Introduction<br />

This guide explains how you can apply to the <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong> (NSNP) through the <strong>Community</strong><br />

<strong>Identified</strong> stream to be nominated for permanent residence. The NSNP is an immigration recruitment and<br />

selection program that allows the Government of <strong>Nova</strong> <strong>Scotia</strong> to nominate to the Canadian government<br />

individuals who can meet the provincial labour market and economic needs and who intend to establish<br />

themselves in <strong>Nova</strong> <strong>Scotia</strong>. A <strong>Nominee</strong>, along with his or her spouse and dependents, approved under this<br />

program may become permanent residents of Canada following approval by the Canadian government. This<br />

stream is part of an economic immigration program, and is not intended to be used for family reunification.<br />

The <strong>Community</strong> <strong>Identified</strong> stream is aimed at selecting individuals who have strong, established connections to<br />

a <strong>Nova</strong> <strong>Scotia</strong> community and wish to live there permanently. They are employable and can contribute to the<br />

labour market and economy of that specific community.<br />

The applicant must have a Letter of Identification from an organization mandated by the Office of Immigration<br />

before submitting an application to the <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong>. The list of mandated organization is<br />

found in Appendix 3.<br />

Three Step Process<br />

Step 1: Contact a Mandated <strong>Community</strong> <strong>Identified</strong> Organization<br />

The Office of Immigration has mandated several <strong>Nova</strong> <strong>Scotia</strong> organizations to help in identifying suitable<br />

candidates to the <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong>. If you wish to apply to the <strong>Community</strong> <strong>Identified</strong> stream, you<br />

must first obtain a Letter of Identification from a mandated organization prior to submitting an application.<br />

Step 2: Application to the <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong><br />

If you are eligible to apply to the nominee program, you must submit a complete application package. The<br />

processing time for completed applications eligible for consideration can take up to two months or more<br />

depending on the volume of applications received and the time required for verifications of documents included<br />

in the application. Nomination under the NSNP is at the sole discretion of the <strong>Nova</strong> <strong>Scotia</strong> Office of Immigration.<br />

Step 3: Application to Citizenship and Immigration Canada for a Permanent Resident Visa<br />

If you are nominated by the Province of <strong>Nova</strong> <strong>Scotia</strong>, you may then apply for a permanent resident visa to the<br />

Government of Canada, through Citizenship and Immigration Canada (CIC), as a <strong>Nova</strong> <strong>Scotia</strong> Provincial<br />

<strong>Nominee</strong>. In this case, you will send your application to the CIC Centralized Intake Office in Sydney, <strong>Nova</strong><br />

<strong>Scotia</strong>, Canada. In your application, you must also select the visa office where you are requesting for your<br />

application to be processed. It can be the Canadian visa office for your country of nationality, citizenship or legal<br />

residence.<br />

In some cases, you may be asked to go for an interview. You, your spouse and dependents must meet statutory<br />

requirements for medical, security and criminal admissibility. CIC has the final authority to issue a permanent<br />

resident visa.<br />

Occupations<br />

The Office of Immigration does not have a specific occupation or skill shortage list. The Office of Immigration<br />

uses the National Occupation Classification (NOC) to classify jobs according to duties, formal qualifications and<br />

experience specified by the employer. The NOC helps determine whether a job meets the skill levels established<br />

for skilled and semi-skilled worker occupations, and whether the candidate’s qualifications and experience<br />

match the requirements of the job. The NOC Matrix provides an overview of the entire occupational classification<br />

structure based on skill levels and skill types. For more details on NOC skill levels, please visit<br />

The Office of Immigration differentiates between skilled workers, semi-skilled and low-skilled workers.<br />

Skilled workers are defined as individuals with occupation within NOC skill levels O, A or B. Priority will be<br />

awarded to these higher skilled occupations.<br />

Semi-skilled workers have occupations that fall under the NOC skill level C occupations. The Office of<br />

