Introduction<br />

Legal Assistance to Helpless Prisoners And Persons (LAHP) is a bureaucratic nonprofit<br />

and nonpolitical organization, which was established in the year 2009 with the philosophy<br />

is to provide aid to the Poor and Helpless prisoner’s in the Court of Law. This is to act<br />

as the contribution for the betterment of the society along with the National Legal Aid<br />

Program of the government. Effective access to justice is not available to the poor.<br />

Constitutional guarantees of human rights, freedom, equality, justice and the equal rule<br />

of law is available for the citizens and it is clearly mentioned in Article 27. Before law and<br />

equal protection of law to all citizens and person remain meaningless for vast majority<br />

of persons since they live below the poverty line and consequently have little or no<br />

access to justice. There is obviously an evident need for a legal aid scheme that would<br />

eventually meet the needs of the poor and create confidence of citizens in the rule of<br />

law and democratic process. The present improvised, adhoc and in the line national<br />

perspective, quite inadequate private efforts in the fi eld inescapably point to the need<br />

for a national institutional effort for providing free legal services.<br />

We are passing every single day with an ever-accelerating pace of the technological<br />

improvement. In simple words we call it the 21st century, a time that only focuses on<br />

the segment for ‘INFORMATION AND TECHNOLOGY’. The more an individual or an<br />

organization is updated the better it will perform. It could be on anything starting from<br />

policy making, strategic plans, management and co-ordination, program, implementation<br />

or benefi ciary selection, etc. Although the government has provided the system with<br />

the facilities for the helpless prisoners to obtain legal assistance, but due to not being<br />

able to collect proper information regarding the issue, we often fi nd the prisoners serving<br />

prison for what he/she is not liable for. It has been found that the information about<br />

the LEGAL AID for the prisoners has no form of system maintained, to keep the public<br />

informed, and so accordingly there are prisoners serving for years doing nothing but<br />

letting their lives to head towards despair. Such lives lead to mental instability, which is<br />

very natural because it only comes from depression. Not only that but also the condition<br />

even lead the prisoners choose a life that will contribute the society with all the possible<br />

negative trials it may require.<br />

Reaching the law and justice system has always been a challenge for the majority of<br />

the population as the governance towards it has been extremely weak and vulnerable.<br />

As a consequence, obtaining a fair trial in case of the court proceedings seems very<br />

restricted. Because of the outdated colonial laws, the judicial segment couldn’t cope<br />

up with time along with the poor fi nancial structure and human resources. The ones<br />

who require the cooperation of the judicial body are often found to be spending more<br />

than they are required to. Of course, again it is because they are not aware of the right<br />

information and their deserving rights as citizens. As a result, there comes a point where<br />

they tend to loose complete interests or the poor system on the other hand stores a<br />

huge amount of backlog of cases. Majority of the population is not aware of the long<br />

detentions without conviction and fair trial, which may constitute a serious violation in<br />

human rights law.<br />

Prisoners/citizens in needed of legal aid will enjoying the benefits of our program.<br />

One wouldn’t need to spend an excess amount of money for running a case.<br />

One won’t be experiencing any sort of harassment or problem while receiving<br />

legal assistance.<br />

One who will be able to legal he/her status in the society once it is proven, the<br />

person is not guilty and free to go.<br />

Objective<br />

We strive to take necessary actions in the justice system for assisting helpless prisoners & people<br />

who strongly required fi nancial support for proceeding further in order to secure their yearned justice.<br />

In order to reduce the percentage of crimes in our society, we plan to educate helpless prisoners & the<br />

general public about the present updated laws in our judiciary regulating system.<br />

We conduct workshops to discuss about the legal structures being updated with time and help the<br />

participants understand the factors that bring changes in the society.<br />

To help publishing the accurate information, news, pictorials, magazine and documentaries by<br />

following the government rules and regulations.<br />

Case story of Sheikh Mohammad Polash Miah<br />

In 6 December, 2016 a feature was published. In the daily star under the headline “<br />

