Source of Activity<br />
On 5/4/13 at 2232 hours I, Ptlm O’Connor and other members of NPD were dispatched to the area of Boston Neck<br />
Road and Bridgetown Road for the report of a motor vehicle accident where the operator did not stop after the<br />
collision. The caller John L. Smith stated the vehicle that struck his continued driving into Bonnet Shores driving<br />
erratically. While en route to the area the caller stated the vehicle pulled into the driveway of 215 Col John Gardner<br />
Road.<br />
Officer’s Observations<br />
Ptlm Storm and I arrived on scene. While Ptlm Storme spoke with Smith I spoke with the operator of the suspect<br />
vehicle, Robert McManus. I observed McManus’s vehicle (MA/PC 939 2012 Honda Accord) sustained fresh front<br />
driver side damage. McManus was standing out of his vehicle when I arrived on scene. I observed McManus to be<br />
unsteady on his feet, he was swaying in a semicircular motion. I asked McManus if he was ok, to which McManus<br />
stated, “Yes”. I asked McManus what had taken place, McManus started speaking and slurring his words to the<br />
point it was difficult to understand. McManus explained that he may have hit a vehicle but he didn’t realize he did. I<br />
asked McManus for his driver’s license. McManus pulled out his wallet, opened his wallet which I had illuminated<br />
with my flashlight. I observed the Massachusetts license was in a clear plastic holder easily visible from 4-5 feet<br />
away. McManus’s body began to sway even more while he was looking down for his license. He continually missed<br />
his license in his wallet, his movements were slow and deliberate. McManus was able to retrieve his license after<br />
approximately 15-20 seconds and I asked him three times. While speaking with McManus I could detect a moderate<br />
odor of alcohol emanating from his mouth as he spoke. McManus’s face was red and his eyes were severely<br />
bloodshot. I asked McManus if he was on any medication or feeling ill and he stated he was not. I asked McManus<br />
if he had any alcohol tonight, McManus stated “I had a glass of wine with dinner”. A check of McManus showed he<br />
was negative for warrants with an active MADL.<br />
I had McManus step out of the driveway and walk to an area on the roadway that was flat, dry, free of debris and<br />
well illuminated by an overhead street light. I asked McManus if he would submit to a series of Standardized Field<br />
Sobriety Tests, to which he stated “Yes”. Before starting the tests all cruiser’s overhead emergency lights were<br />
deactivated.<br />
SFST’s<br />
The first test I administered was the Horizontal Gaze Nystagmus (HGN). I asked McManus if there was anything<br />
wrong with his eyes that would prevent him from following my finger with his eyes, he stated, “No”. I advised<br />
McManus to stand with his feet together, hands by his side and keep his head still while he follows my finger with<br />
his eyes only, which I placed 12-15 inches from his face and slightly above eye level. I asked McManus if he<br />
understood and he stated, “Yes”. During the test I observed lack of smooth pursuit and equal tracking, distinct and<br />
sustained nystagmus at maximum deviation and onset of nystagmus prior to 45 degrees, all in both eyes. I had to<br />
remind McManus numerous times to keep his head still and to continue to follow my finger with his eyes.<br />
McManus was still swaying and I could detect the odor of an alcoholic beverage emanating from his mouth.<br />
The second test I administered was the Walk and Turn Test. I asked McManus if there was anything wrong with his<br />
feet, legs, knees and/or back that would prevent him from walking in a straight line and turning, McManus stated,<br />
“No”. I then had McManus place his left foot on an imaginary line and put his right foot in front of it in a heal to toe<br />
fashion with his hands by his side which I demonstrated. I advised he is to hold that position until told otherwise,<br />
McManus stated he understood. McManus was unable to stay in the instructional stance. McManus lost his balance,

stepped to his left and kept his feet approximately shoulder width apart. I again asked McManus to get into the<br />
instructional stance but McManus was unable to maintain the stance without losing his balance. I then began my<br />
instructions, I explained he is to take 9 steps down a imaginary line, perform a turn using a series of small steps that<br />
I would demonstrate and take 9 steps back down the line to which McManus stated he understood. I explained each<br />
step needs to be in a heel to toe manner, on the line and with his arms by his side to which he stated he understood. I<br />
instructed McManus to count the number of steps out loud, look down at his feet and not to stop during the test,<br />
McManus stated he understood. I then demonstrated the test. McManus stated he understood and did not have any<br />
questions. I attempted to get McManus to hold the instructional stance before beginning the test but he was unable<br />
to hold the stance. I advised McManus he may begin the test to which he did by taking 10 steps down the line<br />
