<strong>Planning</strong> Permit Application TP-2014-1041<br />

Purpose and background<br />

1. The purpose of this report is <strong>to</strong>:<br />

1.1. Advise <strong>the</strong> <strong>Future</strong> <strong>Melbourne</strong> <strong>Committee</strong> of a <strong>Planning</strong> Application, TP-2014-1041 for <strong>the</strong> components<br />

of <strong>the</strong> proposed works that require a planning permit being road works under <strong>the</strong> Land Subject <strong>to</strong><br />

Flood Inundation Overlay, <strong>to</strong> display advertising signs in a Public Use Zone (PUZ4 – Transport), and<br />

<strong>to</strong> remove native vegetation under Clause 52.17 of <strong>the</strong> <strong>Melbourne</strong> <strong>Planning</strong> Scheme.<br />

1.2. Seek approval for management <strong>to</strong> approve <strong>the</strong> works associated with <strong>the</strong> construction of a central<br />

island platform at Tram S<strong>to</strong>p 125 in Whiteman Street for Route 96 and 109 tram services and <strong>to</strong><br />

approve a separate adjacent platform on a third track for <strong>the</strong> Colonial Tram Car Restaurant.<br />

2. This report was requested by Cr Leppert. The matter was originally considered at <strong>the</strong> <strong>Future</strong> <strong>Melbourne</strong><br />

<strong>Committee</strong> meeting held on 7 July 2015 where it was resolved;<br />

2.1. That <strong>the</strong> <strong>Future</strong> <strong>Melbourne</strong> <strong>Committee</strong> defers this item <strong>to</strong> <strong>the</strong> August <strong>Future</strong> <strong>Melbourne</strong> <strong>Committee</strong><br />

meeting in order <strong>to</strong> canvass alternative design options which are <strong>to</strong> be presented at Councillor Forum<br />

prior <strong>to</strong> that meeting.<br />

3. Alternative design options have been presented at Councillor Forum and <strong>the</strong> plans accompanying <strong>the</strong><br />

planning application have since been amended. The proposal still includes <strong>the</strong> construction of a third track<br />

turnout from Clarendon Street and <strong>the</strong> removal of <strong>the</strong> existing tram s<strong>to</strong>p safety zones in Clarendon Street,<br />

located ei<strong>the</strong>r side of Normanby Road, which service Routes 12, 96 and 109. The proposal now includes <strong>the</strong><br />

creation of a wider reserve <strong>to</strong> incorporate additional tree planting by <strong>the</strong> removal of 25 car parking spaces on<br />

Whiteman Street. The overall works will still necessitate <strong>the</strong> removal of 19 Eucalyptus camaldelensis (River<br />

Red Gum trees) and a fur<strong>the</strong>r four trees are impacted by <strong>the</strong> works in <strong>the</strong> Normanby Road Reserve. (see<br />

Concept Plans - Attachment 3).<br />

4. The widening of <strong>the</strong> reserve on Whiteman Street will also result in <strong>the</strong> loss of <strong>the</strong> existing footpath. Cyclists<br />

and pedestrians travelling along <strong>the</strong> Whiteman Street shared path will be re-directed <strong>to</strong> cross <strong>the</strong> tram<br />

reserve at <strong>the</strong> west end of <strong>the</strong> new tram platform <strong>to</strong> connect <strong>to</strong> <strong>the</strong> existing shared path located on <strong>the</strong> south<br />

side of Normanby Road.<br />

Key issues<br />

5. The construction date is yet <strong>to</strong> be scheduled and is subject <strong>to</strong> <strong>the</strong> Council issuing a <strong>Planning</strong> Permit for <strong>the</strong><br />

works. Yarra Trams is responsible for all community consultation related <strong>to</strong> <strong>the</strong> proposed works. One<br />

objection <strong>to</strong> <strong>the</strong> planning application has been received.<br />

6. Traffic capacity will be maintained in Clarendon Street, Whiteman Street and Normanby Road. The existing<br />

s<strong>to</strong>ck of on-street parking in Whiteman Street will be removed under this application and footpaths redirected<br />

within <strong>the</strong> widened road reserve. The proposed tram works will not adversely impact on <strong>the</strong> existing off-road<br />

shared pedestrian / bike paths on Normanby Road. Improvements <strong>to</strong> <strong>the</strong> existing pedestrian / bike crossings<br />

of <strong>the</strong> tram reserve are included in <strong>the</strong> scope of works for this tram project.<br />

7. The key issues for consideration of <strong>the</strong> planning application are addressed by conditions of permit requiring<br />

a landscape plan, offsets from <strong>the</strong> removal of native vegetation, a reduction of <strong>the</strong> number of advertising<br />

signs and conditions required by <strong>Melbourne</strong> Water. The design has been reviewed by officers from<br />

Engineering Services and Urban Landscapes (Tree Planting and Urban Design) and is supported.<br />

Recommendation from management<br />

8. That <strong>the</strong> <strong>Future</strong> <strong>Melbourne</strong> <strong>Committee</strong>:<br />

8.1. Resolves <strong>to</strong> issue a Notice of Decision <strong>to</strong> Grant a Permit, subject <strong>to</strong> <strong>the</strong> conditions listed in <strong>the</strong><br />

attached delegate report (see Attachment 4).<br />

8.2. Notes that, if a planning permit is issued, <strong>the</strong> Manager Engineering Services will approve, under<br />

delegation, <strong>the</strong> proposed tram works that relate <strong>to</strong> Council’s road management responsibilities.<br />

Legal<br />

1. The exemptions under Clause 52.17 of <strong>the</strong> <strong>Melbourne</strong> <strong>Planning</strong> Scheme for <strong>the</strong> removal of native<br />

vegetation does not apply so <strong>the</strong> removal requires a planning permit.<br />

