Minutes of the Ordinary Meeting of Constantine Parish Council held on Thursday, September 16, 2010 at<br />
7.00pm in The Vestry, Constantine.<br />

In the absence of the Chairman, the Vice-Chairman, Cllr Boote assumed the Chair and welcomed members<br />
and visitors to the September meeting.<br />
PUBLIC QUESTION TIME<br />
Speaking of a letter from Mr Dawson which was published in Gweder Myras, Mr Gendall said that he was<br />
there on behalf of a number of local people who between them had expressed the following concerns about<br />
Mr Dawson’s proposals for the Recreation Ground hedge<br />
the present poor state of the hedge is the result of the use of herbicide<br />
it needs to be reinstated as a proper Cornish hedge: the soil needs to be raked and grass-seed sown<br />
if the hedge is removed there will be problems relating to children running straight out onto the road<br />
if a drop-edge kerb is introduced it will result in cars on the pavement<br />
the considerable difference in levels between the road and the Recreation Ground will make for<br />
difficulties in implementing the scheme as proposed<br />
a piped stream runs along the bottom of the hedge and this will present problems if levels are altered<br />
planting of trees will lead to the loss of a fine view.<br />
Cllr Williams suggested that the hedge should be re-stoned and re-seeded and possibly raised so that people<br />
cannot climb over it. He challenged a suggestion that the Community Payback team might undertake this<br />
work, stating that building a Cornish hedge is a job for an expert<br />
Cllr Just thanked Mr Gendall for putting these opinions into words, a sentiment which was endorsed by<br />
all those present.<br />
1 TO ACCEPT APOLOGIES FOR ABSENCE<br />
Cllr Carter (holiday), Cllr Cavanagh (holiday), Cllr Gray (holiday) and Cllr Wiseman (holiday) sent their<br />
apologies for absence. Cllr Nicholls proposed, Cllr Williams seconded all others in favour to accept their<br />
apologies.<br />
2 DECLARATIONS OF INTEREST<br />

Cllr Nicholls declared a personal and prejudicial interest in agenda item 9 (PA10/05274).<br />

3 CONFIRMATION OF THE MINUTES OF THE LAST MEETING<br />
Cllr Williams proposed, Cllr Bolt seconded, (Cllr Cummins and Cllr Just being absent from the last meeting,<br />
abstained), all others in favour that the minutes of the Ordinary Meeting held on Thursday July 15, 2010 are<br />
a true record and the Chairman signed them as such.<br />

4 MATTERS ARISING FROM THE MINUTES BUT NOT INCLUDED ON THIS AGENDA<br />
It was noted that<br />
anti-social behaviour logbooks are available from the police<br />
the dog-bin at the northern end of Well Lane has not, as yet, been replaced<br />
the reactivation of the Neighbourhood Watch Scheme will be an agenda item at the next meeting.<br />
5 POLICE REPORT<br />
PC Hopkins (who was present on his day off) reported that, since the meeting in July, four crimes (three of<br />
criminal damage and one of arson) have been reported to the Police. Numerous reports concerning young<br />
people causing a disturbance in and around the lych-gate have been received and the Police have attended<br />
and dealt with those involved. PC Hopkins again stressed the serious nature of anti-social behaviour and<br />
praised local residents for their action in reporting it. In answer to a question, he said he would investigate a<br />
vehicle apparently abandoned in a field between High Cross and Ponjeravah.<br />
Speaking on behalf of the Parish Council, the Chairman thanked PC Hopkins for giving up his free time to<br />
deliver his report in person.<br />
PC Hopkins left the meeting.<br />
6 CORNWALL <strong>COUNCIL</strong>LOR’S REPORT<br />
CCllr Hatton praised PC Hopkins for his commitment, adding that he was greatly encouraged by his<br />
approach to community policing.<br />
CCllr Hatton reported that<br />
he was saddened not to have heard from Mr Isaac concerning his proposals for a badminton club<br />
the lane between High Cross and Polwheveral has been re-surfaced<br />
drainage works at Port Navas have been completed<br />
yellow paint has appeared on Bowling Green which implies that something will be done before the<br />
end of the financial year<br />
he has agreed to attend a training day which will deal with the safety aspects of spreading road salt<br />
on the public highway<br />
Speaking on behalf of the Parish Council, the Chairman offered his thanks through CCllr Hatton to County<br />
Highways for the work done during the summer on roads in the parish.<br />
7 <strong>PARISH</strong> <strong>COUNCIL</strong> MATTERS<br />
It was agreed that the Emergency Committee should meet on October 19 at 7.00pm.<br />
8 <strong>PARISH</strong> MATTERS<br />
Winter Service Provision<br />
The Clerk reported on Cornwall Council’s new policy concerning the provision and maintenance of salt bins<br />
which (because this is a discretionary service) will all be withdrawn during the summer of 2011. Parish<br />
Councils have been invited to consider whether or not to provide and maintain salt bins once Cornwall<br />
Council ceases to provide the service. Following discussion, it was agreed to express an interest to Cornwall<br />
in taking on the service and in attending a training session, but to defer making further decisions until after<br />
the Emergency Committee meeting.<br />
The garden in The Square<br />
It was noted that Mr Dawson has made a proposal for the planting of the garden in The Square and that,<br />
following publication of his proposal in Gweder Myras, there have been no comments from members of the<br />
public. Cllr Williams spoke of the cost to the Council and offered another possible solution which involved<br />
the planting of prostrate evergreen trees. It was agreed to seek quotations for both courses of action and to<br />
bring them to the meeting in October for decision. The Clerk was asked to invite both the Gardening Society<br />
and the School to become involved in this project.<br />
The extension to the car park<br />
Members noted that the meeting with the County Forester, Mr Oliver Bennett, had gone ahead as planned in<br />
August and that it had been both positive and useful. Mr Bennett had agreed to the felling of the tree which<br />
overhangs Bowling Green Road and the Clerk is now awaiting a letter from him to this effect prior to<br />
submitting a Planning Application for Tree Works. Those who attended the meeting made the following<br />
recommendations<br />

and it was agreed to progress with these recommendations as swiftly as possible.<br />
Members noted that Cllr Reynolds had, as requested, put up new signs in both the existing car park and in<br />
the extension. He was formally thanked for undertaking this work.<br />

