State of the City<br />

Is now the time?<br />

For much of 2016, interest rates have been at record lows, tempting many people<br />

to buy houses. Towards the end of the year, rates began to climb slightly,<br />

but are still low compared to historical rates. No one can predict what a Trump<br />

presidency might do to the market; however, some analysts point out that at<br />

times, when mortgage rates rise, house prices are forced down to compensate.<br />

Thus, the average Lakewood home buyer may not feel a rate increase,<br />

although he will be paying more to interest and less to equity. In highly desirable<br />

areas, house prices are likely to remain constant even with a rate increase.<br />

Ultimately, though, no one can predict the unpredictable, and buyers should be<br />

sure to do their due diligence to ensure that they can afford their purchases.<br />

The Lakewood market<br />

The end of 2016 has seen a slowdown in new construction purchases, as tenants<br />

become scarcer. With an overabundance of inexpensive rentals on the<br />

market, many homeowners are having difficulty finding basement tenants.<br />

Some buyers are reluctant to count on rental incomes, instead opting for singlefamily<br />

homes, many of them beyond Lakewood’s borders. Homeowners in<br />

perenially popular neighborhoods, like Yeshiva area and Ridge, are unlikely to<br />

be concerned about a dearth of tenants. Some report that developments also<br />

seem to attract tenants more easily in their first years, starting to feel the bite<br />

of the competition more closely only when other, newer projects open.<br />

The popularity of single-family homes in neighboring towns has impacted<br />

some Lakewood neighborhoods, as prices in areas such as Raintree have fallen<br />

slightly due to the availability of similar homes elsewhere at lower prices.<br />

Some anticipate that the price of houses will drop as people become reluctant<br />

to rely on rental income to pay their mortgages, but only time will tell for sure.<br />

The move to Jackson and Toms River is picking up speed. While previously, frum<br />

settlement has been confined to a few isolated pockets, it has lately begun<br />

to spread out across wider areas. So far, no shuls have been approved, and<br />

lots of cash on hand, if you can’t prove that you have a reliable income<br />

source, you may not be able to obtain a mortgage.<br />

• Do you plan to live in the neighborhood for a while? If you don’t plan to<br />

hold onto your home, it’s generally not recommended to purchase it: closing<br />

costs, which can total $7,000-$10,000, and the high interest payments<br />

at the start of a loan mean that short-term home ownership is usually not a<br />

wise investment. While some people will rent out their home if they choose<br />

not to live in it, not everyone is comfortable being an absentee landlord.<br />

Generally, the longer you stay in a house, the more cost-effective home<br />

ownership becomes. Although not necessarily applicable to every situation,<br />

conventional wisdom suggests not buying a house unless you plan to<br />

live in it for five years.<br />

• Are you prepared to be a superintendent, or do you prefer to be a tenant?<br />

Remember, you’ll be responsible for all repairs and landscaping in your new<br />

home. If the roof needs replacing, you’ll foot the bill, which may total upwards<br />

of $10,000.<br />

• Get a free credit report (each<br />

of the three credit reporting<br />

companies, Equifax, Experian,<br />

and TransUnion, is required to<br />

provide consumers with one<br />

free report annually). Review it<br />

Understanding your credit score<br />

The majority of Americans have credit<br />

scores somewhere between 600 –<br />

800. For the best loan rates, lenders<br />

look for scores of 720 or above.<br />

Factors that contribute to your<br />

score include your bill-paying<br />

history (have you been on-time?),<br />

your current debt and available<br />

credit (maxing out your cards<br />

regularly is a no-no, but so is<br />

having lots of open cards and<br />

available credit), as well as more<br />

minor factors like length of credit<br />

Keep track of checks you’ve<br />

written, credit card transactions,<br />

and ATM card usage. Review your<br />

monthly statements and report any<br />

discrepancies immediately.<br />

Don’t exceed your credit limit on<br />

lines of credit and credit cards.<br />

Pay what you owe: Always pay<br />

at least your minimum monthly<br />

payment. Be sure not to skip any<br />

payments.<br />

Timely payment is one of the best<br />

ways to establish yourself as a<br />

good credit risk to future lenders. so<br />

stay on top of your bills by making<br />

them all due on the same day of<br />

the month. Contact your lender —<br />

many will allow you to choose your<br />

payment due date.<br />

Schedule automatic payments to<br />

ensure you don’t forget a bill<br />

Keep contact information current:<br />

When moving, be sure to update<br />

your address so you don’t lose track<br />

of bills and statements<br />

closely to see how you can improve your credit score.<br />

• Be aware that using credit cards, even if you pay your bill in full every month,<br />

creates a minimum payment, which mortgage lenders view as debt. When<br />

possible, minimize credit card usage for the month or months before you<br />

apply for a mortgage.<br />

• Lenders require you to demonstrate a stable employment history, so be<br />

careful about switching between 1099 and W2 status (for example, transitioning<br />

from full-time work to freelancing or vice-versa); this could potentially<br />

disqualify you because of your employment history.<br />

A check from an unrecognized<br />

source — for example, a gemach<br />

— can be very difficult to explain<br />

to a bank and may cause your<br />

application to be denied. However,<br />

gifts from blood relatives are<br />

acceptable if they sign a gift letter;<br />

be sure to discuss the possibilities<br />

and limitations of such gifts with<br />

your mortgage professional.<br />

Lenders require meticulous documentation<br />

of every dollar used<br />

towards the down payment, so<br />

any large or unusual deposits into<br />

any of your accounts will be scrutinized<br />

carefully. Whenever possible,<br />

consolidate all the money<br />

for the down payment into one<br />

account as early as possible. Keep<br />

copies of all checks, deposits, and<br />

statements that document the<br />

flow of money in and out of the<br />

account at least two to three months before you will be paying a deposit on<br />

a house or closing.<br />

Get pre-approved<br />

As soon as you’ve decided you are interested in purchasing a home, sit down<br />

with a mortgage professional to discuss how much credit you can expect to<br />

receive. This initial discussion can lead to one of two outcomes: prequalification<br />