Finance<br />

2. There is no cost <strong>to</strong> Council associated with <strong>the</strong> construction of <strong>the</strong> tram platform project.<br />

3. The project results in a change of on-street parking spaces and subsequently change in parking meter<br />

revenue.<br />

4. Tree <strong>Planning</strong> has recommended a condition of planning permit requiring a bank guarantee <strong>to</strong> be provide<br />

<strong>to</strong> <strong>the</strong> Council. The guarantee is <strong>to</strong> be of an equivalent environmental and amenity value of all Council<br />

trees impacted by <strong>the</strong> works.<br />

Conflict of interest<br />

5. No member of Council staff, or o<strong>the</strong>r person engaged under a contract, involved in advising on or<br />

preparing this report has declared a direct or indirect interest in relation <strong>to</strong> <strong>the</strong> matter of <strong>the</strong> report.<br />

Stakeholder consultation<br />

6. Yarra Trams has undertaken significant public consultation in regards <strong>to</strong> <strong>the</strong> tram works project.<br />

7. Yarra Trams will also be responsible for undertaking all public consultation regarding <strong>the</strong> removal and<br />

replanting of vegetation required by <strong>the</strong> tram works.<br />

8. Notification of <strong>the</strong> planning application was given, as detailed <strong>the</strong> attached delegate report (see<br />

Attachment 4).<br />

Relation <strong>to</strong> Council policy<br />

9. The proposed construction of <strong>the</strong> tram platform s<strong>to</strong>p is in line with Section 7 of Council’s Transport<br />

Strategy 2012 which states that “Tram operations in <strong>the</strong> City of <strong>Melbourne</strong> will be improved <strong>to</strong> offer a<br />

more frequent and reliable service. Tram s<strong>to</strong>ps will be better integrated in<strong>to</strong> <strong>the</strong> public realm <strong>to</strong> improve<br />

access, safety and amenity, with 90 per cent of s<strong>to</strong>ps upgraded <strong>to</strong> ‘level access’ by 2016”.<br />

10. Relevant planning policies are discussed in <strong>the</strong> delegate report (see Attachment 4).<br />

Environmental sustainability<br />

11. A condition of permit can require <strong>the</strong> loss of native vegetation <strong>to</strong> be offset. The proposal as a whole is<br />

considered <strong>to</strong> have a net community benefit.<br />

Port Junction Tram Works<br />

Summary of Net Travel Time Savings for Tram Passengers<br />

Increased Walking Time<br />

(associated with passengers currently boarding / alighting at <strong>the</strong> tram safety zone s<strong>to</strong>ps<br />

which are being removed from Clarendon Street, ei<strong>the</strong>r side of Normanby Road)<br />

Route 12:<br />

• Approximately 530 passengers per day currently board and alight Route 12 tram<br />

services (travelling along Clarendon Street) at <strong>the</strong> existing tram safety zone s<strong>to</strong>ps<br />

located ei<strong>the</strong>r side of Normanby Road.<br />

• These passengers will be required <strong>to</strong> walk up <strong>to</strong> 225 metres fur<strong>the</strong>r <strong>to</strong> access<br />

existing tram s<strong>to</strong>ps located at ei<strong>the</strong>r City Road or outside <strong>the</strong> Exhibition Centre.<br />

• Assuming an average walking speed of 1.2 metres per second, this is equivalent <strong>to</strong><br />

approximately 27.6 additional walking hours per day for <strong>the</strong>se passengers.<br />

Route 96 and 109:<br />

• Approximately 760 passengers per day currently board and alight outbound Route<br />

96 and 109 tram services at <strong>the</strong> existing tram safety zone s<strong>to</strong>p located in Clarendon<br />

Street immediately north of Normanby Road.<br />

• These passengers will be required <strong>to</strong> walk 70 metres fur<strong>the</strong>r <strong>to</strong> access <strong>the</strong> new Port<br />

Junction tram platform located on <strong>the</strong> north side of Whiteman Street immediately<br />

west of Clarendon Street.<br />

• Assuming an average walking speed of 1.2 metres per second, this is equivalent <strong>to</strong><br />

approximately 12.3 additional walking hours per day for <strong>the</strong>se passengers.<br />

In summary, <strong>the</strong> additional walking time associated with all tram passengers currently<br />

boarding and alighting at <strong>the</strong> tram safety zones s<strong>to</strong>ps being removed from Clarendon Street,<br />

ei<strong>the</strong>r side of Normanby Road, is estimated at approximately 40 additional walking hours<br />

per day.<br />

Reduced Travel Times for Tram Passengers<br />

(associated with passengers on trams not experience delays by s<strong>to</strong>pping at <strong>the</strong> existing<br />

safety zones ei<strong>the</strong>r side of Normanby Road. This also enables tram traffic signal priority <strong>to</strong><br />

be implemented at this intersection)<br />

Route 12:<br />

• Approximately 7,300 passengers per day currently travel in both directions on<br />

Route 12 tram services along Clarendon Street through <strong>the</strong> intersection of Normanby<br />

Road / Whiteman Street.<br />

• Yarra Trams estimates that <strong>the</strong>se passengers will be experience an average travel<br />

time improvement of 50 second per tram service. This is specifically related <strong>to</strong><br />

eliminating <strong>the</strong> need for trams <strong>to</strong> s<strong>to</strong>p <strong>to</strong> load and unload passengers at <strong>the</strong> existing<br />

tram safety zone s<strong>to</strong>ps ei<strong>the</strong>r side of Normanby Road and <strong>the</strong> subsequent proposed<br />

implementation of tram traffic signal priority <strong>to</strong> reduce delays.