He has received no definitive answer to his question concerning the possibility of Cornwall Council<br />
taking on responsibility for some or all of the lights so repaired.<br />
Young people<br />
Cllr Just reported that, in June, between ten and twelve youngsters had regularly attended meetings of the<br />
Youth Club when the activities had been largely recreational. In July and August, largely as a result of<br />
holiday commitments, there had only been four meetings. It has been decided to devote the first hour of<br />
future meetings of the Youth Club to the under 14 age group and then to open it to all-comers. At its<br />
expense, Cornwall Council has agreed to provide a music workshop in Constantine for eight youngsters<br />
for the next thirty-six weeks. Cllr Just was asked to convey Constantine Parish Council’s appreciation to<br />
Mr Gribble for the work he has done to secure this facility.<br />
9 PLANNING APPLICATIONS AND DECISIONS<br />

PA10/03398 Mrs D.Livingston – Conversion of barn into domestic art studio – Lower Penbothidno,<br />
Constantine. Cllr Bolt proposed, Cllr Williams seconded and it was agreed that this application should be<br />
returned with the following observation “With the proviso that a legal agreement requiring use of the studio<br />
to be incidental to the residential use of Lower Penbothidno, Constantine Parish Council raises no<br />
objections.”<br />
PA10/04720 Mr & Mrs R.Kerswell – Erection of a replacement dwelling (amended design) – Oak View,<br />
Ponjeravah. Cllr Williams proposed, Cllr Bolt seconded and it was agreed that this application should be<br />
returned with the following observation Constantine Parish Councillors support this application.<br />
PA10/04866 Mr V Beckett – Extension to dwelling – 4 Bowling Green Road, Constantine. Cllr Williams<br />
proposed, Cllr Reynolds seconded and it was agreed that this application should be returned with the<br />
following observation Constantine Parish Councillors support this application.<br />
As the son-in-law of the applicant, Cllr Nicholls declared a personal and prejudicial interest in the following<br />
application and left the room.<br />
PA10/05274 Mrs A.Gambier – Erection of a replacement cattle building – Napheane Farm, Constantine.<br />
Cllr Reynolds proposed, Cllr Bolt seconded and it was agreed that this application should be returned with<br />
the following observation Subject to the approval of the County Land Agent Constantine Parish Councillors<br />

10 CLERK’S REPORT AND CORRESPONDENCE<br />
The Clerk reported that in consultation with the Chairman, he had composed a response to the proposal to<br />
cap Town and Parish Council precepts. He explained that, if passed, legislation will allow increases above a<br />
(to be determined) level to be challenged by individuals by means of a referendum. However, proposed<br />
legislation will allow for a de minimis level which, he anticipated, will be in excess of £100,000<br />
(EU regulations allow for a de minimis sum of €300,000). It is therefore unlikely that Constantine Parish<br />
Council’s precept will fall within the scope of these proposals. This response has (as requested) been passed<br />
to the Cornwall Association of Local Councils.<br />

11 FINANCIAL MATTERS<br />
The Clerk presented Councillors with a statement of Constantine Parish Council’s financial position as at<br />
September 16, 2010. A copy of that statement is attached to these minutes.<br />
Members considered a request from the Constantine Silver Band for financial help. Following discussion, it<br />
was proposed by Cllr Just, seconded by Cllr Nicholls, and agreed that, under the terms of S137 of the Local<br />
Government Act 1972, the sum of £250 be forwarded to the Constantine Silver Band.<br />
Members considered a request from Penryn Town Council’s Clerk for sponsorship with money going<br />
towards the Merlin Project (Cornwall Multiple Sclerosis Therapy Centre). Following discussion, it was<br />
agreed that Constantine Parish Council cannot accede to this request.<br />
Members considered a request from the Cornwall County Playing Fields Association for financial help.<br />
Following discussion, it was proposed by Cllr Nicholls, seconded by Cllr Bolt all in favour that the sum of<br />
£50.00 be forwarded to the Cornwall County Playing Fields Association under the terms of Section 19(3)(a)<br />
of the Local Government (Miscellaneous Provisions) Act 1976.<br />
Members considered a request from the Cornwall Air Ambulance Trust for a donation towards the on-going<br />
costs of providing this service. It was proposed by Cllr Willaims, seconded by Cllr Just, all others in favour<br />
that the sum of £250 be forwarded to the Cornwall Air Ambulance Trust under the terms of Section 137 of<br />
the Local Government Act 1972.<br />
Members noted that, using delegated powers, a quotation in the sum of £240 from Mr Adrian Smith for<br />
crown reduction work on a cherry tree on the lane between Bowling Green and Penbothidno had been<br />
accepted.<br />
