close, once again, we take a 

glance back and remember 

some of those good times. 

This summer the Evergreen 

Idol competition was 

held around the region, and 

as in the past, the winner got 

to sing in front of thousands 

of screaming fans before the 

main event. This year was 

special, as the band the winner 

opened for was none other 

than the legendary Queensryche! 

One of the most popular 

karaoke songs sang, "Silent 

Lucidity", is the song that 

Queensryche is most famous 

for. The fact that they're from 

the Seattle area makes it even

Karaoke heats up at 

Hot Iron Bar & Grill 

Finally, karaoke has returned to 

the downtown Bremerton area. 

Mary Hoffman, Hoffman Entertainment, 

brings her entertaining karaoke 

show to the Hot Iron Grill, 610 

North Callow Avenue, every Sunday, 

Monday and Tuesday night. 

The bar and restaurant itself has 

undergone a major renovation, including 

the expansion of the bar, and creating a 

large dance floor and enough space for 

several pool tables. The Hot Iron Grill 

offers a wide range of lunch and dinner 

entrées, specializing in Mongolian Grill 

cuisine. The bar also has a full appetizer 

menu available while you enjoy the 

live entertainment. 

For karaoke fans, the highlight is 

the Hoffman Entertainment karaoke 

show. Mary, along with husband Tim, 

certainly know how to put on a show. 

Many will remember Mary for her time 

hosting at the 19th Hole in Bremerton. 

In July, she picked up and moved the 

whole karaoke show to the Hot Iron 

Grill in busy downtown Bremerton. 

The songbook is one of the most 

complete you will find anywhere, with

Remember back in the day, 

when you’d go out and find your favorite 

bar packed with party-people? 

Way back when it was standing room 

only, but you didn’t care, there was 

always too much to see and do right 

from within your own square foot 

of standing room. You’d just spin 

around and take care of business. 

Well, for one very special bar 

on Seattle’s Greenlake, Little Red 

Hen, this is still a reality, even on 

the heels of… a recession? 

Beautiful college-aged people by 

the hundreds, young, excited, shoulder 

to shoulder, sharing an evening 

of random serendipitous splendor 

and steroidal socializing.

Popped into Jack’s Pub up in the 

Renton Highlands, at 3901 NE 4th, 

and met Carol Potvin. A lovely lady 

with flowing blonde hair and a catchy 

last name to boot. 

Carol’s been running Jack’s 

karaoke since February of this year. 

She’s got her own karaoke room off the 

main part of the sportsbar. In here, 

it’s tables and chairs, a stage, and 

Carol caring for her faithfuls. And 

she really does too, she has a special 

relationship with just about everyone 

in Mount Vernon! 

Every Sunday at Draft Pics 

you can find the best in karaoke 

entertainment and awesome service. 

There’s no question that Sunday 

nights will once again be on the top 

of your list for karaoke fun. 

Beginning in September, you 

are invited to participate in the "Skagit 

Idol Contest". We are looking for 

our own Idol, and you could be it! 

Along with huge prizes, a vacation 

package and ca$h, there will be 

guest judges in the music industry 

to choose our winners.

everybody happy. Carol works hard to 

engage her audience and that’s why 

people are gravitating toward her 

Thursday nights. 

Carol is an accomplished Jazz 

singer and will round out a rotation 

with a Norah Jones number and the 

crowd melts. It’s a real treat to hear 

her perform. 

But the job at hand is to hand the 

mic over to you. Carol’s room has been 

growing, but there’s plenty of slots for 

singin’. The whole bar staff is extra 

supportive of the karaoke and really 

love Carol. 

The full menu is served at your 

table, and the food is real quality. 

Sit close or off to the side, and your 

experience is comfortable. You can 

still talk over the music, which is 

surprisingly robust in the dedicated 

karaoke room. 

My crap took over, like two full 

tables - I was all spread out and Brynn 

sits down at a table next to one of 

mine. She was gonna do some singin, I 

could tell. And she did. Outstanding. 

Then Garrett, aka; Barbie gets 

up there and blows us away. I don’t 

even remember what he sang, but I 

know I liked it! 

