All reservations are on a “on request basis” and<br />

When you place a reservation we will require<br />

a credit card for guarantee and we will not<br />

charge it until the booking is confirmed.<br />

DEPOSIT & FInAL PAYMEnT<br />

A non-refundable, non-transferable 20% deposit<br />

of the total amount is required for <strong>Malatesta</strong><br />

Viaggi to reserve space for you. Your booking<br />

is not confirmed and payment is not deemed<br />

made until the deposit is received by <strong>Malatesta</strong><br />

Viaggi and you receive a confirmation invoice.<br />

<strong>Malatesta</strong> Viaggi accepts certified cheques,<br />

bank wire transfers, Visa, MasterCard and<br />

American Express. Your reservation will be automatically<br />

cancelled if deposit is not received<br />

by <strong>Malatesta</strong> Viaggi by the deposit due date.<br />

Payment of the deposit indicates you have read<br />

and accepted these Terms and Conditions. Final<br />

payment is due 45 days prior to commencement<br />

of services. If final payment is not received<br />

by the due date, your reservation will be<br />

cancelled and your full deposit will be retained<br />

If cancellation is received by <strong>Malatesta</strong> Viaggi<br />

before the final payment date of your vacation,<br />

your non-refundable deposit will be retained.<br />

cHAnGES AFTER DEPOSIT<br />

A fee of € 30 per transaction plus any expenses<br />

imposed by suppliers will be charged for any<br />

alteration or revision made to a reservation.<br />

A change of vacation date or itinerary within final<br />

payment will be treated as a full cancellation<br />

and new reservation; vacation cancellation fees<br />

(as above) apply.<br />

VISAS AnD PASSPORTS<br />

You are responsible for obtaining and paying for<br />

all visas and entry documents, for meeting all<br />

required by the laws, regulations, orders,<br />

and/or requirements of the countries you<br />

will visit. <strong>Malatesta</strong> Viaggi is not responsible for<br />

providing you with specific visa and passport<br />

information or documentation, and <strong>Malatesta</strong><br />

Viaggi cannot accept liability for any passenger<br />

refused entry onto any transport or into any<br />

country due to failure of the passenger to carry<br />

correct documentation.<br />

HOTEL AccOMMODATIOn<br />

Will be provided in accordance with the itinerary<br />

or similar. <strong>Malatesta</strong> Viaggi reserves the right<br />

to make substitutions with hotels of equal or<br />

superior standard. No refunds are provided for<br />

hotel changes. All rooms are standard rooms<br />

with private facilities, unless you have specifically<br />

requested and paid for an upgraded room<br />

category. Special requests such as bed types<br />

are based on availability. Room selection in all<br />

cases, unless otherwise reserved, is strictly at<br />

the discretion of the hotel’s management.<br />

Triple rooms consist of standard twin/queen<br />

bed plus sofa/folding bed or cot for third person.<br />

<strong>The</strong> number of persons accommodated<br />

does not dictate the room size. Hotel checkin<br />

time is generally not before 2:00 p.m. and<br />

check-out time is prior to noon.<br />

LUGGAGE<br />

Porterage for one suitcase is included at all the<br />

hotels. Airport/train station porterage is not included:<br />

please be prepared to carry your own<br />

suitcase on and off airplanes and trains and<br />

through airports and train stations.<br />

MEALS<br />

As specified on each itinerary. Meals are based<br />

on the hotel’s or restaurant’s buffet or set<br />

menu. In general, beverages are not included,<br />

unless specifically stated. Sometimes meals<br />

could be included in local restaurants: this will<br />

be noted on the reservation.<br />

nOn-OPERATIOn OF EScORTED TOUR<br />

Escorted <strong>tour</strong> packages are based upon a minimum<br />

number of 10 participants. Cancellation<br />

of any <strong>tour</strong> for lack of participants will be advised<br />

at least 30 days prior to the <strong>tour</strong>’s departure,<br />

and all money will be refunded. <strong>Malatesta</strong><br />

Viaggi will not be held responsible for any costs<br />

relating to the issuance and/or cancellation of<br />

airline tickets or visa fees.<br />

TRAVEL DOcUMEnTS<br />

Will be sent electronically. Will be sent via email<br />

21 days prior to departure, provided that<br />

due payment is received.<br />

REFUnDS<br />

Please note that any request for refunds is<br />

subject to these Terms & Conditions; no refund<br />

will be made for unused services of less<br />

than 48 consecutive hours, for unused transportation<br />

where group activity tickets are<br />

involved or for voluntary modifications made<br />

by the traveler.<br />

SERVIcE InQUIRIES AFTER VAcATIOn<br />

After returning from your vacation, if you wish<br />

to inquire about any services provided, please<br />

ensure that all correspondence relating to those<br />

services is received by <strong>Malatesta</strong> Viaggi. Any<br />

complaint or claim involving the vacation services<br />

offered in this brochure must be notified to<br />

<strong>Malatesta</strong> Viaggi within 10 working days of the<br />

vacation completion.<br />

HOLIDAYS<br />

During local or national holidays or special<br />

events, on Sundays, and religious occasions,<br />

certain facilities such as museums, churches,<br />

restaurants, sightseeing <strong>tour</strong>s, and shopping<br />

may be limited or not available. Alternatives will<br />

be offered whenever possible. <strong>Malatesta</strong> Viaggi<br />

cannot be held responsible for any closures or<br />

curtails for any reason.<br />

TRAVEL cOnTRAcTS AnD RESPOnSIBILITY<br />

Travel Contracts are governed by specific international<br />

agreements, particularly by the Brussels<br />

Convention of 23 April 1970 relative to Travel<br />

Contracts (CCV), by Legislative Decree (D.<br />

Leg.) no. 79 of 23 May 2011 “Tourism Code”,<br />

by the situations provided for in the <strong>Italia</strong>n Civil<br />

Code, by <strong>Italia</strong>n Regional Law (L.R.) no. 7 of<br />

31/03/2003 and by other rules of internal law.<br />

Responsibility towards Clients shall not exceed<br />

the limits provided for by the afore-mentioned<br />

Laws and Conventions.<br />

SERVIcE InSURAncE GUARAnTEE FUnD<br />

To guarantee the scrupulous fulfillment of the<br />

obligations assumed vis-à-vis the Client, <strong>Malatesta</strong><br />

Viaggi has stipulated an insurance policy<br />

with UGF Assicurazioni S.p.A. – Divisione NA-<br />

VALE Policy no. 4176148/N. It is also declared<br />

that a national guarantee fund has been set up<br />

at the Ministry of Productive Activities to allow<br />

the Organizer, in the event of insolvency or<br />

bankruptcy, to ensure the reimbursement and<br />

repatriation of the Client in the case of travel<br />

abroad. <strong>The</strong> methods of intervention of the fund<br />

are established through a Decree of the Minister<br />

of Productive Activities, together with the<br />

Minister of Economy and Finance.<br />

ARBITRATIOn<br />

For any dispute or controversy, the Forum of<br />

Rimini will be the deciding body.<br />

cOnSEnT TO PROcESSInG OF PERSOnAL<br />

DATA<br />

All personal data will be processed according to<br />

the provisions laid down in D.Leg. 196/2003 and<br />

used exclusively for the fulfilling of the formalities<br />

required to make the booking. Clients have the<br />

right to change, add to and request cancellation of<br />

the personnel data supplied by them.<br />

MANDATORY COMMUNICATION UNDER THE TERMS OF<br />

ART.17 OF ITALIAN LAW No. 38 of 06/02/06: THE ITA-<br />
