“dispute” means any grievance or disagreement brought by a person licensed<br />
under this Part in relation to any decision made ei<strong>the</strong>r by <strong>the</strong> Comptroller or <strong>the</strong><br />
Exporters Club relating to <strong>the</strong> duty suspension scheme;<br />
“Exporters Club” means a company, associated or body <strong>of</strong> persons, corporate or<br />
unincorporate contracted by <strong>the</strong> Comptroller for <strong>the</strong> purpose <strong>of</strong> <strong>the</strong> duty<br />
suspension scheme;<br />
“legal practitioner” <strong>and</strong> “practice” have <strong>the</strong> meaning ascribed to <strong>the</strong>m by <strong>the</strong> Legal<br />
Practitioners <strong>Act</strong> 1997.<br />
PART VIII - BONDED WAREHOUSES<br />
Licensing <strong>of</strong> warehouses<br />
37. No warehouse shall be licensed at any port or place o<strong>the</strong>r than a port or place<br />
appointed by <strong>the</strong> Minister in accordance with section 4.<br />
Appointment <strong>of</strong> bonded warehouses<br />
38.—(1) (a) The Comptroller may, on application, licence any building, enclosure or storage<br />
tank as a bonded warehouse for <strong>the</strong> deposit <strong>of</strong> goods permitted to be warehoused<br />
on first importation without payment <strong>of</strong> duty, <strong>and</strong> may attach such conditions to <strong>the</strong><br />
licence as he may see fit.<br />
(b) A licence is required for each storage tank, notwithst<strong>and</strong>ing that such tank may be<br />
connected by a pipe or o<strong>the</strong>r means to any o<strong>the</strong>r tank.<br />
(2) The licence issued under subsection (1) shall be in such form as may be prescribed<br />
<strong>and</strong> shall be subject to <strong>the</strong> payment <strong>of</strong> such fees as may be prescribed.<br />
(3) A licence shall not be issued under <strong>the</strong> provisions <strong>of</strong> this section until <strong>the</strong> person who<br />
applies <strong>the</strong>refor has furnished such security for <strong>the</strong> due payment <strong>of</strong> all duties <strong>and</strong> <strong>the</strong> due observance<br />
<strong>of</strong> <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> customs laws as <strong>the</strong> Comptroller may require; <strong>and</strong> <strong>the</strong> Comptroller may, at<br />
any time, require a warehousekeeper to furnish such additional or new security as he may consider<br />
necessary for such purposes.<br />
(4) The Comptroller may at any time for reasonable cause revoke any licence, which has<br />
been issued under subsection (1).<br />
(5) A warehousekeeper who, without <strong>the</strong> previous consent in writing <strong>of</strong> <strong>the</strong> Comptroller,<br />
makes any alteration in, or addition to, a warehouse or who uses his warehouse, or permits it to be<br />
used in contravention <strong>of</strong> any <strong>of</strong> <strong>the</strong> conditions <strong>of</strong> his licence, is guilty <strong>of</strong> an <strong>of</strong>fence <strong>and</strong> is liable to a<br />
fine not exceeding $1,000.<br />
(6) An owner or occupier <strong>of</strong> a building, enclosure or storage tank who uses or permits such<br />
building, enclosure or storage tank to be used for <strong>the</strong> deposit <strong>of</strong> goods entered for warehousing while<br />
a valid licence under <strong>the</strong> provisions <strong>of</strong> this section is not in force is guilty <strong>of</strong> an <strong>of</strong>fence <strong>and</strong> is liable to<br />