• This is equivalent <strong>to</strong> an improvement of approximately 101 <strong>to</strong>tal travel time hours<br />

per day for <strong>the</strong>se passengers.<br />

Route 96 and 109:<br />

• Approximately 10,600 passengers per day currently outbound on Route 96 and 109<br />

tram services which turn right from Clarendon Street <strong>to</strong>wards <strong>the</strong> Port Junction tram<br />

s<strong>to</strong>p and through <strong>the</strong> intersection of Normanby Road.<br />

• Yarra Trams estimates that <strong>the</strong>se outbound passengers will be experience an<br />

average travel time improvement of 40 second per tram service. This is specifically<br />

related <strong>to</strong> eliminating <strong>the</strong> need for trams <strong>to</strong> s<strong>to</strong>p <strong>to</strong> load and unload passengers at <strong>the</strong><br />

existing tram safety zone s<strong>to</strong>p located immediately north of Normanby Road and <strong>the</strong><br />

subsequent proposed implementation of tram traffic signal priority <strong>to</strong> reduce delays.<br />

• This is equivalent <strong>to</strong> an improvement of approximately 118 <strong>to</strong>tal travel time hours<br />

per day for <strong>the</strong>se passengers.<br />

In summary, <strong>the</strong> removal of <strong>the</strong> existing tram safety zone s<strong>to</strong>ps located on Clarendon<br />

Street ei<strong>the</strong>r side of Normanby Road is estimated <strong>to</strong> improve overall passengers travel<br />

times by a <strong>to</strong>tal of approximately 219 hours per day.<br />

Net Travel Time Improvements<br />

• 1,290 tram passengers currently boarding or alighting tram services at <strong>the</strong><br />

existing tram safety zone s<strong>to</strong>ps proposed <strong>to</strong> be removed will be required <strong>to</strong> walk up <strong>to</strong><br />

225 metres fur<strong>the</strong>r <strong>to</strong> access adjacent tram s<strong>to</strong>p locations. This results in increased<br />

travel times for <strong>the</strong>se passengers of approximately 40 additional walking hours<br />

per day.<br />

• 17,900 tram passengers travelling on tram services will receive travel time<br />

reductions as a result of <strong>the</strong> removal of <strong>the</strong> existing tram safety zone s<strong>to</strong>ps. This will<br />

result in travel time savings for <strong>the</strong>se passengers of approximately 219 hours per<br />

day.<br />

• Subsequently, this tram project is estimated <strong>to</strong> result in an overall reduction of 179<br />

travel time hours per day for all tram users.

1 SUBJECT SITE AND SURROUNDS<br />

The location of <strong>the</strong> proposed works is <strong>the</strong> Normanby Road Reserve, <strong>the</strong> light rail<br />

reservation on Whiteman Street and <strong>the</strong> road reserve on Clarendon Street.<br />

Normandy Road Reserve is Crown Land managed by <strong>the</strong> City of <strong>Melbourne</strong> reserved<br />

for <strong>the</strong> purpose of public recreation. Clarendon Street is a declared highway. The rail<br />

reservation is used for <strong>the</strong> Route 96 (<strong>to</strong> St Kilda), Route 109 (<strong>to</strong> Port <strong>Melbourne</strong>) and<br />

for <strong>the</strong> Colonial Tram Car Restaurant.<br />

To <strong>the</strong> north, across Normanby Road is <strong>the</strong> rear of <strong>the</strong> <strong>Melbourne</strong> Convention and<br />

Exhibition Centre. To <strong>the</strong> south are multi-s<strong>to</strong>rey residential apartment buildings on<br />

Whiteman Street. To <strong>the</strong> east of <strong>the</strong> site is <strong>the</strong> Crown Entertainment Complex.<br />

2 BACKGROUND AND HISTORY<br />

2.1 Background<br />

The following background is relevant:<br />

On 9 May 2006, Council adopted a Policy for Advertising on Tram and Bus<br />

Shelters<br />

Yarra Trams consulted with <strong>the</strong> City of <strong>Melbourne</strong> in 2013 in <strong>the</strong> planning and<br />

design of various tram work upgrades throughout <strong>the</strong> municipality.<br />

On 1 May 2015, <strong>the</strong> application for a planning permit was formally amended <strong>to</strong><br />

apply for <strong>the</strong> removal of native vegetation.<br />

Yarra Trams and <strong>the</strong> City of <strong>Melbourne</strong> have continuously consulted with each<br />

o<strong>the</strong>r on this project.<br />

2.2 Amendments in <strong>the</strong> assessment process<br />

The application was amended on <strong>the</strong> 12 August 2015 after a decision on <strong>the</strong><br />

application was deferred at <strong>the</strong> <strong>Future</strong> <strong>Melbourne</strong> <strong>Committee</strong> (FMC) meeting held on<br />

7 July 2015. The resolution made at <strong>the</strong> meeting was:<br />

That <strong>the</strong> <strong>Future</strong> <strong>Melbourne</strong> <strong>Committee</strong> defers this item <strong>to</strong> <strong>the</strong> August <strong>Future</strong><br />

<strong>Melbourne</strong> <strong>Committee</strong> meeting in order <strong>to</strong> canvass alternative design options<br />

which are <strong>to</strong> be presented at Councillor Forum prior <strong>to</strong> that meeting.<br />

Yarra Trams and PTV have presented <strong>the</strong> range of design options at a Councillor<br />

