Will you buy your unit, lease<br />

it or live in it under a licence?<br />

While most people understand<br />

the term Retirement Village<br />

as meaning a form of unit<br />

accommodation, it oft en<br />

comes as a surprise to fi nd that there are<br />

diff erent ways of owning or occupying a<br />

retirement unit.<br />

Th e most common forms of occupation<br />

for retirement villages are lease and loan/<br />

license.<br />

A lease is where a resident pays an initial<br />

contribution equating to market value in<br />

exchange for the right to live in a particular<br />

unit and use the village facilities.<br />

With this type of tenure the term of the<br />

lease is usually for a period of 99 years, it<br />

is registered on the title to the retirement<br />

village land and the unit remains the<br />

property of the developer.<br />

A loan/licence agreement is whereby a<br />

developer and/or owner of a retirement<br />

village provides a residence with a licence<br />

to occupy a particular unit. In return the<br />

resident provides the developer with a<br />

form of long-term loan or donation and the<br />

developer remains the owner of the unit.<br />

Th is occupancy arrangement is not<br />

registered on the land’s title and is off ered<br />

by many non-profi t village operators.<br />

A strata title is another common contract<br />

type off ered by retirement villages and<br />

is where the resident owns the unit and<br />

contributes to the maintenance of common<br />

areas. Residents are registered as the owner<br />

of the unit on the title deed.<br />

Th ere may be diff erent types of<br />

contractual arrangements off ered to<br />

residents in the same retirement village.<br />

Retirement villages may also off er diff erent<br />

contracts at diff erent times. For example,<br />

two residents living next door to each other<br />

in similar accommodation, who entered<br />

the village at diff erent times, might have<br />

diff erent contracts that give them diff erent<br />

rights and responsibilities.<br />

Th e type of ownership structure a resident<br />

chooses will have diff erent implications and<br />

raise diff erent issues in terms of applicable<br />

legislation, stamp duty, GST, service<br />

charges, responsibility for refurbishment<br />

and capital replacement costs, security<br />

of tenure, operator default, termination,<br />

vacating the premises, capital losses and<br />

credit risk.<br />

Entering into a retirement village involves<br />

making fi nancial and<br />

lifestyle decisions. It is important to<br />

research the industry and its alternatives,<br />

read disclosure information, village<br />

contracts and any other relevant<br />

documentation. It might also be helpful to<br />

obtain legal and fi nancial advice, prior to<br />

entering into a retirement village.<br />