Mentally ill man languishes in Jail”. From that news headline a panel lawyer of<br />

Brahmanbaria came to know about sheikh Md. Polash Mia, who is a mentally ill<br />

person and has been framed for the riot happened in Nasirnagar Hindu area. After<br />

that occurrence the team of LAHP went to Nasirnagar, Brahmanbaria and fi nd out<br />

that man, Sheikh Md. Polash Miah and did a case story on him.<br />

After investigation we came to know that Polash Miah is a mentally ill and poor<br />

person. For his illness he always been captured in home. His father Ohid Miah is a<br />

70 years old ill man and he earns his bread and butter by day labouring. There are<br />

six members in his family. As he is a day labour so it’s very hard for him to maintain<br />

his family and in this condition he can’t afford a lawyer for his son’s case. He borrowed<br />

some money from his relatives and that money has already in the initiate<br />

stage of the case and now nothing left to him. Basically he (Ohid Miah) even don’t<br />

know with his mentally ill son. what to do or where to go to solve the case or how to<br />

hire a lawyer for the case.<br />

31 years old Polash Miah has been arrested on 7 October, 2016 from his home dathmondol.<br />

A face<strong>book</strong> post related with an issue which goes against Islam and by<br />

centralizing it an occurrence took place in Nasirnagar, hindu area and in accordance<br />

with Polash Miah has framed for rioting in houses and temples and for that<br />

reason has been arrested and took him to the jail.<br />

Mentally ill Polash Miah has been transferred to the Comilla Central Jail in 18 November,<br />

2016 when his mental condition has degraded. There his treatment was<br />

done under the authorization of the Jail authority. It has been mentioned in the<br />

general diary that, a boy named Rashraj Das (30) son of Jogonnatgh Das, Village-<br />

Horinber, Horipur Union, Thana- Nasignagar, District: Brahmanbaria has been<br />

posted in his face<strong>book</strong> a mockery post relating “Kaba Sharif”. By centralizing this<br />

<br />

issue Ahle Sunnahtul Jamayet, Bangladeshi Islami Font and Gausia Jubo Songhoton<br />

and all the Muslim people of Nasirnagar Thana and the neighbouring thana<br />

Sorail and the other villages under these two thana, there took place an assembly<br />

near Nasirnagar College turning point and Nasirnagar High School Ground from<br />

10:am to 2:30 pm. In every point of the assembly there gathered approximately<br />

2500/3000 people. The occurrence basically happened during the assembly when<br />

everyone was busy in protesting the post of face<strong>book</strong>, while doing so some disrestraine<br />

people came and start making nuisance over there, not only that but also<br />

they wrongfully entered into the temple and start destroying the idols which is contempt<br />

of religion as well as it hurts the feeling of religious. The losses of such destruction<br />

of idol is not less than fi fty thousand (50000) and they also ravage the<br />

decoration and other equipments which cost thirty thousand taka (30000).<br />

It is also mentioned in general diary that unrestrained people also tried to wrongfully<br />

and forcefully entered into the house of the server of the temple but when the<br />

police tried to restrain them they become more furious and burst into the police<br />

and started throwing stone, paddle and the piece of bricks and came with the<br />

sticks towards the police. After that police started to charge the sticks and threw<br />

rubber bullet and After 30 minutes of their attempt the police fi nally can controlled<br />

the aggrieved people.<br />

Police has arrested so many people randomly from that crowd and framed them<br />

into this case and Sheikh Polash Miah was there in that list. As we have mentioned<br />

above he is a mentally ill man and he has no connection with this occurrence still<br />

he has been framed into this case. Not only that but also it has been mentioned in<br />

the police list that there have enough evidence against Polash Miah that he has<br />

direct involvement into that occurrence and if he came out in bail he might cause<br />

damage and a threat for the case. But for a mentally pure person like Polash Miah,<br />

it is impossible to involve in such a case. So after investigating and justifying about<br />

Polash Miah it has been cleared that he is a mentally disabled and a innocent<br />

person. And he is a real helpless and poor person. After that by proving him innocent<br />

