are not. This does not affect the way
chiropractors currently work, the only difference
is that practitioners on the ‘A’ list may be paid by
ACC for EVT diagnosed problems.
10. annual practicing certificates
In the 2004/05 year the Chiropractic Board issued
302 Annual Practicing Certificates.
11. board finances
I have been very happy with the Board’s finances
this year. Not only has the Board achieved its
goal of establishing a fund from which continuing
competence programmes for members of the
profession can be supported, it has also been
able to implement the requirements of the HPCA
without increasing the cost of annual practicing
certificates to chiropractors.
Continuing professional development programmes
are encouraged under the provisions of the new
legislation and the early decision to establish a
funding base for this purpose was one which
the Board took in early 2003. This fund is now
available to support competence programmes
and the Board has already made a number of
grants.
The Board has adopted the view that reserve
funds need to be maintained at a level which
equates to one year of base operations. It is likely
that these reserves will be used in situations
where unusually high demand is placed on the
Board, in particular when faced with the expense
of disciplinary hearings. However, with the
budget under tight control I see no reason why
the cost of an annual practicing certificate will
need to rise in the near future. It is noteworthy
that the budget has had to be amended to reflect
the increased costs of competence reviews and
Professional Conduct Committees and this is
likely to result in a levy being applied to APC
holders to fund this increase.
12. late payment for apcs
For a number of years the Board has been
concerned at the habit of some chiropractors of
leaving payment for their APC until a date later
(sometimes considerably later) than 31 March of
each year. This has meant that the chiropractor
concerned is likely to be practicing illegally and,
certainly is not permitted to access ACC funding.
In an attempt to eliminate this practice the Board
has gazetted an additional fee of $100 for APC
payments received after 31 March each year. This
insures that ACC, the Chiropractor’s Association
and other interested parties are informed of the
status of individual chiropractors with regard to
their APC. This year has been the first full year
of this policy and I am pleased at the drop in the
number of chiropractors who are paying for their
APCs after 31 March.
Registered Chiropractors have been and will
continue to be reminded in future newsletters
of their obligations to pay for their APC by 31
March each year.
13. trans-tasman mutual
recognition agreement
In the past the Board has drawn to the attention
of the Minister of Health to the fact that a number
of chiropractors who have not been required
to demonstrate their professional competence
before being registered to practice in New
Zealand. This situation has now been largely
overcome by the establishment of a policy, in
conjunction with Australasian jurisdictions, of
examining all applicants for registration from
outside Australasia. Early indications are that

the policy is working well and the number of applications
for registration in New Zealand, which have clearly used a
‘soft’ Australian jurisdiction as a means of accessing New
Zealand registration, has dropped considerably.
The Board also notes that it has received clear advice from
the Minister that it is able to examine the competence of any
applicants for registration, including those applying under
the provisions of the TTMRA, and it is currently considering
appropriate protocols for this task.

14. board website
The Board’s website continues to be an important platform
for providing information on registration, and can be viewed
on www.chiropracticboard.org.nz.
In the coming year the Board will assess the need for further
modifications to the site with the intentions of introducing
innovations in layout and usability should these be felt
necessary in the light of the last three years experience.

15. mail contact with chiropractors
One of the problems the Board experiences every year
is the fact that some chiropractors change their mailing
address but fail to advise the Board, as they are obliged
to do under the provisions of the HPCA. This has led to
some individuals practicing without an annual practicing
certificate, thereby endangering ACC payments and
exposing themselves to the possibility of prosecution for
practicing improperly.
The Board encourages changes of address to be
notified by fax to (04) 472 2350, or be emailed to
chiropractic@regboards.co.nz.
16. conclusion
The last year has been a particularly challenging one
and I would like to thank all members of the Board, and
in particular the lay members, for their work on behalf
of the profession and their support to me in my role as
Chairman.

AUDIT REPORT TO THE MEMBERS OF THE
CHIROPRACTIC BOARD
We have audited the Financial Statements consisting of the Statement of Financial Performance, Statement of Movements in Equity,
Statement of Financial Position, and Notes to the Financial Statements. The Financial Statements provide information about the past
performance of the Chiropractic Board and its financial position as at 31 March 2005. This information is stated in accordance with
the accounting policies set out in the Notes to the Financial Statements.
Board’s Responsibilities
The Board is responsible for the preparation of Financial Statements, which gives a true and fair view of the financial position of the
Chiropractic Board as at 31 March 2005 and of the results of operations for the year ended 31 March 2005.
Auditor’s Responsibilities
It is our responsibility to express an independent opinion on the Financial Statements presented by the Board and report our opinion
to you.
Basis of Opinion
An audit includes examining, on a test basis, evidence relevant to the amounts and disclosures in the Financial Statements. It also
includes assessing:
• The significant estimates and judgements made by the Board in the preparation of the Financial Statements; and
• Whether the accounting policies are appropriate to the Chiropractic Board’s circumstances, consistently applied and
adequately disclosed.
We conducted our audit in accordance with generally accepted auditing standards in New Zealand. We planned and performed
our audit so as to obtain all the information and explanations which we considered necessary in order to provide us with sufficient
evidence to give reasonable assurance that the Financial Statements are free from material misstatements, whether caused by fraud
or error. In forming our opinion we also evaluated the overall adequacy of the presentation of the information in the Financial
Statements.
Other than in our capacity as Auditors, we have no relationship with or interest in the Chiropractic Board.
Unqualified Opinion
We have obtained all the information and explanations that we have required.
In our opinion:
• Proper accounting records have been kept by the Board as far as appears from our examination of those records; and
• The Financial Statements:
– comply with generally accepted accounting practice; and
– give a true and fair view of the financial position of the Chiropractic Board as at 31 March 2005 and the results of
its operations for the year ended on that date.

1. statement of accounting
policies
REPORTING ENTITY
The Board is constituted under the Health
Practitioners Competence Assurance Act 2003.
These Financial Statements have been prepared
in accordance with the Financial Reporting Act
1993.
The Board qualifies for differential reporting as
it is not publicly accountable and is not large.
The Board has taken advantage of all applicable
differential reporting exemptions.
GENERAL ACCOUNTING POLICIES
The Measurement base adopted is that of
historical cost. Reliance is placed on the fact
that the business is a going concern.
Accrual accounting is used to match expenses
and revenues.
CHANGES IN ACCOUNTING POLICIES
All accounting policies are unchanged and have
been consistently applied.
SPECIFIC ACCOUNTING POLICIES
Annual Practising Certificate Income
Annual Practising Certificate Income is recorded
only upon receipt. No Accounts Receivable are
recognised and receipts for Annual Practising
Certificates issued for future years are shown as
Income Received in Advance.
Goods and Services Tax
The Financial Statements have been prepared
on a tax exclusive basis with the exception of
Accounts Receivable and Accounts Payable
which include GST.
Investments
Investments are recognised at cost. Investment
income is recognised on an accruals basis where
appropriate.
Income Tax
The Board has been granted Charitable Status
by the Inland Revenue Department. Therefore,
under exemption CB4(1)(c) of the Income Tax Act
1994 the Board is exempt from Income Tax.
Tangible Assets
Tangible Assets are shown at original cost less
accumulated depreciation. Depreciation has
been calculated over the expected useful life of
the Assets.
Office Equipment
36.0% of cost price
2. contingent liabilities and
commitments
A contractual liability of $109,683 (2004:
$194,992) exists to the Registration Boards
Secretariat Limited regarding service charges for
the next one year.

parties during the year, other than those
already disclosed elsewhere in these Financial
Statements.
