♦ (3) A person who—<br />
(a) refuses or neglects to comply with a request <strong>of</strong> <strong>the</strong> Comptroller under <strong>the</strong> provisions <strong>of</strong><br />
this section;<br />
(b) knowingly produces any false book, invoice or document;<br />
(c) knowingly makes any false representation in regard to <strong>the</strong> country in which any goods<br />
were grown, produced or manufactured; or<br />
(d) makes any false representation with intent to evade or to contravene <strong>the</strong> provisions <strong>of</strong><br />
this section,<br />
is guilty <strong>of</strong> an <strong>of</strong>fence <strong>and</strong> is liable to a fine not exceeding $2,000 or to imprisonment for 12<br />
months or to both such fine <strong>and</strong> imprisonment.<br />
Power to require ships, etc., to bring to<br />
103.—(1) The master <strong>of</strong> a ship entering <strong>Fiji</strong> or operating within <strong>Fiji</strong> shall bring his ship to for<br />
boarding on being signalled to do so by any ship in <strong>the</strong> service <strong>of</strong> <strong>the</strong> <strong>Customs</strong>, or any o<strong>the</strong>r ship in<br />
<strong>the</strong> service <strong>of</strong> <strong>Fiji</strong>.<br />
(2) The master <strong>of</strong> an aircraft entering <strong>Fiji</strong> or operating within <strong>Fiji</strong> shall l<strong>and</strong> <strong>the</strong> aircraft on being<br />
signalled to do so by a proper <strong>of</strong>ficer.<br />
(3) A ship may be fired upon if—<br />
(a) that ship is liable to forfeiture or examination pursuant to <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> customs<br />
law;<br />
(b) that ship does not bring to when so required;<br />
(c) that ship has been chased by a ship in <strong>the</strong> service <strong>of</strong> <strong>the</strong> <strong>Customs</strong> or in <strong>the</strong> service <strong>of</strong><br />
<strong>Fiji</strong>, which has flown <strong>the</strong> proper flag <strong>and</strong> fired a gun as a signal; <strong>and</strong><br />
(d) that ship continues to fail to bring to.<br />
(4) A master <strong>of</strong> an aircraft or ship who contravenes any <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> this section is guilty<br />
<strong>of</strong> an <strong>of</strong>fence <strong>and</strong> is—<br />
(a) in <strong>the</strong> case <strong>of</strong> <strong>the</strong> master <strong>of</strong> a light aircraft or a ship <strong>of</strong> less than 250 tonnes register,<br />
liable to a fine not exceeding $10,000, <strong>and</strong> <strong>the</strong> aircraft or ship in respect <strong>of</strong> which <strong>the</strong><br />
<strong>of</strong>fence is committed is liable to forfeiture;<br />
(b) in <strong>the</strong> case <strong>of</strong> <strong>the</strong> master <strong>of</strong> an aircraft o<strong>the</strong>r than a light aircraft, or <strong>of</strong> a ship <strong>of</strong> 250<br />
tonnes register or more, liable to a fine not exceeding $50,000; <strong>and</strong> <strong>the</strong> aircraft or ship in<br />
respect <strong>of</strong> which <strong>the</strong> <strong>of</strong>fence is committed may be seized <strong>and</strong> detained until <strong>the</strong> fine is<br />
paid or satisfactory security <strong>the</strong>refor is given.<br />
(5) In this section "light aircraft" means an aircraft licensed to carry less than 8 passengers.<br />
Power to board ship, etc., <strong>and</strong> search<br />
104.—(1) A proper <strong>of</strong>ficer may, in <strong>the</strong> course <strong>of</strong> his duty, board <strong>and</strong> search any aircraft or ship<br />
within <strong>Fiji</strong> <strong>and</strong> may require <strong>the</strong> master <strong>of</strong> any such aircraft or ship to produce documents <strong>and</strong> answer<br />
questions relating to such aircraft or ship, its cargo, stores, baggage, crew <strong>and</strong> passengers, <strong>and</strong> may<br />
examine, lock-up, seal, mark, or o<strong>the</strong>rwise secure any goods on such aircraft or ship; <strong>and</strong> for <strong>the</strong><br />
purpose <strong>of</strong> <strong>the</strong> examination or security <strong>of</strong> any goods, he may require <strong>the</strong>m to be unloaded or<br />
removed to a customs warehouse at <strong>the</strong> expense <strong>of</strong> <strong>the</strong> master <strong>of</strong> <strong>the</strong> aircraft or ship.<br />
(2) An <strong>of</strong>ficer may at <strong>the</strong> risk <strong>of</strong> <strong>the</strong> owner open packages <strong>and</strong> examine, weigh, mark <strong>and</strong> seal<br />