missing the line and heel to toe on every step. McManus stopped and then <strong>com</strong>pleted an incorrect turn by taking<br />
small steps with both feet. McManus took 10 steps back down the line missing the line and heel to toe with every<br />
step. McManus steps were in a normal walking motion approximately shoulder width apart.<br />
The third test I administerd was the One Leg Stand Test. Prior to beginning the test I asked McManus if he had<br />
problems with his feet, legs, knees and/or back that would prevent him from balancing on one foot, to which<br />
McManus stated he did not. I advised McManus to stand with his feet together and arms by his side, McManus<br />
stated he understood but was only able to stand in this fashion for a moment before standing with his feet shoulder<br />
width apart. I advised McManus he is to raise one foot of his choosing approximately 6 inches off the ground while<br />
keeping his legs straight and arms by his sides, McManus stated he understood. I explained he is to keep his foot<br />
raised, look at his raised foot and count out loud, “One thousand one, one thousand two, one thousand three” and<br />
continue counting in this way until told to stop. McManus stated he understood. I explained if he puts his foot down<br />
to pick it back up and continue counting from where he left off. I asked McManus if he had any questions to which<br />
he stated he did not. McManus raised his right foot and raised his arms close to parallel to the ground, McManus<br />
was swaying. McManus quickly counted “One thousand, two thousand, seven thousand, eight thousand” he put his<br />
foot down and stepped to the right. McManus tried two more times but could only keep his foot up for a second,<br />
each time starting his counting back over. After the third time McManus put his foot down which was<br />
approximately 10-12 seconds after starting the test, it was terminated for his safety.<br />
<strong>Arrest</strong> of Suspect<br />
I advised McManus to place his hands behind his back. I advised McManus that he was under arrest for suspicion of<br />
driving a under the influence of intoxicating liquor and/or drugs. I handcuffed McManus, double locked the cuffs<br />
and checked for tightness, searched him and placed him in the rear seat of Car #8. At 2251 hours, I read McManus<br />
his Rights for Use at Scene from a department issued card. These rights include the Miranda Rights, right to an<br />
attorney and the right to be examined by a physician of his own choosing. McManus stated he understood his rights.<br />
I transported McManus back to the station while Ptlm Storm obtained a written statement from Smith regarding the<br />
accident. (See 13-178 AC)<br />
Booking<br />
Once at the station, McManus was searched with negative results. At 2306 hours I read McManus his Rights for<br />
Use at Station form a department issued form. These rights include the Miranda Rights, the right to an attorney, the<br />
right to have a physician or person of his choosing administer any chemical test in addition to the test administered<br />
at my direction, the right to refuse the chemical test and the right to use the telephone. I finished reading McManus<br />
his Right for Use at Station at 2312 hours. McManus refused to use the telephone. At 2320 hours McManus stated<br />
he would like to refuse the chemical test and signed the refuse portion of the form.

I then took McManus photographs. I <strong>com</strong>pleted the Alcohol Influence <strong>Report</strong> with McManus. McManus stated he<br />
was <strong>com</strong>ing from dinner in Providence and heading to his house on Col John Gardner Road. McManus stated he<br />
had two drinks with dinner at around 7 PM in Providence, one was a Manhattan and the other was a glass of wine.<br />
McManus stated the last thing he ate was pasta and steak at around 7 PM.<br />
At approximately 0245 hours McManus was finger printed. McManus was issued 4 th District Court summons<br />
#13501500587 for DUI 1 st offense BAC Unknown with a return court date of 5/7/13 at 0900 hours. In addition<br />
McManus was issued RITT summons #13501500588 for Refusal to Submit to a Chemical Test and Laned Roadway<br />
violations with a return court date of 5/14/13 at 0830 hours.<br />
At approximately 0255 hours McManus was released to a friend.<br />
Evidence<br />
Ptlm Storme obtained a signed written statement from Smith. Smith stated on 5/4/13 at 2228 hours while traveling<br />
North on Boston Neck Road he was approaching Bridgetown Road and was struck by MA/PC 939. Smith explained<br />
the black vehicle with Massachusetts plates was traveling east on Bridgetown Road turning south on to Boston<br />
Neck Road. Smith stated he followed the vehicle as it left the scene. Smith described the vehicles operation as<br />
erratic and at times operating left of center. Smith stated he called 911 and followed the vehicle into the driveway of<br />
215 Col John Gardner Road. Smith stated the operator did not exit the vehicle until he went over to the vehicle.<br />
Smith stated the operator was the only occupant. Smith stated the other operator did not consume any alcohol after<br />
exiting the vehicle.