Meanwhile, Joe’s up there flirtin’ 

with Carol, trying to choose a song. 

When he sang, the whole room responded. 

He sounded awesome. 

Chuck and Debra are my new 

friends. They were along the wall in a 

booth. Now, these two were currently 

on their thirteenth night straight of 

karaoke! That’s gotta be a record.

Contest Finale at skagit County Fair

The Skagit County Fair, for the 

first time in it’s 114 years in existence, 

finally decided to add a karaoke show 

and contest to their wide array of entertainment 

this year. It went off like 

a rocket, a huge turnout of eager singers 

ready to compete for that coveted 

first place spot and win a thousand 

bucks! 

Over $2,000 was awarded on the 

final night to a total of ten contestants. 

Folks young, old and in between 

participated, part of the beauty in a 

fair setting. Contestants as young as 

six years old got up there and gave it 

a shot - and yes, some did make it to 

the finals. In fact, the grand prize winner 

turned out to be Jordan Cook, a 

16 year old sweetheart who had never 

participated in an actual karaoke 

contest before in her life. 

These were the winners: 

1st place - Jordan Cook, $1000 

2nd place -Tony Cea, $500 

3rd place - Shadow Redington, $150 

4th place - Jenna Ruud, $100 

5th place - Jason Stone, $50 

6th place - Kitty Hughes, $50 

7th place - Bonnie Geveshausen, $50 

8th place - Bobby Dean, $50 

9th place - Joey Wasson, $50 

10th place - Jeff Pearson, $50 

Congratulations to all of the winners 

and participants who gave it their 

all and put on a truly exciting show for 

the extra large crowd of onlookers. After 

the karaoke final contest was held, 

Ted Vigil, a ringer for John Denver, 

played and sang Denver’s classics. He 

had everyone in the crowd mooing, 

oinking and singing along to some 

great old favorites, and captivated 

the hearts of all with his astonishing 

voice and John Denver mannerisms. 

Even the adults were participating in 

the “grandma’s featherbed” tune, and 

he remarked to us afterwards that 

it was his best crowd, and most fun 

crowd response he’s ever had. Way to 

go Skagit County fairgoers! 

Alongside the karaoke show, the 

fair held a ‘find Flo at the fair’ event, 

where traffic goddess Flo from KMPS 

94.1 traveled around in a sponsored

about. If you have to be addicted

is not a bad thing. In fact, 

I think it’s a GRRRREAT thing. Having 

gone to Toastmasters trying to gain

regulars at the many karaoke shows 

but still haven’t built up the courage 

to sing, they are already addicted and 

it’s just a matter of time before they’ll 

get up there and try. So they might as 

well take the leap and do it now and 

not wait the three years it took me 

before I got the nerve to try it. 

My true litmus test is if you can 

sing “Happy Birthday.” If you really 

truly don’t ever even sing this 

well known song with just family and 

friends, then maybe karaoke is not for 

you. Otherwise, it starts with just one 

song, like one from your high school 

days where you actually know all the 

words and sing it in the shower or whenever 

you feel like bursting into song. 

If you are truly gutless, for the 

first time, go up with a friend and 

more or less pretend you’re singing. I 

have met countless numbers of singers 

who were told by their parents or 

children, they should never sing. Yet 

today, after getting up time after time, 

they are awesome singers. It’s true, 

practice makes perfect. 

When you walk up to the stage 

for the first time, here’s what you can 

expect. No matter if there is just one 

or two people in the room when you 

submitted the song and the singers 

were kind of average, the room with 

fill up with a crowd and your name will 

be called after a professional sounding 

singer just finishes their performance.

deter from your goal. Just tell Murphy 

to back off. You’re trying to have a new 

personal growth experience. 

Even if it’s a cold night, you’re 

going to feel 20 degrees hotter instantaneously. 

You’ll have a death grip on 

the microphone. Nervous? Definitely! 

I sometimes murmur on my way up 

to the stage “earplugs, five dollars” 

to anyone on the way up to the stage. 

That way, if I bomb, I can always say, 

“should have bought those earplugs” 

on the way back to my chair. 