or preapproval. Although often used interchangeably, the terms do in<br />

fact carry different meanings.<br />

Prequalification is a non-binding assessment of the buyer’s credit, income,<br />

and assets which allows the mortgage broker to provide an estimate of the<br />

loan amount the buyer will qualify for. Based on the buyer’s self-reported information,<br />

a prequalification is neither checked for accuracy nor guaranteed.<br />

A preapproval, on the other hand, usually entails actually pulling the buyer’s<br />

credit and examining all the pertinent documentation. Valid for a limited time<br />

period (typically 120 days), the preapproval letter confirms how much credit<br />

the buyer will qualify for, and at what interest rate. Getting pre-approved signals<br />

to sellers and real estate agents that you are really prepared to buy, and<br />

greatly reduces your risk of failing to qualify for a mortgage. Some agents<br />

won’t even show you houses or make offers on your behalf without a preapproval<br />

in hand. Pre-approval can also save precious time down the line,<br />

when you are trying to qualify for a mortgage under a tight deadline.<br />

How much house can you afford?<br />

Calculating how much you can afford to spend on a house, and how much<br />

credit you can expect to be approved for, is a complicated equation with numerous<br />

factors coming into play. While expert advice is best obtained from a<br />

mortgage professional, it is helpful to understand a number of basic concepts.<br />

Banks typically determine your loan size based on your debt to income ratio<br />

(DTI); they will not allow your monthly payment to be more than a certain<br />

percentage, often 36%, of your income. So if you already have student loans<br />

or car financing, you will generally not be able to receive as large a mortgage.<br />

DTI limits can vary significantly between different lenders.<br />

Also, the higher your credit score, the lower the interest rate you will be able<br />

to secure.<br />

In Lakewood, many people rely on rentable apartments to help meet their<br />

mortgage payments. However, this income will rarely count on your loan<br />

application, even if the apartment has all the necessary permits. While a<br />

rental apartment can still help you afford your monthly mortgage payment,<br />

do not rely on it to secure the loan in the first place.<br />

When you have determined the maximum monthly payment you can make,<br />

you are ready to determine how much you can afford to spend on a house.<br />

Once you own your home, you will be making monthly mortgage payments.<br />

Each payment has four components, commonly referred to by the acronym<br />

PITI: principal, or money borrowed to pay for your home; interest on your<br />

loan; property tax; and home insurance. Toward the beginning of your payments,<br />

a larger percentage of your payment goes to covering the interest on<br />

the loan, but as you pay off more of the loan principal, each month you will be<br />

paying more toward the principal and less in interest.<br />

To illustrate the amortization<br />

process, consider a typical<br />

30-year mortgage of $300,000<br />

begun in 2016. At a 5% interest<br />

rate, the monthly mortgage +<br />

interest will be about $1500, but<br />

only about 20-25% of that will<br />

initially go towards principal; the<br />

rest will pay interest. It will take<br />

about 24 years until that ratio is<br />

reversed, so that by March 2040<br />

80% of the payment will be<br />

towards principal while the rest<br />

goes to interest. By 2046, you<br />

will own the home free and clear.<br />

Amortization refers to this process<br />

of decreasing the amount of loan<br />

principal over time; an amortization<br />

schedule, provided when you obtain<br />

a mortgage, will show you where your<br />

dollars are going over the length of<br />

the loan. A mortgage calculator can<br />

show you how the breakdown progresses.<br />

You can find a mortgage<br />

calculator online, or use an app that<br />

doesn’t require internet access.<br />

Bear in mind that your monthly payment<br />

is not absolutely fixed; your<br />

property taxes and insurance payments<br />

may rise, so be prepared for your<br />

payments to increase even though your<br />

interest rate stays the same.<br />

Although loans are usually structured for the lender to escrow for your taxes<br />

and insurance, you may be allowed to pay them independently if you prefer;<br />

discuss the possibility with your mortgage professional.<br />

Additional closing and ownership costs<br />

Remember that affording the down payment and monthly payments is not<br />

enough; you aren’t done yet!<br />

If you are buying pre-construction, there may be many upgrades you will<br />

want to make that aren’t covered by the contract, such as exterior lighting, an<br />

additional bathroom, or plumbing for a Pesach kitchen. Payment for these will<br />

not be included in the mortgage, so you will need a cash buffer to cover them.<br />

When you apply for a mortgage, your mortgage representative will give you<br />

a disclosure of estimated closing costs. The total amount charged at closing<br />

can’t legally exceed that, with the exception of some charges that can fluctuate<br />

by up to 10%. Be aware that these closing costs are not all extra fees;<br />

some are simply payments that need to be made upfront and placed into<br />

escrow, so the money really remains yours. Make sure to leave enough room<br />

in your budget to cover the various expenses that will arise. (For more information<br />

about these individual costs, see “Under Contract”, page 66.)<br />

• Home appraisal: Ordered by the mortgage lender, this can cost between<br />

$350 and $500<br />

• Closing fee for attorney: This typically ranges from $1200-$1800.<br />

• Title policy: This is about 1% of the loan cost<br />

• Homeowner’s insurance: While this is typically paid as part of the monthly<br />

payment, the first year’s premium is usually due at closing, and is typically<br />

a minimum of $600.<br />

• Property tax escrow: Usually one quarter’s taxes<br />

• Bank fee: This covers loan origination and processing, and is typically between<br />

$1000-$1500.<br />

• Interest for remainder of the month of closing: If you close in mid-April,<br />

you will need to pay the interest for the remainder of April at closing, and<br />

then your next mortgage payment will come due on June 1, as each mortgage<br />

payment covers the previous month’s accrued interest.<br />

Aside from the actual closing costs, you may have other expenditures, such as<br />

moving, painting, renovations, or purchasing furniture or mezuzos. Also, don’t<br />

forget that once you own your own house, you will be responsible for any appliances<br />

that break, exterminator fees, and other assorted maintenance costs.<br />

Don’t use your entire budget on the house and leave yourself with no padding!<br />