Forum Meeting held in August. The permit applicant formally amended <strong>the</strong> plans<br />

under Section 50 of <strong>the</strong> <strong>Planning</strong> and Environment Act 1987 (<strong>the</strong> Act) which now<br />

form <strong>the</strong> basis of this assessment.<br />

3 PROPOSAL<br />

The proposal as shown on <strong>the</strong> plans received 12 August 2015 seeks approval for <strong>the</strong><br />

removal of native vegetation, road works and construction and display of internally<br />

illuminated business identification signs. The components of <strong>the</strong> <strong>to</strong>tal upgrade which<br />

require a planning permit are associated with <strong>the</strong> tram work upgrades. The works<br />

which require a planning permit is listed as follows:<br />

Tree Removal<br />

A <strong>to</strong>tal of 19 Eucalyptus camaldelensis (River Red Gum trees) are proposed <strong>to</strong> be<br />

removed and a fur<strong>the</strong>r four trees impacted in <strong>the</strong> Normanby Road Reserve. Impacted<br />

trees are trees that are those which are impacted by more than 10% in<strong>to</strong> <strong>the</strong> Tree<br />

Protection Zone.<br />

Road works<br />

The road works that require approval are confined <strong>to</strong> land on Clarendon Street and<br />

Whiteman Street this is impacted by <strong>the</strong> Land Subject <strong>to</strong> Inundation Overlay (LSIO)<br />

see map.<br />

The road works proposed that require a planning permit include:<br />

Raising <strong>the</strong> existing track level and road surface regrading;<br />

Widening of <strong>the</strong> footpath on <strong>the</strong> north side of Whiteman Street by approximately<br />

4436mm;<br />

Removal of 25 on-street car spaces on Whiteman Street (due <strong>to</strong> <strong>the</strong> widening of<br />

<strong>the</strong> road and tram reserve);<br />

The widening of <strong>the</strong> road reserve will remove <strong>the</strong> existing footpath on <strong>the</strong><br />

nor<strong>the</strong>rn side of Whiteman Street. Cyclists and pedestrians using <strong>the</strong> nor<strong>the</strong>rn<br />

Whiteman Street shared path will be re-directed <strong>to</strong> cross <strong>the</strong> tram reserve at <strong>the</strong><br />

west end of <strong>the</strong> new tram platform. This crossing will be uncontrolled and<br />

pedestrians and cyclists crossing at this location will need <strong>to</strong> “give way” <strong>to</strong> trams.<br />

This crossing will connect <strong>to</strong> <strong>the</strong> existing shared path located on <strong>the</strong> south side of<br />

Normanby Road and will enable cyclists <strong>to</strong> connect <strong>to</strong> Spencer Street;<br />

Installation of new tracks in Clarendon Street.<br />

Installation of new kerbing <strong>to</strong> Clarendon Street.<br />

Advertising Signs<br />

The advertising signs proposed are:<br />

Four double-sided internally illuminated promotion signs on <strong>the</strong> central platform.<br />

The dimensions of <strong>the</strong> signs are 1.2 metres in width and 1.8 metres in height.<br />

One sign is proposed per shelter. The content of <strong>the</strong> signs is proposed <strong>to</strong> change<br />

from time <strong>to</strong> time and <strong>to</strong> be promotional in content.<br />

Four business identification signs on <strong>the</strong> platform for <strong>the</strong> Colonial Tramcar<br />

Restaurant. The signs are proposed <strong>to</strong> 1.2 metres in width and 1.9 metres in<br />

height. The signs are not proposed <strong>to</strong> be illuminated.<br />

4 STATUTORY CONTROLS<br />

The following clauses in <strong>the</strong> <strong>Melbourne</strong> <strong>Planning</strong> Scheme require a planning permit<br />

for this proposal:<br />

Pursuant <strong>to</strong> Clause 36.01-1 a permit is not required <strong>to</strong> use <strong>the</strong> land for<br />

carry out works for <strong>the</strong> use of <strong>the</strong> land for a tramway.<br />

Advertising sign requirements are at Clause 52.05. This zone, except<br />

for <strong>the</strong> PUZ4 (Transport), is in Category 4 unless a different<br />

requirement is specified in <strong>the</strong> schedule <strong>to</strong> this zone.<br />

For land within <strong>the</strong> PUZ4 (Transport), <strong>the</strong> category of advertising<br />

control which applies is <strong>the</strong> category which applies <strong>to</strong> <strong>the</strong> adjoining<br />

zone nearest <strong>to</strong> <strong>the</strong> land. If land is equidistant from two or more<br />

adjoining zones, <strong>the</strong> least restrictive category applies.<br />

Where <strong>the</strong> Road Zone is <strong>the</strong> nearest adjoining zone, a permit is<br />

required <strong>to</strong> display a sign.<br />

The land is equidistant between <strong>the</strong> Capital City Zone Schedule 3 and<br />

<strong>the</strong> Road Zone. The Capital City Zone is <strong>the</strong> least restrictive category.<br />

A planning permit is <strong>the</strong>refore required <strong>to</strong> construct and display<br />

internally illuminated promotion signs and business identification<br />

signs.<br />

Pursuant <strong>to</strong> Clause 36.4-1, a permit is not required <strong>to</strong> use <strong>the</strong> land for<br />

<strong>the</strong> purpose of a tramway. A permit is not required <strong>to</strong> construct and<br />

carry out works for <strong>the</strong> use of <strong>the</strong> land for a tramway.<br />

There is no requirement for a planning permit for road works under<br />

Pursuant <strong>to</strong> Clause 44.04-1 a permit is required <strong>to</strong> construct a<br />

building or <strong>to</strong> construct and carry out works including: road works.<br />

This overlay relates <strong>to</strong> <strong>the</strong> provision of car parking which is not<br />

proposed as part of this application.<br />

Transport <strong>Planning</strong><br />

A permit is required <strong>to</strong> remove, destroy or lop native vegetation,<br />

including dead native vegetation. This does not apply if <strong>the</strong> table <strong>to</strong><br />

