hen accountability (ehtisab) is understood as a performance<br />

Sometimes it is difficult to decide who actually is the Minister of External<br />

Affairs of the country, Modi himself or Mrs. Sushma Swaraj? Likewise, is<br />

Arun Jaitley the Finance Minister or the Defence Minister when he is not<br />

the chief spokesman of the government, a role he has assigned to his own<br />

self? The government at the centre seems to be made up of just about half a<br />

dozen of ministers, who are beginning to look more and more like members<br />

of the Roman senate. The other ministers seem to have become superbureaucrats.<br />

In our own state, the case is not much different. Civil<br />

administration seems to be concentrated in the hands of just a handful of<br />

people, not all being elected representatives of people or government<br />

appointees. These people decide on much that is supposed to be<br />

government with all its wings, organs and departmental structure. What a<br />

district magistrate is empowered to decide gets decided elsewhere. How a<br />

Chief Minister ought to lead the government, or the Prime Minister lead the<br />

nation appears, sometimes, confusing to people at large. It is hoped that,<br />

henceforth, there is clarity on several issue that worry the people of this<br />

land, on issues that are emotive or induce insecurity among sections of<br />

people, or trends that appear to cause an amount of unease or doubt in the<br />

general population.<br />

the massive riots that followed Partition,<br />

Gandhi urged Hindus and Muslims to live<br />

On July 17, 1944, Gandhi wrote a letter to<br />

Jinnah and requested to meet him. Jinnah,<br />

with the approval of the Muslim League,<br />

agreed to meet Gandhi in Bombay. The Talks<br />

lasted from September 19, 1944 to September<br />

24, 1944. Jinnah presented the stance of the<br />

Muslim League while Gandhi told him that he<br />

had called upon him in a personal capacity.<br />

The stressed nutshell of the Gandhi's talk was<br />

that a separate homeland for the Muslims was<br />

“nothing but a ruin for the whole of India”. Mr.<br />

Gandhi said, “If, however, Pakistan had to be<br />

conceded, the areas in which the Muslims are<br />

in an absolute majority should be demarcated<br />

by a Commission approved by both the<br />

Congress and the Muslim League. The wishes<br />

of the people of these areas will be obtained<br />

through Referendum. These areas shall form<br />

a separate state as soon as possible after<br />

India is free from foreign domination. There<br />

shall be a treaty of separation which should<br />

also provide for the efficient and satisfactory<br />

administration of foreign affairs, defense,<br />

internal communication, custom and the like<br />

which must necessarily continue to be the<br />

matters of common interest between the<br />

contracting countries”.<br />

Jinnah explained the Muslim stance<br />

that the Muslims were a nation according to<br />

any definition of nation with a distinctive<br />

outlook of life and on life and that they were a<br />

nation of 100 million. He also clarified that the<br />

separation of a Muslim state was in favor of not<br />

only Muslims but it would also benefit the rest<br />

understand that in troubled state of TJammu and Kashmir Humanity have<br />

taken a long holiday here , on contrary, murder<br />

of humanity is now a reality on the road shows.<br />

Islam is universal in outlook and speaks for<br />

humanity as a whole. It has no chosen race or<br />

people, nor does it give preferences to anyone<br />

except in terms of virtue and uprightness of<br />

character.<br />

Islam endeavors to set up cooperation<br />

and close knitted society in which people enjoy<br />

equal rights, and their duties are tied to each<br />

other by the bounds of love, respect, and<br />

cooperation.The incidents happening in<br />

Kashmir needs global condemnation and keen<br />

attention for amelioration. The doing of good<br />

and forbidding of evil is one of the most<br />

important principles of faith and ensures the<br />

healthy progress of a society. In the modern<br />

world, the media plays an important role in<br />

influencing the life structure of the society.<br />