Immigration may consider applications based on local labour market requirement and conditions, and six (6)<br />

months of work with the <strong>Nova</strong> <strong>Scotia</strong> employer supporting the application.<br />

At this time, under the <strong>Community</strong> <strong>Identified</strong> stream, the Office of Immigration will not consider low-skilled<br />

occupations that fall under the NOC skill level D.<br />

The Office of Immigration reserves the right to consider only certain types of jobs and occupations for<br />

nomination. This decision will depend on the current economic situation of the <strong>Nova</strong> <strong>Scotia</strong> labour market needs.<br />

Language Standards and Mandatory Testing<br />

As of July 1 st , 2012, Citizenship and Immigration Canada is requiring that all applicants in NOC skill level C<br />

occupations must achieve a minimum standard of Canadian Language Benchmark (CLB) 4 across all four<br />

categories: listening, reading, writing and speaking. Applicants must submit official language test results with<br />

their application to the <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong>.<br />

The <strong>Nova</strong> <strong>Scotia</strong> Office of Immigration will only consider results from designated testing agency. The acceptable<br />

tests are:<br />

• the International English Language Testing System (IELTS) General Training;<br />

• the Canadian English Language Proficiency Index <strong>Program</strong> (CELPIP-General;<br />

mostly in Western Canada – http://www.celpiptest.ca/for-test-takers/registration-information<br />

• the Test d’évaluation de français (TEF)<br />

http://www.francais.ccip.fr/etudiant<br />

No other evidence of language proficiency will be accepted. Language tests have to be no more than two years<br />

old at the date of application to the <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong>.<br />

Exceptions<br />

Temporary Foreign Workers in NOC C and D occupations who arrived in Canada on or before July 1 st , 2012 and<br />

who are nominated under the <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong> before July 1 st , 2013 are exempt from this new<br />

language requirement.<br />

Fees<br />

There is no provincial application fee under the <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong> (NSNP). You must, however, pay<br />

all the required Government of Canada immigration fees when you submit your file to Citizenship and<br />

Immigration Canada (CIC).<br />

Criteria and Requirements for the Principal Applicant<br />

The spouse, common-law partner or conjugal partner, and children, if applicable, can be included as accompanying<br />

dependents.<br />

date of application in an area of employment or sector required by the community. This work<br />

experience does not have to be in Canada. The evidence of work experience or transferable<br />

skills will be verified by certified education documents and/or work experience via your resume or<br />

curriculum vitae (CV) and supporting employment documents.<br />

You have completed the equivalent to a Canadian high school diploma with a minimum of 12<br />

years of education and/or training from a recognized institution and/or authority, PLUS have<br />

completed a minimum of one year post-secondary education or training program at a postsecondary<br />

level (tertiary) AND have received a diploma, certificate or degree; and<br />

You have relevant skills and training for your future employment in a field or sector required by<br />

the community.<br />

For occupations requiring licensing or certification in <strong>Nova</strong> <strong>Scotia</strong>, please contact the<br />

appropriate provincial, national and/or industry regulatory association prior to applying to verify<br />

that you meet licensing or certification requirements. 1<br />

The Office of Immigration may require you to obtain, at your own cost, an evaluation of your<br />

education and training from an authorized Canadian organization specializing in credential<br />

assessment.<br />

Language ability For NOC Skill Levels O, A and B<br />

If your first language is not English or French, your written proof or explanation must clearly show<br />

that you meet the criteria listed in the Canadian Language Benchmarks (CLB) or Niveaux de<br />

compétence linguistique canadiens (NCLC) for at least CLB/NCLC level 5.:<br />

Your abilities are verified by one or more of the following:<br />

� Educational transcripts or other documentation indicating English or French as the<br />

principal language of instruction or communication.<br />

� Employment history and references with English or French as the principal language of<br />

For NOC Skill Level C<br />

Even if your first language is English or French, you must submit an internationally recognized<br />

test results to prove a CLB/NCL level 4.<br />

• Canadian English Language Proficiency Index <strong>Program</strong> (CELPIP); or<br />

