In S v S, Sir James Munby,<br />

President of the Family<br />

Division of the High Court<br />

of England & Wales gave<br />

clear approval for the use<br />

of arbitration as a means of<br />

dispute resolution in Ancillary<br />

Relief claims. This article<br />

will address the legislative<br />

context in which that decision<br />

was reached and the key<br />

points addressed in S v S.<br />

The legislative context<br />

The various legislative provisions which<br />

previously regulated arbitration were codified<br />

in a single Act, the Arbitration Act 1996. The<br />

Act expressly extends to Northern Ireland<br />

and its provisions apply where the “seat” of<br />

arbitration is sited within Northern Ireland<br />

(Section 2). Whilst the Act itself contains no<br />

express definition of arbitration, the General<br />

Principles set out in Section 1 identify its<br />

purpose:<br />

(a) The object of arbitration is to obtain the<br />

fair resolution of disputes by an impartial<br />

Tribunal without unnecessary delay or<br />

expense;<br />

(b) The parties should be free to agree how<br />

their disputes are resolved, subject only<br />

to such safeguards as are necessary in<br />

the public interest;<br />

(c) In matters governed by Part 1 the Court<br />

should not intervene except as provided<br />

by [Part 1].<br />

This object, expressed with admirable clarity,<br />

is supported and further advanced by the<br />

express duties imposed on the arbitrator<br />

(Section 33) and the parties themselves<br />

(Section 40).<br />

Section 1(b) emphasises the autonomy<br />

of the parties to adopt a procedure for<br />

resolution by arbitration which meets their<br />

needs, (speed, cost and flexibility) subject<br />

to the minimum procedural safeguards. The<br />

Act, therefore, contains a binary procedural<br />

framework comprising both mandatory<br />

and non-mandatory provisions (Section<br />

4). The mandatory provisions are contained<br />

in Schedule 1 to the Act and include such<br />

matters as the staying of legal proceedings,<br />

the general duties of the Tribunal and<br />

the parties, and the enforcement of the<br />

award. The non-mandatory procedural<br />

rules (which will apply in default of any<br />

alternative procedure agreed by the parties)<br />

are contained within the body of the Act and<br />

include such matters as, whether or not the<br />

strict rules of evidence as to the admissibility,<br />

relevance or weight of any material should<br />

apply and the form in which evidence should<br />

be submitted, eg orally or in writing and<br />

whether the Tribunal may appoint an expert<br />

and whether or not it can make a provisional<br />

award.<br />

The Court’s powers pursuant to Section 1(c)<br />

are broadly confined to those which support<br />

the arbitral process or correct a manifest<br />

injustice. Once the parties have entered<br />

into a valid and binding written agreement<br />

to arbitrate, the scope for either party to<br />

subsequently resile and resort to litigation<br />

before the Court is extremely limited. The<br />

broad but not unlimited autonomy provided to<br />

the parties by Section 1(b) endows arbitration<br />

with a flexibility which may better serve the<br />

interest of the parties than a “full-blown” Court<br />

adjudication of Ancillary Relief.<br />

Arbitration as a means of dispute resolution<br />

alternative to the Court system has the<br />

potential to achieve significant time and cost<br />

savings. Often, one or two issues will emerge<br />

as “sticking points” in negotiations whether<br />

before or during formal Court proceedings. For<br />

example the quantum and duration of ongoing<br />

spousal maintenance by way of periodical<br />

payments, the valuation of commercial<br />

interests or farm lands, whether there should<br />

be pension sharing or set-off and, if so, the<br />

quantum of each. Whilst it is possible to have<br />

a discrete “valuation” hearing in the course of<br />

Ancillary Relief proceedings, this requires the<br />

initiation of proceedings by way of a Petition<br />

(usually on the grounds of Behaviour which<br />

brings with it a significant risk of escalation)<br />

and can only take place after the parties have<br />

filed substantive affidavits (in which each<br />

party will typically amplify accusations of<br />

behaviour under the banner of “conduct”).<br />

When the Court is asked to determine valuation<br />

as a discrete issue in the course of ongoing<br />

proceedings there is a real risk that whichever<br />

party feels he or she has lost the valuation<br />

hearing, will then force the proceedings on<br />

in the hope of recovering perceived “lost<br />

ground”. By contrast, arbitration can provide<br />

an early pre-proceedings determination of<br />

discrete issues, without the risk of escalation<br />

and allow negotiations on the broader issues to<br />

advance once the “sticking points” having been<br />

removed.<br />

The Matrimonial Causes (Northern Ireland)<br />

Order 1978<br />

Those readers familiar with the provisions<br />

of the Order will immediately identify the<br />

potential problem with enforcement of an<br />

arbitral award in an Ancillary Relief dispute.<br />

The statute grants the Divorce Court a broad<br />

discretion as to what Ancillary Relief, if any,<br />

should be granted to either or both of the<br />

parties (and in some circumstances children)<br />

and expressly provides that the discretion<br />

cannot be ousted by an agreement. Time<br />

and again, the Courts have re-affirmed
