The Council finds that the adoption and implementation of this ordinance is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment, CEQA Guidelines section 15064(e), which exempts purely economic regulations, and Public Resources Code Section 21080(b)(4) regarding actions to mitigate or prevent an emergency. SECTION 4. Urgency Finding. The City Council finds and declares that the adoption of this Urgency Ordinance is necessary for the immediate preservation of the public peace, health, and safety. The Woolsey Fire destroyed hundreds of housing units in the City of Malibu and the increased pressure on rental housing demand has resulted in a high risk of price gouging by persons seeking to profit from the current state of emergency. Resident victims have in fact contacted city officials with reports of continuing predation since the City adopted its prohibition against price gouging. This ordinance is needed to enable the City and local prosecutors to address these actions and effectively enforce the heightened protections against predatory activity enacted into state law. SECTION 5. Severability. If any section, subsection, sentence, clause, phrase or word of this Ordinance is for any reason held to be invalid and/or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. SECTION 6. Effective Date. This Ordinance shall be effective immediately upon its adoption by four-fifths of the City Council. SECTION 7. Certification. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted in the manner required by law.