Adv. Mohammad Abu Yousuf, Panel Lawyer of Brahmanbaria district has<br />

bailed him out at 13/03/2017 that means after 4 months and 8 days of his arrest.<br />

Finally he has set free from the dark and horrifi c imprisonment<br />

Case Story of Helpless Truck Helper Suruj Miah<br />

Helplessly, acquitted truck helper Suruj Miah had suffered imprisonment for 13<br />

years. One of the panel lawyer of Legal Assistance To Helpless Prisoners and Person<br />

(LAHP) Adv. Md. Moniruzzaman has bailed out this helpless prisoner after 13 years<br />

of imprisonment.<br />

The truck was fully loaded while it was on its way to the assigned destination. On<br />

the way to Dhanmondi Thana, the police confi ned the truck and after that they<br />

investigated the truck. After investigation the police had found drugs or drugs<br />

related products inside the truck and Dhanmondi Thana police arrested Suruj Miah,<br />

the helper of the truck.<br />

After arresting him Dhanmondi Thana Police fi led a case under Special Power Act,<br />

1970 and he was then send to the jail.<br />

Truck helper Suruj Miah had no idea about how the drugs reached his truck. There<br />

was also no one available from his side. He had suffered imprisonment for 13 years<br />

having no knowledge or any other support.<br />

After 13 years of imprisonment, the panel lawyer of the Legal Assistance To Helpless<br />

Prisoners and Persons (LAHP) came to know about the accused.<br />

A ordinary but real helpless person have been lost 13 years old for false case. After<br />

losing an unusually long period of time how can a person live or survive? After<br />

losing valuable 13 years, how can fi ght Suruj Miah against the reality of life? Can we<br />

repay those valuable moments which he could be used for the race of his life?<br />

No, actually no one can.<br />

Though LAHP couldn’t return those 13 years of his life but LAHP has able to overcome<br />

from that false & fabricated allegation. By bailing him successfully the accused set<br />

Adv. Sharmin Jahan Shimu, one of the panel lawyers of Dhaka district of LAHP has<br />

bailed out two accused persons named Shamim Babu and Md. Jafor respectively<br />

on January 17, 2017.<br />

They were alleged under Section 19 0f (1) of 7 (Ka) under Narcotics Control Act<br />

1990 with the Case no. Hazaribag 5(3)11. Under this section the number of total<br />

acust wear 9 and acust Shamim Babu and Md Jafar were among them who had<br />

gone through imprisonment for 5 years 8 months.<br />

It has been mentioned in the general diary that at 7 pm the police came to know<br />

from a very secret source that, near the Bonkotoli city colony gate under Hazaribagh<br />

Thana, there were the two very acust were present to purchase and sale illegal<br />

narcotics, that is, marijuana. On the basis of the news , and with the permission of<br />

the higher authority in 02/03/2011 at 7.30 pm, the police present in that place and<br />

along with the witnessed arrested that 9 acust and started searching through and<br />

after that they discovered 100 puria (100 gm) marijuana. The police found 12 Puria<br />

(12gm) marijuana from Shamim Babu and 11 Puria (11gm) from Mohammad Jafor.<br />

It has been mentioned that the two accused was alleged for keeping illegal marijuana<br />

under Section 19 (1) of table 7 (Ka) of Narcotics Control Act 1990.<br />

Shamim Babu and Md. Jafor had suffered imprisonment for 5 years 8 months for<br />

keeping 12(gm) and 11(gm) marijuana. Sharmin Jahan Shimu, Panel Lawyers of<br />

Dhaka Bar, came to know about them and discovered the detail about how and<br />

when they both have been falsely framed. They both were innocent and really don’t<br />

know how they victimized in this case. Due to fi nancially insolvency, destitution and<br />

helplessness their family and relatives could not able to seek for justice.<br />

