Ken Sauter, Esq., CCAL Hill Wallack, LLP 2015 CAI-NJ President “The LAC is constantly educating our legislators regarding the needs of our members.” This edition of Community Trends ® highlights the Chapter’s Legislative Action Committee (LAC). I am certain that most of us are aware of the LAC’s efforts, but for those who may not be aware, its duties include reviewing pending legislation to determine whether such legislation is in the best interest of our members and also proposing legislation to serve our members. Having served on the LAC for several years, including two years as its Chair, I can attest to the hard work by its members and the need for constant vigilance of our legislators and the legislative process. We frequently find that our legislators fail to recognize and understand the needs of community association members and the differences between condominiums, townhomes, cooperatives, and other single family residences. I am amazed at how frequently one resident’s experience and complaint with a community association results in “overkill” legislation, to the detriment of our members generally. The LAC is constantly educating our legislators regarding the needs of our members. Unfortunately, the LAC must also spend a significant amount of time objecting to and seeking modifications to legislation that is harmful to our members, misplaced, or simply unnecessary. Recent LAC efforts include amendments and clarifications to legislation regarding notification of next of kin (A3630), clarification and support of bills expediting foreclosure of vacant (abandoned) properties (A3793/S2545) and uncontested foreclosure (A4075) and the pursuit of manager licensing (S1367). All of these laws would or will serve and promote the interests of members and residents of community associations in New Jersey. The LAC also regularly provides programs updating our members on legislative matters. Please be sure to follow the legislative update column in Community Trends ® . As I prepare this column, the Chapter is about to sign a lease for new and larger space for the Chapter offices in Freehold. The space will be able to accommodate committee meetings and Chapter programs, and the Chapter was also able to substantially reduce the rent and related costs. We expect the new office to be fully operational by November 1st. As we approach the years end, please be sure to watch for the committee sign up forms. It starts with the board, filters down to the staff, then to the involved committees and finally to the exhibitors and attendees. If we don’t have cohesion with all of the above groups, these events would not be as popular or successful as they are. So moving on from the conference weekend, we still have a lot of events for the remainder of the year. Please check our “Save the Date” on page 7 of this issue of Community Trends ® . Since this is the annual Legislative issue, I would be remiss if I didn’t recognize all of the efforts of our LAC and PAC Committees. The LAC is a collection of industry experts with years of experience in the community management field. This is a very passionate group of professionals dedicated to enhancing the quality of life for those that live in our common interest communities. This month, we are welcoming a new member to the LAC committee. Paul Reich was appointed to the LAC Committee at the September 11th meeting. Paul is the president of the Woods Landings at Mays Landing Community located in Mays Landing. Paul is president of the board and has an extensive managerial and legislative background. I am especially excited to have Paul on the committee so that we can get “a voice” from our southern part of the State. Paul will assume a CAVL seat that was created by the resignation of Myrna Reiter. I also want to thank Myrna for her service and contributions to our LAC Committee. So, please take the time and read the many articles in this issue. They contain the most upto-date information concerning the many legislative issues that we are currently facing.
