“OUR YOUNGSTOCK IS THE TALENT<br />
POOL FOR THE AUCTION”<br />
Forty or so top-level ridden horses will go under the hammer during the enervating<br />
young dressage horse auction ‘<strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong>’ on 30th March. But how does such an<br />
auction collection come about? We put the question to the driving force behind <strong>Van</strong><br />
<strong>Olst</strong> Horses, owner Gertjan van <strong>Olst</strong>.<br />
Own breeding pool<br />
Owner Gertjan van <strong>Olst</strong>: ‘Our<br />
business consists of the stud, sport,<br />
sales, breeding, and for a large part<br />
youngstock. All mainly specialised in<br />
dressage horses. Together these links<br />
form a circle. The stud, for example, is<br />
very important but we also benefit from<br />
good youngstock. Our youngstock is<br />
actually the talent pool from which we<br />
get the talent, certainly for the auction<br />
too.”<br />
Win-win situation<br />
“With our system we create a win-win<br />
situation. Each year we buy back around<br />
one hundred foals from a set group of<br />
breeders. As well as these, we also<br />
have the 10 to 20 foals that we breed<br />
ourselves each year. These all go into<br />
our own youngstock, to be sold on as<br />
three-year-olds after they have been<br />
trained by us. The very best horses<br />
in the group are selected for the <strong>Van</strong><br />
<strong>Olst</strong> <strong>Sales</strong>. The auction is the sales<br />
opportunity of the year and is also the<br />
last link in our circle: we buy the horses<br />
as foals and sell them at the auction with<br />
a great future ahead of them.”<br />
Strict selection<br />
“Over the years, dressage horse<br />
breeding has made a tremendous leap.<br />
That is reflected in the quality of our<br />
horses; this has increased tremendously.<br />
The increase in quality comes from two<br />
sides: breeding has certainly grown,<br />
but we too have also set the bar higher.<br />
We now select the horses even more<br />
consciously. Only the top horses are selected for the <strong>Van</strong> <strong>Olst</strong><br />
<strong>Sales</strong>.”<br />

Wide distribution<br />
“Each year international interest in the auction increases. During<br />
the last edition a couple of the most expensive horses went to<br />
good clients in Australia. We also sell to America, Japan, UK,<br />
Scandinavia, Germany and France. We have a wide distribution<br />
area. Yet I really like it when a lot of quality also remains in the<br />
Netherlands”, says Gertjan.

During the presentation on March 28th, the horses will presented in order of the<br />
catalogue. The order in which the horses will be auctioned, on March 30th, will differ.<br />
The order will be announced one hour prior to the auction.<br />
VAT<br />
All horses will be sold excluding 21% VAT, unless it is stated otherwise.<br />
Approved stallions - 3/4: 6% VAT - 1/4: 21% VAT.<br />
Geldings - 1/1: 21% VAT.<br />
Mares - sport 21% VAT, breeding 6% VAT.<br />
AUCTION COMMISSION<br />
No auction commission will be charged.<br />
This is a compensation for the high VAT rate.<br />
Auction price + 21% VAT = Total price.<br />
VETERINARY REPORTS<br />
All horses have been fully X-rayed and clinically approved. X-rays and veterinary<br />
reports are available for inspection at the sales office.<br />

Crosby is a seven-year-old NRPS-approved<br />
stallion. Last year Crosby was amongst the top<br />
five of the six-year-olds during the Pavo Cup.<br />
As a result he was selected for the qualifiers for<br />
the World Championship for Young Dressage<br />
Horses. He displays a beautiful technique,<br />
performs very beautiful flying changes and<br />
excels with his correct attitude. Sire Chippendale<br />
is a son of the charming Lord Leatherdale. On<br />
his dam’s side Chippendale goes back to the<br />
famous preferente Negro and the Oldenburg<br />
top-producer Landadel. Chippendale’s dam, the<br />
elite sport-(dr) mare Ti Amo, is also well-known<br />