Consider Co-borrowing<br />

Both co-signers and co-borrowers are other individuals whose income,<br />

debt, and credit are factored into the calculation when determining the loan<br />

amount you qualify for. Including a co-signer on the loan can significantly<br />

increase the loan size that a borrower qualifies for; for more information on<br />

co-borrowing, see page 69.<br />

How much will you put down?<br />

Just how much of a down payment should you plan to put down? With a<br />

smaller down payment, your initial cash outlay will be less, but your monthly<br />

payment will consequently be higher. Also, many lenders will require you to<br />

purchase private mortgage insurance (PMI), which protects them from loss in<br />

case you default on your payments. PMI usually costs between .5%-1% of the<br />

loan value on an annual basis, so a $200,000 loan might incur an additional<br />

annual PMI cost of $1,000-$2,000, or up to about $166 extra a month. This<br />

expense has the additional disadvantage of increasing the debt factored into<br />

the DTI determination, which could result in a rejection of the application.<br />

The “magic number” for down payments that most people are familiar with is<br />

20%. 20% is ideal for a number of reasons:<br />

• Mortgage lenders view the transaction as lower risk, thus allowing you to qualify<br />

for the best possible mortgage rate based on your income and credit history.<br />

• Your monthly payment will be lower if your total loan amount is smaller.<br />

• Lenders will not require the added expense of mortgage insurance, which<br />

protects the lender if you default on the loan.<br />

For some, who are sure they can afford the costs of home ownership but<br />

don’t qualify for a conventional loan, FHA loans, secured by the Federal Housing<br />

Administration, can be a viable alternative. However, because of the very<br />

high insurance costs associated with these loans, they are generally only recommended<br />

for buyers with no other options. Learn more about FHA loans on<br />

page 68.<br />

Once you have determined how much you are prepared to spend on a house,<br />

you are prepared to embark on the house hunt.<br />

Buying vs. building<br />

By far the most common purchase is that of an existing home, purchased<br />

from a previous owner. One attraction of an existing home is its immediacy;<br />

these offers abound, and once you find the home you want, you simply need<br />

to sign a contract and arrange financing, and could move in within a month<br />

or two of first seeing the home.<br />

Purchasing a new home from a builder or developer is another option. Rather<br />

than choosing every tile, cabinet, and finish, a basic package has been determined<br />

for you, although you can often upgrade specific components, and the<br />

framework allows for expansion down the line. This keeps costs and delays<br />

down, while allowing you some control over the finished product.<br />

Others choose to purchase a lot and hire a builder to build a custom home.<br />

The sky is the limit in terms of customization and flexibility, but all that<br />

uniqueness will have to be paid for, making this the most expensive option<br />

for most people. While an existing home may require some renovations or<br />

upgrades, when building, there is always the temptation to add in numerous<br />

upgrades and personal customizations, all of which quickly add up.<br />

Also, because you have complete control over every element of the construction,<br />

you will be involved in choosing everything from cabinet hardware to<br />

appliances to paint colors. Some people love these decisions, while others<br />

find them overwhelming. Be prepared for a wait before you move in; construction<br />

takes time, and anything from inclement weather to labor shortages can<br />

slow it down.<br />

To build your dream home, you will need to finance two steps: the purchase of<br />

a lot, as well as the construction. This will require either large cash reserves, to<br />

buy your lot free and clear, or impeccable credit and income to qualify for loans<br />

to cover both of these investments. Unless you have an excellent deal on a lot,<br />

building a custom home will usually be your most expensive option, but may<br />

be worth it to you in terms of the flexibility and customization it will afford you.<br />

Working with a Real Estate Agent<br />

Because real estate agents are typically paid a commission by the seller (in<br />

the frum community, usually 3-4% of the purchase price, or as little as 1%<br />

on new construction), there is very little reason not to engage their services<br />

when house-hunting. Buying without an agent is usually recommended only<br />

for investors or very experienced buyers with expert familiarity with the ins<br />

and outs of the real estate market.<br />

The real estate agent will hold your hand throughout the home-buying process,<br />

explaining the steps to you, guiding your choices, and answering your questions.<br />

Some ways a real-estate agent can help streamline your search include:<br />

• Saving you time and effort by scouting listings and narrowing down the choices<br />

• Advising you whether prices are fair and/or whether the house has defects<br />

that you might not otherwise notice<br />

• Negotiating sale price and terms<br />

• Recommending the services of other professionals involved in the purchase<br />

process, such as lawyers or mortgage brokers, if you don’t have one<br />

already<br />

Choosing a real estate agent<br />

Because the real estate agent will be you go-to person with all your questions<br />

and concerns throughout the home-buying process, availability is crucial. You<br />

need to be sure that the agent will answer your calls or emails, explain things<br />

clearly, and understand your needs and priorities. As with other professionals<br />

you will encounter, recommendations from friends or family are important.<br />

Aside from recommendations, the personal relationship is vital as well. You<br />

may be spending long hours with your agent visiting houses and weighing<br />

their pros and cons, so make sure that you feel comfortable with the agent,<br />

and that you don’t feel rushed or intimidated by him/her. Do you feel that<br />

he/she respects your preferences? Because the agent plays such an integral<br />

role, including helping choose the other key professionals in the process, it is<br />

vital that you establish trust as well as a good rapport.<br />

Don’t worry about choosing an agent who has a lot of his or her own listings.<br />

All agents have access to the same available houses; any agent can show<br />

you a house listed by another agent, even if they are not part of the same office.<br />

In fact, using the listing agent as your own agent can potentially create<br />

a conflict of interest: the listing agent is working on the seller’s behalf and is<br />

legally bound to negotiate for him, which may impact your ability to negotiate<br />

a better price or other concessions.<br />

If you do have a particular area or type of house in mind — if you’re only<br />

looking within a specific neighborhood, or if you prefer a newly constructed<br />

home — you may choose to look for an agent who specializes in that field. To<br />

determine who that specialist is, inquire how many of that type of house an<br />

individual agent has sold, and speak to references who have bought that type<br />

of house through the agent.<br />

Agent Exclusivity<br />

The advantage of commitment to a particular agent cannot be overstated. While<br />

in many industries, it is common practice to pay a retainer or a fee for any visit,<br />

regardless of the job outcome, real estate agents are compensated only when a<br />

sale is completed, which could theoretically take months or never happen at all.<br />