Clause 52.17-7 specifically states that a permit is not required.<br />

The removal of native vegetation does not meet <strong>the</strong> exemptions<br />

under Clause 52.17-7. Therefore a permit is required.<br />

Pursuant <strong>to</strong> Clause 52.36-1, an application <strong>to</strong> construct a building or<br />

<strong>to</strong> construct or carry out works for any alteration or development of<br />

or removal of a building or works unless a permit is specifically<br />

8 PUBLIC NOTIFICATION<br />

8.1 Initial proposal<br />

It was determined that <strong>the</strong> proposal as it related <strong>to</strong> <strong>the</strong> removal of native vegetation<br />

may result in material detriment. Notice of <strong>the</strong> proposal was given by posting two<br />

notices on <strong>the</strong> site for a 14 day period, in accordance with Section 52 of <strong>the</strong> <strong>Planning</strong><br />

and Environment Act 1987.<br />

Pursuant <strong>to</strong> Clause 44.04-4 an application under <strong>the</strong> Land Subject <strong>to</strong> Inundation<br />

Overlay is exempt from <strong>the</strong> notice requirements of Section 52(1)(a), (b) and (d), <strong>the</strong><br />

decision requirements of Section 64(1), (2) and (3) and <strong>the</strong> review rights of Section<br />

82(1) of <strong>the</strong> Act.<br />

8.2 Amended proposal<br />

The amended proposal involves similar works compared <strong>to</strong> that of <strong>the</strong> original<br />

application and does not trigger primary consent under any of <strong>the</strong> affecting controls<br />

of <strong>the</strong> <strong>Melbourne</strong> <strong>Planning</strong> Scheme. Given that <strong>the</strong> amended proposal does not<br />

change <strong>the</strong> impact on native vegetation removal, it was determined that <strong>the</strong> amended<br />

application did not need <strong>to</strong> be readvertised.<br />

9 OBJECTIONS<br />

The initial proposal received one objection raising <strong>the</strong> following concerns<br />

(summarised):<br />

The loss of <strong>the</strong> trees would reduce birdlife, reduce shade cover and negatively<br />

impact upon <strong>the</strong> amenity of <strong>the</strong> area and reduce <strong>the</strong> wellbeing of residents.<br />

Numerous attempts have been made <strong>to</strong> contact <strong>the</strong> objec<strong>to</strong>r <strong>to</strong> discuss <strong>the</strong>ir<br />

concerns, but no response has been received.<br />

10 REFERRALS<br />

10.1 Internal<br />

The original and amended application was referred internally <strong>to</strong> <strong>the</strong> Engineering<br />

Services Group and Tree <strong>Planning</strong> (comments not received in relation <strong>to</strong> <strong>the</strong><br />

amended application). Comments received are summarised as follows:<br />

10.1.1 Engineering Services<br />

Initial application<br />

The application was referred <strong>to</strong> <strong>the</strong> Engineering Services Group who supported <strong>the</strong><br />

proposal subject <strong>to</strong> conditions and notes of permit, should one issue. One issue that<br />

was noted was that:<br />

The proposed widening of <strong>the</strong> footpath on <strong>the</strong> north side of Whiteman Street will<br />

not require <strong>the</strong> removal of any of <strong>the</strong> existing parallel parking spaces on <strong>the</strong> north<br />

and south sides of <strong>the</strong> street; or alter <strong>the</strong> existing traffic lane capacity on<br />

Whiteman Street, i.e. providing one lane of traffic flow in each direction. The net<br />

effect of <strong>the</strong> proposed works will reduce <strong>the</strong> existing width of <strong>the</strong> footpath<br />

adjacent <strong>to</strong> <strong>the</strong> tram s<strong>to</strong>p from 3.2 <strong>to</strong> 2.5 metres (as shown on drawing No.<br />

SB0485-ESR-DG-0614 P4). This is not supported. The existing footpath width<br />

should be retained by reducing <strong>the</strong> width of <strong>the</strong> north and south bound<br />

carriageways of Whiteman Street”.<br />

Amended application<br />

Engineering services provided comment on <strong>the</strong> amended application on 18 August<br />

2015 and noted <strong>the</strong> following in relation <strong>to</strong> <strong>the</strong> amended application:<br />

<br />

The amended application will result in a loss 25 on-street spaces. This represents<br />

6.0m long standard parking spaces, as we will need <strong>to</strong> relocate <strong>the</strong> existing<br />

<strong>to</strong>urist bus parking spaces. Engineering are supportive of this revised design<br />

solution.<br />

The majority of on-street car spaces being removed are ei<strong>the</strong>r “4P-Ticket” or “All-<br />

Day Ticket” spaces and may accommodate visi<strong>to</strong>rs who could utilise surrounding<br />

off-street car parking garages.<br />

The proposal will also result in <strong>the</strong> loss of <strong>the</strong> nor<strong>the</strong>rn section of <strong>the</strong> footpath for<br />

Whiteman Street. it is expected that cyclists and pedestrians travelling along <strong>the</strong><br />

Whiteman Street shared path will be re-directed <strong>to</strong> cross <strong>the</strong> tram reserve at <strong>the</strong><br />

west end of <strong>the</strong> new tram platform. This crossing will be uncontrolled and<br />

pedestrians and cyclists crossing at this location will need <strong>to</strong> “give way” <strong>to</strong> trams.<br />

This crossing will connect <strong>to</strong> <strong>the</strong> existing shared path located on <strong>the</strong> south side of<br />

Normanby Road and will enable cyclists <strong>to</strong> connect <strong>to</strong> Spencer Street.<br />

