Dear Members,<br />

I feel very lucky to be serving as your EPSHRM president-elect this year! As the<br />
president-elect, some of my primary duties include representing our organization at<br />
meetings our president is unable to attend and assisting the president in the oversight<br />
of all activities of the chapter. I also have the privilege of helping other officers where<br />
needed. The president-elect is responsible to the <strong>members</strong> of the chapter as well.<br />
President Fred Perea has established a theme of engaging our <strong>members</strong>hip <strong>for</strong> this<br />
year. It is with this in mind that I am excited to also take on a role of creating some<br />
additional opportunities <strong>for</strong> our <strong>members</strong> to network and get to know each other in a<br />
more social setting. We will be offering some <strong>new</strong> events this year that give our<br />
<strong>members</strong> additional chances to connect. The first of these events was the February<br />
HR Connections event held at Hope and Anchor. It was a little chilly on the patio, but it provided <strong>for</strong> great networking<br />
as we huddled around the heaters. A special thanks to all who were able to attend. Look <strong>for</strong> e-blasts on more of these<br />
“HR Connection” events coming to your inbox throughout this year. I hope you will find one that interests you and you<br />
will attend.<br />
We have a great line up of programs <strong>for</strong> you this year! I look <strong>for</strong>ward to meeting and speaking with each of you. If you<br />

EPSHRM Legal Seminar<br />
This month, EPSHRM is proud to partner with<br />
Kemp Smith, LLC to bring you our annual Employment<br />
Law Seminar. This year, we will bring<br />
a round of updates from Washington, D.C. and<br />
Austin, as well as Retaliation, best practices with<br />
social media, and what’s happening with the National<br />
Labor Relations Board. The second half of<br />
the day will bring topics such as ADA/FMLA updates,<br />
Handling Unemployment Claims, and a<br />
roundtable discussion of best practices from Kemp Smith’s attorneys.<br />
Our speakers will include Gerry Howard, AbeHoward-Gonzalez, Mike<br />
McQueen, Gilbert Sanchez, and CB Burns.<br />
EPSHRM’s April Employment Law Seminar and Membership Meeting will<br />
be Wednesday, April 25th. Registration <strong>for</strong> the seminar begins at 7:45 a.m.,<br />
with the seminar beginning at 8:30 a.m. and concluding at 4:00 p.m. The<br />
luncheon meeting will run from approximately 11:30 a.m. to 1:15 p.m.<br />
We will be at our <strong>new</strong> location, the <strong>El</strong> <strong>Paso</strong> Club, on the 18th Floor of the<br />
Chase Bank Building downtown. The cost <strong>for</strong> the seminar is $75 <strong>for</strong> <strong>members</strong><br />
and $95 <strong>for</strong> guests, including a light breakfast and lunch. Cost <strong>for</strong> the<br />
luncheon meeting only is $18<strong>for</strong> <strong>members</strong> and $23 <strong>for</strong> guests and includes<br />
the <strong>El</strong> <strong>Paso</strong> Club’s awesome luncheon buffet.<br />

Court of Appeals Enjoins NLRB From En<strong>for</strong>cing New Posting Requirement Until Court Rules On Its Legality<br />

The deadline <strong>for</strong> employers subject to the National Labor Relations Act to comply with the controversial employee rights notice<br />
posting has again been postponed–this time by Court order. As you may recall, this rule requires all employers subject to the National<br />
Labor Relation Board’s jurisdiction – whether unionized or not – to post a notice in a “conspicuous place” at the workplace<br />
in<strong>for</strong>ming employees of their rights and protections under the NLRA. Failure to post the required notice may result in the tolling of<br />
the six-month statute of limitations to file an unfair labor practice (“ULP”) charge and/or may be considered evidence of an employer’s<br />
anti-union animus in a ULP proceeding. The rule was supposed to go into effect in November 2011, but the NLRB twice<br />
postponed the implementation date to April 30, 2012 while the legality of the rule was decided by the courts. Since that time, one<br />
court has held that the rule is legal; the other court has held to the contrary. The issue has now been appealed.<br />
While on appeal, the United States Court of Appeals <strong>for</strong> the District of Columbia has prevented the NLRB from en<strong>for</strong>cing<br />
the posting requirement while the court reviews the rule’s legality. The Court of Appeals is not expected to rule until sometime after<br />
September 2012 (and most likely later than that). There<strong>for</strong>e, the en<strong>for</strong>cement date <strong>for</strong> the posting requirement is postponed<br />
until the Court of Appeals makes its decision.<br />

SHRM Launches Internet News Program<br />

The <strong>Society</strong> <strong>for</strong> <strong>Human</strong> <strong>Resource</strong> <strong>Management</strong> (SHRM) has debuted<br />
“Focus on HR,” a biweekly, 10-minute online <strong>new</strong>s program showcasing<br />
the latest <strong>new</strong>s and in<strong>for</strong>mation in business, HR and SHRM.<br />
Multimedia producer Patrick Mirza, <strong>for</strong>mer editor of HR Magazine,<br />
and assistant producer Angela Smith make up the crew that interviews,<br />
writes, directs, edits and produces the <strong>new</strong>s show. Veteran<br />
CNN correspondent Kathleen Koch hosts the program.<br />
Shot in a <strong>new</strong>ly expanded studio at SHRM headquarters, the program<br />
looks and feels like a broadcast <strong>new</strong>s program. The cast and<br />
crew film the show on location around the country, Mirza said.<br />
“Focus on HR” highlights <strong>new</strong>s articles from the SHRM website and<br />
features original programming and content from Mirza and Smith.<br />
The show incorporates interviews with SHRM conference keynoters,<br />
leading business and HR executives, thought leaders and other HR<br />
practitioners.<br />
Available to SHRM <strong>members</strong> and non<strong>members</strong>, the show can be<br />
seen on the SHRM website and YouTube and is coming soon to<br />
iTunes.<br />
“In 10 minutes, viewers get insights into developing trends and issues<br />
and are steered to more in<strong>for</strong>mation on the SHRM website,”<br />
Mirza said. “Most people will never get to sit six feet away from top<br />
business leaders, much less get to ask them questions. This show<br />
will give them that kind of access.”<br />
The premiere episode examined seasonal workers’ legal rights; holiday<br />
party responsibilities; an interview with the 2011 SHRM Losey<br />
Award winner; and a feature on job creation. Upcoming episodes will<br />
look at safety training; employee development; SHRM’s <strong>new</strong> standard<br />
on cost-per-hire; and an employment law update.<br />