If there is a stage, pay attention 

to getting up there without making 

a fool of yourself. The first (and only 

time) I went to the Seattle Dance Club, 

I tripped walking into the room on the 

corner of the dance floor. Tripping and 

falling isn’t something I usually do but 

I wasn’t watching where I was going 

and falling into a dance club with 

professional dancers’ all eyes was excruciatingly 

embarrassing. You don’t 

want that! Ideally, position yourself 

so you can read the words yet not put 

your back to the crowd majority. It’s a 

bit rude to turn your back on everyone 

but hey, if that’s what you need to do 

to transition into being a singer versus 

a wanna-be, go for it. 

With the microphone in your hand 

and up to your mouth, make a quiet 

click, say “test,” or something to check 

the microphone. The wireless ones 

running on batteries need to get their 

batteries changed quite frequently. I 

usually just do a little finger tap. 

And here is the most important 

thing I can share with you. Even 

though you are a karaoke virgin (as 

they love to call you), hold that mike 

up to your mouth when you sing. A 

timid singer holding the mike too far 

away cannot hear themselves so you 

think you sound terrible, the audience 

can’t hear you and you’re going to feel 

like a failure. If you can actually hear 

yourself, you’re going to do a better job. 

As you sing, if you are having a hard 

time doing that, move around a bit 

until you find the sweet spot in front 

of a speaker. 

If you are one of those people 

whom I greatly admire and can actually 

sing AND dance, or even move or 

gesture while singing, you are ahead 

of all of us who can’t. Having a great 

voice is only a part of getting up and 

performing. One act I’ll always remember 

is a young girl singing “Working at 

the Car Wash” who worked the whole 

room dancing around and flirting with 

everyone. Her singing wasn’t top-notch 

but she was VERY entertaining. 

There are really two reasons I 

was able to finally get up and sing. 

There was one singer who had soooo 

much enthusiasm and obviously was 

enjoying herself, it was contagious. I 

almost got up with her and her friend 

doing a duet to make it three part 

harmony but I was still too gutless, 

drinks and all. And the other, one 

singer whom I love dearly today got 

up week after week with a voice that 

is quite indescribable. The message I 

kept telling myself is “if SHE can do 

it, I can do it.” 

Yes, I had been singing along in 

my seat to all the songs my partner 

had been singing the three years prior 

to my becoming an actual singer. It 

took me forever to start. Today, I love 

to work the crowd. If I see someone 

singing along at their table, I find a

Been VERY busy! Decided to 

do a minor remodel that started 

out as a 24-hour project and is now 

on day five. 

We moved the DJ booth across 

from the bar (near the front door), 

added an 80” projection TV and adjusted 

the other big screen from a 

5’ to a 6’ screen. We added a couple 

more TV’s, so now you can see all 

your favorite sporting events from 

anywhere in the building! 

Speaking of sporting events, 

we’ll be showing UFC pay per view 

fights here too! We also have some 

great shows lined up, including 

live music with Inhale (from Santa

over to them and say something corny 

like “we came here to hear YOU sing.” 

If they say they are awful, I ask if they 

think people are going to ask for their 

money back. It’s Karaoke, a free-forall. 

The scene from “My Best Friend’s 

Wedding” when Cameron Diaz got up 

and did a pretty poor job on the song 

is inspiring. It’s about letting loose, 

having some good clean fun, finding 

a song that the crowd loves, bringing 

back long-lost memories when an old 

tune comes up, and putting a song into 

your heart. Singing is the best stress 

reliever I know.

pull the events together. Without sponsorship, 

some of the new events wouldn’t 

have been made available. The free kids 

zone, for example, was new to the fair 

this year, and provided children with 

fun, hands-on projects to do. 

On the main stage there were 

plenty of other entertainers throughout 

the days, including the magic of 

Brian Ledbetter, Roberto the magnificent, 

a juggling funnyman act, the 

Bikini Clad Barista band, Flo and the 

fabulous Flotones, and many, many 

more. The list goes on. There was 

always something fun happening on 

the main stage! 