10.1.2 Tree <strong>Planning</strong><br />

Tree <strong>Planning</strong> was supportive of <strong>the</strong> initial proposal, subject <strong>to</strong> conditions that have<br />

been incorporated in<strong>to</strong> <strong>the</strong> recommended decision.<br />

10.2 External<br />

The application was referred externally <strong>to</strong> <strong>the</strong> Department of Environment, Land,<br />

Water and <strong>Planning</strong> (DELWP); <strong>Melbourne</strong> Water and Public Transport Vic<strong>to</strong>ria<br />

(PTV).<br />

10.2.1 DELWP<br />

A referral was required <strong>to</strong> <strong>the</strong> Secretary of DELWP as <strong>the</strong> tree removal is on Crown<br />

Land which is managed by <strong>the</strong> Responsible Authority. DELWP did not object <strong>to</strong> <strong>the</strong><br />

proposal.<br />

10.2.2 <strong>Melbourne</strong> Water<br />

Initial proposal<br />

<strong>Melbourne</strong> Water did not object <strong>to</strong> <strong>the</strong> proposal subject <strong>to</strong> a condition and note on <strong>the</strong><br />

permit, should one issue.<br />

Amended proposal<br />

The applicant directly provided <strong>Melbourne</strong> Water with a set of <strong>the</strong> revised drawings<br />

under <strong>the</strong> amended application. Comments from <strong>Melbourne</strong> Water were received 17<br />

August 2015 and specify <strong>the</strong> following:<br />

The amended proposal <strong>to</strong> increase <strong>the</strong> green area will increase flood levels by 3mm,<br />

according <strong>to</strong> <strong>the</strong> revised report. Although 3mm does not appear <strong>to</strong> be a significant<br />

increase in flood level, in this situation where <strong>the</strong>re is a shopfront with a floor at<br />

footpath level, <strong>the</strong> additional loss of flood s<strong>to</strong>rage by widening <strong>the</strong> green area by<br />

using a standard kerb height is not acceptable <strong>to</strong> <strong>Melbourne</strong> Water. These works are<br />

already likely <strong>to</strong> increase <strong>the</strong> 100 year flood level by approximately 15mm, and<br />

<strong>Melbourne</strong> Water only allows an increase of flood level of up <strong>to</strong> 25mm in cases<br />

where floors and buildings are not impacted.<br />

<strong>Melbourne</strong> Water has no objection <strong>to</strong> <strong>the</strong> widening of <strong>the</strong> pedestrian/green area<br />

subject <strong>to</strong> <strong>the</strong> conditions.<br />

10.2.3 PTV<br />

PTV did not object <strong>to</strong> <strong>the</strong> proposal.<br />

11 ASSESSMENT<br />

The application seeks approval for road works and construction and display of<br />

advertising signs and removal of native vegetation,<br />

11.1 Road works<br />

A permit is required for road works under <strong>the</strong> Land subject <strong>to</strong> Inundation Overlay<br />

(LSIO). <strong>Melbourne</strong> Water, as <strong>the</strong> relevant flood plain manager for <strong>the</strong> area did not<br />

object <strong>to</strong> <strong>the</strong> initial or amended proposal subject <strong>to</strong> conditions. The purpose of <strong>the</strong><br />

LSIO is <strong>to</strong> manage development in flood prone areas, <strong>to</strong> protect water quality and<br />

minimise risks and damage from flood events.<br />

Given that <strong>Melbourne</strong> Water offered no objection subject <strong>to</strong> conditions; <strong>the</strong> proposal<br />

is considered <strong>to</strong> be consistent with <strong>the</strong> purpose and decision guidelines of <strong>the</strong> LSIO.<br />

The City of <strong>Melbourne</strong>’s Engineering Services Group recommended a number of<br />

conditions of permit for <strong>the</strong> initial plans proposed under this application. One of <strong>the</strong><br />

conditions related <strong>to</strong> <strong>the</strong> potential reduction of <strong>the</strong> width of <strong>the</strong> footpaths <strong>to</strong> Whiteman<br />

Street which was not supported. The amended application involves a design which<br />

will result in a shared (bike and pedestrian) footpath being created in <strong>the</strong> new reserve<br />

<strong>to</strong> be widened and which is now supported by Engineering Services.<br />

As specified in Section 10.1.1 of this report <strong>the</strong> Engineering Services are generally<br />

supportive of <strong>the</strong> revised proposal including <strong>the</strong> removal of 25 on-street car parking<br />

<strong>to</strong> provide for an increased reserve with landscaping. Should a permit issue a<br />

condition will specify that <strong>the</strong> application must gain all necessary approvals from<br />

Engineering Services prior <strong>to</strong> <strong>the</strong> commencement of any works.<br />

As a matter of clarity, <strong>the</strong> area which is impacted by <strong>the</strong> LSIO is not clearly shown on<br />

<strong>the</strong> submitted plans for <strong>the</strong> proposal. It recommended that this be overlayed on <strong>the</strong><br />

plans <strong>to</strong> clearly show <strong>the</strong> road works which require a planning approval.<br />

11.2 Advertising Signs<br />

The application seeks approval <strong>to</strong> display up <strong>to</strong> eight signs on <strong>the</strong> proposed tram<br />

shelters used for promotional purposes and <strong>the</strong> Colonial Tramcar Restaurant.<br />

Policy under Clause 21.06-1 (Municipal Strategic Statement), seeks <strong>to</strong> ‘Ensure<br />

advertising signs avoid visual pollution and intrusive light spill and respect <strong>the</strong><br />

architecture of <strong>the</strong>ir host buildings, <strong>the</strong> surrounding streetscape character and<br />

skyline.’<br />

More specific objectives and policies for advertising signs are listed at Clause 22.07<br />

of <strong>the</strong> <strong>Melbourne</strong> <strong>Planning</strong> Scheme. Decision Guidelines for Advertising Signs are<br />

found at Clause 52.05. As a general rule, promotion signs are discouraged by policy.<br />