• Test d’évaluation de français (TEF), General Training.<br />

See above section Language Standards and Mandatory Testing for more information.<br />

The NSNP Officer must be satisfied that you have both a strong, established connection to the<br />

community, and you have strong employability potential in <strong>Nova</strong> <strong>Scotia</strong> which will allow you to<br />

settle successfully and permanently in the province. You can satisfactorily demonstrate to the<br />

Province your genuine intention and ability to settle permanently in the <strong>Nova</strong> <strong>Scotia</strong> community<br />

which provided the Letter of Identification. You must also provide a Letter of Intent which<br />

outlines your employability and your potential social, economic and labour market contributions<br />

to that community. You must also demonstrate your long established association to the <strong>Nova</strong><br />

<strong>Scotia</strong> community by a combination of the following:<br />

• have close family relations in the community<br />

• have resided in the community for extended periods in the past<br />

• have business connections and activities in the community<br />

• have significant community connections<br />

When assessing an applicant’s adaptability and employability, the Office of Immigration will<br />

consider the current <strong>Nova</strong> <strong>Scotia</strong> labour market conditions and requirements for job prospects.<br />

You need to demonstrate your efforts to secure employment by providing, for example:<br />

• Identification of your current and future occupation<br />

• Identification of your future business plans<br />

• Information about your research in the community<br />

• Contacts with professional organizations regarding the recognition of your credentials<br />

• Other relevant information<br />

The Office of Immigration may request additional information and evidence from you, may<br />

require an in person interview, and may conduct interviews with third parties during the<br />

assessment process.<br />

You can demonstrate that you have sufficient settlement supports and financial resources,<br />

including transferable funds in your name or your spouse’s, in order to pay your immigration<br />

costs and travel expenses (if applicable) and to successfully establish yourself and your family.<br />

The Office of Immigration recommends for an individual without arranged employment to meet<br />

the Statistics Canada Low-Income Cut-Off (LICO) minimum requirements for their net worth. See<br />

Table 3 at Low-Income Cut-Off.<br />

When Not to Apply<br />

To apply under the <strong>Community</strong> <strong>Identified</strong> stream, the applicant cannot be eligible for any other NSNP<br />

streams.<br />

The Office of Immigration will not consider as principal applicants under this stream:<br />

• Parents, spouses, common-law or conjugal partners of Canadian citizens or permanent residents.<br />

These individuals are encouraged to apply under the federal Family Class which exists for this purpose.<br />

• Individuals who are living in Canada and are a refugee claimant, failed refugee claimant or an applicant<br />

under humanitarian and compassionate grounds.<br />

• Individuals who are in Canada illegally, are under a removal order in Canada, or are prohibited from<br />

entering or being in Canada due to their inadmissibility.<br />

• International students enrolled in a Canadian post-secondary education program.<br />

• If the principal applicants’ spouses or common law partners or conjugal partners are international<br />

students in a Canadian post-secondary institution and are not in their last year of studies.<br />

• Individuals with unresolved custody or child support disputes affecting any dependent.<br />

• Seasonal, part-time or casual workers.<br />

• Sales positions that are based solely on commission for compensation.<br />

• Helpers and labourers in construction, agriculture and primary resources sectors.<br />

• Child minding or elder care services or live in caregiver services for the employer - in this case they<br />

should apply under the federal Live-In Caregiver class.<br />

• Jobs that are not based in <strong>Nova</strong> <strong>Scotia</strong>.<br />

• Passive Investors – individuals who intend to invest in a <strong>Nova</strong> <strong>Scotia</strong> business with very limited or no<br />

involvement in the day-to-day management of the business.<br />

Application and Assessment Process<br />

If you meet all the eligibility criteria, you can prepare and submit a complete application package to the <strong>Nova</strong><br />

<strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong> (NSNP). You must notify the Office of Immigration of any changes in your status<br />

or eligibility criteria for this stream.<br />

1. The principal applicant contacts a <strong>Community</strong> <strong>Identified</strong> mandated organization<br />

If you meet all the criteria described in the section Criteria and Requirements for the Principal Applicant, you can contact<br />

the appropriate <strong>Community</strong> <strong>Identified</strong> mandated organization as listed in Appendix 3. The organization may require that<br />

you provide documentation for assessment purposes. It may also request letters of support identifying your connections<br />

and social contribution to the community, as well as an interview, in order to make a decision. As the requirements may<br />

vary, it is important that you check directly with the organization.<br />

If the <strong>Community</strong> <strong>Identified</strong> mandated organization is satisfied that you are a suitable candidate under the NSNP<br />

requirements, and can meet community specific labour market priorities, the organization will issue a Letter of Identification<br />

in your name. The Letter of Identification is sent by the organization directly to the <strong>Nova</strong> <strong>Scotia</strong> Office of Immigration with a<br />

copy to you. This letter is valid for a period of one year from the date of the letter.<br />

The issuance of a Letter of Identification from the <strong>Community</strong> <strong>Identified</strong> mandated organization is at the sole discretion of<br />

the organization. In addition, the provision of the Letter of Identification does not guarantee that you will be nominated or<br />

that you will receive a permanent resident visa.<br />

2. The principal applicant prepares an application<br />

Carefully read the application guide. You must gather and prepare all your application materials.<br />

• NSNP application forms<br />

• Government of Canada forms (Citizenship and Immigration Canada)<br />

• Supporting Documents<br />

Please refer to Appendix 1 – Document Checklist.<br />

Eligible family members included in the application are called “dependents” and include:<br />

• Spouse (legal marriage)<br />

• Common-law/conjugal partnership of at least one year, 2<br />

• Dependent children: Daughters and sons, including children adopted before the age of 18, who:<br />

o are under the age of 22 and do not have a spouse or common-law partner;<br />

o have been continuously enrolled as full-time students and financially supported by their parents<br />

since turning 22 (or from the date of becoming a spouse or common-law partner if this happened<br />

before the age of 22); or<br />

2 You are a common-law partner either of the opposite sex or same sex if you have been living together in a conjugal relationship for at least one year<br />

in a continuous, non-interrupted 12-month period. You are a conjugal partner if you have maintained a conjugal relationship for at least one year and<br />

you have been prevented from living together or marrying if you can provide evidence there was a satisfactory reason you could not live together. You<br />

will need to complete a Statutory Declaration of Common-Law Union [IMM 5409] at http://www.cic.gc.ca/english/pdf/kits/forms/IMM5409E.PDF<br />

Supporting Documents<br />

o have substantially depended on the financial support of their parents since before turning 22 and<br />

are unable to support themselves due to a medical condition.<br />

Where the documents are not in English or in French, the principal applicant must submit a photocopy of the original<br />

document and a photocopy of the certified translation.<br />

The Office of Immigration will only accept translations prepared by certified translators. Translators must be certified by a<br />

regulatory body and cannot be a family member of the applicant or spouse, or common-law or conjugal partner, or work for<br />

a paid consultant or representative who is preparing the application. The applicant must also supply proof from the<br />

translator describing their translation ability or certification.<br />

3. Submit the complete application to the <strong>Nova</strong> <strong>Scotia</strong> Office of Immigration<br />

1. Combine the required documents for the principal applicant into a complete application package:<br />

- Original NSNP 100 Application Form<br />

- Photocopies of the Citizenship and Immigration Canada (CIC) forms<br />

- Photocopies of supporting documents<br />

- If applicable, one original NSNP 50 Use of a Representative<br />

- If applicable, one original NSNP 60 Authority to Release Personal Information to a Designated Individual<br />

If you are using a paid immigration representative to conduct business on your behalf with the Province of <strong>Nova</strong><br />

<strong>Scotia</strong>, that individual must be either:<br />

− an immigration consultant who is a member in good standing of the Immigration Consultants of Canada<br />