SUMMATION: On 5/4/13 at 2232hrs members of NPD were dispatched to the area of Boston Neck Rd and<br />
Bridgetown Rd., for a report of an accident where the operator of the vehicle causing the accident did not stop<br />
after the collision. The caller John Smith, the operator of Vehicle 2 (RI Reg 809-983) stated the vehicle continued<br />
driving into Bonnet Shores, driving erratically. While enroute to the location, the caller stated he was following the<br />
vehicle that struck him and they had currently pulled into the driveway at 215 Col. John Gardner Rd.<br />
Upon arrival, I Ptlm Storme spoke to the operator of Vehicle 2, John Smith while Ptlm O'Connor spoke with the<br />
identified operator of the suspect vehicle, Vehicle 1 (MA Reg 939). John Smith identified the operator of Vehicle 1<br />
on scene, who was identified as Robert McManus and indicated he believed that McManus was possibly HBD.<br />
While obtaining a witness statement from Smith, Ptlm O'Connor along with Sgt Vellone conducted a series of<br />
Field Sobriety Tests with McManus in which he subsequently failed. McManus was placed into custody for<br />
Operating a Motor Vehicle Under the Influence. Damage to Vehicle 1 consisted of fresh body damage to the<br />
driver's side front bumper area. Damage to Vehicle 2 consisted of fresh body damage to the rear driver's side<br />
back seat door area and to the rear driver's side quarter panel area.<br />
While on scene I obtained a written statement from Smith who indicated that while travelling northbound on<br />
Boston Neck Rd., he was stopped at the red light waiting to turn left onto Bridgetown Rd. While stopped at the<br />
light, he was struck by Vehicle 1 (MA Reg 939), which was travelling eastbound on Bridgetown Rd. Smith advised<br />
that after being struck, the vehicle proceeded southbound on Boston Neck Rd. Smith described the vehicle that<br />
struck him as a black vehicle. Smith stated he followed the vehicle as it left the scene. Smith advised the vehicle<br />
continued driving erratically and at times crossing the center median, travelling left of center. Smith stated he<br />
called 911 and followed the vehicle into the driveway of 215 Col. John Gardner Rd. Smith stated the operator did<br />
not exit the vehicle until he approached the vehicle. Smith stated the operator was the only occupant. Smith<br />
stated the operator did not consume any alcohol after exiting the vehicle. Smith advised responding officers once<br />
on scene he believed the operator he identified as the operator of the vehicle that had struck him may be HBD.<br />
Smith advised officers on scene that he was able to observe and stayed with McManus from the time he exited<br />
the vehicle until the arrival of police and at no time did he observe McManus consume any alcohol.<br />
RECOMMENDATION: Based on the damage observed to Vehicle 1, consisting of fresh body damage to the<br />
driver's side front bumper area, and damage to Vehicle 2 consisting of fresh body damage to the rear driver's side<br />
back seat door area and to the rear driver's side quarter panel area, corroborates Smith's account of how the<br />
accident occurred. While travelling northbound on Boston Neck Rd., he (Smith) was stopped at the red light<br />
waiting to turn left onto Bridgetown Rd. While stopped at the light, he was struck by Vehicle 1 (MA Reg 939),<br />
which was travelling eastbound on Bridgetown Rd., and made a right hand turn onto Boston Neck Rd. As Vehicle<br />
1 was making the turn, Vehicle 1 made a wide right hand turn and in doing so, struck Vehicle 2 while stopped at<br />
the stop light. Vehicle 1's front drivers side bumper, ended up striking the rear driver's side back seat door area<br />
and to the rear driver's side quarter panel area.<br />
After further investigation, operator of Vehicle 1, Robert McManus was charged with DUI-First Offense, Leaving<br />
Scene of Accident-Attended Vehicle, Refusal To Submit To A Chemical Test and Laned Roadway Violation.<br />
Photographs of the observed damage to both Vehicles were taken on scene by Sgt Vellone and attached to this<br />
case by Sgt Vellone. Refer to 13-294-AR. Refer to 13-178-AC.<br />
INJURIES: On scene, Operator 2 Smith advised he struck his head on the drivers side window and was<br />
experiencing neck pain. Smith declined medical treatment on scene. A short time later at 2330hrs, Smith<br />
contacted NPD <strong>com</strong>plaining of pain and he would be responding to South County Hospital for treatment. Smith<br />
advised he would respond to NPD at a later time to <strong>com</strong>plete a South County Medical Release Form.

