Public Act No. 261 of 1988<br />

'(As amended)<br />

An act to provide for the apportionment of county<br />

boards of commissioners; to prescribe the size of the<br />

board; to prescribe the manner of election of the members<br />

of the county board of commissioners.<br />

Sec.!. Within 60 days after the publication ofthe latest<br />

United States official documented census figures, the<br />

county apportionment commission in each county ofthis<br />

state shall apportion the county into not less than 5 nor<br />

more than 35 county commissioner districts as nearly<br />

ofequal population as is practicable and within the limitation<br />

of Section 2.<br />

Section 9. The electors of each district established in<br />

accordance with this act shall elect one county commissioner<br />

to the county board of commissioners. There shall<br />

be no representation on the county board of commissioners<br />

other than that set forth by the provision ofthis act.<br />

Section 10. The term of each commissioner shall be concurrent<br />

with that of state representatives as specified<br />

in article 4, Section 3 of the state constitution.<br />

Section 11. Candidates for the office of commissioner<br />

shall be residents and registered voters of the district<br />

which they seek to represent and shall remain so to hold<br />

their office, if elected. Nominations and elections for commissioners<br />

shall be by partisan elections. To obtain the<br />

printing of the name of any person as a candidate for<br />

nomination for the office of commissioner upon the offi­<br />

cial primary ballot, there shall be filed with the county'<br />

clerk of each county, a filing fee of $100 or nomination<br />

petitions signed by a number of qualified and registered<br />

electors residing with the district, equal to but not less<br />

than 1% nor more than 4% of the number of voters cast<br />

in the district by such party for the office of secretary<br />

of state at the last general election in which a secretary<br />

of state was elected. The deadline for filing nominating<br />

petitions or filing fees shall be the same as candidates<br />

for state representatives.<br />