A real estate agent, then, is motivated to do whatever he can to close a sale,<br />

but will not be able to invest inordinate amounts of time in clients who are not<br />

serious. If an agent realizes that the customer is shopping around, talking to<br />

other agents, and calling sellers directly (any of which could cost the agent his<br />

commission), the agent will be unable to give that particular search his all, as<br />

his client’s trust is his only guarantee of ever being compensated for his time.<br />

If you do speak with an agent other than your own, such as at an open house,<br />

be upfront about the fact that you have already committed to a different agent.<br />

When you commit to work exclusively with one agent, he or she will act as<br />

an advocate on your behalf. If he is confident that he has your trust and your<br />

business, that will be the incentive necessary to build a productive relationship<br />

in which he does whatever he can to further your search.<br />

suited to your family will depend<br />

on a lot of dynamics. How many<br />

kids? What are their ages? Do you<br />

host a lot of company, or perhaps<br />

boarders or elderly parents? Here<br />

are some of Lakewood’s most<br />

common house styles.<br />

The ranch house is laid out entirely on<br />

one floor, often with a built-in garage.<br />

Some will have basements.<br />

The colonial, the country’s most<br />

popular house style, is a 2-3 story<br />

home, which separates the bedrooms<br />

on the upper floor(s) from<br />

the daytime living space, located<br />

on ground level.<br />

A bi-level opens to face two halfflights<br />

of stairs, one leading up to<br />

the majority of the living space —<br />

the kitchen, dining room, and some<br />

bedrooms — and the other leading<br />

down, often to 1-2 bedrooms, a<br />

family room or study, laundry<br />

room, and perhaps a garage.<br />

A cape is generally one-and-ahalf<br />

stories, with a steep roof with<br />

dormers. The facade is typically<br />

simple and unadorned.<br />

The split-level has multiple levels of<br />

living space — usually family room and<br />

garage on the lower level (while still<br />

not underground), then dining area<br />

and kitchen on the middle (main) level,<br />

and bedrooms above. Other ways of<br />

While some of this infrastructure may come with time, local residents and zoning<br />

boards often resist the encroachment of Jewish institutions. “Jackson Strong” and<br />

“Toms River Strong” signs urging locals not to sell out are a familiar sight. While<br />

most neighbors are courteous and polite to whoever behaves in kind to them, it is<br />

worthwhile to verify to the best of one’s ability that the nieghbors near a prospective<br />

home are respectful and not hostile.<br />

Aside from the comforts of feeling welcome, other issues<br />

to consider include:<br />

• Community infrastructure: As of this printing, no<br />

shuls have been approved in either Jackson or Toms<br />

River. Additionally, no mikveh is on the horizon in<br />

either town.<br />

• Construction permits: In Lakewood, it’s unfortunately<br />

too easy to fall into sloppy habits regarding<br />

permits and other building ordinances. Exercise<br />

care to hire contractors who are well-versed in the<br />

appropriate building codes and will adhere to the<br />

letter of the law while executing your project.<br />

• Transportation: When trying to obtain busing<br />

to Lakewood schools, students who live in other<br />

towns have met with varying degrees of success.<br />

The township reimburses the Lakewood Board of<br />

Lakewood schools; in practice, there are sometimes<br />

while others bring their children to the nearest stop<br />

Jackson is home to increasing numbers of frum families in a wide variety of neighborhoods.<br />

It offers everything from affordable starter homes to stately mansions, with<br />

all kinds of neighbors.<br />

Brookwood I and II, north of County<br />

Line near NPGS, are home to about<br />

75 frum families. The mostly capes<br />

and some ranches and bi-levels that<br />

populate this area range in size from<br />

about 1300-1800 square feet. With prices<br />

ranging in the upper $200- to low<br />

$300’s, many young yeshivish families<br />

are purchasing their first homes in this<br />

area. The nearest formal shul is in the<br />

Pawnee area, a 15-20 minute walk.<br />

Brookwood III, also known as Villanova,<br />

across County Line, is the closest Brookwood<br />

neighborhood to Lakewood, with<br />

similar houses to the others, but with a<br />

larger number of colonials. Brookwood<br />

IV, while the furthest out, is beginning<br />

to gain traction among both resident<br />

owners and investors.<br />

Just a bit further north, Harmony Farms<br />

(already about 40 families) and Oakley<br />

Hill are growing as well, and offer larger<br />

houses in a variety of layouts, including<br />

colonials and split levels.<br />

Green Valley features a wide range of<br />

home types. One can easily find larger<br />

The crowd is diverse in age, and there a<br />

variety of house styles available, some<br />

very large but most more average in<br />

size. Well over a minyan of families already<br />

As far east as Flair but further south,<br />

Meadow Run and surrounding blocks,<br />

such as Owl, Blue Heron, and Mimi, are<br />

seeing a lot of sales. The upscale houses<br />

in this area go for $600k and up. Further<br />

south, around Melissa Lee and nearby<br />

streets like Pitney and Daniel, prices are<br />

lower, starting in the $500’s, with less<br />

oversized houses.<br />

Walk are two options for single family<br />

a sizeable Sefardic presence.<br />

Hearthstone, bounded by Route 9,<br />

Cross, and Massachusetts, is a quiet,<br />

mostly yeshivish neighborhood of<br />

bi-levels and some ranches ranging in<br />

price from the high $300s to the mid-<br />

$400s. More recently, development has<br />

beugn on its outskirts, with townhouses<br />

such as Chateu Woods and private<br />

homes on Finchley.<br />

Albert Avenue offers some of the largest<br />

lots in Lakewood. The value of these<br />

houses is typically in the land, which<br />

can be worth $300-400k.<br />

Chestnut Estates comprises diverse<br />

• Check out the window exposure in the home. When and where does the<br />

house get sunlight? This will impact both quality of life, as well as utilities.<br />