As a young horse Denzel Washington did not<br />
really stand out but that is now completely<br />
different. The stallion does everything very<br />
easily. The expectation is that he will easily<br />
progress to Grand Prix-level. He is a six-yearold<br />
NRPS-approved stallion who stands out<br />
due to his talent for collection. This son of the<br />
dressage legend De Niro is combined with the<br />
top bloodline of the Pleijter family and goes back<br />
to the well-known UTV-mare Dollie. She is also<br />
the dam of the Olympic dressage horse Just<br />
Mickey, by Michelangelo, and two other Small<br />
Tour horses. Mother Ulla Dolly is also the dam<br />
of an elite mare and of the stallion Genesis, by<br />

Nagano, approved by the NRPS, is a very<br />
elegant dressage horse. He received only nines<br />
for his performance inspection. He received<br />
a nine for his walk, trot and canter. He is a<br />
horse that is easy to ride and train. Nagano has<br />
developed well over the years and is showing<br />
a lot of talent for collected work. He has good<br />
action. He has a future in the competition arena<br />
ahead of him. He was effortlessly placed for the<br />
Pavo Cup last year and performed exceptionally<br />
well. Being five, he is a horse suitable for the<br />
ambitious dressage rider who wants to compete<br />
immediately. Sire Negro is already a legend,<br />
dam Cilenka goes back to the ‘rittigkeits’<br />
producer Lord Leatherdale and is also a halfsister<br />

This dark bay tyrant is out of Everdale’s third<br />
crop. Ernesto is a three-year-old stallion who<br />
has just been approved by the NRPS. He has<br />
still to carry out his performance test. This<br />
Everdale-offspring is a true pedigree horse<br />
and shows much elasticity and suppleness.<br />
Dam Andett,e by Tuschinski, was awarded ster<br />
predicate with 80 points for movement and<br />
granddam Jadette, by Equador, is keur and<br />
prestatie. Talent for the sport is anchored in this<br />
bloodline, proven by the large number of sport<br />
horses out of the immediate dam-line that are<br />
competing at the highest levels both nationally<br />

Sire Arlando has competed at all the big<br />

Kick Off van de Heernis is a horse with three<br />
good basic paces. He is showing sufficient<br />
quality to progress up to the higher level. He is<br />

appealing head and well-formed long neck. The<br />

The insurance can take effect immediately after allotment based on the wordings<br />
of the Equipe 3 Equine Insurance (Mortality and Loss of Use due to an accident or<br />
disease) for the period of 2 weeks. The premium is 1% of the purchase price.<br />
Equipe 3 Equine Insurance includes:<br />
• 100% indemnification in case of Mortality due to an accident or disease.<br />

