expenses for a period exceeding <strong>on</strong>e m<strong>on</strong>th from the end of the deadline for the<br />

submissi<strong>on</strong>/publicati<strong>on</strong> of the report, s/he is guilty of an illegal act. The authorities add that under<br />

secti<strong>on</strong> 55, the sancti<strong>on</strong> in this case has been raised from €342 to €1000 in order to better reflect<br />

the seriousness of the offence. Any pers<strong>on</strong> found guilty of this illegal act may also be subject to<br />

impris<strong>on</strong>ment for up to 6 m<strong>on</strong>ths, as well as deprivati<strong>on</strong> of his/her right to vote and his/her registry<br />

in the electoral registry for up to 7 years. Also, where campaign expenditures exceed the<br />

permissible ceiling with respect to a candidate, the Auditor General shall forward the candidate’s<br />

electi<strong>on</strong> statement to the Commissi<strong>on</strong>er of Electi<strong>on</strong>s for the impositi<strong>on</strong> of a pecuniary fine equal to<br />

the total amount of overspending.<br />

37. GRECO takes note of the informati<strong>on</strong> provided which shows that the new legislati<strong>on</strong> provides a<br />

range of sancti<strong>on</strong>s in respect of electi<strong>on</strong> candidates violating the legislati<strong>on</strong> c<strong>on</strong>cerning the<br />

submissi<strong>on</strong> of their electi<strong>on</strong> statements, as required by this recommendati<strong>on</strong>.<br />

38. GRECO c<strong>on</strong>cludes that recommendati<strong>on</strong> vi has been implemented satisfactorily.<br />

III.<br />

CONCLUSIONS<br />

39. In view of the above, GRECO c<strong>on</strong>cludes that <strong>Cyprus</strong> has made tangible progress in<br />

respect of the pending recommendati<strong>on</strong>s since the adopti<strong>on</strong> of the <str<strong>on</strong>g>Interim</str<strong>on</strong>g> <str<strong>on</strong>g>Compliance</str<strong>on</strong>g><br />

report. <strong>Cyprus</strong> has so far implemented satisfactorily, or dealt with in a satisfactory<br />

manner, six of the eight recommendati<strong>on</strong>s c<strong>on</strong>tained in the <str<strong>on</strong>g>Third</str<strong>on</strong>g> <str<strong>on</strong>g>Round</str<strong>on</strong>g> <str<strong>on</strong>g>Evaluati<strong>on</strong></str<strong>on</strong>g><br />

<str<strong>on</strong>g>Report</str<strong>on</strong>g>, and the two pending recommendati<strong>on</strong>s have been partly implemented.<br />

40. With respect to Theme I – Incriminati<strong>on</strong>s, recommendati<strong>on</strong> i remains partly implemented. With<br />

respect to Theme II – Transparency of Party Funding, recommendati<strong>on</strong>s i, iii, v and vi have been<br />

implemented satisfactorily and recommendati<strong>on</strong> ii remains partly implemented.<br />

41. C<strong>on</strong>cerning incriminati<strong>on</strong>s, GRECO welcomes in particular that it would appear that a more<br />

uniform legal framework for the criminalisati<strong>on</strong> of corrupti<strong>on</strong> could possibly be underway with the<br />

establishment of a nati<strong>on</strong>al strategy and an acti<strong>on</strong> plan under the authority of the Ministry of<br />

Justice and Public Order. A new legal framework in respect of corrupti<strong>on</strong> offences has l<strong>on</strong>g been<br />

advocated by GRECO as it would be an important achievement, as compared with the current<br />

“patch-work legislati<strong>on</strong>”, made up of provisi<strong>on</strong>s c<strong>on</strong>tained in various laws and in two internati<strong>on</strong>al<br />

treaties.<br />

42. C<strong>on</strong>cerning political financing, GRECO also welcomes the enhanced transparency in the system<br />

of political financing in <strong>Cyprus</strong> and commends the authorities for the efforts made. It is to be<br />

noted that the new obligati<strong>on</strong> for political parties and electi<strong>on</strong> candidates to draft and submit, to<br />

the appropriate authorities, specific reports relating to electi<strong>on</strong> campaigns is a very positive step,<br />

as is the involvement of the Auditor General in the m<strong>on</strong>itoring. Some shortcomings remain,<br />

however, such as the lack of obligati<strong>on</strong> for electi<strong>on</strong> candidates to disclose the identities of d<strong>on</strong>ors<br />

exceeding a certain threshold.<br />

43. Five years after the adopti<strong>on</strong> of the <str<strong>on</strong>g>Evaluati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g>, <strong>Cyprus</strong> has achieved very positive results.<br />

GRECO c<strong>on</strong>cludes that the current level of implementati<strong>on</strong> of the recommendati<strong>on</strong>s is no l<strong>on</strong>ger<br />

“globally unsatisfactory” in the meaning of Rule 31, paragraph 8.3 of its Rules of Procedure.<br />

GRECO therefore decides not to c<strong>on</strong>tinue applying Rule 32 c<strong>on</strong>cerning members found not to be<br />

in compliance with the recommendati<strong>on</strong>s c<strong>on</strong>tained in the <str<strong>on</strong>g>Evaluati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g>.<br />
