President Elect’s Letter...
Dear Members,

I feel very lucky to be serving as your EPSHRM president-elect this year! As the
president-elect, some of my primary duties include representing our organization at
meetings our president is unable to attend and assisting the president in the oversight
of all activities of the chapter. I also have the privilege of helping other officers where
needed. The president-elect is responsible to the members of the chapter as well.
President Fred Perea has established a theme of engaging our membership for this
year. It is with this in mind that I am excited to also take on a role of creating some
additional opportunities for our members to network and get to know each other in a
more social setting. We will be offering some new events this year that give our
members additional chances to connect. The first of these events was the February
HR Connections event held at Hope and Anchor. It was a little chilly on the patio, but it provided for great networking
as we huddled around the heaters. A special thanks to all who were able to attend. Look for e-blasts on more of these
“HR Connection” events coming to your inbox throughout this year. I hope you will find one that interests you and you
will attend.
We have a great line up of programs for you this year! I look forward to meeting and speaking with each of you. If you
need help with navigating your EPSHRM resources or would like information about any area, please do not hesitate to

This month, EPSHRM is proud to partner with
Kemp Smith, LLC to bring you our annual Employment
Law Seminar. This year, we will bring
a round of updates from Washington, D.C. and
Austin, as well as Retaliation, best practices with
social media, and what’s happening with the National
Labor Relations Board. The second half of
the day will bring topics such as ADA/FMLA updates,
Handling Unemployment Claims, and a
roundtable discussion of best practices from Kemp Smith’s attorneys.
Our speakers will include Gerry Howard, AbeHoward-Gonzalez, Mike
McQueen, Gilbert Sanchez, and CB Burns.
EPSHRM’s April Employment Law Seminar and Membership Meeting will
be Wednesday, April 25th. Registration for the seminar begins at 7:45 a.m.,
with the seminar beginning at 8:30 a.m. and concluding at 4:00 p.m. The
luncheon meeting will run from approximately 11:30 a.m. to 1:15 p.m.
We will be at our new location, the El Paso Club, on the 18th Floor of the
Chase Bank Building downtown. The cost for the seminar is $75 for members
and $95 for guests, including a light breakfast and lunch. Cost for the
luncheon meeting only is $18for members and $23 for guests and includes
the El Paso Club’s awesome luncheon buffet.

Court of Appeals Enjoins NLRB From Enforcing New Posting Requirement Until Court Rules On Its Legality

The deadline for employers subject to the National Labor Relations Act to comply with the controversial employee rights notice
posting has again been postponed–this time by Court order. As you may recall, this rule requires all employers subject to the National
Labor Relation Board’s jurisdiction – whether unionized or not – to post a notice in a “conspicuous place” at the workplace
informing employees of their rights and protections under the NLRA. Failure to post the required notice may result in the tolling of
the six-month statute of limitations to file an unfair labor practice (“ULP”) charge and/or may be considered evidence of an employer’s
anti-union animus in a ULP proceeding. The rule was supposed to go into effect in November 2011, but the NLRB twice
postponed the implementation date to April 30, 2012 while the legality of the rule was decided by the courts. Since that time, one
court has held that the rule is legal; the other court has held to the contrary. The issue has now been appealed.
While on appeal, the United States Court of Appeals for the District of Columbia has prevented the NLRB from enforcing
the posting requirement while the court reviews the rule’s legality. The Court of Appeals is not expected to rule until sometime after
September 2012 (and most likely later than that). Therefore, the enforcement date for the posting requirement is postponed
until the Court of Appeals makes its decision.

Bylaws and Revisions: introduced changes to EPSHRM Constitution and Bylaws. These include the following: cosmetic changes to site, clarification of
membership qualifications (including student membership), define honorary and lifetime membership criteria, voting procedure updates, review of membership
application procedure, update solicitation of services for/from membership, membership cancellation review, dues changes, membership rolling
calendar year, EPSHRM fees, clarification of EPSHRM attendance requirement at HR Southwest and TX leg., schedule for annual meeting in September,
clarification of ‘quorum’ for voting purposes, eligible voters (officers), defined core leadership areas, revision of Mission, Vision, and Core Values of
EPSHRM. All changes in detail are found on the EPSHRM website for membership review.

SHRM Launches Internet News Program

The Society for Human Resource Management (SHRM) has debuted
“Focus on HR,” a biweekly, 10-minute online news program showcasing
the latest news and information in business, HR and SHRM.
Multimedia producer Patrick Mirza, former editor of HR Magazine,
and assistant producer Angela Smith make up the crew that interviews,
writes, directs, edits and produces the news show. Veteran
CNN correspondent Kathleen Koch hosts the program.
Shot in a newly expanded studio at SHRM headquarters, the program
looks and feels like a broadcast news program. The cast and
crew film the show on location around the country, Mirza said.
“Focus on HR” highlights news articles from the SHRM website and
features original programming and content from Mirza and Smith.
The show incorporates interviews with SHRM conference keynoters,
leading business and HR executives, thought leaders and other HR
practitioners.
Available to SHRM members and nonmembers, the show can be
seen on the SHRM website and YouTube and is coming soon to
iTunes.
“In 10 minutes, viewers get insights into developing trends and issues
and are steered to more information on the SHRM website,”
Mirza said. “Most people will never get to sit six feet away from top
business leaders, much less get to ask them questions. This show
will give them that kind of access.”
The premiere episode examined seasonal workers’ legal rights; holiday
party responsibilities; an interview with the 2011 SHRM Losey
Award winner; and a feature on job creation. Upcoming episodes will
look at safety training; employee development; SHRM’s new standard
on cost-per-hire; and an employment law update.
