can testify, initiating a judicial review <strong>of</strong> the NREAP in the Irish High Court, in relati<strong>on</strong><br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the breach <strong>of</strong> Aarhus rights, was a farce extending over three years and nine<br />

m<strong>on</strong>ths before any written judgement was obtained. 3 The first judge walked <strong>of</strong>f the<br />

job after several days <strong>of</strong> the hearing, the sec<strong>on</strong>d <str<strong>on</strong>g>to</str<strong>on</strong>g>ok nearly a year and a half <str<strong>on</strong>g>to</str<strong>on</strong>g> write<br />

his judgement, in that he didn’t have <str<strong>on</strong>g>to</str<strong>on</strong>g> decide. As the State’s senior c<strong>on</strong>sul, an exat<str<strong>on</strong>g>to</str<strong>on</strong>g>rney<br />

general repeatedly summed it up: “If the State so chooses <str<strong>on</strong>g>to</str<strong>on</strong>g> breach its<br />

internati<strong>on</strong>al treaty obligati<strong>on</strong>s, then the citizen can complain about it, but that is all<br />

the citizen can do”.<br />

The reacti<strong>on</strong> <strong>of</strong> the EU Commissi<strong>on</strong> in its proposal <strong>of</strong> 29 June 2017 for a Council<br />

Decisi<strong>on</strong> 4 <str<strong>on</strong>g>to</str<strong>on</strong>g> reject the findings <strong>on</strong> communicati<strong>on</strong> ACCC/C/2008/32 (Part II) is typical<br />

<strong>of</strong> the anti-democratic positi<strong>on</strong> and c<strong>on</strong>tempt for the rule <strong>of</strong> law that this instituti<strong>on</strong><br />

has. In is not surprising that there is a growing chorus <strong>of</strong> disc<strong>on</strong>tent around the EU at<br />

the lack <strong>of</strong> democratic structures, which has already greatly c<strong>on</strong>tributed <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

populati<strong>on</strong> <strong>of</strong> <strong>on</strong>e Member State choosing <str<strong>on</strong>g>to</str<strong>on</strong>g> leave.<br />

In relati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the Council Decisi<strong>on</strong> (EU) 2017/1346 <strong>of</strong> 17 July 2017 <strong>on</strong> the positi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

be adopted, <strong>on</strong> behalf <strong>of</strong> the European Uni<strong>on</strong>, as regards compliance case<br />

ACCC/C/2008/32 5 , <str<strong>on</strong>g>EPAW</str<strong>on</strong>g> would like <str<strong>on</strong>g>to</str<strong>on</strong>g> point out that the EU has a c<strong>on</strong>sistent track<br />

record <strong>of</strong> failing “<str<strong>on</strong>g>to</str<strong>on</strong>g> take note” <strong>of</strong> the provisi<strong>on</strong>s <strong>of</strong> the C<strong>on</strong>venti<strong>on</strong> and the resulting<br />

compliance proceedings. Therefore, these findings should be endorsed, while as<br />

Compliance Committee has clarified in its Open <str<strong>on</strong>g>Statement</str<strong>on</strong>g> <strong>of</strong> the 30 th June 2017: 6<br />

• “A party may not invoke the provisi<strong>on</strong>s <strong>of</strong> its internal law as justificati<strong>on</strong> for its<br />

failure <str<strong>on</strong>g>to</str<strong>on</strong>g> perform a treaty. …”<br />
