an extra room, you have a potential<br />

income spinner in your hands. Your home can be a<br />

Here are some realistic ways of<br />

earning income on your<br />

spare/extra room or space:<br />

Spare room, spare change!<br />

There are a lot of young school leavers, graduates,<br />

corp members and people who need<br />

accommodation. A lot of rancor that comes from<br />

accommodating a friend or relative for free can<br />

actually be nipped in the bud if you offer your<br />

spare room at a price. That way, you earn some<br />

income towards the rent. Don't just lock up that<br />

spare room! It's a potential money spinner. If you<br />

don't have friends that you can rent to, an ad in the<br />

classified section of a newspaper or on social<br />

media will help you source potential house mate.<br />

Bed and Breakfast<br />

If you have spare rooms, you may consider<br />

renting them out as a Bed and Breakfast. This is<br />

common in more developed countries.<br />

Housemates share a common sitting room and<br />

kitchen, and the host provides bed space and<br />

breakfast for a fee. This is good for singles,<br />

visitors on a short visit who want a feel of family<br />

setting and home made food.<br />

Rent out your Boys Quarters<br />

Most Nigerian homes come fitted with Boys<br />

Quarters. These are also called servants Quarters.<br />

Most eventually become storage facilities. Some<br />

people never return to their boys' quarters. A<br />

friend moved into an apartment some years back,<br />

and discovered the landlord had stored property<br />

from the 60s in the Boys quarters. This was<br />

cleaned out, and a rent of N200k collected yearly.<br />

The landlord had lost income from using that<br />

space for many decades. Worst still was that the<br />

goods stored in the BQ had aged and had become<br />

worthless. Depending on your preference, you<br />

can rent your Boys' Quarters to students, corp<br />

members, or newly married couple.<br />

Renting out your BQ will reduce your total rental<br />

exposure to your landlord<br />

Holiday Homes/Short let<br />

Turning your home to a holiday home/short let<br />

(especially when you are also on vacation) is<br />

becoming fairly popular in Nigeria. That way,<br />

your house isn't on “holiday” with you, but<br />

making some passive income while you are away.<br />

Rent/share your garage<br />

If you have a garage you never use, or an extra<br />

spot in your garage, consider renting out that<br />

unused space to someone as a storage unit for<br />

Iwas at the Lagos State Lands Registry a few<br />

weeks ago, and I must confess that I was<br />

amazed at what i saw. It was really fulfilling to<br />

see that the Government of the day has made bold<br />

steps in changing the face of the Registry, making<br />

the conduct of a property search as easy as ABC.<br />

Gone are the days of patronizing touts and wondering<br />

where the 'archive' is located. I conducted<br />

my business and left like a breeze.<br />

What Does it mean to conduct a<br />

'Search'?<br />

To conduct a search is do legal assessment of title<br />

of a land to ensure that the title is free from any<br />

encumberances.<br />

Why is it necessary to conduct Search<br />

Before Closing a <strong>Property</strong> Transaction?<br />

It is mandatorily adviseable that prospective buyers<br />

of property conduct due diligence. This is<br />

EFFECT OF PURCHASER OF PROPERTY DEFAULTING IN<br />

PAYING BALANCE OF PURCHASE PRICE AS AGREED WITH VENDOR<br />

Florence Achonu and Oladipo Okuwobi SC 254/2006 delivered<br />

by the Supreme Court of Nigeria on 13th April, 2017<br />

FACTS: The respondent, Mr Oladipo Okuwobi<br />

offered his property located at No 65, Bode<br />

Thomas Street, Surulere, Lagos, to the appellant,<br />

Florence Achonu for sale at the price of<br />

N1.5million. The appellant accepted the offer and<br />

made part payment in two instalments, to the<br />

tune of N700,000.00 with the promise to pay the<br />

balance of N800,000.00 within a week.<br />

When the appellant failed to meet her obligation,<br />

the respondent directed his solicitors to write the<br />

respondent repudiating the contract. The appellant<br />

resisted the steps taken by the respondent<br />

and filed action in court, praying the court to<br />

order specific performance of the contract, and<br />

mesne profit. The trial court granted her the<br />

reliefs she sought. On appeal to the court of<br />

Appeal and further to the Supreme Court, the<br />

decision of the trial court was reversed.<br />

From the decision of the Supreme Court, important<br />

principles concerning part payment for property<br />

were raised:<br />

On the EFFECT OF PURCHASERS OF LAND<br />

DEFAULTING IN PAYING BALANCE OF<br />

PURCHASE PRICE AS AGREED, the court held<br />

that where a purchaser of land makes part payment<br />

of the purchase price, but defaults in paying<br />

the balance, there can be no valid sale even<br />

where the purchaser is in possession. Such possession<br />

is incapable of defeating the vendor's<br />

title. In the instant case, the purchaser (appellant)<br />

having failed to pay the balance of the purchase<br />

price at the expiration of the agreed period<br />

despite extension of time and repeated demands<br />

for payment, the Court of Appeal was justified<br />

when it quashed the trial court's order for specific<br />

performance of the contract of sale. Reference<br />

