We request the opportunity <str<strong>on</strong>g>to</str<strong>on</strong>g> make a brief interventi<strong>on</strong> at the finalisati<strong>on</strong> <strong>of</strong><br />
the following documents:<br />
• Draft decisi<strong>on</strong> VI/8 <strong>on</strong> general issues <strong>of</strong> compliance, ECE/MP.PP/2017/19<br />
• Draft decisi<strong>on</strong> VI/8f c<strong>on</strong>cerning compliance by the European Uni<strong>on</strong> with<br />
its obligati<strong>on</strong>s under the C<strong>on</strong>venti<strong>on</strong>, ECE/MP.PP/2017/25<br />
H<strong>on</strong>orary representatives <strong>of</strong> the Parties <str<strong>on</strong>g>to</str<strong>on</strong>g> the Aarhus C<strong>on</strong>venti<strong>on</strong>, thank you for the<br />
opportunity <str<strong>on</strong>g>to</str<strong>on</strong>g> make this short submissi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g>day:<br />
Background:<br />
<str<strong>on</strong>g>EPAW</str<strong>on</strong>g> represents nearly 1,300 member organisati<strong>on</strong>s from 31 European countries,<br />
who questi<strong>on</strong> the unacceptable impacts and lack <strong>of</strong> effectiveness <strong>of</strong> wind farms. The<br />
findings and recommendati<strong>on</strong>s <strong>on</strong> ACCC/C/2010/54 led <str<strong>on</strong>g>to</str<strong>on</strong>g> Decisi<strong>on</strong> V/9g <strong>of</strong> n<strong>on</strong>compliance<br />
by the European Uni<strong>on</strong>. Namely, that the provisi<strong>on</strong>s <strong>of</strong> Article 7 <strong>of</strong> the<br />
C<strong>on</strong>venti<strong>on</strong> were bypassed in the adopti<strong>on</strong> <strong>of</strong> the Nati<strong>on</strong>al Renewable Energy Acti<strong>on</strong><br />
Plans (NREAPs) for the 20% by 2020 renewable energy Directive 1 .<br />
‘So<strong>on</strong>er or later every<strong>on</strong>e sits down <str<strong>on</strong>g>to</str<strong>on</strong>g> a banquet <strong>of</strong> c<strong>on</strong>sequences’. More than a<br />
thousand billi<strong>on</strong> Euros has now been invested in the EU in wind farm and solar<br />
infrastructure. No envir<strong>on</strong>mental informati<strong>on</strong> was ever available, as <str<strong>on</strong>g>to</str<strong>on</strong>g> what these<br />
NREAPs were <str<strong>on</strong>g>to</str<strong>on</strong>g> actually deliver, while the public were denied their lawful<br />
opportunity <str<strong>on</strong>g>to</str<strong>on</strong>g> participate in their decisi<strong>on</strong> making.<br />
What carb<strong>on</strong> savings now achieved, could easily have been d<strong>on</strong>e so, for less than<br />
5% <strong>of</strong> that cost. While the weather c<strong>on</strong>tinues <str<strong>on</strong>g>to</str<strong>on</strong>g> be just the weather, it does not<br />
interfere with people pursuing their lives, as was the case in the past, and with each<br />
passing year, it is clearer as <str<strong>on</strong>g>to</str<strong>on</strong>g> how widely speculative those claims <strong>of</strong> an impending<br />
envir<strong>on</strong>mental catastrophe are.<br />
If the EU and its Member States had followed the legal framework <strong>of</strong> the C<strong>on</strong>venti<strong>on</strong><br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> promote democracy and the rule <strong>of</strong> law in envir<strong>on</strong>mental matters, we would not<br />
now be in this mess, with the landscape and natural heritage scarred, billi<strong>on</strong>s<br />

squandered, citizens angry and disillusi<strong>on</strong>ed, and ever increasing claims <strong>of</strong> adverse<br />
health impacts.<br />
<str<strong>on</strong>g>EPAW</str<strong>on</strong>g> c<strong>on</strong>tinues <str<strong>on</strong>g>to</str<strong>on</strong>g> be active in two <strong>on</strong>going Communicati<strong>on</strong>s ACCC/C/2013/96<br />
(European Uni<strong>on</strong>) and ACCC/C/2014/112 (Ireland), both <strong>of</strong> which are close <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
finalisati<strong>on</strong>.<br />
Draft Decisi<strong>on</strong> VI/8 <strong>on</strong> General Issues <strong>of</strong> Compliance<br />