Therefore, it is highly important to put the right<br />

people in its in-charge.<br />

Where are so called Civil Society<br />

members, Intellectuals, religious organisations,<br />

Islamic Clerics, responsible Citizens, Social<br />

Activists, Human Rights Defenders and so on ?<br />

Do not you people can raise your voice high<br />

against the loss of precious human lives. Cannot<br />

you people preach the masses and take an<br />

initiative towards peace and development.<br />

Evey matter needs peaceful atmosphere and<br />

holistic discussion to find a solution. Bullet,<br />

Violence and terrorism will lead us towards<br />

annihilation. We are losing our young<br />

generation to the gun.<br />

We have lost 11 individuals, Kashmiris<br />

and humans from last 24 hours. Encounters ,<br />

Civil Killings, Hartals, stone pelting, burning of<br />

Karar Hashmi<br />

Institutions, ambush, and so on have become<br />

mouth piece of everybody living in the state of<br />

Jammu and Kashmir. It is true that Violence is<br />

met with the violence only but result of all this<br />

frenzy mess is that we are hastly moving<br />

towards the Civil war in the valley in which<br />

brother will kill his own brother without<br />

knowing the logic of execution such sinful<br />

act.Whether a police man, Army men or a<br />

Militant is killed in the Kashmir, it is worth<br />

condemnable and murder of the humanity. From<br />

last two days dozens of Mothers have lost their<br />

kiths and kins and it is she who knows the actual<br />

pain and anguish. Mere condemnation,<br />

statements and bandh calls cannot silent the gun<br />

culture, violence and terrorism in the State of<br />

J&K. We have collectively found a peaceful way<br />

and get the things diplomatically done and<br />

executed.<br />

The Indian leadership and Pakistan must<br />

come forward to find a peaceful way as per<br />

wishes of the Kashmiris in finding a lasting<br />

solution for the betterment of humanity in<br />

keeping view the present Scenario into<br />

Certain things have an afterlife. And<br />

certain a life after. It is in the latter<br />

category that leaves or flower petals<br />

pressed in the pages of books and certain books<br />

themselves fall. In early seventies of the<br />

century gone by when Sartre and Camus had<br />

already been deconstructed, in a manner of<br />

speaking, in our mind's eye – suddenly Andre<br />

Gide, who was their senior, began to fascinate<br />

us. In our trilingual minds pace, where Urdu<br />

and Kashmiri occupied equal salience and<br />

Iqbal, Ghalib, Faiz and Manto were discussed<br />

as animatedly as Akhtar, Nadim, Kamil and<br />

Rahi, there was something awe-inspiring<br />

about the authors from shores afar who came to<br />

us enveloped in the heady smell of some exotic<br />

paper crackling like fresh currency notes<br />

directly off the shelves of Kashmir Book Shop.<br />

A visit to the bookshop was a rarely missed<br />

ritual and a new arrival would cause feverish<br />

excitement and the news of that arrival would<br />

go around a group of people very quickly<br />

indeed. So, it was the time when we would be<br />

discussing the ideas of Ayn Rand in the<br />

Shop. Antoine de Saint-Exupery<br />

had written the book 'Night Flight'<br />

in 1931 and it had shortly become an<br />

i n t e r n a t i o n a l b e s t s e l l e r .<br />

Incidentally, Gide wrote the<br />

foreword to its first edition. In 1932<br />

it was translated into English by<br />

Stuart Gilbert and the next year –<br />

1933 – turned into a movie starring<br />

Clark Gable. It was recreated in an<br />

Italian opera in 1940 and continued<br />

to be printed in modest numbers for<br />

many years in editions in French,<br />

English and several other languages<br />

it was translated into. The book had enjoyed a<br />

fair run of success and almost completed its<br />

life cycle without being classified as a classic.<br />

However, it appeared that in the early 70s the<br />

book, Gilbert's translation of it in particular,<br />

got another lease of life internationally and<br />

also in Kashmir. Suddenly it became de<br />

rigueur to read or appear to have read it.<br />

The book is about the night flight of an<br />