Signs are encouraged <strong>to</strong> be compatible and integrated with <strong>the</strong> structure <strong>the</strong>y are<br />

located on and sympa<strong>the</strong>tic <strong>to</strong> <strong>the</strong>ir surrounds. Views from all angles should be<br />

considered. The managing of signage <strong>to</strong> allow for reasonable identification and <strong>to</strong><br />

avoid visual clutter is also a policy consideration for advertising signs.<br />

As a matter of consistency, Council in May 2006, resolved <strong>to</strong> adopt a policy for<br />

advertising on tram shelters. Although, this policy is nei<strong>the</strong>r an incorporated,<br />

reference nor policy document listed in <strong>the</strong> <strong>Melbourne</strong> <strong>Planning</strong> Scheme, it does<br />

provide some clarity and consistency on assessing advertising signs for trams<br />

shelters under <strong>the</strong> abovementioned <strong>Melbourne</strong> <strong>Planning</strong> Scheme controls.<br />

This policy discourages signs in parklands. In relation <strong>to</strong> super s<strong>to</strong>ps, one sign per 8<br />

metre long shelter is recommended or one per 4 metre shelter. Signage is<br />

encouraged not <strong>to</strong> exceed three signs per platform. The proposed shelters appear <strong>to</strong><br />

be 6 metres long, with four signs proposed per platform.<br />

To allow no signage in this location would be unreasonable. This is because <strong>the</strong><br />

signage on <strong>the</strong> nor<strong>the</strong>rn platform is proposed <strong>to</strong> be used for <strong>the</strong> Colonial Tramcar<br />

Restaurant which requires signs for <strong>to</strong>urists and patrons <strong>to</strong> locate where <strong>to</strong> assemble<br />

for <strong>the</strong> tram restaurant. The proposed promotion signs <strong>to</strong> <strong>the</strong> central platform are <strong>to</strong><br />

shelters which are spread out over a longer platform than <strong>the</strong> proposed nor<strong>the</strong>rn<br />

platform. Given this spacing, <strong>the</strong> signs would not result in visual clutter.<br />

These signs are considered not <strong>to</strong> be detrimental <strong>to</strong> <strong>the</strong> public reserve. The signs<br />

would be integrated with <strong>the</strong> design of <strong>the</strong> shelters. The signs are a comfortable fit<br />

with <strong>the</strong> area and would not be detrimental <strong>to</strong> <strong>the</strong> appreciation and enjoyment of <strong>the</strong><br />

Normanby Road Reserve. However, as a matter of consistency, three signs per<br />

platform have been generally supported by <strong>the</strong> City of <strong>Melbourne</strong>. It is considered<br />

that should a permit issue, a condition of permit can require <strong>the</strong> removal of at least<br />

one sign per platform. This would reduce <strong>the</strong> overall impact of <strong>the</strong> signs, and would<br />

be consistent with o<strong>the</strong>r approvals elsewhere in <strong>the</strong> municipality.<br />

A planning permit is not required for signage that provides information <strong>to</strong> public<br />

transport users. The number of signs for this purpose is not impacted by this<br />

recommendation, but <strong>the</strong> potential for such signage should be considered when<br />

assessing whe<strong>the</strong>r <strong>the</strong> number, size and location of promotion signs are acceptable.<br />

11.3 Removal of Native Vegetation<br />

The application seeks <strong>to</strong> remove 19 native trees with a fur<strong>the</strong>r four impacted. The<br />

City of <strong>Melbourne</strong>’s Tree <strong>Planning</strong> team supported <strong>the</strong> proposal (subject <strong>to</strong><br />

conditions) and DELWP did not object nor specifically require any offsets.<br />

A permit is required under Clause 52.17 of <strong>the</strong> <strong>Melbourne</strong> <strong>Planning</strong> Scheme <strong>to</strong><br />

remove native vegetation which does not meet <strong>the</strong> exemption criteria specified under<br />

that provision. The relevant purposes of this provision (summarised) is <strong>to</strong> ensure no<br />

These amended plans must be <strong>to</strong> <strong>the</strong> satisfaction of <strong>the</strong> Responsible Authority<br />

and when approved shall be <strong>the</strong> endorsed plans of this permit.<br />

2. The development as shown on <strong>the</strong> endorsed plans must not be altered or<br />

modified unless with <strong>the</strong> prior written consent of <strong>the</strong> Responsible Authority.<br />

Advertising signs<br />

3. The signs, including <strong>the</strong>ir structure and advertising material as shown on <strong>the</strong><br />

endorsed plan, must at all times be maintained in good order and condition, <strong>to</strong> <strong>the</strong><br />

satisfaction of <strong>the</strong> Responsible Authority.<br />

4. The signs must not be animated or contain any flashing light.<br />

5. This permit, in relation <strong>to</strong> <strong>the</strong> signs expires 15 years from <strong>the</strong> date of issue, at<br />

which time <strong>the</strong> signs and all supporting structures must be removed and <strong>the</strong> site<br />

made good <strong>to</strong> <strong>the</strong> satisfaction of <strong>the</strong> Responsible Authority.<br />

<strong>Melbourne</strong> Water<br />

6. The finished <strong>to</strong>p of kerb height (and planted area) must be at least 50mm lower<br />

than <strong>the</strong> street/ground floor levels of <strong>the</strong> businesses along Whiteman Street.<br />