Eventually in last 10/02/2017 Sharmin Jahan Shimu, Panel Lawyers of Dhaka<br />

Bar Association Bailed both of them, Shamim Babu and Md. Jafor from such<br />

Case story of Khandoker Enamul Haque @ Mitul<br />

One of the panel lawyer of LAHP Adv. Sharmin Jahan Shimu has bailed out a helpless<br />

prisoner on the day of september20,2016. The name was khandoker Enamul<br />

Haque @ Mitul(23).<br />

Under the 1908 Explosive Substance Act, section: 4 was fi led a case against khandoker<br />

Enamul Haque @ Mitul(23) son of khandoker Abdul Nowarul Haque from the<br />

district of Gopalganj , Kashiyani Thana.<br />

As it has been mentioned in the general diary on the last 17 July 2012 they got the<br />

information from a very secret source and there they seize some explosive Substances<br />

and arrested the accused from west kazipara. During arresting the accused<br />

the police found 45,000tk from his pocket. The accused has been taken to<br />

Sher-E-Bangla Model Thana from Mirpur Model thana; case no- 27 dated 17/17/12<br />

under section:3/4/6 of Explosive Substances Act, 1908 and section: 370/326/34 of<br />

Penal Code, 1860<br />

Again there pertaining to the general diary, after many interrogation the accused<br />

gave his admission that he got the money (45,000 TK) after selling the bomb<br />

which he made to murder the victim of the case Ayesha. The seizure list has made<br />

in the presence of the witnesses, the bomb and the money was seized and kept<br />

under the supervision of police in 29/07/2015. Referring to that accused kept<br />

mobile bomb in his possession which is a punishable offence under section:4 of<br />

Explosive Substances Act, 1908.<br />

After that Sharmin Jahan Shimu, The panel lawyer of LAHP, Dhaka district came to<br />

know about the accused, khandoker Enamul Haque @ Mitul. After scrutinizing his<br />

case she found that, basically khandoker Enamul Haque @Mitul came to dhaka<br />

along with the 45,000tk and supposed to give that money to a Travel Agency for<br />

going to abroad. There a confl ict took place between Mitul and police. Carried over<br />

that confl ict khandoker Enamul Haque @Mitul has been framed by the police. The<br />

told the panel lawyer of LAHP that he sold out the last resource, his land and came<br />

to dhaka. No one has been come forward to help him for last 4 years 2 months. No<br />

one was there to help him out or stand by him or made a petition for him.<br />

At last this our panel lawyer of LAHP come and help out this truly deprived person.<br />

After these 4 years 2 months of brutal imprisonment our panel lawyer make it possible<br />

Case Story of Kajol and Anik<br />

Kodomtoli situated on the south part of the map Daniya, Md. Khokon (60), son of Yaseen<br />

Kabiraj along with his son Johnny (18) had the enmity with these people from the past. Since<br />

its inception on 15/09/16 LAHP the Dhaka Bar Panel lawyers Sharmin Jahan Shimu has<br />

helped and released on bail two of defenseless prisoners of the ten recorded. The reason for<br />

the attacks and hijacking attacks at the end of the case was fi led. A total of 10 accused in<br />

the case as the charge was fi led.<br />

As it was mentioned in the complaint fi led that at 11:40 am when Johnny (18) son of Md.<br />

Khokon, got out of the house heading towards Shonir Akhra. At around 12 noon Daniya cemeteries<br />

Kadamtali under way as Johnny proceeded, he was attacked and was hit by iron rods<br />

carried out by the group they held the enmity against his father. After that Johnny was<br />

stepped on with the motive to be more injured even after being already injured and was<br />

profusely bleeding.<br />

As mentioned in the charge sheet, Sohail (18) and Rasel Sikder (18) with a knife, wounded<br />