MEMBERS OF NPD WERE DISPATCHED TO A HIT AND RUN MOTOR VEHICLE ACCIDENT IN THE<br />
AREA OF BOSTON NECK ROAD AND BRIDGETOWN ROAD. THE CALLERS VEHICLE WAS STRUCK<br />
BY THE SUSPECT VEHICLE WHICH WAS TURNING FROM BRIDGETOWN ROAD, EASTBOUND ONTO<br />
BOSTON NECK ROAD, SOUTHBOUND. THE CALLERS VEHICLE WAS SIDESWIPED, SUSTAINING<br />
DAMAGE TO THE DRIVER SIDE OF THE VEHICLE. THE SUSPECTS VEHICLE SUSTAINED DAMAGE<br />
TO THE FRONT DRIVER SIDE WHILE EXECUTING THE RIGHT TURN. AFTER THE COLLISION THE<br />
CALLER FOLLOWED THE SUSPECT VEHICLE AND CALLED 911. THE CALLER FOLLOWED THE<br />
SUSPECT VEHICLE, WHICH WAS IDENTIFIED AS A BLACK VEHICLE BEARING MASSACHUSETTS<br />
REGISTRATION 939, TO THE DRIVEWAY OF 215 COL JOHN GARDNER ROAD. WHILE FOLLOWING<br />
THE VEHICLE, THE CALLER DESCRIBED THE SUSPECTS VEHICLE OPERATION TO BE, "ERRATIC,<br />
UNABLE TO MAINTAIN CONTROL AND CROSSING LEFT OF THE CENTER LINE". THE CALLER<br />
STATED ONCE SUSPECT VEHICLE PARKED IN THE DRIVEWAY OF 215 COL JOHN GARDNER ROAD<br />
THE SUSPECT AND SOLE OCCUPANT OF THE VEHICLE DID NOT GET OUT. THE CALLER THEN<br />
APPROACHED THE VEHICLE AND THE SUSPECT GOT OUT OF THE VEHICLE. MEMBERS OF NPD<br />
ARRIVED MOMENTS LATER AND THE CALLER POINTED OUT THE SUSPECT TO THE OFFICERS. THE<br />
CALLER STATED THE SUSPECT DID NOT CONSUME ANY ALCOHOL AFTER EXITING THE VEHICLE<br />
(SEE SIGNED WITNESS STATEMENT). CONTACT WAS MADE BY OFFICERS WITH SUSPECT WHO<br />
WAS SWAYING AND UNSTEADY ON HIS FEET. THE SUSPECT, WHO WAS IDENTIFIED AS ROBERT J.<br />
MCMANUS, STATED HE WAS DRIVING FROM PROVIDENCE TO HIS RESIDENCE AND DID NOT<br />
REALIZE HE STRUCK ANOTHER VEHICLE. FRESH DAMAGE WAS OBSERVED ON THE FRONT<br />
DRIVERS SIDE OF SUSPECTS VEHICLE MATCHING THE DAMAGE TO THE CALLERS VEHICLE.<br />
SUSPECT HAD SLOW AND DELIBERATE MOVEMENTS. THE ODOR OF ALCOHOLIC BEVERAGE WAS<br />
EMANATING FROM SUSPECTS MOUTH AS HE SPOKE. THE SUSPECTS EYES WERE WATERY AND<br />
SEVERELY BLOODSHOT. SUSPECTS FACE WAS REDDISH. SUSPECT FAILED ALL THREE PHASES OF<br />
THE SFSTS TO INCLUDE THE HORIZONTAL GAZE NYSTAGMUS WALK AND TURN AND ONE LEG<br />
STAND.<br />

On 5/6/13 After <strong>com</strong>pletion of the accident investigation (See 13-178-AC), it was determined that an additional<br />
charge of Leaving the Scene of an Accident, Damage to Attended Vehicle, in violation of RIGL 31-26-2. This<br />

On 05-04-13 at approximately 10:30 p.m. I Sgt Vellone along with other members of the <strong>Narragansett</strong> <strong>Police</strong><br />
<strong>Department</strong> responded to 215 Col John Gardner Rd. for a hit and run accident. Upon arrival Officer's were already<br />
on scene starting the investigation. Ptlm Storme was with the caller and victim John Smith obtaining a statement.<br />
Ptlm O'Connor advised me that he had already made contact with the suspect and sole occupant of the other vehicle<br />
Robert McManus. He also informed me that he suspected that McManus was operating under the influence and that<br />
he was going to conduct the standardized field sobriety tests (see Ptlm O'Connor's narrative).<br />
Upon <strong>com</strong>pletion of the standardized field sobriety tests Ptlm O'Connor took McManus into custody and read him<br />
his rights for use on scene. McManus was secured in the rear of Ptlm O'Connor's cruiser and transported to the<br />
station without incident.<br />
While on scene I took photographs of the damage to both Smith and McManus' vehicles. When I arrived back at<br />
the station I uploaded those photographs to the accident report.<br />
