Terms and Conditions for <strong>Trade</strong> orders<br />

Orders for goods<br />

1. Orders should be placed by telephone or email and received by us by 9am on Monday morning for delivery within that<br />

week. (If you have an urgent order, we may be able to assist—please call us and we will do our best).<br />

2. Goods will only be supplied in the quantities and flavours described overleaf. For the trade boxes of macarons, we can<br />

only supply in the quantities and flavours stated. However, we reserve the right to change flavour quantities should we<br />

be unable to meet supply but will always provide a full 144 or half 72 box as standard.<br />

3. By placing an order as set out above, your are obligated to our Terms and conditions for payment as set out below.<br />

Due to the bespoke nature of our products, once an order is placed , cancellations can not be accepted and the delivery<br />

and payment terms will apply.<br />

Delivery of Goods<br />

4. Delivery will be between Tuesday and Friday. We will let you know of your delivery date when you order.<br />

5. All delivers will require a signature on receipt. Goods should be inspected on receipt and any discrepancies or damages<br />

should be reported within 24 hours in writing by email. Due to the fresh and fragile nature of our products, we can<br />

not accept responsibility for problems reported after 24 hours of receipt. Please see limitations and liability section for<br />

what we will reimburse.<br />

6. Fresh Macarons should be frozen on receipt to benefit from the full shelf life once defrosted. We can not accept responsibility<br />

for a reduced shelf life due to incorrect storage and handling of goods.<br />

Payment<br />

7. New accounts will be required to make payment for their first order before delivery. Thereafter, for subsequent orders, a<br />

30 day terms of payment will be offered.<br />

8. Payment can be made by BACS , or cheque as per the details set out on the invoice, which will be sent with each delivery<br />

or by email to the accounts department.<br />

9. New businesses that have not been trading for a minimum of 6 months will be required to pay for all orders before delivery.<br />

After 6 months, this will be reviewed for the 30 day payment.<br />

Limitations and Liability<br />

10. If, for any reason we are not able to fulfil your order in the time frames outlined above, we will inform you at the earliest<br />

opportunity and give you an alternative date for delivery which you may or may not accept. If you choose not to accept<br />

it, we will cancel your order and you will not be obligated as set out above.<br />

11. We will not be liable (whether caused by our employees, agents or otherwise) in connection with goods for:<br />

a) any indirect or consequential loss, damage, costs or expenses<br />

b) any loss of profits, loss of business, loss of goodwill or reputation, or third party claims<br />

12. Damages or discrepancies to orders reported as in the terms set out above, which prevent the purchaser from reselling<br />

the stock provided, will either be deducted off the relating invoice or credit in goods will be applied for subsequent<br />

orders (whichever the customer wishes to receive) but only for a like-for-like replacement of damaged quantities.<br />

Due to the fragile nature of our goods, we reserve the right to ask for photographic evidence of breakages and quantities.<br />

Delivery costs of £10 per order applies.<br />