For example, an end-unit townhouse will have more sun and space, but<br />

higher utility bills.<br />

• Drive down the street at different times of night and day. Are the neighbors<br />

noisy? Is there a lot of vehicular traffic at certain times? Are there<br />

unsavory characters using the street as a shortcut or hangout? Who can<br />

see into the backyard?<br />

• Ask about utilities. Inquire whether there was ever an underground oil<br />

tank and whether it was properly removed. If the house is heated through<br />

an above-ground oil tank, make sure you understand what that entails;<br />

many people today prefer gas heat. Most people also prefer city sewer instead<br />

of a septic tank (if you have a septic tank, the potentially expensive<br />

repairs would be your headache, not the city’s, although septic tanks are<br />

much cheaper on a monthly basis).<br />

• Has the house been renovated? Verify that all renovations were performed<br />

properly, and that the utility systems in place are capable of handling the<br />

added space, so that the addition will be properly cooled and heated when<br />

necessary. If you are thinking of adding to the home, double check the zoning<br />

laws to make sure that you can.<br />

• Find out the amount of the property taxes on the home.<br />

• Search the State Police database at www.njsp.org for any nearby registered<br />

offenders.<br />

Lakewood Living: Development or Private Home<br />

For many prospective Lakewood homeowners, this is the million-dollar question.<br />

Developments are convenient, sociable, and often cost-effective, and<br />

the houses are well-designed for frum families. Private homes can be more<br />

costly, are often older and generally do not have amenities designed for frum<br />

living. These homes do often provide more privacy and outdoor space that<br />

you can call your own. How do you choose between the two options?<br />

Here are some questions that you can ask yourself to help you decide which<br />

style better suits your personality.<br />

• Do you crave a unique home, or do you love that easy and convenient layout<br />

and don’t care that your house is identical to those of your neighbors,?<br />

• Are you a private person or more sociable? Will it bother you if all the outdoor<br />

space you have access to is communal, or will you love the built-in social life?<br />

• Do you have small children? Developments offer easy access to a communal<br />

playground, built-in friends for your kids, and more. But if you are<br />

somebody who likes to stay inside more and keep to your own schedule,<br />

or who enjoys open spaces and large green yards, a development may not<br />

be for you.<br />

• Are you comfortable being a landlord? Often, owning a townhouse in a<br />

development means renting out an apartment. This entails sharing close<br />

quarters (soundproofing has its limits!) and sometimes common space with<br />

another family. You also need to be sure that you have the temperament to<br />

collect rent from a potentially recalcitrant tenant and take responsibility for<br />

maintenance and repairs.<br />

• Are you prepared for maintenance? In a private home, you will be responsible<br />

for outdoor maintenance like shoveling snow and lawn care, which is<br />

usually covered by the homeowner’s association in a development.<br />

New Construction vs existing Homes<br />

New homes go up almost daily in Lakewood, but there are also many buyers<br />

who opt to purchase a resale house. Here are some considerations to factor<br />

into that choice:<br />

• Is somebody in your family handy? Newer homes are likely to need less<br />

maintenance and repairs than older ones.<br />

• Who are the developer and builder of the new construction? The developer,<br />

who is backing the project, needs to be someone you can trust will not<br />

cut corners. The builder who is actually executing the project should stand<br />

behind his work and take responsibility for defects even after closing.<br />

• What is your timeframe? Depending on what stage the construction is up<br />

to, you may need to wait months or more before a new home is completed.,<br />

while a resale home may be just waiting for you to close.<br />

Although newly built homes appear to have a higher price tag than some<br />

older private homes, from a financial perspective, you might come out ahead<br />

by buying one anyway under certain circumstances.<br />

• Many new homes are built with rentable basements. Many people rely<br />

on this income to cover the larger mortgage payment, but being unable to<br />

secure a tenant for a few months can be financially draining. In a development,<br />

you will also pay a monthly association fee of about $50-$100 to<br />

cover maintenance of common areas.<br />

• New homes are purchased in move-in condition, with no need for expensive<br />

renovations — which are not covered by the mortgage. You also will<br />

typically have much more time before a new home begins to need costly<br />

major repairs. Additionally, some systems, like the HVAC or roof, may be<br />

under a builder’s warranty, further minimizing your risk.<br />

• New construction is built with an eye towards the future. A good developer<br />

will build a framework that will allow for future expansion and<br />

customization down the line. The electric, HVAC, and other systems are<br />

built with an understanding of contemporary needs.<br />

Some buyers view short sales or foreclosures as an opportunity to snatch up<br />

a great deal. However, these transactions are often complicated and end up<br />

generating hidden costs and aggravation. Unless you are a seasoned investor,<br />

many agents will advise against these purchases.<br />

Negotiating a Price<br />

When you finally find the house you want, you are ready to make your initial<br />

offer. If you’re working with a real-estate agent, he will conduct the negotiations<br />

on your behalf, but the principles are the same. While you obviously<br />

want to secure the lowest price possible, you also need to be taken seriously<br />

as a potential buyer to encourage the seller to work with you. Do your homework<br />

well so that you can choose an appropriate starting point.<br />

Ask your agent or review public records, available from the County Clerk’s office,<br />

to learn about recent homes sales in the neighborhood. For how long were<br />

they on the market? How much is the asking price? How much was the selling<br />

price? Try to understand the seller’s position as much as you can: Does he have<br />

any particular pressure factors that will push him to accept an offer more hastily?<br />

Is he closing on another house or starting a job elsewhere very soon?<br />

At the same time, do not offer any more information about yourself than is<br />

strictly necessary. You want to be careful not to sound desperate for this particular<br />

house; if you treat the process as a business transaction without getting<br />

emotionally involved, you are less likely to be taken advantage of.<br />

Once you agree on a price, both sides will sign a contract for the sale of the<br />

home. The contract will list the price, the dates for the deposit and other<br />

payments and the latest closing date. The contract will also list any exclusions<br />

or inclusions to the contract (e.g., are the appliances included in the<br />

sale? The window treatments?).<br />

A typical contract includes several conditions that need to be met before the<br />

deal is closed. These conditions are called contingencies. Both parties to the<br />

contract will have contingencies protecting their interests. Some of the most<br />

common ones include:<br />

• An inspection contingency provides you with a frame of time in which to<br />

conduct a home inspection and discuss the results with the seller. At that<br />

point, if material defects are found, the seller will usually need to offer to<br />