The Skagit County Fair always 

has what you’d expect too, a fantastic 

rodeo, animal exhibits, rides, booths 

with fair garb for sale, games and of 

course the food court. The $4 burgers 

from the Lions Club were delicious, 

the funnel cakes and elephant ears, 

caramel apples and all the other fair 

food were all tempting too. 

If you’ve never been to the Skagit 

County Fair, you really ought to 

mark your calendars and keep your 

eye on this publication next year for 

fair dates, or go onto the fair website 

for more information. This is one fair 

that’s well worth the price for all the 

entertainment value you receive, and 

all of the endless fun! 

Karaoke crackdown continues 

Sound Choice

nurture the development in America 

of a participatory entertainment phenomenon 

now known as “karaoke.” 

During that time, Sound Choice 

came to be recognized as the leading 

producer of high-quality karaoke 

backing music. The company invested 

over $18 million dollars to re-record 

and replicate the authentic sound of 

popular music across different eras 

and genres of music. 

Sound Choice’s dedication to 

producing music of the highest quality 

and most authentic character led 

its music to become the staple of most 

every karaoke show in the country. 

As karaoke grew in popularity, Sound 

Choice became the brand that most 

every karaoke fan wanted to sing and 

that most every karaoke jockey (“KJ”) 

wanted in his or her library. 

KJs play karaoke songs using 

compact discs written in a special encoded 

format known as “CD+G” (“compact 

disc plus graphics”), in which the 

CD contains the music and the lyrics, 

which will display on a screen. In 

recent years, computer technology and 

networking have made it possible for 

CD+G discs to be decoded and “ripped” 

(copied) to a user’s hard drive and easily 

copied and distributed between 

KJs. This technology has proven irresistible 

to KJs, many of whom have 

used this opportunity to trade these 

digital copies to build libraries of tens 

of thousands of karaoke songs without 

paying for them. Instead of buying 

licensed discs for their commercial 

karaoke shows, many KJs instead 

buy computer drives pre-loaded with 

thousands of illegally copied songs, 

copy one purchased disc to several different 

computer based systems, copy 

a singer’s personal discs if they use 

them during a show, “swap” song files 

among each other, or download them 

from illegal file sharing sites. 

These practices have become so 

widespread that Sound Choice has been 

nearly driven out of business. At its 

peak, Sound Choice employed 75 individuals 

and produced as many as five 

new karaoke discs per month. Today, 

Sound Choice employs fewer than ten 

individuals and loses money on every 

new karaoke disc it produces, since sales 

are not high enough to cover recording 

and licensing costs. For example, 

the latest karaoke disc Sound Choice 

produced has sold fewer than 750 copies 

- yet the songs from that disc can be 

found on as many as 30,000 karaoke 

systems around the United States. 

For KJs, karaoke is a commercial 

enterprise. KJs who legitimately 

acquired all of their music at great 

cost are being forced by illicit competition 

to produce shows for lower and 

lower fees. Illegitimate competitors 

offer libraries of tens of thousands of 

songs, which would have cost $50,000 

to $100,000 or more to acquire legitimately, 

but produce shows for onethird 

the rates a legitimate KJ can 

offer. The result is significant financial 

pressure on once legitimate KJs 

to skirt or ignore the law and become 

pirates, simply to stay in business. 

Sound Choice has been forced to 

undertake this litigation in order to 

ensure that it survives and continues 

to produce the high-quality karaoke 

music its fans demand, and to level the 

playing field for the legitimate KJs.

distributors, KJ/DJ hosts, venue owners 

and karaoke enthusiasts. 

The KIAA was formed by a group

find solutions to the many issues and 

challenges that are facing the karaoke 

industry today.

all aspects of karaoke be it as 

an art form, a form of entertainment, 

a recreational activity or even just as

Gloria’s celebrates karaoke excellence

odee and David, Gloria’s 

karaoke hosts, were both on 

hand Thursday, August 20th 

to put the wraps on their 

big karaoke contest. Twohundred 

bucks to the best 

singer they could find in the 

neighborhood. 