VEILINGVOORWAARDEN<br />
1. Deze Veilingvoorwaarden zijn van toepassing op de rechtsverhouding tussen de besloten<br />
vennootschap <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> B.V. (‘<strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong>’) en deelnemers aan de door <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong><br />
georganiseerde veiling van dressuurpaarden op 30 maart <strong>2018</strong> te Den Hout. De gene die tijdens<br />
de veiling op een paard biedt wordt geacht de toepasselijkheid van deze Veilingvoorwaarden te<br />
hebben aanvaard. Toepasselijkheid van andere (algemene) voorwaarden is uitgesloten.<br />
2. <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> organiseert en faciliteert de veiling en veilt paarden in opdracht van verkoper.<br />
<strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> is geen partij bij tot stand te komen of gekomen overeenkomsten tussen verkoper<br />
en bieder/koper.<br />
3. Ieder paard wordt voetstoots bij opbod geveild in de staat en toestand waarin het zich op het<br />
moment van toewijzing bevindt. Op het moment van toewijzing komt een koopovereenkomst<br />
tot stand tussen bieder als koper en verkoper en is het paard voor rekening en risico van koper.<br />
4. Veterinaire rapporten inclusief röntgenfoto’s van de te veilen paarden zijn voor iedereen ter<br />
inzage vóór de veiling. Indien koper binnen 7 dagen na de veiling schriftelijk aan <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong><br />
meedeelt dat het paard lijdt aan weven, luchtzuigen of cornage, is verkoper verplicht het paard<br />
terug te nemen en de koopprijs terug te betalen, nadat een door verkoper aangewezen dierenarts<br />
het betreffende gebrek bindend heeft vastgesteld.<br />
5. De betaling van de koopsom (laatprijs + BTW)* moet geschieden op uiterlijk 3 april <strong>2018</strong><br />
om 12.00 uur in Euro’s à contant of door overmaking per bank op een door <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong><br />
onmiddellijk na afloop van de veiling aan te geven rekeningnummer.<br />
6. Iedere bieder biedt voor zichzelf en is aan zijn bod gebonden totdat een hoger bod is<br />
geaccepteerd. Er dient te worden geboden in bedragen van EUR 250,- of veelvouden daarvan.<br />
7. <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> en/of de veilingmeester bepalen de (volg)orde van en op de veiling.<br />
8. De veilingmeester heeft het recht een bod zonder opgaaf van redenen te weigeren.<br />
9. Een verkocht paard moeten, met inachtneming van het bepaalde in artikel 10, uiterlijk 3 april<br />
<strong>2018</strong> om 16:00 uur van het veilingterrein zijn verwijderd. Eventueel langer verblijf kan na overleg,<br />
tegen een vooraf overeengekomen billijke vergoeding. Zolang koper niet aan al zijn (betalings)<br />
verplichtingen heeft voldaan, kan <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong>/verkoper zich op een retentierecht op het paard<br />
beroepen.<br />
10. Alleen op vertoon van een door het veilingsecretariaat afgegeven afleidbewijs mag een paard<br />
uit de stallen en van het terrein worden verwijderd.<br />
11. Indien koper niet voldoet aan zijn (betalings)verplichtingen kan verkoper de<br />
koopovereenkomst, zonder dat een ingebrekestelling is vereist, ontbinden en is koper<br />
aansprakelijk voor alle schade die verkoper dientengevolge lijdt, waaronder gederfde winst en<br />
kosten. Alle buitengerechtelijke en gerechtelijke kosten die verkoper maakt, zijn voor rekening<br />
van koper met een minimum van 25% van de koopsom.<br />
12. <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> en verkoper zijn niet aansprakelijk voor schade, ongeacht oorzaak, aard en<br />
omvang, tenzij de schade het gevolg is van opzet of grove schuld aan de zijde van <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong><br />
en/of verkoper.<br />
13. De koopprijs wordt vermeerderd met 21% BTW, tenzij anders aangegeven. Er wordt geen<br />
opgeld in rekening gebracht (dus laatprijs (+ BTW) = totaalprijs).<br />
14. Alle geschillen die tussen <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> en/of verkoper enerzijds en koper anderzijds<br />
mochten ontstaan met betrekking tot de veiling, deze Veilingvoorwaarden en/of (een) (koop)<br />
overeenkomst(en) worden met uitsluiting van de gewone rechter in enige en hoogste instantie<br />
voorgelegd aan een commissie, bestaande uit drie deskundigen. Ieder der partijen benoemt<br />
één deskundige, de twee door partijen benoemde deskundigen benoemen samen een derde<br />
deskundige. Bij gebrek aan overeenstemming wordt de derde deskundige benoemd door de<br />
kantonrechter te Breda. Indien koper consument is, is op diens verzoek overeenkomstig het<br />
Burgerlijk Wetboek de gewone burgerlijke rechter bevoegd, in eerste aanleg uitsluitend de<br />
Rechtbank Zeeland-West-Brabant, locatie Breda.<br />
15. Indien <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> en/of verkoper een geschil aanhangig wil maken, zal indien koper<br />
consument is, koper gedurende een maand in de gelegenheid zijn schriftelijk kopers keuze als<br />

<strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> en/of verkoper deze termijn bekorten tot vijf werkdagen.<br />
16. Op de onderhavige overeenkomst is Nederlands recht, met algehele uitsluiting van het<br />
Weens Koopverdrag (CISG), van toepassing.<br />

