P u r c h a s e r ’ s l i a b i l i t i e s<br />

The monthly interest shall be 1 % of the purchase price.<br />

VAT or transfer duty, as applicable, shall be paid in addition to the purchase price;<br />

Occupational interest at a rate of 1% per month from date of acceptance up until date of registration of<br />

transfer;<br />

The PURCHASER shall at his own cost obtain:<br />

A certificate of compliance with the requirements of the Occupational Health and Safety Act, Act 85 of<br />

1993 and/or Government Regulations No. 2920/1992 to the effect that the electrical installation on the<br />

property complies with SABS 0142, or is reasonably safe;<br />

A certificate to the effect that the improvements on the property are free from infestation by timber<br />

destroying insects, if<br />

specifically required by a financial institution;<br />

A certificate of the occupation of the property (if applicable);<br />

A NHBRC Certificate (if applicable).<br />

O c c u p a t i o n<br />

Possession and occupation of the property shall be given by the Seller to the Purchasers on date of registration<br />

of transfer, unless otherwise agreed in writing.<br />

From date of transfer, the risk of profit and loss of the property shall pass to the Purchaser. Any agreement<br />

in respect of occupation prior to transfer, shall only be binding if reduced to writing and signed by Seller<br />

and Purchaser;<br />

From date of occupation the Purchaser shall be obliged to make payment of all consumption and amounts payable<br />

to the Regional Services Council, Local Authority, Metropolitan Council's or other authorities in respect<br />

of the use of electricity, the water consumption and other expenses related to the use of the property.<br />

From date of acceptance the Purchaser shall be liable for payment of all levies, rates, taxes and charges payable<br />

in respect of the property;<br />

The PURCHASER agrees that the SELLER does not make any warranties or representations, whether express<br />

or implied, regarding vacant occupation and possession. The property is hereby sold free of any leases which<br />

arose subsequent to any bonds be registered over the property or any claims preferent to the lease.<br />

Occupational rental will be payable by the Purchaser from acceptance of the offer to the date of registration<br />

of transfer.


I n t e r e s t<br />

The PURCHASER will pay interest on the purchase price from DATE OF ACCEPTANCE to date of registration<br />

of transfer calculated at 12% (twelve percentum) per annum, both days inclusive. The interest will be<br />

payable monthly in advance before or on the first day of each and every month, the first payment to be<br />

made on the first day of the month following the DATE OF ACCEPTANCE. Payment of the interest will be<br />

effected to the CONVEYANCER.<br />

V o e t s t o o t s<br />

The Purchaser has inspected the property and is fully acquainted with the condition of the same and is satisfied<br />

with the suitability of the property for Purchaser's purposes;<br />

The property is sold Voetstoots, as it is, and subject to all latent and patent defects. Purchaser acknowledges<br />

that he/she has inspected the property and is fully acquainted with the condition of same and the conditions<br />

of title applicable.<br />

No guarantee whatsoever was given to Purchaser relating to the property or improvements thereon and where<br />

upon a re-survey the area of the property is found not to correspond with that set out in the title deed or in<br />

this agreement, neither Seller nor Purchaser, the one to the other, shall be liable in any way whatsoever.<br />

Seller shall not be liable for any deficit nor be entitled to claim compensation for any surplus. This in no way<br />

allows Seller to remove or damage any fixture or improvement, from any portion of the property.<br />

B e a c o n s<br />

Seller is not obliged to indicate the boundaries or the beacons of the property. The Seller confirms that to<br />

the best of his knowledge all beacons are correctly positioned, and the border of the property is fenced correctly.<br />

The Purchaser will be entitled to satisfy himself as to the correctness of the extent of the property.<br />

“ R o u w k o o p ”<br />

The Purchaser irrevocably agrees that in the event of this transaction being cancelled for any reason<br />

whatsoever due to any default by the purchaser, any deposit paid by the Purchaser shall be considered as<br />

"rouwkoop" and against cancellation of the agreement, due to the non-compliance of the Purchaser of the<br />

Purchaser's obligations, the amount shall be forfeited as "rouwkoop" and the transferring attorneys shall<br />

be entitled to make payment of the deposit amount in its trust account directly to the Seller as rouwkoop,<br />

in addition to any other amounts payable to the seller or claims against the Purchaser.
