The tax rate situation is explained<br />
by Col. McCarthy as follows: The<br />
rate was fixed for this year on the<br />
hnsis of the assessed valuations of<br />
1913. The total 1913 assessment for<br />
the territory in 1913 was on a valua-<br />
tion of about $88,000,000. But re-Hnr-<br />

kinds, due to the tariff's effect here,<br />
brought the actual 1914 assessment<br />

This year, however, the rate will be<br />
figured on the basis of an $84,000,000<br />
valuation. The European war and<br />
consequent higher prices should raise<br />

Under th title "A Bill to Amend<br />
an Act Entitled 'An Act to Codify, Re<br />
vise and Amend the Laws Relating to<br />
the Judiciary' approved March 3, 1911,<br />
the house of representatives has "put<br />
one oyer" on Hawaii.<br />
Some years ago, through an inno<br />
cent-lookin- g and altogether unnoticed<br />
amendment to an appropriation bill,<br />
appeals to the supreme .court of the<br />
United States from judgments of the<br />
supreme court of the territory of Ha<br />
wail, in all cases where more than<br />
$5000 was involved, were permitted.<br />
On December 16 of the present year,<br />
under the heading, above referred to,<br />
another amendment was made, by<br />
which appeals , of the nature noted<br />
are no longer ' allowed. Should the<br />
bill as it passed the house receive the<br />
sanction of the senate, persons dissat<br />
isfied with judgments of the supreme<br />
court of the territory will be compelled<br />
to resort to what the lawyers call<br />
certiorari.<br />
Put in plain English, this means that<br />
the $5000 clause is entirely wiped out,<br />
and appeals in the future will be as<br />
a matter of grace father than of right<br />
Lawyers also say that the granting; of<br />
writs of certiorari to ; the supreme<br />
court of the United States is ft ery<br />
rare incident, and that the amendment<br />
passed by the"house wllf practically<br />
nullify the right of appeal to the su<br />
preme court of the United States, $ave<br />

any such case unless the petition therefor<br />
is'presented to the supreme court<br />
of the United States within six months<br />
from the date of such Judgment or<br />
decree."<br />
The change has been made after the<br />
words "provisions of section 237."<br />
The house debate on this bill, as<br />
shown by the Congressional Record of<br />
December 16, does not indicate that<br />
Hawaii was given any attention,<br />
though Porto Rico is spoken for.<br />

Chief Justice A-- G. M. Robertson, on<br />
being informed of the bill's passage by<br />
the house, said he wondered , who was<br />
urging the measure. "I think that the<br />
provision allowing appeals from Hawaii<br />
has worked well on the whole,'<br />
said the chief justice, "and ought to<br />
be retained."<br />

final effort to establish prohibition in<br />
Hawaii is being arranged. It is realized<br />
that but little time remains in<br />
which to accomplish this end before<br />
the present session of Congress expires<br />
on March 4. For that reason<br />
Senator Gronna and those legislators<br />
who think with him that all stimu-<br />
lants should be removed from the mid-pacifi-<br />
c<br />
territory are manifesting<br />
symptoms of becoming busy.<br />
The peg on which renewed activity<br />
looking to eradicating the rum evil<br />
from Hawaii is hung originated with<br />
the determination of the house rules<br />
committee to bring a direct vote on<br />
the Hobson resolution amending the<br />
Federal Constitution so that prohibition<br />
may become nation-wid- e. It was<br />
decided to have this vote taken in the<br />
house December. 22. A two-thir-ds being<br />
necessary to adopt the resolution<br />
in the house its defeat was accepted<br />
as & foregone conclusion. Enough<br />
votes have been In sight all along to<br />
pretent favorable action. The sticking<br />
point.was that a large number of<br />
memtarjdesirdd tc 4uclt the "actual<br />
possible , bjr une; action of toe TaTea<br />
committee, fixing a date for. voting.<br />
Hence it became apparent that each<br />
and v every member who did not seek<br />
nation-wid- e prohibition must step forward<br />
and go on record to that effect<br />
Figuring out that prohibition was<br />
lost in the house, and Hawaii would<br />
not be included In a nation-wid- e elim-<br />
ination of drink, those senators who<br />
have been agitating prohibition for<br />
the territory .determined to seize the<br />
opportune moment and endeavor to<br />
have the Gronna bill, which applies<br />
to the territory, taken up and pushed<br />
through before adjournment<br />
It Is not believed that (he end<br />
sought can be achieved. The impression<br />
prevails ' that the tGronna bill<br />
cannot be brought to a vote in the<br />

LEGISLATING FOB HAWAII ON UNJUST<br />

The Star-Bulleti- n is not particularly concerned<br />
with the bill which passed the house of<br />
representatives on December 1(5, concerning appeals<br />
from the Supreme Court of the Territory<br />
of Hawaii to the Supreme Court of the United<br />
States in cases where more than five thousand<br />
dollars is involved. Nor as laymen are we suf-ficieut- ly<br />
advised as to the justice or lack of<br />
justice in the amendment.<br />
Wre are, however, and all citizens of Hawaii<br />
must be, concerned in the method employed.<br />
The title of the bill teaches nothing. Some<br />
years ago the right to the appeal was granted<br />
notony of an appropriation bill. No citizen of<br />
Hawaii appears to have been consulted, either<br />
iii the granting of the right, or in its abolition.<br />
Some idea of the multitude of bills introduced<br />
in Congress may be gathered from the<br />
fact that the one which passed on December 10<br />
is numbered With the innocent title<br />
attached to it, the fact that it has been<br />

them. Mr. George Webb's work shows<br />

stage presence, fine voice a no<br />
authoritative, facile methods - are admirable.<br />
Miss Florence Oakley is<br />
very good indeed. Her. transitions<br />
from comedy to a mood bordering on<br />
the pathetic are convincing, which Is<br />
saying a good deal where the comedy<br />
runs as high and the movement is as<br />
swift as in "Our Wives." Indeed,<br />
some of the best moments,, of the play<br />

The three hapless husbands-Syf-v- an<br />
Martin, taken by Mr. Jack Fraser;<br />
Harry Lyon, by, Mr. Cliff Thompson,<br />
and Melville Tatum, by Mr. Bert<br />
Chapman carry the comedy finely.<br />
Their work is well sustained throughout.<br />
The three wives are equally well<br />
portrayed by Miss Olga Gray, Miss<br />
Blanche Burns and Miss Helen Carew.<br />
Broad comedy is their cue and they<br />
respond to it effectively.<br />
A particularly good bit of character<br />
work is done by Mr. Robert Mackenzie<br />
as Otto, the" butler. He playB a<br />
very large part throughout the three-ac- t<br />
comedy and plays it welL .<br />
Tonight and tomorrow night "Our<br />
Wives" will again be the bill and certainly<br />
this comedy should idraw banner<br />
houses. There . were plenty of<br />
seats back! of the dividing aisle last<br />
night and the play is essentially one<br />
that 4 gets over" to every part of the<br />
house. On its merits the play deserves<br />
to be well patronized and the cause<br />
of the Army Relief Society will be<br />
served besides.<br />
A pretty feature last night to be<br />
repeated on the succeeding nights,<br />
was the selling of lapel rosettes, in the<br />
national colors by lads from the Hono<br />
lulu School for. Boys. The rosettes<br />
were furnished by Mrs. Walter F. Dillingham.<br />