cure the defect, offer you a credit for curing the defect, or allow you to walk<br />

away.<br />

• A financing contingency allows you to walk away from the deal if you cannot<br />

obtain financing by a set date.<br />

• Some buyers add an insurance contingency which makes the contract dependent<br />

on their ability to get homeowner’s insurance, which might be a<br />

challenge in areas known to have specific problems, such as flooding or<br />

mold.<br />

• Other less standard contingencies that are subject to negotiation are contingencies<br />

that make the contract dependent on the seller finding a new<br />

home, the buyer selling their current home, or, in a brand-new development,<br />

meeting and approving the other buyers.<br />

Attorney Review<br />

Once both parties have signed the contract, the three-day period of attorney<br />

review begins. You will want your attorney to look at your contract immediately<br />

and iron out any issues, so make sure, when signing, that both you<br />

and the lawyer are available during this period. Don’t sign a contract the day<br />

before you are going out of town to your brother’s chasunah; the brief window<br />

of attorney review is your best chance at catching major problems in the<br />

phrasing of your contract.<br />

If the lawyer finds something problematic in the contract, he or she will negotiate<br />

to have it changed or send a letter of disapproval, which terminates the<br />

contract without a penalty. When both parties have approved the contract,<br />

you will give your deposit to the lawyer, who will hold it in escrow until closing.<br />

Choosing a Lawyer<br />

Choose an attorney based on positive recommendations from friends, family,<br />

or your real estate agent. If accepting your realtor’s recommendation, be<br />

sure to also do some independent verification to ensure that the lawyer is<br />

not dependent on the agent for business or otherwise biased in the agent’s<br />

favor, and that the agent is not receiving any commission or other benefit<br />

from the referral. (The same applies to any other type of professional your<br />

agent recommends.)<br />

• Choose a lawyer who will be responsive to your calls.<br />

• If you work full-time, consider whether off-hours availability, such as<br />

Sundays or evenings, is important to you. You may also want to find out<br />

whether the lawyer maintains a staff who will be able to answer your questions<br />

in his or her absence.<br />

• Make sure you are comfortable asking your lawyer for clarification of any<br />

point, no matter how foolish it may seem to you. If you are intimidated or<br />

don’t feel you are being taken seriously, the lawyer is not for you.<br />

• Does the lawyer meet buyers face-to-face for the initial contract review?<br />

If yes, how long do those meetings typically last?<br />

What services will your attorney provide?<br />

The lawyer will review the purchase contract and negotiate on your behalf to<br />

revise any items he feels are not in your best interest.<br />

Typically, the lawyer also orders the title search and works with the seller’s<br />

lawyer to clear any title concerns. Once the title and mortgage are settled, the<br />

lawyer will review the closing documents provided by the seller to ensure you<br />

are receiving everything necessary. He or she will also file the deed with the<br />

county clerk to register the sale.<br />

If the home inspection or any other process discover any defects in the<br />

home, your lawyer will attempt to negotiate a credit against the purchase<br />

price to cover the cost of repairs. However, be aware that in a strong seller’s<br />

market, the lawyer will not necessarily have enough leverage to negotiate<br />

effectively with the seller. It is not advisable to leave the inspection for late<br />

in the process and hope things work out; it may even be worthwhile to order<br />

an inspection on a home you are seriously considering even before signing<br />

the contract.<br />

Your lawyer will attend the closing with you and walk you through the process<br />

to ensure nothing is skipped and you understand everything.<br />

Attorney Fees<br />

Typically, the fees for these services are assessed on a flat fee schedule, determined<br />

by the details of the sale — is the home new construction? Is it a short<br />

sale? The fee will vary based on circumstances, but expect to pay anywhere<br />

between $1200-$1800 for a residential closing. These fees are very similar<br />

among all local lawyers; shopping around will save a maximum of $200, so<br />

the attorney’s fees should be among the less significant considerations when<br />

selecting your representation.<br />

A retainer of between $200-300 is paid when the lawyer first accepts your<br />

case, with the balance due at closing. If the contract falls through for any reason,<br />

the retainer is the entire compensation the lawyer receives.<br />

Choosing Your Mortgage provider<br />

If you haven’t already, once you’ve entered into a contract you need to immediately<br />

choose a mortgage lender or broker. Several options are available<br />

to choose from.<br />

Bank: Dealing with a bank means going straight to the source, with no middlemen.<br />

Occasionally, this allows you to procure a better rate. A downside of<br />

borrowing from a bank, though, is that you don’t typically receive the full service<br />

experience that a mortgage broker will provide. The bank manager won’t<br />

sit down with you in advance to review your circumstances and advise you on<br />

the best way to prepare for a loan, or whether you will qualify. They also tend<br />

to have the strictest debt to income ratio and income requirements. However,<br />

if you are fairly certain you have your paperwork in order and understand the<br />

process, you may want to go straight to the funding source.<br />

Mortgage Broker: A broker is a professional who connects individuals with<br />

the lenders or banks most appropriate to their needs. He will shop around<br />

for you and help you find the lender most suited to your particular needs. He<br />

will know, based on the particulars of your income, documentation, and other<br />

circumstances, which bank is most likely to extend favorable terms, and will<br />

help you through the process.<br />

Mortgage Lender: A direct lender underwrites the loan and provides the<br />

money, then sells the loan to a bank. All decisions are made in-house, by<br />

their own staff. A direct lender can sometimes offer a more generous debt to<br />

income ratio, and can sometimes obtain faster approvals.<br />

Often, the differences between the types of lenders will make little or no<br />

difference to the buyer; the most important trait to look for is integrity. An<br />

honest, knowledgeable professional will be able to advise you based on<br />

your circumstances and will point you to the best product for your needs.<br />

Mortgage Approval Process<br />

Upon applying for a mortgage, you will submit all your necessary supporting<br />

documents to your loan representative, who will submit them, along with the<br />

mortgage application, to an underwriter. The<br />

underwriter, a representative of the lender,<br />

will review the application and render a decision,<br />

whether to approve the loan, deny it, or<br />

request additional supporting documentation<br />

or explanation of discrepancies.<br />

Also while considering the loan application,<br />

the lender will order a home appraisal to<br />

assess the value of the home. If the home is<br />

appraised as less valuable than the mortgage<br />

Once you have been approved for a loan, you will need to lock in your interest<br />

rate. Locking in a rate means that even if interest rates increase before you<br />

close, you will still receive the loan at the original rate. The shorter you lock<br />

your rate, the better rate you will get. There may also be a charge for long<br />

locks. Sit down with your mortgage representative and discuss the probability<br />

of closing within the specified timeframe and the various risks or benefits<br />

of locking in a rate for a given amount of time. With new construction, in<br />

particular, it can be difficult to determine when the closing will actually occur.<br />

