2 District of Oak Bay Council Meeting September 30, 2013 Ms. Hilton requested that it be clarified if it is Council‟s intention that the development variance permit applications be denied or be deferred until the Floor Area Review Committee has completed its review and made recommendations to Council. It was the consensus of Council that that the proponent be asked to comment on the potential changes to the application. Leonard Cole, applicant, noted that he is considering revising his proposal to take into account comments by staff and Council; however, Mr. Cole stated that it would be his preference that the current application be deferred rather than denied. He noted that, in the event that the Floor Area Review Committee completes their review and recommendations in the next few months, the current application could be considered without the 6 month waiting period that is necessary after an application has been denied. MOVED by Councillor Ney Seconded by Councillor Copley, That the minutes of the Committee of the Whole meeting held on Monday, September 23, 2013, and the recommendations contained therein, with the exception of the recommendation regarding correspondence items no. 2013-263 and no. 2013-264, being development variance permit applications for 2670 Margate Avenue, be adopted. CARRIED MOVED by Councillor Ney Seconded by Councillor Herbert, That further consideration of the applications for development variance permits on Lot 51 and Lot 52 of 2670 Margate Avenue, as outlined in the September 9, 2013 reports of the Director of Building and Planning, correspondence item no. 2013-263 and correspondence item no. 2013-264, be deferred until the Floor Area Review Committee has completed its review and made its recommendations to Council. COMMUNICATIONS: CARRIED 1. 2013-271 JOHN DOUGLAS KELK, Sept. 17, 2013 Re Temporary Road Closure for Block Party, Heron St./Lincoln Rd., Oct. 6, 2013 MOVED by Councillor Herbert Seconded by Councillor Copley, That permission be given for a temporary road closure of Heron Street and Lincoln Road to the south of Estevan Avenue on Sunday October 6, 2013 from 12:45 pm to 4:00 p.m. for the purpose of a neighbourhood block party. CARRIED 2. 2013-272 SCOUTS CANADA – 5 TH GARRY OAK SCOUTS, Aug. 23, 2013 Re Occupancy Agreement – Scout Hall Adam Nott, Group Commissioner, 5 th Garry Oak Scouts, commented that it had been his understanding that a change would be needed to the occupancy agreement to allow for rental of the Scout Hall by other community organizations, as is proposed in his correspondence. If a change is not necessary, he said, they are happy to proceed.
District of Oak Bay Council Meeting September 30, 2013 MOVED by Councillor Murdoch Seconded by Councillor Herbert, That a Bylaw be drafted to authorize Council to enter into a new five year agreement to allow Scout Properties (BC/Yukon) Ltd. to occupy the Scout Hall, on the same terms the current agreement, to be brought forward for formal consideration. 3. 2013-273 SCOUTS CANADA – GREATER VICTORIA AREA, Sept. 4, 2013 Re Request for Apple Tag Day – Oct. 5, 2013 CARRIED MOVED by Councillor Kirby Seconded by Councillor Herbert, That permission be granted to Scouts Canada, Greater Victoria Area, to conduct an apple tag day in public places in Oak Bay on October 5, 2013. 4. 2013-274 VICTORIA CARSHARE COOPERATIVE, Sept. 5, 2013 Re Request to Occupy Municipal Parking Space CARRIED MOVED by Councillor Herbert Seconded by Councillor Ney, That permission be given for the Victoria Car Share Cooperative to occupy one parking space at the Monterey Avenue parking lot adjacent to the Monterey Centre for a two year period, and that the Mayor and Municipal Clerk be authorized to execute an agreement with the Victoria Car Share Cooperative for the use of the parking space. 5. 2013-275 OAK BAY HERITAGE COMMISSION, Sept. 10, 2013 Re Minutes of Meeting CARRIED MOVED by Councillor Kirby Seconded by Councillor Ney, That the minutes of the Oak Bay Heritage Committee meeting held on September 10, 2013, be received. The Municipal Administrator responded to questions from Council with respect to potential issues arising from advisory committees, such as the Heritage Commission, having individual email accounts. Mr. Nason noted that staff members would discuss the proposal with the Heritage Commission. During Council discussion it was also noted that careful consideration should be given to the cost and intention of reprinting “More Than Bricks and Boards” and that the Heritage Commission should be congratulated on their recently published walking brochure.