Several of the qualifiers that 

entered into the mix and perform in 

the finals were simply amazing talent 

to hear. Eleven contestants gave 

it their all to a small panel of judges 

and a large panel of critics. Everyone 

was praised for their efforts, but as in 

all things, there must be the superior. 

These were the singers Gloria’s had 

been hoping to root out and reward 

with cash money. 

David took the mic and proudly 

announced the winners. Congrats to 

the following standouts in Gloria’s Bar 

& Grill’s karaoke contest: In 4th Place, 

Katy was a strong contestant, David 

landed in 3rd Place with his own 

impressive style. The final two spots, 

only one of which would cash out, were 

so close, Jodee was considering a singoff 

– which is how you want it, right? 

“They are both incredible singers”, she 

says, “They both deserve to win”. 

David calls them to the stage, 

Jodee and David beside Galen (ctr) and the judges on the outside 

2nd Place first… Terrel, and in 1st 

Place and two-hundred bucks richer… 

Galen! The crowd erupts in a standing 

ovation, agreeing on the chosen winner. 

He modestly takes the stage and 

blushes to an applauding room full of 

apprecianados. 

Galen dropped out of medical 

school to move up here from Illinois 

with his new wife a couple years ago. 

She’s since left the poor guy and now 

he’s just tryin’ to make a living like the 

rest of us. I told him he really ought

to consider a career in music, like he’s 

never heard that before, right? 

Galen used to live in Germany 

and sang karaoke a lot over there. “Isn’t 

it hard to sing in German”, I asked jokingly. 

“They pretty much like the same 

stuff we sing over here”, he says. 

His Em-Oh, or M.O. (Modus Operandi) 

is to perform 

his stuff without 

any lyrics on the 

screen, so I had to 

ask him what the 

reason for that was. 

His answer blew me 

away and makes 

so much sense. He 

said, “That way I’m 

not staring at the 

screen trying to follow 

along intently. 

I can open up, let 

loose, even ad-lib, 

and stay connected 

to the audience 

during the entire performance.” 

What an epiphany! I wish more 

competitors employed this sort of reasoning. 

Galen’s heartfelt performances 

and strong vocals will draw you right 

into his web, and there you’ll stay, 

transfixed until the final note. 

Jodee, David, Gloria herself, and 

the whole entire room was pleased 

with the results of their contest and 

enjoyed a surge of business during 

the event and they want to do it again 

very soon. But this time, they want

to pay down to 3rd Place so they can 

have more winners and reward more 

of their favorite singers. So, watch for 

details on this one! 

Gloria’s has been around for 

a long time at 82nd and Pacific in 

Tacoma. I’ve been by there countless 

times and had never walked through 

the front doors. I changed that last 

month and I’m so glad I did. Gloria’s 

is such a comfortable and well laid out 

bar. Everyone is super nice and easygoing. 

I could totally hang out here on 

a regular basis.

Tuesday through Friday nights, and 

David runs the show every Saturday 

night – so five nights a week you can 

enjoy hearing yourself on their huge 

speakers connected to a premium 

sound system in their sweet sound 

booth on a big ol’ stage in killer little 

bar! Gloria’s got the walls all mirrored 

off, which gives the illusion that the 

place just stretches on and on. I kept 

wanting to continue walking into the 

other rooms, only to be reminded that 

wasn’t an option.

Station 56 proves Tacoma’s Got Talent

So, the verdict is in. 

If you had been among those 

skeptical few who couldn’t believe that 

Tacoma’s Got Talent, then you weren’t 

Jesse found himself a new friend 

at Station 56 to witness for yourself. 

Tacoma definitely has got talent. And 

the stage was full of it for a month of 

Tuesdays. Then, as suddenly as the 

whirlwind began, it all came to an exciting 

crescendo on August 25, 2009. 

At the time of this writing, the 

final winners were not yet known. 

But, I was able to catch a “regular” 

Tuesday night qualifier leading up to 

the Finals. 

Let me just say, “WOW!” What 

an absolute crazy night out. Montell 

Jordan, “This Is How We Do It”, was 

Star Machine’s celebrity guest judge. 