Regulatory Council (ICCRC); or<br />

− a lawyer or paralegal who is a member in good standing of a Canadian Law Society or a student-at-law<br />

under the supervision of a recognized lawyer; or<br />

− a notary public who is a member in good standing of the Chambre des notaires du Québec and a<br />

student-at-law under their supervision.<br />

WARNING: Payment to an individual who is not regulated as above offers no legal opportunity for complaint and is strongly<br />

discouraged by this office. The Office of Immigration will not deal with non-authorized representatives.<br />

2. Review and organize your completed forms and supporting documents according to Appendix 1 – Documents<br />

Checklist. It is your responsibility to submit all requested documents. If documents are missing, not translated by a<br />

certified translator, or are not clear, your application may not be assessed.<br />

When preparing your application package do NOT:<br />

- send double-sided copies<br />

- bind your application or put the pages in a ring binder<br />

- enclose individual pages in plastic, envelopes or folders<br />

- tie, sew, bolt, or glue the pages together,<br />

- use multiple staples on a page,<br />

- send multiple copies of identical documents.<br />

3. PHOTOCOPY all your completed forms and supporting documents and keep these copies for your records.<br />

4. Mail or drop off your complete application package to the <strong>Nova</strong> <strong>Scotia</strong> Office of Immigration. The address can be found<br />

at the end of this application guide.<br />

4. The application is assessed by the <strong>Nova</strong> <strong>Scotia</strong> Office of Immigration<br />

A. Eligibility and completion check<br />

The Office of Immigration will review your application to ensure that it is complete and meets eligibility criteria before it is<br />

accepted for assessment. If your application is not complete or if you do not meet basic eligibility requirements, your<br />

application will be returned.<br />

B. Assessment<br />

The Office of Immigration will conduct a full review and evaluation of the complete application. The Office of Immigration<br />

reserves the right to request an interview with the applicant to gather additional information or to clarify information<br />

provided.<br />

C. Decision<br />

The Office of Immigration will communicate the decision in writing to the applicant or their representative. If nominated by<br />

the Province of <strong>Nova</strong> <strong>Scotia</strong>:<br />

� the applicant will receive a letter from the Office of Immigration to confirm that a Nomination has been issued;<br />

and<br />

� the Proof of Nomination will be sent directly to the appropriate Canadian visa office by the Office of Immigration.<br />

Please note: the Proof of Nomination expires 6 months after the date of issuance.<br />

D. Refusal<br />

If the application is being considered for refusal, the applicant or their representative will receive an initial letter of Intent for<br />

Refusal from the Office of Immigration. The Intent for Refusal letter gives the opportunity to provide additional information<br />

to be considered in the recommendation. The applicant has 30 days to submit additional information.<br />

After 30 days, the file will be re-assessed, including any new information submitted and a final decision made. This<br />

decision is sent in writing. There is no appeal process. Nomination is at the sole discretion of the Office of Immigration.<br />

The <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong> is only one means of applying for permanent resident status in Canada. We<br />

encourage applicants to explore alternatives at the Citizenship and Immigration Canada website www.cic.gc.ca<br />

5. Temporary work permit for provincial nominees<br />

Please note: If you are not applying for a temporary work permit, please proceed to n o 6.<br />

If nominated by the Province of <strong>Nova</strong> <strong>Scotia</strong>, it is possible to request a letter from the Office of Immigration to support the<br />

application of a work permit or the renewal of an existing temporary work permit. This letter of support replaces the labour<br />

market opinion (LMO) from Service Canada in applying for the new work permit.<br />

This request should not be submitted until within three (3) months of the expiry of the current work permit, if applicable.<br />

Also, Citizenship and Immigration Canada cannot authorize status documents (e.g. work permit), if the individual’s<br />

passport will not be valid during the requested time frame.<br />

The work permit will enable the applicant to continue working in <strong>Nova</strong> <strong>Scotia</strong> while the application for a permanent resident<br />

visa is being processed at the Canadian visa office. Please contact the Office of Immigration.<br />