its owner forces the pilot to undertake during a<br />

thunderstorm. Now, in 1930s there were no<br />

flight instruments and facilities either on board<br />

or on ground and night flying was akin to a<br />

game of Russian roulette with the odds heavily<br />

stacked against the pilot. If a thunderstorm is<br />

thrown into the mix, one can see the kind of<br />

stage Saint-Exupery has set in this novel. The<br />

owner is in radio contact with the pilot as the<br />

situation becomes progressively more<br />

dangerous for the flight and then the radio<br />

contact is lost. It is here that the book ends. A<br />

major concern of the novel is whether 'karma'<br />

(the imperative of action that defines life) is<br />

more important than life itself.<br />

Having read the book in 1972 or<br />

thereabouts, I did not remember all this – the<br />

plot and the background of the writer and the<br />

book. There was a vague memory of a speech<br />

by a character that had stayed, in some form,<br />

with me. And the other day it haunted me to the<br />

extent that I had to get hold of a copy of the<br />

book and re-read it after forty years. And there<br />

was that speech again – "We don't ask to be<br />

eternal. What we ask is not to see acts and<br />

objects abruptly lose their meaning. The void<br />

surrounding us then suddenly yawns on every<br />

side." It was then that the answer to the<br />

question: “Why do some books have a 'life<br />

after'?” hit me. Some books, like some events<br />

and some people, have certain truths within<br />

them which make us revisit them across time.<br />

It is not like clothes or hairstyles, that tend to<br />

get repeated in a cyclical manner. The truths in<br />

these books, or events, or people – are<br />

immutable. And these are the kinds of truths<br />

that define civilization.<br />

suddenly yawns on every side" Who is doing<br />

what 'karma' in Kashmir and what will the<br />

result of that be, for the result will certainly be<br />

there. The more the cost is passed on, the<br />

higher it becomes – but pay someone must. In<br />

the unfortunate situation Kashmir finds itself<br />

in, it has become easy for everyone to blame<br />

everyone else except himself or herself. But at<br />

the end of the day the bereaved are all<br />

Kashmiris, all of them - wherever they are.<br />

Historical and Legal Facts<br />

Order, 1954 - issued by the President of India, "in<br />

exercise of the powers conferred by" clause (1) of<br />

Article 370 of the Constitution, with the concurrence<br />

of the Government of the State of Jammu and<br />

Kashmir. The 1927 hereditary State Subject Order<br />

granted to the state subjects the right to government<br />

office and the right to land use and ownership, which<br />

were not available to non-state subjects.<br />

Insertion of article 35 A into Indian constitution:<br />

Following the accession of Jammu and Kashmir to<br />

the Indian Union on 26 October 1947, The Maharaja<br />

ceded control over defence, external affairs and<br />

communications (the 'ceded subjects') to the<br />

Government of India. The Article 370 of the<br />

Constitution of India and the concomitant<br />

Constitutional Order of 1950 formalized this<br />

relationship. Discussions for furthering the<br />

relationship between the State and the Union<br />

continued, culminating in the 1952 Delhi Agreement,<br />

whereby the governments of the State and the Union<br />

agreed that Indian citizenship would be extended to<br />

all the residents of the state but the state would be<br />

empowered to legislate over the rights and privileges<br />

of the state subjects, who would now be called<br />

permanent residents. Following the adoption of the<br />

provisions of the Delhi Agreement by the Constituent<br />

Assembly of Jammu and Kashmir, the President of<br />

India issued The Constitution (Application to Jammu<br />

and Kashmir) Order, 1954, through which Indian<br />

citizenship was extended to the residents of the state,<br />

and simultaneously the Article 35A was inserted into<br />

the Indian constitution enabling the State legislature<br />

to define the privileges of the permanent residents<br />

Jai LalKilam , ShankerLalKoul , Jia Lal Jalali started<br />

