Mbeya market project<br />

The Government has directed<br />

the Controller and<br />

Auditor General (CAG) to<br />

conduct a special audit on<br />

Appeal against Mzumbe University dismissed<br />

Appeals Authority (PPAA)<br />

has dismissed an appeal<br />

against Mzumbe University<br />

with regard to tender for supply,<br />

installation and commissioning of<br />

air conditioning, on account of failure<br />

to meet tender requirements,<br />

TPJ has learnt.<br />

According to the proceedings of<br />

the appeal, EA Brothers<br />

Constructors Co. Ltd, who was the<br />

appellant, was dissatisfied with the<br />

disqualification of its tender by<br />

Mzumbe University on the grounds<br />

that it failed to submit one particular<br />

Prime Minister Kassim Majaliwa<br />

Mbeya City Council over ´inflated´<br />

costs in the construction of the<br />

Mwanjelwa Market.<br />

The Prime Minister, Mr. Kassim<br />

document, namely a bank statement,<br />

contrary to the requirements of the<br />

tender document.<br />

While the appellant argued that<br />

submission of a bank statement was<br />

not necessary as they had attached all<br />

relevant documents indicating financial<br />

capability, the respondent countered<br />

the argument by saying the<br />

matter was one of the stated criteria<br />

in the tender document and therefore<br />

had to be complied with.<br />

In determining the grounds of the<br />

appeal, PPAA observed that the<br />

requirement of the bank statement<br />

was clearly indicated in the bidding<br />

Majaliwa, issued the directive in<br />

Mbeya recently during an<br />

impromptu visit at the the newly<br />

constructed market.<br />

Mr. Majaliwa said construction<br />

of the market was supposed to cost<br />

16bn/-but was at a loss as how it<br />

ended up costing 26bn/- and so<br />

ordered the audit to establish the<br />

truth over the matter.<br />

He said upon completion of the<br />

audit, the findings would be made<br />

public and anybody implicated in<br />

the scandal would be taken to task.<br />

“We cannot tolerate this, appropriate<br />

action must be taken against<br />

anyone who will be implicated in<br />

the scam after the investigations,“<br />

he said.<br />

Mr. Majaliwa added that due to<br />

the exhorbitant costs, the city council<br />

was now paying 200m/- monthly<br />

to settle its debt. “Whoever<br />

caused the unnecessary costs must<br />

be found immediately and be made<br />

to face stern measures as a lesson to<br />

others,“he directed.<br />

The PM also gave the Mbeya<br />

Regional Commissioner, Mr. Amos<br />

Makalla, three days to investigate<br />

and find the culprits behind the<br />

‘disappearance‘ of 489m/- donated<br />

by CRDB towards development of<br />

the market.<br />

After considering the arguments<br />

of both parties, PPAA concluded that<br />

the disqualification of the appellant<br />

bank statement was fair.<br />

Consequently, PPAA dismissed<br />

the appeal and ordered each party to<br />

bear their own costs.<br />

OBITUARY<br />

The Chief Executive Officer of PPRA regrets to<br />

announce the untimely death of a staff member,<br />

Mr. James Emmanuel Kitainda, which occurred<br />

on Wednesday, 10th August, 2016 in Dar es<br />

Salaam. Mr. Kitainda, who joined PPRA as a<br />

procurement expert in November 2008, worked<br />

in the Division of Monitoring and Compliance.<br />

James Kitainda was born on 13th April, 1965<br />

and completed his bachelor’s degree in<br />

procurement and logistics from Kampala<br />

International University, Uganda in June 2008.<br />

Prior to joining PPRA, he worked with the<br />

Ministry of Finance and Planning in the defunct<br />

Central Tender Board, from 1990 as a supplies<br />

officer.<br />

His body was laid to rest at Kinondoni<br />

cemetery on 13th August 2016.<br />

May the Almighty God rest his soul in eternal<br />

ENHANCEMENT OF PROCUREMENT CAPACITY OF<br />

LOCAL GOVERNMENT AUTHORITIES PROJECT (EPC-LGAP)<br />

Introduction<br />

Implementation of the Enhancement of Procurement<br />

Capacity of Local Government Authorities Project (EPC-<br />

LGAP) progressed well in 2016. Most key activities were<br />

executed as planned in line with the key interventions setout<br />

in the Local Government Procurement Capacity Building<br />

Strategy Formulation Workshop of June 2013.<br />

Procurement Skills Development Plans (PSDP)<br />

All 28 Local Government Authorities (LGA) from the four<br />

regions covered by the Project (Dodoma, Kigoma, Pwani,<br />

and Tanga) submitted PSDP progress reports. The reports<br />

formed the basis for the 1 st round of monitoring, follow-up<br />

and coaching missions, which were completed in 26 LGAs by<br />

two teams comprising Consultants, PIU, PO-RALG and LGTI.<br />

Focus was on the use and application of PPA/PPR,<br />

procurement records, EPICOR skills of the various LGA job<br />

familiesand agreement on action plans to address<br />

organisational bottlenecks and constraints.<br />

Procurement Manuals and Guides<br />

Final validation with stakeholders of several procurement<br />

manuals and guides was completed and status is as follows:<br />

1) LGA Procurement Guide for Outsourced Revenue<br />

Collection: completed with dissemination of trial version<br />

by PPRA and PO-RALG in preparation;<br />

2) LGA Standard Training Manual in Procurement and<br />

Contract Management: completed with dissemination by<br />

LGTI in preparation;<br />

3) LGA Procurement Operational Manual: received pending<br />

final review and approval by PPRA/Project;<br />

4) PSDP Training Module N o 4 “Contract Management &<br />

Administration for LGAs”: developed, tested and used;<br />

5) PSDP Training Module N o 5 “Contract Closure, Review<br />

and Evaluation of Outputs and Performance for<br />

LGAs”:developed, tested and used;<br />

6) PSDP Training Module N o 1 “Use and Application of<br />

PPA/PPR in LGAs” customized and translated to Swahili;<br />

7) Training Manual in “Methodology and Tools for<br />

Procurement Internal Audit”: developed; and<br />

8) Development of the long-anticipated Procurement Guide<br />

for Lower Local Government Authorities is in progress.<br />

Procurement Training<br />

Selected LGA job families of 28 LGAs and staff from the four<br />

regions benefitted from procurement training to develop and<br />

improve procurement skills and competencesin prioritised<br />

areas, see table 1:<br />