6. If nominated, the applicant applies for a permanent resident visa<br />

If nominated by the Province of <strong>Nova</strong> <strong>Scotia</strong>, then you, the applicant, are responsible for submitting a complete application<br />

for a permanent resident visa to the Centralized Intake Office as indicated in the Office of Immigration’s Letter of<br />

Nomination, within 6 (six) months.<br />

A nomination by the Province of <strong>Nova</strong> <strong>Scotia</strong> does not guarantee that a permanent resident visa will be issued.<br />

Citizenship and Immigration Canada makes the final decision for the granting of permanent resident visas after ensuring<br />

that all legislative requirements are met, including medical, criminality and security checks.<br />

The Office of Immigration may withdraw the nomination at any time prior to the issuance of the permanent resident visa<br />

and prior to landing in Canada if:<br />

• Citizenship and Immigration Canada finds that you or a dependent is inadmissible as a result of medical,<br />

criminality, security checks or valid passport; or<br />

• The Office of Immigration is advised by the Canadian visa office that any information provided in the application is<br />

false or fraudulent.<br />

• The applicant does not meet minimum eligibility requirements of the NSNP anymore.<br />

7. Issuance of permanent resident visa<br />

If approved by the visa office, you, your spouse and dependents will be issued a Confirmation of Permanent Residence.<br />

You must contact the <strong>Nova</strong> <strong>Scotia</strong> Office of Immigration within 30 days of your arrival.<br />

You must provide the Office of Immigration with a copy of the Confirmation of Permanent Residence, as well as a current<br />

<strong>Nova</strong> <strong>Scotia</strong> address and contact information such as phone number(s) and email address.<br />

Use this form is to demonstrate and indicate your common-law relationship<br />

and make a solemn declaration before a commissioner of oath.<br />

This form must be completed by the principal applicant whether or not you<br />

have travelled outside your country of origin or of residence.<br />

List all trips you, and if applicable, your family members have taken outside<br />

your country of origin or of residence in the last ten years (or since your<br />

18th birthday if this was less than ten years ago). Include all trips: tourism,<br />

business, training, etc. If you or your family member did not travel outside<br />

of your country during this period, check "did not travel".<br />

Optional. Use this form if you wish to have your application information sent<br />

to a designated individual other than yourself or your representative.<br />

The individual you designate will be able to obtain information on your case<br />

file, such as the status of your application. However, he or she will not be a<br />

representative who can conduct business on your behalf with Citizenship<br />

and Immigration Canada.<br />

This form must be completed by the principal applicant and by all<br />

Where documents are not in English or in French, the principal applicant must submit a copy of the original document and<br />

a certified translation of the document.<br />

Travel Documents, Passports and Visas For the principal applicant, spouse, common-law or conjugal partner,<br />

and all accompanying dependents.<br />

� Valid regular passport. Include only copies of pages showing the<br />

passport number, date of issue and expiry, your photo, name, date<br />

and place of birth, and any previous visas and/or visits to Canada.<br />

In order to ensure successful immigration processing, it is<br />

recommended that passports have an expiry date no less than two<br />

years from the date of your <strong>Nova</strong> <strong>Scotia</strong> <strong>Nominee</strong> <strong>Program</strong><br />

application.<br />

� If you live in a country other than your country of nationality,<br />

include a photocopy of your visa for the country where you<br />

currently live.<br />

� All previous temporary residence permits, if applicable and<br />

available.<br />

� Correspondence from previous attempts to immigrate to Canada<br />

through provincial or federal immigration categories. Please include<br />

correspondence received from the provincial or Canadian<br />

government associated with each previous application.<br />

Identity and Civil Status Documents � One colour passport sized photograph for each family member.<br />

� Birth certificates for the principal applicant, spouse, common-law or<br />

conjugal partner.<br />

� Final divorce, annulment or separation documents for you and your<br />