AUCTION TERMS<br />
1. These Auction Terms apply to the legal relationship between the private limited company <strong>Van</strong><br />
<strong>Olst</strong> <strong>Sales</strong> B.V. (‘<strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong>’) and participants in the auction for dressage horses organised by<br />
<strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> on 30 March <strong>2018</strong> in Den Hout. Persons bidding on a horse for sale at the auction<br />
are deemed to have agreed to the applicability of these Auction Terms. The applicability of other<br />
(general) terms and conditions is excluded.<br />
2. <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> organizes and facilitates the auction and auctions horses on the vendor’s behalf.<br />
<strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> is not a party to agreements to be established or previously established between<br />
the vendor and bidder/buyer.<br />
3. Each horse will be sold at auction “as seen”, in the state and condition when the winning bid is<br />
placed. When the winning bid is placed, a purchase agreement is established between the bidder<br />
as the buyer and the vendor and the horse passes to the expense and risk of the buyer.<br />
4. Veterinary reports, including x-ray images of the horses for auction, are available for public<br />
inspection prior to the auction. If the buyer notifies <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> within 7 days of the auction<br />
that the horse is exhibiting weaving, wind-sucking or cribbing behaviour, the vendor shall be<br />
obliged to take the horse back and refund the purchase price, once a veterinarian designated by<br />
the vendor has definitively determined that the defect in question is present.<br />
5. Payment of the purchase price (offer price + VAT)* must be made no later than 12.00 hours on<br />
3 April <strong>2018</strong>, in euros, in cash or by bank transfer to an account number to be indicated by <strong>Van</strong><br />
<strong>Olst</strong> <strong>Sales</strong> immediately after the close of the auction.<br />
6. Each bidder is bidding for himself and is bound by his bid until a higher bid is accepted. Bids<br />
shall be made in amounts of 250 or multiples thereof.<br />
7. <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> and/or the auctioneer determine the order of and at the auction.<br />
8. The auctioneer has the right to refuse a bid without stating reasons.<br />
9. A sold horse must, having due regard for the provisions of Article 10, be removed from the<br />
auction premises no later than 16.00 hours on 3 April <strong>2018</strong>. A longer stay may be agreed in<br />
return for a fair payment agreed in advance. As long as the buyer has not satisfied his payment<br />
and other obligations, <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong>/vendor may invoke a retention of title with respect to the<br />
horse.<br />
10. A horse may only be removed from the stables and from the premises on presentation of a<br />
permit to lead the horse away (“afleidbewijs”), issued by the auction office.<br />
11. If the buyer does not satisfy his payment and other obligations, the vendor may dissolve<br />
the purchase agreement without the need for notice of default and the buyer shall be liable<br />
for all damages suffered by the vendor as a consequence, including lost profit and costs. All<br />
extrajudicial and judicial costs incurred by the vendor shall be for the buyer’s account, subject to a<br />
minimum of 25% of the purchase price.<br />
12. <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> and the vendor shall not be liable for damages, irrespective of their cause,<br />
nature and extent, unless the damages are the result of intent or gross negligence on the part of<br />
<strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> and/or the vendor.<br />
13. Unless otherwise indicated, VAT will be added to the purchase price at 21%. No commission<br />
will be added (i.e. offer price (+VAT) = total price).<br />
14. All disputes that may arise between <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> and/or the vendor on the one hand<br />
and the buyer on the other relating to the auction, these Auction Terms and/or (a) purchase<br />
agreement(s) shall be submitted to a panel of three experts, to the exclusion of the ordinary<br />
courts of law, and the decision of that panel shall be final. Each of the parties shall appoint one<br />
expert and the two experts appointed by the parties shall together appoint a third expert. If<br />
no agreement can be reached, the third expert shall be appointed by the district court judge in<br />
Breda. If the buyer is a consumer, at his request and in accordance with the Dutch Civil Code, the<br />
ordinary civil court shall have competence; in the first instance, this shall exclusively be the Court<br />
of Zeeland-West-Brabant, Breda location.<br />
15. Should <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong> and/or the vendor wish to bring a dispute before the court, if the buyer<br />
is a consumer, he shall be allowed a period of one month in which to notify his choice, in writing,<br />
as mentioned in article 14. In the case of an urgent interest (interim measures), <strong>Van</strong> <strong>Olst</strong> <strong>Sales</strong><br />
and/or the vendor may reduce this period to five working days.<br />
16. The present agreement is subject to Dutch law, to the full exclusion of the Vienna <strong>Sales</strong><br />
Convention (CISG).<br />