Loan Products<br />

Mortgages are described as either Adjustable Rate Mortgages (ARM) or<br />

fixed-rate. An ARM loan begins with a very low interest rate, but after an initial<br />

introductory period, it can fluctuate in either direction. Because of this volatility,<br />

mortgage professionals strongly caution against ARM loans unless you plan to<br />

either move or otherwise pay off the loan within a very short time period.<br />

The much more common fixed-rate mortgage offers a stable Interest rate over<br />

the length of the loan, and is therefore considered a much safer investment.<br />

Usually, buyers choose a 30-year mortgage. While a 15- or 20-year mortgage<br />

will allow for lower interest rates, as well as much less total interest over the<br />

life of the loan, the monthly payments will be substantially higher, and they<br />

are thus only recommended for small loans or loans that people are absolutely<br />

sure they will be able to afford.<br />

FHA loans<br />

For people who don’t meet the qualifications<br />

of conventional mortgages, the<br />

Federal Housing Administration, or FHA,<br />

insures loans that are easier to be approved<br />

for. FHA loans accept down payments<br />

as low as 3.5%. With lower credit<br />

score requirements, and higher debt-toincome<br />

allowances, these loans are much<br />

easier to qualify for, and have lower interest<br />

rates. However, they can be costly in<br />

other ways, as they require the purchase<br />

of two types of mortgage insurance from the FHA, which together add up to<br />

thousands of dollars in insurance payments.<br />

For some, who are sure they can afford the costs of home ownership but<br />

don’t qualify for a conventional loan, FHA loans can be a viable alternative.<br />

However, because of the very high insurance costs associated with these<br />

loans, they are generally only recommended for buyers with no other options.<br />

responsibility in case of default.<br />

documentation will be scrutinized as carefully as the borrower’s, so be sure<br />

to share it. Another consideration is that missed mortgage payments will adversely<br />

affect the cosigner’s credit, as well.<br />

The co-signer will need to be present at closing, or prepare a Power of Attorney<br />

document that allows someone else to sign in his place.<br />

One drawback of having someone co-sign on a loan is that many special<br />

mortgage programs, such as Citizens in Action or TD First Time Home Buyer’s<br />

program, won’t offer their reduced rates on loans with co-signers.<br />

Understanding Homeowner’s Insurance<br />

To qualify for a mortgage, you will need to show that you have obtained<br />

homeowner’s insurance. Because the home is the lender’s collateral on the<br />

loan, no lender will finance the purchase of a home that is uninsured against<br />

damage or loss.<br />

Homeowner’s insurance policies can cover situations ranging from a thief<br />

making off with one valuable item, to serious structural damage in the event<br />

of a fire or the like, to liability cases if somebody is injured on your property,<br />

so getting appropriate coverage is invaluable.<br />

Start by obtaining quotes from multiple insurance agencies, but verify that<br />

the companies they are quoting from are reputable. What is their pay-out<br />

history like: do they give customers a hard time when processing claims, or<br />

is the process smooth and quick? How long has the company been around?<br />

Websites such as JD Powers and A&M Best give ratings to insurance companies<br />

and are a good source to check before going with a specific company.<br />

Here are some of the basics to know about homeowner’s insurance:<br />

Structure/Dwelling: Insures the structure of your home for a set amount, usually<br />

the amount it would cost to rebuild a comparable home at today’s costs.<br />

Personal Property: Insures the contents of your home up to a certain dollar<br />

amount. Keep in mind that typical policies do not cover the mysterious disappearance<br />

of valuables like a diamond ring or silver; these items often need to<br />

be insured individually after getting appraised. There are various add-ons that<br />

insurance companies offer to their basic policies to insure things like jewelry<br />

and silver. Some companies offer blanket coverage on valuables for a specific<br />

cost, and some insure each item separately; ask your agent about this.<br />

Replacement Cost: If a company guarantees replacement cost, that means<br />

that they will replace the damaged item with a new one at its current cost. The<br />

alternative, Actual Cash Value (ACV), covers only what the item was worth at<br />

the time of the damage, taking depreciation into account. If a 20-year-old roof<br />

is destroyed in a fire, its ACV will be much lower than its replacement cost.<br />

Flood Insurance: Flood insurance is not included in a homeowner’s policy. In<br />

documented flood zones, lenders will require flood insurance, but otherwise<br />

it is optional. Bear in mind, though, that floods can strike anywhere; 25% of<br />

all flood damage claims come from areas that are not high-risk zones.<br />

Sewer Backup: Optional add-on coverage that speaks for itself.<br />

Sometimes a title search will reveal that there is an outstanding court judgment<br />

or other impediment that the seller must address before sale, and the<br />

lawyers and title company will work together to “clear the cloud,” or address<br />

the issue that is blocking the clear transfer of the title.<br />

Once any issues have been resolved, the title company will issue a title policy.<br />

Title insurance protects the parties in the sale from any damage that could<br />

result from any previous erroneous or illegal title transfers, such as in cases<br />

where the title company overlooked documents, documents were filed incorrectly<br />

with the authorities, or previously unknown heirs have stepped forward.<br />

Title insurance is paid for by a one-time premium, payable at closing. The title company<br />

then sends the policy to the buyer’s attorney, who delivers it to the buyer.<br />

