"police officer" means a member of the Eeyou Eenou Police Force, the regional police force established by thc Cree Nation Goven:unent pursuant to section 6 (n) of An Act Respecting the Cree Nation Government, its successor, or any other police force having jurisdiction within the Category lA lands of the Nemaska Band; "public place" means any place within or on the lands described in section 109 to which the public have access as of right or by invitation, express or implied, including any land not specifically granted in writing by the Band for the exclusive use or occupation of a designated person pursuant to part V11 of the Act. "sterilized" means, in respect of a dog, either neutered or spayed. APPLICATION 109. This Division shall apply to the Band's lands listed in section 6 of the Act. ANIMAL CONTROL OFFICER 110. (1) The Director of Public Health and Safety of the Crec Nation of Nemaska shall appoint a person as the Animal Control Officer to provide for the administration and enforcement of this Division and more specifically to receive registrations, to issue identification tags, and to protect the public. (2) The Director of Public Health and Safety of the Cree Nation of Nemaska can appoint other people to assist the Animal Control Officer in the performance of his duties set in subsection (1). REGISTRATION AND IDENTIFICATION 111. The owner of an animal within or on the lands described in section 109 shall register the animal with the Animal Control Officer and shall have an identification tag placed around the neck of the animal 112. The application for registration and identification tag shall be filed with the Animal Control Officer and shall include the following informations : (a) the owner's name; (b) the owner's address; (c) the owner's telephone number; (d) a description of the animal sought to be registered, including age, sex, name, colour and breed, if known; (e) a record that the animal is immnnizcd against rabies, noting the date of such immunization, the name of the person or clinic immunizing the animal, including the manufacturer's name of the vaccine; (f) in the event of the registration of a dog, a record that the dog is sterilized; and 2$
(g) any other information deemed by the Animal Control Officer to be necessary for the proper administration of this Division. The owner of the registered animal shall notify the Animal Control Officer of any change in the above mentioned informations or cf the sale or death of the animal. 113. The charge for registration and identification tag shall be of $10.00 per year and shall be paid no later than thirty (30) days after the acquisition of the animal and then, every year before the veterinarian comes to Nemaska. 114. (1) The Animal Control Officer shall issue the identification tag upon registration and payment of the annual fee. (2) No identification tag shall be issued unless a record that the animal is immunized against rabies is provided to the Animal Control Officer, and, if the animal is a dog, a record that the dog is sterilized. (3) If an Elnimni is acquired before the veterinarian comes to Nemaska, the owner shall immunize the animal against rabies, and, if the animal is a dog, sterilize the animal, the next time the veterinarian comes to Nemaska. 115. The identification tag shall indicate: (a) the name of the community of Nemaska; (b) the year for which the identification tag is valid; and (c) a number corresponding to that entered into the animal register kept by the Animal Control Officer. 116. A duplicate identification tag may be obtained from the Animal Control Officer at a cost of $10.00. 117. The Animal Control Officer shall keep an animal register in respect of which identification tags are issued and provide each registrant with a numbered tag and a sticker for each animal in respect of which the tag is issued. 118. The identification tag issued by the Animal Control Officer in respect of an animal is not transferrable. RABIES IMMUNIZATION 119. All animals on the lands described in section 109 must be immunized against rabies in accordance with generally accepted veterinary standards. 120. The owner of an animal exposed to rabies shall inform the Animal Control Officer without delay. Such animal will be held into quarantine at the impoundment for fourteen (14) days and shall not be released from quarantine without the permission of the Animal Control Officer. 26