7. A roll over kerb and channel, or similar, must be used <strong>to</strong> minimise <strong>the</strong> finished <strong>to</strong>p<br />

of kerb height (e.g. refer <strong>to</strong> Morning<strong>to</strong>n Peninsula Council's standard drawing<br />

(MP101- 102) kerb and channel detail - MP101).<br />

8. The level of <strong>the</strong> pedestrian/green area must be graded down <strong>to</strong>wards <strong>the</strong> road<br />

(away from <strong>the</strong> street/ground floor level of <strong>the</strong> businesses).<br />

Engineering Services<br />

9. Existing public street lighting must not be altered without first obtaining <strong>the</strong> written<br />

approval of <strong>the</strong> City of <strong>Melbourne</strong> - Engineering Services.<br />

10. Relocated kerb and channel in Whiteman Street must be constructed in sawn<br />

blues<strong>to</strong>ne in accordance with plans and specifications first approved by <strong>the</strong><br />

Responsible Authority - Engineering Services.<br />

11. All drainage works within <strong>the</strong> road reserve shall be in accordance with City of<br />

<strong>Melbourne</strong>'s Drainage Specification <strong>to</strong> <strong>the</strong> satisfaction of <strong>the</strong> City of <strong>Melbourne</strong> –<br />

Engineering Services.<br />

12. Road and footpath must be constructed in accordance with plans and<br />

specifications first approved by <strong>the</strong> Responsible Authority - Engineering Services.<br />

13. All pedestrian ramps must be designed and constructed in accordance with AS<br />

1428:2009 Design for Access and Mobility and should be fitted with ground<br />

surface tactile indica<strong>to</strong>rs (TGI's). Details of <strong>the</strong> TGI's must be submitted <strong>to</strong> and<br />

approved by City of <strong>Melbourne</strong> - Engineering Services prior <strong>to</strong> <strong>the</strong>ir installation.<br />

Native Vegetation Offsets<br />

14. Prior <strong>to</strong> commencement of any removal of native vegetation, <strong>the</strong> applicant must<br />

provide a Native Vegetation Offset in accordance with <strong>the</strong> Permitted clearing of<br />

native vegetation – Biodiversity Assessment Guidelines and <strong>the</strong> Native vegetation<br />

gain scoring manual.<br />

Tree <strong>Planning</strong><br />

15. Prior <strong>to</strong> commencement of works Tree Protection Management Plan (TPMP) <strong>to</strong><br />

<strong>the</strong> satisfaction of <strong>the</strong> Urban Landscapes Branch is required <strong>to</strong> be submitted that<br />

outlines how all nearby council trees will be adequately protected during<br />

construction. The TPMP must be written by a qualified arborist and reference <strong>the</strong><br />

Australian Standard for <strong>the</strong> protection of trees on development sites AS-4970.<br />

16. A bank guarantee or bond <strong>to</strong> <strong>the</strong> equivalent combined environmental and amenity<br />

values of all council trees covered by <strong>the</strong> TPMP is <strong>to</strong> be held for <strong>the</strong> duration of<br />

construction activities. Should any tree be adversely impacted on, <strong>the</strong> City of<br />

<strong>Melbourne</strong> will be compensated for any loss of amenity, ecological services or<br />

amelioration works incurred.<br />

17. No council tree is <strong>to</strong> be pruned in any form and branches and roots will not be<br />

removed without <strong>the</strong> prior written consent of <strong>the</strong> Urban Landscapes branch. No<br />

council tree is <strong>to</strong> be pruned/root pruned in any form without <strong>the</strong> prior written<br />

consent of <strong>the</strong> Urban Landscapes branch.<br />

18. Prior <strong>to</strong> commencement of works, a landscape plan developed in consultation<br />

with <strong>the</strong> Urban Landscapes branch must be submitted <strong>to</strong> <strong>the</strong> satisfaction of <strong>the</strong><br />

Responsible Authority. The agreed scheme must address <strong>the</strong> loss of canopy and<br />

green space from <strong>the</strong> Normanby Rail Reserve. Proposed tree locations and<br />

species in <strong>the</strong> public realm consistent with current City of <strong>Melbourne</strong> strategies.<br />

These landscape plans must be <strong>to</strong> <strong>the</strong> satisfaction of <strong>the</strong> Responsible Authority<br />

and when approved shall form a part of <strong>the</strong> endorsed plans of this permit.<br />

19. The site must be landscaped six months of <strong>the</strong> completion of <strong>the</strong> development <strong>to</strong><br />

<strong>the</strong> satisfaction of <strong>the</strong> Responsible Authority and <strong>the</strong> areas concerned must be<br />

subsequently maintained <strong>to</strong> <strong>the</strong> satisfaction of <strong>the</strong> Responsible Authority.<br />

Expiry of permit<br />

20. This permit will expire if one of <strong>the</strong> following circumstances applies:<br />

NOTES:<br />

a) The development is not started within two years of <strong>the</strong> date of this permit.<br />

b) The development is not completed within four years of <strong>the</strong> date of this<br />

permit.<br />

The Responsible Authority may extend <strong>the</strong> permit if a request is made in writing<br />

before <strong>the</strong> permit expires, or within six months afterwards. The Responsible<br />

Authority may extend <strong>the</strong> time for completion of <strong>the</strong> development if a request is<br />

made in writing within 12 months after <strong>the</strong> permit expires and <strong>the</strong> development<br />

started lawfully before <strong>the</strong> permit expired.<br />

where <strong>the</strong> decision on <strong>the</strong> application was deferred.<br />

The amended application was presented <strong>Future</strong> <strong>Melbourne</strong> <strong>Committee</strong> meeting for<br />

01 September 2015.<br />