The costs of the title company’s services are regulated by the government,<br />

so will vary very little between companies; your lawyer will usually choose the<br />

company whose customer service he prefers. Any kickback or incentive to acquire<br />

a client’s business is illegal.<br />

lender than mortgaging an existing home, these loans typically have tight<br />

criteria. For this reason, it often pays to seek a lender with experience<br />

in securing these types of loans.<br />

Usually, construction loans are short-term loans in which the funds are<br />

released in stages, or “draws”, at different points in the construction process—for<br />

example, before laying the foundation, before framing, etc. Once<br />

the construction is complete, they roll over into conventional mortgages with<br />

the house as collateral. During the construction stage, the interest is usually<br />

structured as “prime-plus”, which is the prime rate (the rate charged by banks<br />

Set price, exactly like it sounds, means that a price is negotiated at the start<br />

contractor might be left with only a small profit, but if prices dropped, he will<br />

A customer using an experienced contractor, who has learned to estimate accurately,<br />

will usually get a better price by paying cost-plus. This is because<br />

contractors need to build a cushion into their set prices to ensure that they are<br />

When overwhelmed by the myriad lighting choices available, many people<br />

opt for the path of least resistance and put in spotlights. However, wiring<br />

each spotlight adds up, so sometimes the most economical choice is to leave<br />

in a builders-grade fixture and eventually upgrade to a permanent fixture,<br />

which can sometimes cost less than the spotlights.<br />

The dining room is usually the most expensive room in the house to light;<br />

budget $700-800 for its fixture, and roughly the same amount for everything<br />

else on the first floor combined.<br />

When building or renovating, most builders will include installation of lighting<br />

fixtures if they are present at the time the work is being done. Try to develop a<br />

lighting plan 4-8 weeks in advance to leave yourself ample time and save money.<br />

Moving in<br />

Summer is far and away the most popular time to move, as families are anxious<br />

to settle in before the school year and yamim tovim arrive. If you can<br />

schedule your move for the off-season, you may be able to negotiate a better<br />

price. Also, weekday moves tend to be cheaper — and easier to reserve — than<br />

Sundays. Book as far in advance as you realistically can; although you want to<br />

secure a good mover as soon as possible, remember that closings are often<br />

delayed, so don’t be too optimistic about your timeframe.<br />

• Label everything, and keep a list! The destination room and a number should<br />

appear on the top and sides of each box. When it’s jammed into a stack of<br />

identical boxes in your new home and you’re desperately looking for Shmuli’s<br />

spaceship pajamas in box 43, you’ll thank yourself. Bonus points for colorcoding<br />

each room’s boxes so the movers easily know where you want things.<br />

• Get lots of supplies. Figure out how many boxes you expect to need, and<br />

then get more — a lot more. People tend to underestimate how much space<br />

their possessions take up. If you are buying from a moving supply store,<br />

you can usually return unused supplies.<br />

• Keep track of valuables — if possible, take expensive items and papers<br />

with you in your car.<br />

You’ve moved in, you love it — and now you want to maintain that fresh feel<br />

and keep everything running in tip-top condition. Here are some pointers that<br />

will help keep your house and its contents in good shape and save you money.<br />

• When moving to a new house, immediately locate your water shutoff<br />

valve so you know where it is in case of emergency.<br />

• Change your filters regularly. Monthly changes are recommended, but if<br />

your family is small or usage low for any other reason, you can get away<br />

with waiting 2-3 months. Use cheap filters, changed regularly, rather than<br />

expensive ones. Neglecting to change your filters adds to your utility bills,<br />

because your HVAC will have to work that much harder to pump air through<br />

the dirt, and the resulting stress can cause mechanical problems.<br />

• Vacuum fridge coils twice annually. Your fridge uses up to 15% of your<br />

home’s energy, so you want it running at optimum efficiency. Vacuuming<br />

twice a year can save you as much as $100 in electricity.<br />

• Vacuum the exhaust duct of your clothes dryer at least once a year to<br />

prevent clogging and fire risk.<br />

• If your toilet is running constantly or flushing on its own, use the shutoff<br />

valve behind the toilet to prevent waste of water and money until it can<br />

be repaired.<br />

• Turn off your outdoor water supply before the winter. Water left in hoses or<br />

pipes can freeze, expand, and cause expensive burst pipes and water damage.<br />

Electrical maintenance<br />

• Bathroom exhaust fans were not made to run all Shabbos! Either install a<br />

timer or a continuous motor fan, or leave it off to avoid blowing the system.<br />

• Just because you’ve overloaded your circuits in the past with no problem<br />

doesn’t mean you will be able to do that with impunity forever. Any appliance<br />

using more than half of a line’s wattage (Think iron, blow drier, fridge,<br />

etc.) should be on its own line. Each GFCI outlet (the ones with reset buttons<br />

in the center) represents an individual line.<br />

• Consider switching your light bulbs to fluorescent, or even LED. Giving<br />

much more light with much less energy consumption, these low-maintenance<br />

options will quickly pay for themselves.<br />

• The police department reminds us to change our smoke detector batteries<br />

when we change the clock, but don’t forget to test the detectors! Use a<br />

blown-out match or candle to make sure they actually detect smoke.<br />

Tile talk<br />

This section has been prepared with the assistance of David Schleifer of Groutworks.<br />

• Keep your eyes open when checking out a house. If you notice several<br />

cracked tiles, or grout missing in a few places, that could mean that the<br />

entire floor will need replacing.<br />

• Push the bottom of a shower tile wall. If it moves and is not solid this may<br />

require significant repair work or even require replacing all the tile,<br />

• For new construction homes always make sure bathtubs are caulked (not<br />

grouted) on all their edges both against the wall and floor or you may<br />

have a leaking issue. Caulk looks more rubbery, as oppose to grout, which<br />

looks and feels like cement.<br />

• Grout often gets discolored by the waste water from mopping; use plenty<br />

of water so that the water doesn’t become blackened and stain the grout.<br />

When done, dry tiles with a towel so the filthy water doesn’t have a chance<br />

to soak into the grout.<br />

• Since the dirty water begins seeping into the grout on contact, you may<br />

choose to seal the grout, which ensures that no dirt will penetrate before<br />

you have a chance to dry your tiles.<br />