He definitely drew some attention. We 

didn’t get to hear him sing, since he’d 

been singing at a picnic of some sort 

all day, according to Virginia Ashby, 

who was also there. 

But everyone was excited, the 

place was packed, the lights were rolling 

- the stage came alive! Virginia 

and Star Machine hosted a wild night 

of qualifiers, with ten on the docket. 

Also at the judge’s table, was Scott 

Douglas, professional musician, photographer 

and businessman. Having 

amassed quite a history of stories to tell, 

Scott is a celebrity in his own rite. He’s 

currently hosting a family-friendly show 

at the Dafodil Bowl in Puyallup. 

At the other end, was DJ Harvis, 

next month’s edition of the Karaoke 

& Entertainment Guide. 

The bar was busy busy all night 

long. DJ Dirty White (Rick) was in 

charge of spinnin’ records during the 

Angel attempts to qualify 

who comes in with a 

keen ear for quality. 

Station 56 is a 

special location, distressed 

wood flooring, 

brick walls, wide-open 

format. You can see 

from one end to the 

other. And there’s 

something fun to do 

in every corner of the 

massive barroom. 

As for the contest, 

it was well underway - 

and so was the partay! 

Virginia took control 

and guided us through 

an incredible evening 

of great fun.

were Edward, 

Jeff, Jay, Tiffany, Geri, 

Jason, Rocky, Angel, 

Ashley, and Meredith.

a superb job and the judges were very

Beautiful women danced everywhere 

they could find a spot. The stripper’s 

pole was a favorite spot, so I just 

figured I’d just snap a few shots of the 

sexy girls playing on and around it. 

They were all amateurs and newbies 

to the pole, which made it even better. 

I’ll tell ya, there’s a naughty side to shy 

girls when you give ‘em shots, a pole, 

and the flash of a camera! Check out

Star Machine is like a drug. They 

find a way to your soul and allow you 

to be something you don’t always get 

to be. It’s different for everyone, I’m

The raised stage is backed by a 

huge 10-foot projection screen with the 

lyrics scrawled bigger than life. 

Ashley and her gang of friends lit 

the place up with their dancing and 

singing. They found the dancer’s pole 

in the middle of the dance floor and 

shook their groove thing. 

Tony’s quality wireless microphones 

enabled the singers to go anywhere 

in the bar. Sometimes, they’d 

disappear all the way in the back for 

awhile. John G. sang before Rebecca 

did Pour Me, Rico, new to the Rocksport, 

sounds just like the King and 

even kinda dressed like him too.

made it even more funny was that they 

were both dressed in suits. When Pat 

struck a superstar’s pose, the crowd 

laughed aloud. 

Then it was Randy and Candy’s 

turn together. They did a very animated 

Love Shack. Good times.

Rocksport, in the heart of the West 

Seattle Junction, you really ought to. 

DJ Tony makes an appearance every

reader. What Bonnie Geveshausen 

else can I do when I’m waiting through 

all those long rotations to sing? 

How long have you been doing and /or enjoying 

karaoke? About a year now. It’s become 

an addiction actually, as bad as it 

may sound. Singing is therapeutic for 

me. I love the feeling of getting on that 

stage and just letting go of everything, 

and expressing life through song. I 

could be mad, sing an angry song, 

happy, sing an upbeat song. You get 

it. It’s been the best 12 or 13 months 

for me. I’ve met so many people and 

have learned a whole lot really. 

Have you ever hosted? Oh no. Have tried 

a couple times, but certain people 

won’t hire women, and certain others 

are just too good at it. It’s kind of 

intimidating really. 

What type of music do you enjoy singing? 

All types. Country is a big attraction 

right now, but some pop, and honestly, 

I’m getting into this whole classic rock 

stuff. It’s catchy. 

Favorite Song(s) to sing? Right now, 

Thats What I Like About You (Trisha 

Yearwood), Don’t Look Back In Anger 

(Oasis), Jackson ( Johnny and June) 

and well... Bubbly (Colbie Calliat)

my horn a dozen times to get my radio

packed one night, 60 people or more.

actually. Just made the finals in July 

for my first karaoke contest at the 

Skagit. Very excited. Finals in September, 

stay tuned! 

