While arbitration remains the primary Construction Industry method of final and binding
dispute resolution for construction projects in the region, we have extensive experience
of advising on a wide range of alternative dispute resolution methods such as,
adjudication, mediation and litigation or through a structured negotiation process.
The Mack Services Dispute Resolution Model
Once a valid claim has been established if the other party chooses to avoid settlement
procedures, our clients are faced with no alternative to move to Arbitration or Litigation.
This is an expensive process and in our experience, many clients avoid this step in the hope that
they can reach a settlement. Unfortunately, this is rarely successful and leverage through the
threat of Arbitration or some other means is typically required. What we offer is the opportunity to
start the Arbitration process for a relatively low-cost capped fee with the balance of fees being
linked to a successful outcome.
Litigation Support and Funding
Mack Services can offer, in certain circumstances, litigation funding though it’s associate
Litigation Fund which in essence provides a funding platform to enable our clients to proceed
without delay in collecting their rightful dues.