agitation against for securing rights of state subject<br />

the outcome of which was that Persian language was<br />

removed and replaced by Urdu language in the reign<br />

of Maharaja Pratab Sngh.This had negative impact<br />

on pundit community who were not acquainted with<br />

new language fully were thrown out by Maharaja<br />

Pratap Singh. An influx of Urdu knowing Punjabi<br />

Muslim from India came to Kashmir and Maharaja<br />

recruited them. This created bitterness among Pandits<br />

and they started opposing the recruitment of Indian<br />

in Kashmir courts and British residency supported<br />

them as well. The result of this agitation was creation<br />

of state subject definition committee soon after the<br />

accession of Maharaja Hari Singh after 1926 CA.The<br />

new definition arrived at the committee was accepted<br />

by new Maharaja Hari Singh in 1927.So there after<br />

none from India after that period was appointed in<br />

any state job in Jammu and Kashmir if he or she<br />

doesn't own hereditary state subject document. It is<br />

icon of Kargil, who<br />

revolutionized this remote and<br />

impoverished region in the<br />

midst of Himalayas, died in<br />

peace at his home last year<br />

on July 28.Thousands of<br />

people joined his funeral<br />

prayers. A relentless fighter,<br />

Sheikh Zakiri remained active<br />

in the public life of Kargil, a key<br />

strategic town in the Ladakh region<br />

of Kashmir. Zakiri was deeply influenced<br />

by Islamic Revolution of Iran and its founder<br />

Imam Roohullah Khomeini. During the Islamic<br />

Revolution in Iran he fully realized the guiding<br />

spirit of the revolution which is to revive the true<br />

and real Islam that is the Seerah of the Holy<br />

Prophet (S.A.W.) and the Infallible Ahlul Bayt<br />

(A.S.) and in order to defend the teachings and<br />

ideals of the great personality of the present<br />

era Hazrat Imam Khomeini (R.A.).<br />

In1989 Zakiri with his fallowers<br />

founded an Islamic orginization name it<br />

Imam Khumaini Memorail Trust (IKMT),<br />

which played a key role, not only in<br />

educational and social sectors, but gave a<br />

new direction and meaning to politics of<br />

this most neglected region of the state.<br />

Trust (IKMT) had developed a large<br />

in local politics, though he himself<br />

shunned the lure of power politics and<br />

eked his living by working in farms. Zakri adopted a simple living and adhered to the<br />

principles of Iran's revolution and inculcated them among his disciples. Despite his<br />

influence he remained down to earth personality, a reason he earned love and respect<br />

among the masses. He always stressed on purity of soul which reflects the true<br />

teachings of Islam and guides to moderation which is must in this age where everyone<br />

seems to be in race of getting more and more. He kept<br />

himself away from greed of this materialistic world and<br />

remained sharply focused on welfare of humankind to<br />

gain pleasure of The Almighty Allah.<br />

His established IKMT-backed candidates not only<br />

reached state assembly but to parliament as well thus<br />

breaking the myth of Ladakh being a monopoly of a<br />

particular religious order. Zakiri faced challenges not only<br />

from within by the conservative clergy but also from the<br />

established political parties of the state all his life. He<br />

however successfully thwarted their attempts to split the<br />

community for their vested political interests. Zakiri was<br />

heard urging people to remain united and steadfast and<br />

work for the overall development of Kargil. Zakiri was a<br />

combatant scholar who sincerely struggled all his life for<br />

the cause of truth. Later, he along with a group of like<br />

minded Ulema and revolutionary youth of Kagil, made<br />

outstanding efforts with selfless courage and sacrifice till<br />

the last<br />

breath of<br />

his life.<br />

Zakiri, would be remembered for long<br />

not only for spreading the message of<br />

humanism, love, peace and brotherhood<br />

but also for his contribution in the socioeconomic<br />

and educational emancipation<br />

of the people of Kargil.<br />