If you could sing with anyone, ever, who 

would it be? Honestly, John Travolta. 

Why? Because I love him. Plain and 

simple. 

Most famous person you’ve ever met? I 

met Jim Brickman. He’s my favorite 

Pianist. 

How’d it happen? I went to a show he 

did, and then stood in line for his 

autograph. 

Do you have any musical fantasy(s)? Singing 

in front of a crowd of 5,000 people 

holding signs saying I love you Bonnie, 

and one day singing with Alan Jackson

Nisqually Radio is playing the 

original music of local artists, 24 

hours a day, across the internet, worldwide, 

since November 2008. 

We welcome all musicians to 

submit their original music to play 

in our broadcasts. We will include a 

photo, blurb, and link to you or your 

band from our Musicians page. 

A recent milestone was our 

10,000th visitor on Memorial Day, and 

by the end of that day, an additional 

189 visitors. We are continuing to 

reach new listeners as word spreads. 

Our staff of mostly volunteers 

should grow during the next year 

as we are applying for grant monies 

to expand our

of the song writers and publishers, but 

do not extend to the karaoke sound 

recordings themselves. If the karaoke 

operators that you hire are using illegal 

karaoke products of any sort, then 

you are at risk of being named in a 

contributory or vicarious (third party) 

lawsuit for copyright infringement if 

you knowingly use their services. 

There are two basic approaches 

in addressing this problem, both 

of which endeavor to keep illegal 

karaoke products out of your establishment. 

One approach would be to 

establish an in-house anti-piracy program 

which would of course require a 

certain amount of maintenance and 

monitoring on a regular basis. Another 

approach is to become a member 

of the KIAA agreeing to use KIAA 

member karaoke operators wherever 

possible, and thereby virtually free- 

privilege of seeing two of America’s 

funniest comedians, Adam Ferrara 

and John Reep, also known as the 

Hemi guy. The show itself was hilarious, 

I hadn’t laughed that hard since 

last year’s Seattle International Comedy 

competition. Speaking of which, 

this year the Skagit will be hosting the 

competition again on November 20th 

in the Pacific Showroom. Remember

Thomas verdict: 

willful infringement, 

$1.92 million penalty 

Jammie Thomas-Rasset’s federal retrial concluded 

today as a jury found her liable for willful 

copyright infringement, awarding the record 

labels nearly $2 million in damages.

Jammie Thomas- 

Rasset. In a repeat 

of the verdict 

from her first 

federal trial, Thomas-Rasset was 

found liable for willfully infringing 

all 24 copyrights controlled by the 

four major record labels at issue in 

the case. The jury awarded the labels 

damages totaling a whopping $1.92 

million. As the dollar amount was 

read in court, Thomas-Rasset gasped 

and her eyes widened. 

Kiwi Camara, Thomas-Rasset's 

lead attorney, spoke briefly after the 

trial. He told reporters that when 

he first heard the $80,000 per song 

damage award, he was "angry about 

it" and said he had been convinced 

that any liability finding would have 

been for the minimum amount of $750 

per song. 

As for Thomas-Rasset, she appeared 

shaken by the verdict but 

didn't blame the jury. "They did their 

job," she said, "I'm not going to hold 

it against them." She added, though, 

that the recording industry would 

never collect the money. "Good luck 

trying to get it from me... it's like 

squeezing blood from a turnip." 

The recording industry lawyers, 

though clearly pleased, had no desire 

to showboat this one. The massive 

damage award, which increased from 

$9,250 per song in the first trial to 

$80,000, might sounds like a "win," 

but will probably stoke grassroots anger 

against the industry's campaign... 

if the music business tries to collect. 

There are hints that it might not. 

Spokesperson Cara Duckworth 

of the RIAA, who attended the trial, 

told reporters afterwards, "Since day 

one we have been willing to settle 

this case... and we remain willing 

to do so." The industry appears to 

be doing everything it can not to appear 

vindictive in these cases, though 

Duckworth refused to discuss any 

details of what a proposed settlement 

might look like. 