The draft Decisi<strong>on</strong> VI/8 is very welcome, as the findings and recommendati<strong>on</strong>s <strong>on</strong><br />
compliance in the period 2014–2017 build <strong>on</strong> the Maastricht Recommendati<strong>on</strong>s, the<br />
sec<strong>on</strong>d editi<strong>on</strong> <strong>of</strong> the Aarhus C<strong>on</strong>venti<strong>on</strong> Implementati<strong>on</strong> Guide and previously<br />
endorsed findings and recommendati<strong>on</strong>s <strong>of</strong> the Compliance Committee. Despite<br />
such clarity <strong>on</strong> the obligati<strong>on</strong>s inherent <str<strong>on</strong>g>to</str<strong>on</strong>g> the C<strong>on</strong>venti<strong>on</strong>, it is disturbing <str<strong>on</strong>g>to</str<strong>on</strong>g> see how<br />
so many Parties within the EU c<strong>on</strong>tinue <str<strong>on</strong>g>to</str<strong>on</strong>g> politically bully through renewable<br />
projects, in direct c<strong>on</strong>traventi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the provisi<strong>on</strong>s <strong>of</strong> the C<strong>on</strong>venti<strong>on</strong>.<br />
In particular, the obligati<strong>on</strong>s inherent <str<strong>on</strong>g>to</str<strong>on</strong>g> multi-tier decisi<strong>on</strong>-making are <strong>on</strong>ce again<br />
articulated in these recent findings, in that:<br />
• If a particular tier <strong>of</strong> the decisi<strong>on</strong>-making process has no public participati<strong>on</strong>,<br />
then the next stage that does have public participati<strong>on</strong> should provide the<br />
opportunity for the public <str<strong>on</strong>g>to</str<strong>on</strong>g> also participate <strong>on</strong> the opti<strong>on</strong>s decided at that<br />
earlier tier. 2<br />
The EU and its Member States clearly see themselves <str<strong>on</strong>g>to</str<strong>on</strong>g> date, as exempt from these<br />
provisi<strong>on</strong>s. This can be seen in the manner in which they have pursed the<br />
implementati<strong>on</strong> <strong>of</strong> the NREAPs and the related Projects <strong>of</strong> Comm<strong>on</strong> Interest, the<br />
latter being the particular subject matter <strong>of</strong> Communicati<strong>on</strong> C/96. As Communicati<strong>on</strong><br />
C/112 also dem<strong>on</strong>strates, they have turned the whole c<strong>on</strong>cept <strong>of</strong> public participati<strong>on</strong><br />
<strong>on</strong> downstream renewable project approvals in<str<strong>on</strong>g>to</str<strong>on</strong>g> a meaningless pro forma exercise,<br />
in which opti<strong>on</strong>s are no l<strong>on</strong>ger open and the public participati<strong>on</strong> is a complete sham.<br />
Diktat instead prevails, as the <strong>on</strong>ly criteri<strong>on</strong> is <str<strong>on</strong>g>to</str<strong>on</strong>g> meet a manda<str<strong>on</strong>g>to</str<strong>on</strong>g>ry target and plan<br />
previously decided without input from the public.<br />
Draft Decisi<strong>on</strong> VI/8f C<strong>on</strong>cerning Compliance by the European Uni<strong>on</strong><br />
It <str<strong>on</strong>g>to</str<strong>on</strong>g>ok less than a year for the EU and its Member States <str<strong>on</strong>g>to</str<strong>on</strong>g> develop and legally<br />
adopt the NREAPs for this simply enormous renewable investment. Yet year after<br />
year, the representatives <strong>of</strong> the EU Commissi<strong>on</strong> persistently obfuscated and<br />
deliberately time wasted with regard <str<strong>on</strong>g>to</str<strong>on</strong>g> compliance with Decisi<strong>on</strong> V/9g. Bizarrely,<br />
despite being provided with a period <strong>of</strong> more than two years by the Compliance<br />
Committee, they were unable <str<strong>on</strong>g>to</str<strong>on</strong>g> write <str<strong>on</strong>g>to</str<strong>on</strong>g> and obtain from the same Member States,<br />
details as <str<strong>on</strong>g>to</str<strong>on</strong>g> how the public participati<strong>on</strong> provisi<strong>on</strong>s <strong>of</strong> Article 7 were addressed in the<br />