Odusoga v Rickets (1997) 7 NWLR (Pt 511) 1<br />

On WHEN OBLIGATIONS OF PARTIES TO A<br />

CONTRACT ARE DISCHARGED, the court held<br />

that a contract is discharged only when both parties<br />

are released from their obligations under the<br />

agreement. A contract is usually discharged by<br />

performance if both parties have done all that is<br />

required of them by the express agreement.<br />

On WHAT PARTY SEEKING TO ENFORCE<br />

CONTRACT MUST SHOW TO SUCCEED, the<br />

court held that a person seeking to enforce a contract<br />

must show:<br />

That all conditions precedent have been fulfilled.<br />

That he has performed all the terms which he<br />

ought to perform or is willing to do so if he has<br />

not done so.<br />

In the instant case, the appellant failed woefully<br />

to discharge her obligation under the contract of<br />

sale of the property, the contract cannot be<br />

enforced on her behalf. Reference Coker V<br />

What informed your choice of business?<br />

vision was hugely successful. As a restless and<br />

serial entrepreneur, I started the manufacturing<br />

over their heads. This desire gave birth to<br />

operations cut across different class as we<br />

develop housing for the small, medium and<br />

high net worth individuals and corporations.<br />

What has been the biggest challenge of<br />

achieving your goals?<br />

Challenges gravitate towards their solution.<br />

My upbringing and philosophy are geared<br />

towards seeing challenges as opportunities o<br />

get to the next level. It is not easy setting up<br />

an enterprise in this country. The challenges<br />

are too daunting because you'll provide<br />

your own infrastructures<br />

like power,<br />

water<br />

and security etc. Ironically, most countries of<br />

the world have moved beyond the issue and<br />

complaints of energy. It is a big challenge that<br />

government must tackle.<br />

I know the present administration is doing<br />

something about it but they need to do more to<br />

tackle the issue as that is the reason most companies<br />

are leaving Nigeria because the cost of<br />

providing your own energy is usually very<br />

high. Luckily for me, I've come this far by<br />

applying the principles of perseverance, honesty,<br />

hard work, faith and a strong belief in<br />

God. To get funding to start a business has<br />

been identified as a major challenge to most<br />

entrepreneurs, but in all I advise budding<br />

entrepreneurs to start small with whatever they<br />

have and build it from there.<br />

How were you able to cope in terms of technical<br />

knowhow of the business ventures you<br />

are into?<br />

The fact remains that to succeed in anything<br />

you do, you must first of all articulate your<br />

vision. With dedication, trust and perseverance,<br />

success is always assured. Even though I<br />

started with importation, I looked at the economy<br />

and made up my mind that the best way<br />

to make an impact by creating jobs for our<br />

teeming youths is through manufacturing.<br />

Youth empowerment is the factor that led me<br />

into manufacturing. What I normally do is to<br />

assemble experts in any industry I want to go<br />

into and sell my vision to them and work<br />

out a strategy to operate and succeed in<br />

the business. Creativity is at the heart<br />

of our operations, and the power to<br />

deliver on our offering is brought<br />

about by having a renowned collection<br />

of experienced experts and<br />

passionate professionals under one<br />

What can government do differently<br />

investors. They should believe and<br />

work with locals first because<br />

nobody can develop our country<br />

more than us. Remember that<br />

when things are working well, you<br />

don't need to look for investors,<br />

they will come themselves. They<br />

should work with serious minded<br />

Nigerians as they say 'charity<br />

begins at home'.<br />

The government should try as<br />

much as possible to provide infrastructure<br />

like energy, roads, water<br />

and security to allow for robust<br />

indigenous participation in the<br />

economy. I commend the government<br />

for the efforts they are making<br />

to stabilize the power situation,<br />

but they need to do more. I encourage<br />

them to work hard to get it<br />

right so that the economy will be<br />

better than what it is today. Taxes<br />

should be harmonized to reduce<br />

the incidence of multiple taxation<br />

as well as the high interest rate of<br />

getting facilities from financial<br />

institutions.<br />

What drives you?<br />

My driving force is always God as<br />

He is behind everything we have<br />

achieved both as individuals and as<br />

an organisation. Our belief is in<br />

God, who makes all things possible.<br />

I also draw inspiration from<br />

the life of my hardworking mother.<br />

I don't want to be associated with<br />

failure and the desire to contribute<br />

to the development of the society<br />

is a key driving force. Each time<br />

I'm called upon to receive an<br />

award or title, I feel so much honoured<br />

because it shows that people<br />

recognize our hard work and zeal<br />

to make the society a better place.<br />

These recognitions humble me and<br />

make me work harder towards the<br />

not interested in working hard any<br />

longer but I tell them that there's<br />

no short cut to success. Whatever<br />