Johnny fl ed away with all the money (20000 taka) he had in his pocket. Later, local people<br />

took Johnny’s injured body to Dhaka Medical College Hospital in Dhaka.<br />

As it was mentioned, in the charge sheet there were 10 accused and among them accused<br />

no.9 named Kajol and accused no.10 named Anik has no specifi cally with proper attention<br />

allegation.<br />

On the basis of charge sheet among the 10 accused, accused no.9 Kajol, who was basically<br />

a day laborer got arrested by police near from the Daniya cemeteries Kadamtali, when he<br />

was returning from his day-to-day working place to home at 10:30 pm. Police also arrested<br />

accused no.10 Kajol, who was also a day laborer and returning from his working place to his<br />

home. Both of them didn’t know anything about the fact of the case which they were alleged<br />

for.<br />

Later they were sentenced for the allegation. But they were incapable of seeking justice due<br />

to their fi nancially insolvency, destitution, helplessness and there was no one who can stand<br />

by them. For that reason they had to spend 2 years 17 days behind the prison bars. After that<br />

long term imprisonment, the panel lawyer of LAHP, Adv. Sharmin Jahan Shimu came to know<br />

about their situation and she was able to bail both of them out successfully.<br />

Only because of the insolvency, destitution and helplessness two innocent people have lost<br />

2 years 17 days from their lives just like that. Though LAHP can not compensate those valuable<br />

times of their lives by any means hence other innocent and deprived lives like Kajol and<br />

Anik can be rescued from the darken nights spent in the prison cells and so help them able<br />

to lead a normal life. The aim of LAHP is to help improving the society and consequently<br />

represent the country in a better and standard form.<br />

Adv. Md. Mahbubur Rahman, one of the panel lawyers from Moulvibazar of LAHP<br />

has bailed accused individual name Rajon Miah. He has been suffered imprisonment<br />

for 4 years 8 month.<br />

Rajon Miah (21) son of Dulal Miah was arrested for the commission of theft under<br />

Section 457/382/411 Penal Code in Srimongol Thana Case no- 04, Date-5(3)11 GR<br />

case no-52/11(sri). The place of occurrence was reported in the quarter jame<br />

mosque.<br />

It has been mentioned in general diary acust Rajon Mia he broke into the premises<br />

and caused damage to the household property belonged to quarter of Sona Miah<br />

road mosque during 10 pm to 2 am in 4/3/2011 -5/3/2011. At 2 am when the plaintiff<br />

came back from Waaz Mahfi l, he found the acust in his room damaging his household<br />

property. After seeing him in his room he gave the acust and starting shouting<br />

and the acust was trying to fl ee off by hurting the plaintiff. The acust broke the lock<br />

of the plentif trunk and took 255 tk (Two hundred fi fty tk). It has been mentioned<br />

that to 55 tk has found from the acust. After that the local people send him to the<br />

police station and police fi le the case against him under section 380/411 penal<br />

code.<br />

He has suffered for 4 years 8 months for that very allegation.<br />

But after 4 years 8 months, Adv Md Mahbubur Rahman the panel lawyers of the<br />

moulvibazar district came to know about Rajon Miah, who has been arrested in<br />

doubt with and after that the blame was intentionally imposed on him.<br />

Seminar In Sylhet<br />

On 5th April, 2016 Legal Assistance To Helpless Prisoners and Persons hosted a<br />

seminar in Sylhet featuring some prominent Judges, and Magistrates from the<br />

district.<br />

Judge Munir Ahmed Patwary has highly commended, and called out to the authorities<br />

to extend their support to helpless prisoners. He has claimed that standing<br />

by them is a “social duty”. “These prisoners do not even get to contact their<br />

loved ones, so the motive was to seek for them and help the prisoners fi nd their<br />

loved ones.” He urged, on behalf of prisoners who were held in custody without<br />

their due legal support advice, which they are entitled to. “It is a boon for us that<br />

LAHP is helping to serve this purpose with their operations in Sylhet.”<br />

“It is so wonderful that we have organizations like LAHP taking an initiative to help<br />

prisoners in need. But we also need support from people those who are working<br />

with law enforcement for justice to prevail.”<br />

With the presidency of District Parishad Administrator of Sunamganj, and the<br />

Vice President of LAHP Enamul Karim, with management support from our team<br />

organized the seminar, featuring speeches from prominent guests such as: Metropolitan<br />

Session Judge Muhammed Akber Hossain Mridha, Session Judge and<br />