adopti<strong>on</strong> <strong>of</strong> these NREAPs. They also choose <str<strong>on</strong>g>to</str<strong>on</strong>g> simply ignore <str<strong>on</strong>g>to</str<strong>on</strong>g> provide a resp<strong>on</strong>se<br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> the Committee’s written questi<strong>on</strong>s related <str<strong>on</strong>g>to</str<strong>on</strong>g> the same, but were well able <str<strong>on</strong>g>to</str<strong>on</strong>g> write<br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> members <strong>of</strong> the public in Ireland, formally denying that any such n<strong>on</strong>-compliance<br />
had occurred in the first place.<br />
The sec<strong>on</strong>d part <strong>of</strong> draft Decisi<strong>on</strong> VI/8f in relati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> access <str<strong>on</strong>g>to</str<strong>on</strong>g> the European Court <strong>of</strong><br />
Justice is particularly welcome and highly important. As the Communicant in C/54<br />

can testify, initiating a judicial review <strong>of</strong> the NREAP in the Irish High Court, in relati<strong>on</strong><br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> the breach <strong>of</strong> Aarhus rights, was a farce extending over three years and nine<br />
m<strong>on</strong>ths before any written judgement was obtained. 3 The first judge walked <strong>of</strong>f the<br />
job after several days <strong>of</strong> the hearing, the sec<strong>on</strong>d <str<strong>on</strong>g>to</str<strong>on</strong>g>ok nearly a year and a half <str<strong>on</strong>g>to</str<strong>on</strong>g> write<br />
his judgement, in that he didn’t have <str<strong>on</strong>g>to</str<strong>on</strong>g> decide. As the State’s senior c<strong>on</strong>sul, an exat<str<strong>on</strong>g>to</str<strong>on</strong>g>rney<br />
general repeatedly summed it up: “If the State so chooses <str<strong>on</strong>g>to</str<strong>on</strong>g> breach its<br />
internati<strong>on</strong>al treaty obligati<strong>on</strong>s, then the citizen can complain about it, but that is all<br />
the citizen can do”.<br />
The reacti<strong>on</strong> <strong>of</strong> the EU Commissi<strong>on</strong> in its proposal <strong>of</strong> 29 June 2017 for a Council<br />
Decisi<strong>on</strong> 4 <str<strong>on</strong>g>to</str<strong>on</strong>g> reject the findings <strong>on</strong> communicati<strong>on</strong> ACCC/C/2008/32 (Part II) is typical<br />
<strong>of</strong> the anti-democratic positi<strong>on</strong> and c<strong>on</strong>tempt for the rule <strong>of</strong> law that this instituti<strong>on</strong><br />
has. In is not surprising that there is a growing chorus <strong>of</strong> disc<strong>on</strong>tent around the EU at<br />
the lack <strong>of</strong> democratic structures, which has already greatly c<strong>on</strong>tributed <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />
populati<strong>on</strong> <strong>of</strong> <strong>on</strong>e Member State choosing <str<strong>on</strong>g>to</str<strong>on</strong>g> leave.<br />
In relati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the Council Decisi<strong>on</strong> (EU) 2017/1346 <strong>of</strong> 17 July 2017 <strong>on</strong> the positi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
be adopted, <strong>on</strong> behalf <strong>of</strong> the European Uni<strong>on</strong>, as regards compliance case<br />
ACCC/C/2008/32 5 , <str<strong>on</strong>g>EPAW</str<strong>on</strong>g> would like <str<strong>on</strong>g>to</str<strong>on</strong>g> point out that the EU has a c<strong>on</strong>sistent track<br />
record <strong>of</strong> failing “<str<strong>on</strong>g>to</str<strong>on</strong>g> take note” <strong>of</strong> the provisi<strong>on</strong>s <strong>of</strong> the C<strong>on</strong>venti<strong>on</strong> and the resulting<br />
compliance proceedings. Therefore, these findings should be endorsed, while as<br />
Compliance Committee has clarified in its Open <str<strong>on</strong>g>Statement</str<strong>on</strong>g> <strong>of</strong> the 30 th June 2017: 6<br />
• “A party may not invoke the provisi<strong>on</strong>s <strong>of</strong> its internal law as justificati<strong>on</strong> for its<br />
failure <str<strong>on</strong>g>to</str<strong>on</strong>g> perform a treaty. …”<br />