Camara acknowledged the settlement 

offer and said that his side would 

certainly investigate it, but he made 

clear that he intends to file numerous 

motions if Thomas-Rasset wants 

to continue the fight. Motions on the 

constitutionality of such massive damages 

and other issues can still be filed 

with the judge, and then there's the 

entire matter of an appeal. 

Thomas-Rasset sounds inclined 

to fight on. The case was "one for the 

RIAA, not the end of the war," she 

said. 

As for Camara, he intends to 

press ahead with his class-action lawsuit 

against the recording industry, in 

which he will take up the daunting 

task of trying to claw back all the 

money that the recording industry 

has collected in the course of its legal 

campaign to date. 

Not good enough 

A vigorous defense from Kiwi Camara 

and Joe Sibley was not enough 

to sway the jury, which had only 

to find that a preponderance of the 

evidence pointed to Thomas-Rasset. 

The evidence clearly pointed to her 

machine, even correctly identifying 

the MAC address of both her cable 

modem and her computer's Ethernet 

port. When combined with the facts 

about her hard drive replacement (and 

her failure to disclose those facts to 

the investigators), her "tereastarr" 

username, and the new theories that 

she offered yesterday for the first 

time in more than three years, jurors 

clearly remained unconvinced by her 

protestations of innocence. 

Camara suspects that the jury 

thought Thomas-Rasset was a liar and 

were "angry about it," thus leading to 

the $80,000 per-song damages. 

The case is a reminder that in 

civil trials, simply raising some doubt 

about liability is not enough; lawyers 

need to raise lots of doubt to win the 

case, and Camara and Sibley were 

unable to do so here. 

The jury found Thomas-Rasset's 

conduct to be willful, which means 

that statutory damages under the 

Copyright Act can range from $750 

per infringement up to $150,000. In 

his closing statement, defense lawyer 

Joe Sibley made clear that even the 

minimum award would run $18,000 

(24 songs x $750 = $18,000), an amount 

that he said was unfair and crippling to 

Thomas-Rasset. The jury decided that 

the per-song penalty would be $80,000, 

for a total damage award of $1.92 million, 

over $1.7 million more than the 

award in her first trial.

out there as you stand a good foot and 

a half above your adoring fans, but 

still within arms reach, of course. The 

lyrics appear on a very large flatscreen 

monitor on a wall in the back, above 

everybody’s head. You’re looking over 

everyone’s head in the audience to see 

the words – Nice! 

Just about anything goes at the 

Little Red Hen – you’ll see duets, 

truets, and morets – everybody sings. 

And the thing is, it just keeps getting 

busier and more packed. By 11:30pm, 

this place was bursting at the seams, 

no kidding. It was unbelievable how 

Sunny and her barstaff of two managed 

to calmly and quickly take care 

of everyone’s order at the bar. Rainier 

cans were flyin’ outta there by the dozens. 

I asked Sunny, “Are Rainier cans 

a buck or something?” She says, “No, 

it’s usually the PBR’s...” She offers $3 

shot specials hourly on Wednesdays.

body was on some kind of party-

Everyone had a beer in hand, all was 

happy and good. 

Dan had 30 in the rotation. The 

room was absolutely filled to capacity.

waiting for their turn to sing, there 

was plenty to do in the meantime. For 

Dan, it was business as usual. He’s 

professional, courteous and knows 

where his job ends and the singer 

spotlight takes over. 

Jackie and about a kazillion of 

her friends gathered for her birthday, 

filling half the bar. Dan gave away 

Sounders tickets and later that night, 

NBA’s Spencer Hawes showed up, a 

UW alum who now plays for the Sacramento 

Kings. Just last week, the 

Mariners were in there! 

I’m tellin’ ya, the Little Red Hen 

is a hotbed for young party action. 

On Mondays, you got DJs Lo-Key and 

awesome bartender at Hayley’s Bar 

and Grill in Everett makes some 

amazing Key Lime Pie Lemondrops! 

Whats the nicest thing you’ve ever done 

for a stranger? I’ve handed a few 

people money on the freeway exit 

before. I’m a nice person, but I do the 

normal nice things,
